An Ordbance to impose a recordation tax in an amount equal to one third of the amount of the State recordation tax collectible for the State on the first recordation of each taxable instrument in the Clerk's Office of the Circuit Court of Chesterfield County, except no-tax shall be collected in a case in which the State recordation tax is specifically fifty cents; and prescribing the duties of the Clerk in the collection thereof. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTER- FIELD COUNTY as follows: Sec. 1. There is hereby imposed a County recordation tax in an amount equal to one-third of the amount of the State -' recordation tax collectible for the State on the first recordatio of each taxable instrument; provided, no tax shall be imposed under the ordinance upon the recordation of any instrument in which the State recordation tax is specifically fifty cents. Sec. 2. That where a deed or other instrument conveys, covers or relates to property located partly in Chesterfield County and partly in another County or City, or in other Counties or Cities, the tax imposed under the authority of this Ordinance shall be computed only with respect to the property located in Chesterfield County. Sec. 3. The Clerk of the Circuit Court of this County collecting the tax imposed under this ordinance shall pay the sam into the treasury of this County. For his services in collecting the tax imposed by this Ordinance, the Clerk shall be compensated by the County of Chesterfield out of the treasury of this County in an amount of five (5) per cent of the local tax collected from the recordation of taxable instruments under this Ordinance. Sec. 4. The Clerk of the Circuit Court of this County shall compile and furnish the necessary information to the Board of Supervisors of this County so that the Board may, at least semi annually, pay into the Treasury of the City of Colonial Heights a amount equal to the recordation tax collected on the recordation 0 instruments taxable under this Ordinance with respect to property located in the City of Colonial Heights, less the proportional compensation paid by the County to the Clerk of the Circuit Court for his services in collecting the same. , . . . (b) The ()wner to pay for test borings, soil examination, test pits and for chemical, mechanical, or other tests when required, 7, When requested to do so, the Architect will furnish preliminary estimates of the cost of the work, but he does not 'guarantee the accuracy of such estimates, 8, The Architect will endeavor to guard the Owner, through supervlslOn of the work, against defects and deficiencies in the work of the contractors, but he does not guarantee the performance of their contracts. (a) The supervision of an Architect is to be distinguished from the continuous personal superintendence to be obtained by the employment of a clerk-of-the-works. (b) When authorized by the Owner, a clerk-of-the-works acceptable to both Owner and Architect shall be engaged by the Architect at a salary satisfactory to the Owner and paid by the Owner, upon presentation of the Architect I s monthly statements. 9, (a) The cost of the work, as herein referred to, means the cost to the Owner, but such cost shall not include any professional service fees, reimbursement items, or the cost of a clerk-of-the-works. (b) When labor or material is furnished by or to the Owner below its normal market cost, the cost of the work shall be computed upon such market cost. 10. The drawings and specifications are instrmnents of service and as such are the property of the Architect whether the work for which they were ma.de be executed or not, and are not to be used on other work except by agreement with the Architect. 11, Payments to the Architect on account of his fee shall be made as follows, subject to the provisions established in Articles 3, 4 and 5: Form ETC-1 3 of 5 . . (a) Upon; completion and approval of the preliminary studies, a sum equal to 250/0 of the fee computed upon a reasonable estimated cost, (b) Upon completion of the contract drawings and specifications, a sum equal to 750/0 of the fee computed upon a reasonable estimated cost, or upon receipt of bid or bids, a sum equal to 750/0 of the fee computed upon the lowest bona fide bid, (c) Upon completion of the execution of the work covered under the contract docUIllents, including any extras pertaining thereto, a " sum equal to 1000/0 of the fee computed upon the amount of the original low bid plus the approved extras added thereto, the total SUIll being in no 'case les s than an amount equal to the original fee, , (d) Payments to the Architect, other than those'on his fee, shall be payable upon presentation of proper statements therefor, (e) No deductions shall be made from the Architect's fee on account of penalties, liquidated damages, or other sums withheld from payments to contractors, 12.
