PROPOSED LAND USE:
The request property is occupied by a church with associated parking and
recreational facilities, and by a child care center approved by a previously granted
Special Exception (Case 75A033), Condition 4 of Case 75A033 restricted
enrollment at the child care center to thirty (30) children. The applicant seeks
amendment to Condition 4 of Case 75A033 to increase enrollment to a maximum
of 100 children. Since approval of Case 75A033, the Zoning Ordinance has been
amended to require a Conditional Use for a child care center in Agricultural (A)
Districts,

Prior to site plan approval, thirty-five (35) feet of right-of-way on
the south side of Cogbill Road measured from the centerline of that
part of Cogbill Road immediately adjacent to the property shall be
dedicated, free and unrestricted, to and for the benefit of
Chesterfield County,

Prior to the issuance of an occupancy permit for any day care use
anticipated to generate traffic that would warrant a left and/or right
turn lane based on Transportation Department standards, additional
pavement shall be constructed along Cogbill Road at the approved
access to provide a left and/or right turn lane. The developer shall
dedicate, free and wrrestricted, to and for the benefit of Chesterfield
County any additional right-of-way (or easements) required for
these improvements,

Within sixty (60) days from the date of approval of this request by
the Board of Supervisors, a locked gate shall be installed and
maintained across the driveway onto Frankmont road to restrict all
vehicle access, This locked gate shall only be opened during the
specified times as outlined in Proffered Condition 3,

Environmental:
Drainage and Erosion
Site drains to the east through Meadowbrook Manor Subdivision. Existing drainage
improvements within this subdivision are inadequate to control area runoff and, as a
consequence, minor flooding has occurred. Any new construction which has additional
impervious areas has the potential to increase downstream flooding; therefore, any
additional development for private school use should be designed so as not to contribute
to existing downstream flooding conditions, (Condition 4)
Off-site easements and drainage improvements may be required to accommodate runoff
from future improvements on the property,
Fire Service:
Dale Fire Station, Company #11. Existing facilities or new construction must conform to
the requirements of the Virginia Uniform Statewide Building Code for the proposed use.
Transportation:
In 1975, a special exception was approved, with conditions, permitting the operation of
a child care facility on the property, One (1) of the conditions permits the keeping of no
more than thirty (30) children on the property. This request is an amendment to that
condition which would allow the number of children to be increased to 100, Based on day
care center trip rates, development could generate approximately 470 average daily trips.
Vehicles generated by this development will be distributed along Cogbill Road which had
a 1994 traffic count of 5,249 vehicles per day,
The Thoroughfare Plan identifies Cogbill Road as a collector with a recommended right
of way width of seventy (70) feet, The applicant has proffered to dedicate thirty-five (35)
feet of right of way measured from the centerline of Cogbill Road in accordance with that
fl/m, (Proffered Condition 1)
Two (2) streets (Frankmont Road and Homeward Road) in the Meadowbrook Manor
Subdivision adjoin this property, In addition to Cogbill Road, Frankmont Road is
currently used to access the existing development on the property. Frankmont Road serves
as a link between this property and Chippenham Parkway, Staff has received several
complaints from residents in the Meadowbrook Manor Subdivision about the volume and

1. No outside activities or play area shall be conducted or provided except that
such,area shall not be within 110 feet of any adjacent property zoned
Residential (R-15), It is suggested that the play area be provided west of
the Fellowship Hall.
2. Any outside activity of play area shall be entirely enclosed within a fence
not less than four (4) feet in height.
3. All outside activity shall be supervised at a ratio of not less than one (1)
adult for every seven (7) children.
4, This Special Exception shall permit the keeping of no more than thirty (30)
children on the parcel.
5, Hours of operation shall be restricted to between 7:00 a,m. and 7:00 p,m,
This child care operation is currently active on the request property,
Site Design:
The request site is occupied by buildings housing an existing church and child care
operation, plus associated parking and recreational areas. Primary access is provided via
a driveway to Cogbill Road. A secondary access is provided via a driveway to Frankwont
Road. The applicant has proffered to restrict vehicular access via this driveway (Proffered
Conditions 3 and 4), Proffered Conditions 3 and 4 would apply to any use permitted on
the request property, including a church use with or without an associated private school
use, As noted in the transportation portion of this "Request Analysis and
Recommendation," this restriction could be difficult to enforce,
The recommended conditions would require any new development for child care use to
conform to the development standards of the Zoning Ordinance for commercial uses in
Emerging Growth Areas whic::h address architectural treatment, access, parking,
landscaping, setbacks, signs, utilities and screening (Condition 2). In addition, Condition
3 would require child care operations to be conducted only in conjunction with church use.
Other conditions applicable to any child care operation at the request property require
outside activities to be located at least 110 feet from adjacent residentially zoned property
and that outside activity or play areas be fenced and supervised (Conditions 1, 2 and 3 of
Case 75A033), These conditions remain in effect with the approval of the request to
increase enrollment,

Planning Commission Meeting (7/18/95):
At the request of the applicant, the Commission deferred this case for ninety (90) days.
Applicant (7/19/95):
The applicant amended the application to delete the request for Conditional Use to permit
a private school and to include a request to amend Case 75A003 to increase enrollment at
a permitted day care, as outlined herein.
Staff (7/19/95):
The applicant was advised in writing that any significant new or revised information
should be submitted no later than August 14, 1995, for consideration at the Commission's

REOUEST: (Amended) Amendment to a previously granted Conditional Use (Case 75A003) to
increase enrollment of an existing child care operation in an Agricultural (A) District.
On November 20, 1995, the applicant amended Proffered Condition 3 to expand the hours that access
would be allowed to Frankmont Road for church use on Sundays, Specifically, the proffered condition
'in the "Request Analysis and Recommendation", as recommended for acceptance by the Planning
Commission, would limit the hours for access to Frankmont Road for church use on Sundays to between
7:00 a,m, and 2:00 p,m. and between 7:00 p,m, and 8:00 p,m.. The amended proffer seeks to expand
the hours for access to Frankmont Road for church use only on Sundays to between 7:00 a,m, to 2:00
p,m, and 5:00 p,m, to 8:00 p,m..
Proffered Condition 3 as it appears in the "Request Analysis and Recommendation" was negotiated
between the applicant and area residents at the time the case was pending before the Planning Commission
to address concerns about traffic through the neighborhood from activities on the church property. The
amended proffer would expand the time period for which access will be permitted to Frankmont Road
for church use on Sunday, Staff is unsure as to whether the amended proffer is acceptable to area
residents, Following is the amended Proffered Condition 3,

CONFORMANCE WITH THE BOARD'S POLICY RELATIVE TO TIMING OF SUBMISSION

PROFFERED CONDITION
3, No access shall be provided to the property from Homeward Road. No access shall be provided
to Frankmont Road for any use, except for church use on Sundays from 7:00 a,m, to 2:00 pm and
5:00 pm to 8 pm, and special events for Christmas, Easter, High School Baccalaureate,
University/College graduations, and July Patriotic Musical.
