11-11-1958 Packet . q '- , . t " t VIRGINIA:' At a 'regular meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on Nov. 11, 1958 at 10:00 .M. On motion of my' 8,..d.-+oVl MY'" GO:j~e , seconded by , the following resolution was adopted. This day again the matter of closing and abandoning that unnamed street or road leading from Mid-City Road in a wester ly direction to the right of way of the Atlantic Coast Line Rail- road past Mid-City Station, as requested by C. Wesley Cunningham and Jacquelyn W. Cunningham, his wife, and it appearing that the petitioners have duly filed their petition; that at least thirty days notice of the intent of the Board to close said road has been given by posting a notice thereof at the front door of the Court House and by posting notice thereof on at least three places along, and on said road by the return of Sheriff O. B. Gates, filed here- with, and by the posting of said notice at least twice in the 'News-Journal", a newspaper having general circulation in the Count as shown by certificate of the Business Manager of said newspaper filed herewith; and no opposition appearing thereto, it is unan- imously resolved that the Board, under the provisions of Title 33- 76.13 - 76-20 of the Code of Virginia of 1950 abandons that unname street or road leading from Mid-City Road in a westerly direction to the right of way of the Atlantic Coast Line Railroad past Mid- City Station, as shown on a plat of Mid-City Farms recorded April 4, 1927 in Plat Book 3, at pages 242 and 243, in the Clerk's Offic of the Circuit Court of this Count~and the same is hereby closed and abandoned as a public road. "'y:, On November ,11, 195~, the Board of Supervisors formally pasned a rasolution accepting the offer of Mr. Jacobs to give to the County of Chesterfield'the st~dium stands and other equipment at the Mooer's Athletic Field and expressed to him at that time the thanks of the County for such a generous gift. At this same meeting plans were made to have the proper surveys made of the Fair grounds and race traok to obtain the proper location, and bids were authorized for removing the steel seats and other facilities and reoonstructing same at the Court House. Shortl~ thereafter, Mr. Samuel Mayo, Architect, was , --.., . , ., commissioned to prepare working plans for the complete stadium. Bids were received and theJ.W.Enochs Construction Company was awarded the contract for building the first half of the ..stadium for the sum of $57,731.00. Underneath the stadium the Board of Supervisors, through its architBct, Mr.Samuel Mayo, drews plans of and received bids on the construction of complete dressing rooms for two teams, two concession stands with storage room facilities, rest room facilities, Red Cross and Office facilities with storage spaces. Thi s work has just been completed by the Burgess Construction and Contracting Company , of Bon Air, Virginia, for the sum of $32,997.00. There is a ,stro!'lg feeling held by many that the second half of this stadium should be erected immediately; however, no action has been taken on this question by the Board of Supervisors at this time. ~ " )... > -~ ,..." At a regular meeting of the Board of Supervisors' on Octo~er 14, 1956, Mr. R. Pinkney Sowers, representing Mr. Paul Jacobs came before the Board offering to the County ,of Chesterfield the stadium equipment at the old Mooer's Athletic Field in Richmond~ which' facility he said included 3500 to 4000 seats, several hundred bleacher seats, a lighting system, turnstiles, fencing and other,miscellaneous equipment, plus, of course, the part of the stadium itself that could be moved. Mr. Jacobs had one condition in his offer whichwas that 'the' County re~erect this stadium within a period of three years at Bome central location ,for the use of all the people in the County, preferably at Chesterfield Courthouse. At this meeting, Mr. Jacobs statp.d that he offered this equipment to the County of Chesterfield because in his opinion it would be of more benefit to the citizens of the area in this,locatdlon and \~ould actually 'benefit morep'eople. Such a facility could be the nucleus of County recreation facilities and would give Chesterfield a start1n this field. The Board of Supervisors on considering the question voted to give an answer within thirty days and asked that the Edecutive Secretary get proposed plans and bids for the moving of such a facility and requested the Commonwealth's Attorney to investigate the legality of accepting this stadium. .;.;;.. ,.' . . This summar,V deals with the Net Funds Available for Distdbution, as noted in the Final Budget for your county. MAINTEN~.NCE AND HAINTENANCE REPLACEMENT It will be well to note that the items of !1aintenance and Muinte- nance Replacement are items, which, of a necessity, cannot be considered as fixed items. The fluctuations of the wea~her, along with traffic, can cause large differences in these costs. We h~ve a heavy responsibility here, and regardless of other items, this maintenance must have first call upon our funds. DETAILS OF IXllISTP.UCTION PRO,JECTS The item listed as State Construction covers the imProvements effected during the past fiscal year. As ie well known, the estimates of cost for these items are not based on proposals prepared hy Engineering Surveys, but only on visual exe.minations. To obtain very close estimates would entail extensive engineering studies, which would not only delay the work, but .-1ould result in excessive costs. Such items as weather cond- itions, traffic usage, and the time of the year that a project is constructed a,lso are reflected in the final cost. .Ii th these uncertainti,es ever pres- ent, it is to be noted that there '.ill be at times wide varia~ions in the estimated cost and the actual cost. These variations, however, tend to balance themselves, and the over-all result is usually fairly constant. STATE FUNDS FOR NTJ1.lBERED PROJECTS . When F.A.S. Projects are constructed, there are certain items for w:1ich the cost cannot be included and paid for out of Hatched F .A.Ss Funds. These are such t.hings as Surveys, Right of I'Tay Cost.s, ano 1.nci- dental non-participating construction items. Their costs are very indefi- ni te and, cannot be ani ticipated wi.th any degree of accuracy. Also included are those projects to be constructed by State Funds, which for good and sufficient reasons require Engineering Surveys, deeded Right of Way, and/or rigid design. PAYNENTS TO TO\omS The payments, under Section 33-50.2 of the 1950 Code as amedded, cannot be accurately determined in advance. The payments, as a matter of 1m" are based on $300 per mile, with a, percentage of increase or decrease in proportion to the percentage increase, or decrease in the allocations to the State Secondary System. ., , . . -2- BAIu~~CE OR DEFICIT The balance or deficit at the end of this fiscal year must be added to or deducted from tht total allocations for the subsequent year prior to the distribution to indivi.ctual items. Because of an ertreme emergency, an authorized deficit, or part of the defi.cits, may have been allowed. This defi.cit, as well as the authority. for' same, is shown on the front sheet of the Final Budget. F.A.S. MATCHED FUNDS To effect the proper planning of the approximately 100-plus B.A.S. Project put underway each year, it has been found necessary to generally plan these projects at le~3t three (3) years in advance. The balance, as shown here, is the unlet balance as of June 30, 1958 and does not neces- sarily represent the unobligated balance. The next financially-planned project is shown. There may be times, however, when another project is put under actual construction prior to this project due to some difficulties being encountered in plans, design, right of way, or in negotiating with others affected such as railroads, power or the telephone companies and other utility owners. CO> BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY that: for.the year beginning January 1, 1959, and ending.on December 31, 1959, and also for each and every year thereafter, beginning January 1 of each year and ending with December 31 following until otherwise changed, that the business license ordin ance adopted December 1, 1957 be amended as follows: follows: That Chapter 1, be amended to add two new sections as Section 5-A - AMUSEMENT PARKS, GARDENS OR BUILDINGS Every person owning or operating an amusement park, garden, or building devoted to general amusement and entertainment and which is open to the public, including, but not limited to, a bowling alley, a billiard, pool and bagatelie parlor or establish-< ment, miniature golf course, golf driving 'range and public skating rinks, shall pay a license tax equal to $10.00 and twenty-hundredt s of one per centum of the gross receipts in excess of $10,000.00 of gross receipts for the business or businesses conducted by such person. Section 5-B - CLEANING, DYEING, PRESSING, REPAIRING, SPONGING OR SPOTTING CLOTHES, HATS, CARPETS, RUGS OR OTHER FABRIC ARTICLES (1) Every person agaged in the business of cleaning, dyeing, pressing, repairing, sponging or spotting clothes, hats,? carpets, rugs or other fabric articles shall pay a license tax equal to $20.00 and twenty-hundredths of one per.centum of gross receipts for the business or businesses. . . (2) The provisions of this section shall apply to an person who has a definite place of business or maintains an office in the County a~d to any person who maintains an office or has a . . definite place of business outside the County and solicits or engages in said business in the County. Where such other localit levies a local license tax and the same is measured by volume, the volume on which the tax shall be computed shall be the volume attributable to the business in such other locality. All volume attributable to the business in any such other locality which levies a local license tax thaeon shall be deductible from the base in computing the local license tax by volume imposed herein. If any such person engages in said business in the County and he has no definite place of business or office either within or without the County, then the local license tax imposed herein shall be computed on volume of business done in the said County. Every person agaged in said business which is mobile in character, where principal and essential acts constituting the doing of such business takes place in Chesterfield County, al- though the person may have a definite place of business in anothe locality, shall pay a license tax as provided herein. The term "principal and essential acts constituting the doing of such bus- iness" as used in this section, includes the collection from cus- tomers of articles on which work is to be done by such collector at a definite place of business, even though located in some othe locality, and includes the delivery to customers of articles on which work hB been done by such deliverer at a definite place of business, even though located in some other locality. That Chapter 1, Section 1 (i) be repealed and reenact ed as follows: (i) When a contractor, electrical contractor, plumb- ing or steamfitting contractor or building wrecker as defined in the foregoing paragraphs, shall have paid a local license tax to any city, town or county in which his principal office or branch office or ,offices may be located, shall be exempt from the paymen of additional license tax to the County of Chesterfield for con- f , ducting any such business within the confines of this County ex- . . c \ \ . . cept where the amount of business done by any such person in this County, exceeds the sum of $25,000 in any year, in which event, the said person shall be liable for the license tax as provided in the preceding paragraph as well as all other provisions of this section. The Commissioner of Revenue shall have the power to re- quire such periodic reports as he may deem necessary of all person claiming exemption under this sub-section. The exemption mentione in this sub-section shall not affect in any other way the require- ments of this section. In computing the license tax of a contractor, electric 1 contractor, plumbing or steamfitting contractor or building wrecke whose principal office or branch office or offices are located in the County of Chesterfield, there shall be exempt from the basis 0 taxation, the amount of business done in any other city, town or county upon which a local license tax has been assessed as provide in the Code of Virginia, Section 5g-299. That Chapter I, Section 7, be amended by adding a new sub-section to be known as paragnph (g) as follows: (g) Every person issued a permit by the Virginia Alco holic Beverage Control Board for the purpose of selling alcoholic beverages at a banquet, picnic, outing or other social gathering shall pay a license tax of $5.00 per event. We have been Architects or Associated Architects on the layout and facilities for Parker Field, Highland Springs Athletic Field, Richmond Arena, and other recreational facilities. Our consultant structural engineer was the engineer responsible for dismantling, re-designing, and re-assembling the steel stands moved from Scranton, PennsylvaniaJto Parker Field several years ago. He is proficient in both steel and concrete structures as to economy of design. It is difficult to determine at this time just how much is to be involved in the salvaging and re-Iocation of Moores Field. We believe that a cost-plus fee, as outlined in the enclosed brief, wuuld best protect the Owner's interest, as well as the Architect's. We do not see how any other equitable fee could be determined at this time. Cost-Plus Fee Basis In cases where the scope of the project and the extent of the services are not well defined as to magnitude and duration, payment to the Architect for architectural and engineering services would be based on a prearranged hourly cost, plus an equitable additional percentage for overhead and profit. In advance of performing the services in connection with the contract, the Architect shall provide the Owner with a.list of technical employees whom he proposes to employ on the project, along with a schedule of the hourly rate of each employee (not to exceed $4.00 per hour for principals of the firm.) The Owner shall pay the Architect the total technical personnel cost incurred by him on account of the project. Technical personnel costs shall be construed to mean the cost to the Architect of technical per sonnel, including designers, engineers, specification writers, inspectors and draftsmen when actually working in connection with the project. The Owner shall also pay the Architect an additional arrlOunt equal to 55 percent of the ,to~al personnel cost as defined above ,for his profit. LICENSE INSPECTOR - POWERS AND DUTIES The License Inspector is authorized to enforce the pro- visions of this Ordinance and any and all ordinances of the County requiring license taxes to be paid to the County, review any and all records of the Commissioner of Revenue other than Income Tax Returns and examine and audit the returns of allpersons, firms and corporations whom he has reason to believe to be liable to payment of any license levied by the County and to do any and all acts as authorized by Chapter 57, Acts of Assembly 1956. As indicated on the attached specifications, of equipment proposed by Motorola, it will be noted that Motorola provides a steel housing cabinet, suitable for mounting against the wall as requested, how- ever, access to all metering, and tuning is obtained by the opening of one door only. A second door on the reverse side of the cabinet affords excellent space to perform all service functions without the removing of equipment from the wall mounting. One very noteworthy advantage is the fact that the transmitter and receiver components of the mobile units are directly interchangeable with the transmitter and receiver components of the base station. This change can be accomplished by the removal of four screws, then disconnection of a cable plug and lifting the component out of the mobile case. No soldering iron or other tools with the exception of a screw driver is needed for this operation. Shipping dates are approximate and are based upon prompt receipt of all necessary information. The COMPANY shall not be liable for delay due to causes beyond its reasonable control, such as acts of GOD, acts of the PURCHASER, acts of civil or military authority, priorities, fires, strikes, floods, epidemics, quarantine restrictions, war, riots, delays in transportation, car shortages and inability due to causes beyond its reasonable control to obtain necessary labor, materials or manufacturing facilities. In the event of any such delay, the date of delivery shall be deferred for a period equal to the time lost by reason of the delay. 4. PAYMENTS-If, in the judgement of the COMPANY, the financial condition of the PURCHASER at any time does not justify continuance of production or shipment on the terms of . payment specified, the COMPANY may require full or partial payment in advance. This hose is to ~eplace 500 feet of hose purchased when the 1949 model truck was purchased during the year 1949. In a recent test of this hose, many sections were found leaking, some broken, and we feel it absolutely necessary to replace this 10 year old hose at a very early date.
