On motion of Mr. Holland, seconded by Ms. Haley, the Board went
into closed session pursuant to § 2.2-3711(A)(19), Code of

On motion of Ms. Haley, seconded by Mr. Holland, the Board
adopted the following resolution:
WHEREAS, the Board of Supervisors has this day adjourned
into Closed Session in accordance with a formal vote of the
Board and in accordance with the provisions of the Virginia
Freedom of Information Act; and
WHEREAS, the Virginia Freedom of Information Act effective
July 1, 1989 provides for certification that such Closed
Session was conducted in conformity with law.
NOW, THEREFORE BE IT RESOLVED, the Board of Supervisors
does hereby certify that to the best of each member’s
knowledge, i) only public business matters lawfully exempted
from open meeting requirements under the Freedom of Information
Act were discussed in Closed Session to which this
certification applies, and ii) only such business matters were
identified in the motion by which the Closed Session was
convened were heard, discussed or considered by the Board. No

Mr. Winslow called the meeting to order. He reviewed COVID-19
protocols for masks and spatial distancing.
2. APPROVAL OF MINUTES

3. REQUESTS TO POSTPONE AGENDA ITEMS AND ADDITIONS,
DELETIONS OR CHANGES IN THE ORDER OF PRESENTATION
There were no requests to postpone agenda items, additions,

4. WORK SESSIONS
4.A. PROPOSED FY2023 BUDGET
Dr. Casey provided the Board with an overview of the FY2023
budget topics. He stated today is the release of the balanced,
proposed County Administrator’s budget. He further stated it
is subject to community meetings, public processes, and hearing
from a variety of officials over the next month or so leading
to a public hearing on March 23rd, with a scheduled adoption
date of April 6th. He stated staff is still working with state
estimates and large investment of school and county resources
into the workforce, retention, recruitment and reward type
systems, and the continuation of teacher and public safety
sworn officers, including the rest of the civilian employees
relative to the pay study, as well as other initiatives.

Dr. Joseph Tylus, Deputy Superintendent of Chesterfield County
Public Schools (CCPS), introduced Ms. Ann Coker, Chair of the
Chesterfield County School Board, who provided details of the
School Board approved FY2023 operating budget and CIP. She
stated the superintendent’s proposed budget focused on three
main priorities which included an investment in the workforce,
student needs and infrastructure. She further stated the
superintendent came to the School Board with a needs-based
budget that included a $23.4 million funding gap. She stated
throughout the School Board’s budget process and by working
with the county, the funding gap has been reduced to $8.5
million, through additional county revenue and a conservative
addition through state revenue and taking a hard look at some
line items taking a focus on compensation and student growth.
She further stated state revenue is projected to increase by
$50 million, although meaningful differences exist at state
level. She then reviewed increases from FY2022 operating
budget, specifically relative to the salary study and the
importance of bringing positions closer to market average and
compression adjustments, as well as actual expenditures per
capita.
In response to Ms. Haley’s question, Ms. Coker stated
expenditures per capita does include debt service funding.
Ms. Coker concluded her presentation by reviewing proposed
school construction projects. She stated Chesterfield County
is a thriving, growing community and school infrastructure also
needs to grow. She further stated the county’s StratIS projects
enrollment is to increase by about 5,700 students by September
2026. She stated the initial plan identifies five new or
rebuilt elementary schools, four new or rebuilt middle schools,
and one new high school and one high school addition. She noted
the county is planning a bond referendum in November 2022 to
secure additional funding.
Mr. Holland expressed his appreciation relative to the on-
going collaborative effort between the county and school
division. He requested additional information relative to the
trend in the number of students enrolled in CCPS this calendar
versus last calendar year.
In response to Mr. Winslow’s question relative to the current
percentages of households in the county with school aged
children, Dr. Casey assured the Board they would receive that
actual figure from staff.
Ms. Haley stated the county and school division are absolutely
committed on both sides to employees and cautiously approaching
the budget process with the perspective of building a base of
expenditures that needs to remain sustainable.
Mr. Gerard Durkin, Budget and Management Director, provided
the Board with details of the proposed FY2023 budget. He stated
the proposed budget focuses on the following themes: historic
investment in Schools, employee recruitment and retention; the
upcoming $540 million referendum and the broad tax relief. He
then reviewed FY2023 proposed budget expenditures and general
fund growth. Regarding the FY2023-2027 Five-Year Plan, he
stated revaluation growth to follow pre-pandemic trend at
average 3.5 percent year-over-year; local sales tax forecasted
to remain strong but with subdued growth; growth in personal
property tapers as values expected to normalize in coming

years; compensation plan built into each year of the five-year
model; capital plan contributions maintain momentum heading
into referendum; and school system transfer grows by $17
million annually.
Regarding the $17 million school system transfer, Mr. Holland
stressed the importance of student growth relative to dollars
spent.
Mr. Durkin continued his presentation by noting additional
funding requests that place an emphasis on customer service,
specifically Commissioner of the Revenue taxpayer portal and
Treasurer’s Office customer service staffing, Communications
and Media creative content writer and videographer,
Constituent Services intergovernmental affairs analyst, plans
review team planner, and Registrar absentee coordinator. He
stated the budget also places an emphasis on the importance of
investment in support services, specifically focused on the
countywide paid internship program; support for Employee
Medical Center in customer service representative and nurse
practitioner; Information Systems Technology desktop support
position; Real Estate Assessment assistant director; and
Accounting Department financial systems part-time to full-time
conversion.
In response to Mr. Winslow’s question regarding the Employee
Medical Center, Mr. Durkin stated those positions should be
able to sustain themselves and help with cost-savings in the
future.
Mr. Durkin continued his presentation by noting additional
funding requests that place an emphasis on the commitment to
public safety, specifically Community Corrections probation
officer and technician part-time to full-time conversions, and
Emergency Communications Center technology maintenance. He
noted the Fire and EMS FY2023 general fund enhancement total
$1,443,100. He then reviewed Police Department and Sheriff’s
Office additional funding requests. Regarding infrastructure
and facilities, he stated there is about $281,000 in the local
fund contribution to the Greater Richmond Transit Company
(GRTC) to fund the 82x Express Route.
In response to Mr. Winslow’s question relative to GRTC funding,
Dr. Casey stated the process of the Central Virginia
Transportation Authority’s governance over budget resolutions
is explicit. He further stated the governance of the three
localities that will hopefully convene in mid-April will be
that link to CVTA of the three localities. He noted GRTC is
conducting a micro transit analysis that will be reported to
the CVTA.
Mr. Carroll noted CVTA funds are allocated in three ways – a
portion to GRTC, 50 percent to each participating locality
proportionally, and the rest for regional projects. He stated
the majority of funds received by GRTC will be allocated to
support regional routes in the current system; however, GRTC
is planning on allocating $10 million on expansion of the
network bases on regional priorities.
Mr. Durkin continued his presentation by covering details
relative to the upcoming referendum, general fund spending per
capita and Schools’ spending per student.

Discussion ensued relative to the importance of cost and
spending per student, the future delivery of education, ways
to alleviate overcrowding, as well as the opportunity to engage
in partnerships with local community colleges. Emphasis on
continuing to address and resolve salary compression for the
school system was also discussed.
Mr. Durkin continued his presentation by covering support for
Schools through operating funds, capital funds and one-time
funds.
Discussion ensued relative to the importance of funding
dedicated to the major maintenance program as well as details
relative to the fully funded school system’s supplemental
retirement plan.
Regarding broad tax relief, Mr. Durkin noted the real estate
tax rate reduction from $0.95 to $0.92. He stated personal
property tax relief thresholds increased from $1,000 to $1,500;
the first amendment to threshold since 1998. He further stated
personal property tax exemption adjustment went from 46 percent
to 55 percent. He stated all program eligibility brackets for
elderly and disabled tax relief were adjusted up by 6 percent.
Regarding BPOL tax relief, he stated the threshold is
increasing from $300,000 to $400,000, with two-thirds of
businesses now exempt from tax. He further stated the vehicle
registration fee will decrease from $40 to $20, equivalent to
1.5 cents on the real estate rate.
In response to Ms. Haley’s question regarding how citizens
receive information relative to elderly and disabled tax relief
amendments, Mr. Harris stated the Commissioner of the Revenue’s
office will handle notifications to the public.
Dr. Casey noted county departments and various organizations
market informational campaigns for the public relative to tax
relief programs.
Mr. Holland commended staff on the initiative to decrease the
vehicle registration fee which compliments the increase in
personal property tax relief thresholds.
Mr. Durkin continued his presentation by covering many unknowns
facing the FY2023 budget development such as labor market
fluctuations, inflationary pressures, and geopolitical unrest.
He stated this budget has been developed with flexibility in
mind, specifically the sizable increase in pay-go
(contributing to the new district enhancement program, seed
money for referendum projects); the merit adjustment in
February of 2023; long-term liability contributions above
policy requirements; and a conservative approach to state and
personal property tax collections, interest rate assumptions.
He then covered several unfunded requests, specifically
operating and capital requests, as well as $4 billion in
unfunded transportation projects.
Discussion ensued relative to proposed regional transportation
project funding.
In conclusion, Mr. Durkin reviewed FY2022 projections. He
stated the projected surplus of +/- 5 percent attribute to
strong real estate and personal property tax collections. He
stated year-end actions under consideration are as follows:

auto reserves; public safety pay plan reserve contribution;
unassigned fund balance contribution – fund through the five-
year plan; and OPEB/SRP contribution to recalibrate funded
status following the pay study implementation. Regarding long-
term liabilities, he stated the Supplemental Retirement Plan
(SRP) funded status is at 92.3 percent prior to the planned $5
million contribution related to the public safety pay plan
implementation. He further stated additional SRP contribution
may be needed due to the general government pay plan
implementation.
Ms. Stephanie Brown, Procurement Director, provided the Board
with details of the department’s budget. She reviewed cost
avoidances/savings due to procurement efforts. Regarding
pandemic challenges, she stated the department’s response
quickly pivoted to a virtual environment with no delays or
downtime to operations. She stressed the importance of the
collaboration with an established supplier base to overcome
supply chain issues and the restructuring on the department to
increase focus on leveraging technology. She then highlighted
examples of term contract impacted by supply chain issues
outside of inflation and examples of challenges of on spot
purchases and construction projects. In conclusion, she
reviewed how the department will continue to address various
challenges going forward, specifically related to relationship
management, internal collaboration, and an increase in
efficiencies.
Discussion ensued relative to future projections and increased
supplier diversity.
Ms. Mary Martin Selby, Director of Human Resources, provided
the Board with details relative to the employee pay study. She
stated to assist in recruitment and retention efforts, the
county conducted 3 pay studies. She further stated the two of
the pay studies were finalized in FY2021: the sworn public
safety study and teacher pay study. She stated the third and
final pay study for all remaining county and schools’ positions
is currently underway. She noted how minimum wage has increased
as compared to actual market pay. She stated approximately 300
county employees earn less than the proposed minimum wage. She
further stated the county has been fortunate enough to give
annual merit increases consistently over the years; however,
those increases have been relatively modest over the past 12
years and have not always kept pace with cost-of-living
increases. She then reviewed data relative to the comparison
of employees in Chesterfield and employees in a neighboring
locality. She stated on the county side, in addition to the
standard merit increases for this year and next year, staff
would like to implement Phase 1 of the pay study
recommendations, which includes the following: as the new
minimum wage is currently $11 per hour, staff would like to
move most county employees to a pay plan where $12 is the
minimum rate; 120 select positions have been identified by
department leaders as being hard to fill because of starting
salaries; those 120 critical positions are unique to the
county, and staff is proposing that those positions move to
the $16 minimum pay plan in Phase 1; since the midpoint of the
new pay ranges represents “market” and what a proficient
employee should earn according to market data, the plan places
employees, in their new pay ranges, bases on years of service;
employees who are already at or above midpoint would receive
a flat 5 percent increase to prevent compression and to

recognize them for their tenure as well; and Phase 2 of the
pay study would move all employees who were on the $12 minimum
pay plan during Phase 1 to the $16 minimum pay plan. In
conclusion, she stated in roughly a 12-month period, the
minimum increase of a non-probationary county employee would
receive a total of 9 percent, and employees below the midpoint,
would receive more than the 5 percent increase.
In response to Mr. Holland’s question regarding disparity, Ms.
Selby stated the way the plan is established, staff can
accomplish getting people to competitive salaries within the
two phases.
Discussion ensued relative to ways to retain valuable and long-
serving employees and a reserve system for all county step-
based plans.
Fire Chief Loy Senter started off his presentation by stating
the county’s public safety compensation package had become less
competitive in the region. He further stated the salaries of
many veteran public safety employees has become compressed
through stagnant wage growth in the years following the
recession, during a time when salary adjustments were focused
primarily on starting pay and those with 5 years or less of
service. He stated this Board recognized this was not
sustainable and invested over 13 and a half million dollars to
implement a “hybrid” public safety step plan, uniformly applied
to minimize compression among tenured employees and prevent
leapfrogging by those similarly classified employees with less
experience. He further stated the new public safety pay plan
had an immediate positive effect on the attrition rates of our
public safety agencies, especially in retaining our most
experienced employees. He stated the investments proposed by
the County Administrator in both public safety and general
government compensation will be critical to attract and retain
top quality talent for not only those who wear the uniform and
serve on the front lines, but also for those civilians embedded
in public safety department who work tirelessly behind the
scenes to ensure operational success. He then reviewed proposed
budget funds for various operational improvements to public
safety as well as needs that may lie ahead as the community
grows and Fire and EMS demands continue to increase. In
closing, he expressed appreciation on behalf of all public
safety members for the Board’s efforts over the past few years
to improve compensation and provide needed support in the areas
of staffing, equipment, and facilities.
Mr. Winslow commended Chief Senter and members of the Fire and
EMS department for their continued hard work and dedication to
citizens of the county.
In response to Mr. Holland’s question, Chief Senter stated the
sites for the proposed Five Forks fire station and the proposed
Highlands fire station have already been secured, as well as
future sites for proposed fire stations.
Board members commended the efforts of the organization in
terms of offering competitive compensation and quality
proposed facilities.

Mr. George Hayes, Director of Utilities, stated the
department’s mission is to provide the highest quality water
and wastewater services that meet or exceed the needs and
expectations of present and future customers. He then reviewed
the average residential customer’s monthly charge and stated
there is no increase in water or wastewater connection fees.
He highlighted the county’s FY2023 proposed monthly
residential charge compared to the current FY2022 charge in
other localities, as well as service line charge increases.
Regarding the budget, he stated operating and capital outlay
increases include $2 million in operating funds and $0.43
million in capital outlay.
In response to Mr. Ingle’s question, Mr. Hayes stated the
customer rate in Chesterfield County is lower than Richmond’s
rate. He further stated the county contractually pays for the
services they provide, as well as a share of the infrastructure
that feeds into the county.
Mr. Hayes continued his presentation by noting personnel
increases which include the annual merit increase, the county’s
classification and compensation study and various positions.
He then highlighted the ten-year capital projects plan which
includes the PCWWTP equalization basin; AEWTP projects;
Hopkins Road to Route 1 waterline; Otterdale Road waterline
interconnection; and the Providence and Woodward waterline.
Mr. Harris reviewed dates relative to upcoming community
meetings, public hearings and budget adoption.
4.B. CONSENT AGENDA HIGHLIGHTS
Mr. Jesse Smith, Deputy County Administrator, provided details
of Item 13.A.2. - Appropriation of Funds and Authorization to
Award a Construction Contract for the Otterdale Road (Route
360 to Woolridge Road) Widening Project.
Mr. Jeff Mincks, County Attorney, provided details of Item
17.B. - To Consider an Ordinance to Amend County Code § 7-3
(Precinct Boundaries and Polling Places) to Cure Voting
Precinct Splits Resulting from the Redistricting of the
County’s Magisterial Districts and from the State’s
Redistricting of Congressional and Legislative Districts; to
Establish Polling Places for New Precincts; and to Move
Precincts Redistricted into New Magisterial Districts.

Mr. Winslow reviewed COVID-19 protocols for masks and spatial
distancing. He stated he verified that all Board members have
received copies of citizen comments posted to the online
portal. (It is noted citizen comments received through the
online portal are attached as Attachment A.)

The Honorable Jim Holland, Dale District Supervisor, gave the
invocation.
9. PLEDGE OF ALLEGIANCE
Deputy County Administrator Matt Harris led the Pledge of
Allegiance to the Flag of the United States of America.
10. COUNTY ADMINISTRATION UPDATE
10.A. GENERAL ASSEMBLY UPDATE
Ms. Natalie Spillman, Intergovernmental Relations
Administrator, provided the Board with a General Assembly
update. She stated last Tuesday, both chambers rejected each
other’s recommended budgets, which are currently in
conference. She noted there is a $3 billion dollar variance
between the House and Senate versions of the budget, with the
House version including over a $5 billion dollar tax cut
condition, where the Senate has opted to defer and study
further. She stated there are topics that appear to be similar
in both versions of the chambers budget; however, members are
far apart on the approach taken to get there. She noted
tomorrow is the last day to put bills through conference.
10.B. BLACK HISTORY MONTH REVIEW
Ms. Kimberly Conley, Assistant Director for Citizen
Information and Resources, who shared with the Board various
events and programs that occurred throughout February in honor
of Black History Month. She also provided a brief update
relative to the highly anticipated return of the USCAA Small
College Basketball Championship to VSU, which began this week.
Mr. Holland and Mr. Carroll both commended Ms. Conley and her
team for providing an outstanding program of various activities
during the month of February, in honor of Black History Month.
10.C. OTHER COUNTY ADMINISTRATION UPDATES
Ms. Jess Robison, Chesterfield Emergency Management
Coordinator, who provided an update to the Board relative to
some special activities happening this week and beyond that
are designed to engage the public on the importance of being
prepared during the occurrence of severe weather.
Mr. Winslow and Mr. Holland emphasized the importance of being
prepared as an individual, business, local government, and a
country especially recently, specifically relative to the war
in Ukraine and natural disasters.

Dr. Casey announced the Federal Communications Commission,
through its Emergency Connectivity Fund Program, has granted
the Chesterfield County Public Library funds to purchase 100
Wi-Fi hotspots to loan to Chesterfield citizens, enabling them
to access the internet with their phones, laptops, or other
Wi-Fi-enabled devices. He stated the service is intended to
provide connectivity to those who cannot pay for internet
service in their homes.
Dr. Casey announced the county was put into the lowest category
under the Centers for Disease Control Covid-19 guidelines. He
stated the lowest category removes the regulations,
specifically the mandate relative to spatial distancing.
11. BOARD MEMBER REPORTS
Mr. Carroll announced a meeting was held last night at
Chesterfield Career and Tech Center regarding the odor issue
at Skinquarter Landfill.
Regarding Mr. Carroll’s remarks, Dr. Casey reviewed the County
Landfill Action Plan to be further refined over the next two
weeks with timelines establish, as follows: 1) Odor Management
Plan: Publicly report out the timeline for Skinquarter to
produce the newly required Department of Environmental Quality
(DEQ) Odor Management Plan; 2) Website: Enhance the county’s
Environmental Stewardship website to include the Skinquarter
Landfill with the variety of information that is of the
county’s and public’s interest, such as DEQ reports and Odor
Management Plan; 3) Odor Complaint Portal: If Skinquarter
cannot timely develop a public comment portal easily assessable
by the public, the county would utilize IST resources to
develop a portal for anyone with odor or other complaints that
would automatically be forwarded to Skinquarter’s management
and DEQ; 4) Memorandum of Understating: MOU for county’s role
to act as agent of DEQ to spend the time-attention needed with
the county defining scope for a dedicated employee or
contracted resources; 5) Monitoring Stations: Facilitate
additional monitoring stations on private property for those
landowners wanting stations free of charge with defined
reporting practices; and 6) Future Community Meeting: Prompt
and host, if needed, Skinquarter management periodic community
meetings.
Mr. Carroll expressed his appreciation to county staff for
their work preparing and setting up the meeting and to members
of the public for their participation.
Mr. Holland announced the Dale District Budget Town Hall will
be held tomorrow evening, March 10th at 6:30 p.m. in the Public
Meeting Room.
Discussion ensued relative to the other district’s respective
budget town hall meetings in the upcoming weeks.
Mr. Winslow announced he attended the 33rd Annual Chesterfield
County Black History Month Celebration – Scholarship
presentation on February 18th. He also announced he attended
the special program where broadcast media professional Theresa
Gee portrayed Coretta Scott King, on February 26th.

WHEREAS, Mr. Lonnie R. Worrell retired from the
Chesterfield County Department of General Services Buildings
and Grounds Division effective February 1, 2022, after over 28
years of service; and
WHEREAS, on November 7, 1994, Mr. Worrell was hired by
Chesterfield County as a County Maintenance Worker; and
WHEREAS, in October 1999, Mr. Worrell was promoted to a Sr.
Maintenance Worker and ultimately reclassified to a Principal
Maintenance Worker; and
WHEREAS, Mr. Worrell continued to learn new skills which
resulted in the reclassification of his position to Sr. Labor
Crew Chief; and
WHEREAS, Mr. Worrell demonstrated his commitment to the
County and contributed to a positive work environment; and
WHEREAS, Mr. Worrell was an invaluable member of the
Horticulture Shop because of his positive attitude,
willingness to help others, and vast landscaping knowledge;
and
WHEREAS, Mr. Worrell was very safety conscious while
handling all equipment assigned to him and had minimal
downtime; and
WHEREAS, Mr. Worrell supervised seasonal grounds
employees, overseeing them in the performance of assigned
duties; and
WHEREAS, Mr. Worrell’s strong work ethic was inspirational
to co-workers and other County employees; and
WHEREAS, Mr. Worrell supported the County’s goals, values,
and objectives through teamwork and dependability.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County
Board of Supervisors recognizes the outstanding contributions
of Mr. Lonnie R. Worrell, expresses the appreciation of all
citizens for his service to Chesterfield County, and extends
appreciation for his dedicated service to the County,
congratulations upon his retirement, and best wishes for a
long and happy retirement.

REAL ESTATE ASSESSMENTS, UPON HER RETIREMENT

WHEREAS, Mrs. Sharon S. Driskill retired from the
Department of Real Estate Assessments on November 1, 2021; and
WHEREAS, Mrs. Driskill began her public service with the
County as a clerk typist for Lane Ramsey in the Budget
Department in 1979, and has faithfully served Chesterfield
County for over 36 years; and
WHEREAS, Mrs. Driskill demonstrated her work ethic and
dedication in many roles throughout the county, moving first
into the Building Inspections office for seven months, then to
the record room of the Clerk of Circuit Court recording deeds
and issuing marriage licenses, then after five years as a title
examiner in private sector, brought that experience back to
the County in reviewing plats, deeds, and other legal documents
for the Departments of Right of Way (three years) and Real
Estate Assessments (28 years); and
WHEREAS, Mrs. Driskill demonstrated versatility and the
highest level of customer service when working with both
internal and external customers; and
WHEREAS, Mrs. Driskill displayed a profoundly caring
attitude toward all of her customers, often going out of her
way to remember everyone’s name, no matter their position, and
WHEREAS, Mrs. Driskill was always willing to listen and
share her knowledge in legal documents and business practices,
regularly and patiently working with coworkers to understand
them; and
WHEREAS, Mrs. Driskill’s vast knowledge, years of
experience, and tireless dedication to supporting and achieving
the goals and objectives of the County Departments for which
she has worked have enabled her to make a significant
contribution to its success; and
WHEREAS, more than anything else, Mrs. Driskill has been
a loyal friend to many, regularly greeting everyone by name,
and with skills and willingness to help in a way that will be
sorely missed at the County.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield
County Board of Supervisors recognizes the contributions of
Mrs. Sharon S. Driskill, and on behalf of its members and the
citizens of Chesterfield County, extends its appreciation for

to award a construction contract in the amount of $12,847,211
to Curtis Contracting, Inc.; and to execute all necessary
change orders up to the full amount budgeted for the project.

13.A.3. RESOLUTION AUTHORIZING THE GENERAL REGISTRAR AND
DIRECTOR OF ELECTIONS OF CHESTERFIELD COUNTY TO FILE
AN APPLICATION WITH THE STATE BOARD OF ELECTIONS FOR
A WAIVER TO ADMINISTER SPLIT VOTING PRECINCTS
On motion of Mr. Ingle, seconded by Ms. Haley, the Board
adopted the following resolution authorizing the General
Registrar and Director of Elections of Chesterfield County to
file an application with the State Board of Elections for a
waiver to administer split voting precincts:
WHEREAS, Section 24.2-307 of the Code of Virginia, 1950,
as amended, requires each voting precinct in the County of
Chesterfield to be wholly contained within a single
congressional district, Senate district, House of Delegates
district, and magisterial district;
WHEREAS, Section 24.2-307 of the Code of Virginia, 1950,
as amended, further provides that the Board of Supervisors may
request the State Board of Elections to grant a waiver from
the above-stated requirement if a congressional, Senate, or
House of Delegates district splits a voting precinct and the
Board is unable to establish a precinct containing at least
100 registered voters that is wholly contained within a single
congressional district, Senate district, House of Delegates
district, and magisterial district;
WHEREAS, the State’s redistricting of congressional
districts has split (among others) the following existing
voting precincts in the County:
1) Genito Voting Precinct (402) – split by Congressional
Districts 1 and 4
2) Clover Hill Voting Precinct (412) – split by
Congressional Districts 1 and 4
WHEREAS, the portions of the Genito Voting Precinct and
Clover Hill Voting Precinct that have been split by the State’s
congressional redistricting cannot be merged into adjacent
precincts without creating new splits between election
districts; and

WHEREAS, the number of registered voters in the portions
of the Genito Voting Precinct and Clover Hill Voting Precinct
that have been split by the State’s congressional redistricting

Chesterfield County to submit a request for a waiver from the
State Board of Elections pursuant to Section 24.2-307 of the

and the Zoning Ordinance of Chesterfield County, Virginia, for
itself and its successor or assigns, proffers that the
development of the approximately 96.25 acres with Chesterfield
County Tax Identification Number 737688399500000 and the
approximately 83.90 acres with Chesterfield County Tax
Identification Number 739692556200000, 180.15 acres total
(collectively, the “Property”) under consideration will be
developed, as applicable, as set forth below; however, in the
event the request is denied or approved with conditions not
agreed to by the Owner-Applicant, these proffers shall be
immediately null and void and of no further force or effect.
A. The Applicant hereby proffers the following conditions,
applicable to the entire Property (Districts C-3 and I-
1).
1. Master Plan. The Textual Statement last revised
February 3, 2022, shall be considered the Master
Plan. (P)
2. Burning Ban. The Developer shall not use burning to
clear or timber the Property. (P)
3. Design Guidelines. These proffers shall include the

The following proffers shall apply only to the Falling
Creek Property to be rezoned C-3, which proffers shall be
in addition to proffers A(1)-A(3):
1. Density. The maximum density of the Falling Creek
Property shall be a maximum of: 35,000 square feet
of shopping center/retail, 260 multi-family dwelling
units with no more than 25% permitted to be three or
more bedrooms, 60 townhomes, and 45 single family
detached homes. (P)
2. Access. Direct vehicular access to and from the
Falling Creek Property to and from Genito Road shall
be limited to three (3) entrances/exits. The exact
location of each access shall be approved by the
Transportation Department. (T)
3. Open Space, Amenity Areas, and Pedestrian Areas. (P)
a. Common areas and recreational spaces for use by
owners, residents, tenants, guests, and
invitees shall be provided throughout the
Falling Creek Property and designed to include
amenities that provide recreational
opportunities, gathering areas, and add high
visual interest, and shall include at a minimum
the following: 6,000 square foot clubhouse, a
pool, sundeck, dog park, outdoor grills, fire
pit, decorative pedestrian-style lighting,
benches, landscaped areas, plantings, bike
racks and storage, multi-purpose lawn (for use
for such activities as bocce ball), and other
pedestrian-friendly or community amenity
features approved by the Planning Director at
the time of plans review.
b. Prior to the issuance of certificates of
occupancy for more than one hundred fifty (150)
dwelling units, a clubhouse of a minimum of
6,000 square feet in size with a fitness center
shall be provided.
c. Pedestrian areas such as trails, walks and
paths, and the above amenities along such areas,
shall be provided throughout the Falling Creek
Property to provide pedestrian connectivity

throughout the entire development and in
particular between buildings and different uses
on the Falling Creek Property. The exact
design, material and location of such
pedestrian elements shall be approved by the
Planning Director at the time of plan approval.
The exact location and surfacing of any path or
trail within any Resource Protection Area must
be approved by the Department of Environmental
Engineering at the time of plans review.
d. There shall be an internal system of sidewalks,
paths and crosswalks along and between roads
and drives providing overall pedestrian
connectivity within the Falling Creek Property.
Such hardscaped walks shall be constructed of
various hard and decorative materials, such as,
but not limited to pavement, concrete, stone
pavers, asphalt, or stamped concrete.
4. Public Water and Wastewater. Public water and
wastewater systems shall be used, however, the
existing stormwater pond may be put to non-potable
use such as irrigation. Prior to any site plan
approval, a utility plan for the Falling Creek
Property shall be submitted to and approved by the
Utilities Department. Utilities for this
development, and phasing thereof, shall conform to
the approved utilities plan or as otherwise approved
by the Utilities Department. (U)
5. Landscaping. (P)
a. Street trees shall be provided along both sides
of all streets. Such trees shall be planted a
minimum of every fifty (50) feet on average
unless there are conflicts with utilities,
sightlines, driveway areas or other items as
determined at the time of plan approval.
Enhanced landscaping shall be provided in the
center of all traffic circles and any roads with
a boulevard design.
b. Within the Single Family Detached Residential
Area, the rear of any lot adjoining the pond or
common area surrounding the pond shown on the
Concept Plan, shall include a fence, wall, or
landscaping to separate the rear yard of such
single family detached homes from the common
area, unless otherwise approved at the time of
plan review. Any common access in and around
any single family detached home within the
Single Family Detached Residential Area shall
include signage designating the common areas
from individual lots and private areas.
c. In the Commercial Area, a landscape strip shall
be provided along Genito Road planted in
accordance with Zoning Ordinance requirements
for 1.5x Perimeter Landscaping C. A variable
width landscape strip a minimum of ten (10)
feet in width shall be provided along the
boundary of the Commercial Area adjoining any

residential use, excluding any drive aisles.
Hedges shall be planted in a landscape strip
six (6) feet in width along the Commercial Area
parking area to screen adjacent residential
areas from vehicle sounds and headlights.
6. Foundation Planting. Foundation plantings shall be
required along the entire front façade of all
dwelling units, and shall extend along all sides of
such units facing a street. Foundation planting beds
shall be a minimum of three (3) feet wide measured
from the dwelling unit foundation. Planting beds
shall be defined with a trenched edge or suitable
landscape edging material and shall include medium
shrubs spaced a maximum of four (4) feet apart and
may include spreading groundcovers. The plant
materials used should visually soften the unit
corners and complement the architecture of the home
at their mature sizes, and shall include native
species and/or drought-resistant plants when located
in irrigated beds in order to minimize the need for
irrigation. Planting bed deviations may be approved
by the Planning Department at the time of plan review
due to unique design circumstances. (P)
7. Slopes. With the exception of any grading or
improvements required for the conversion of the
existing pond facility to a stormwater BMP, steep
slopes on the portion of the property located north
and west of the existing pond, which are equal to or
greater than 20%, shall remain in their natural,
undisturbed state to the maximum extent practicable,
unless otherwise approved by the Department of
Environmental Engineering. In locations where the
disturbance of slopes greater than 20% is
unavoidable, enhanced erosion and sediment control
measures will be provided as directed by the
Department of Environmental Engineering at the time
of plans review. The Department of Environmental
Engineering shall approve the exact design and
implementation of these standards. (EE)
8. Stormwater. (EE)
a. The maximum post-development discharge rate for
the 100-year storm shall be based on the maximum
capacity of the existing facilities downstream,
and shall not increase the recorded and/or
established 100-year backwater and/or
floodplain beyond pre-development discharge
rate. On-site detention of the post-development
100-year discharge rate to below the pre-
development 100-year discharge rate may be
provided to satisfy this requirement.
b. For any areas which will drain towards the Plum
Creek at South Ridge subdivision, the post-
development 1, 2, 10 and 100-year peak discharge
rates shall not exceed the pre-development 1,
2, 10 and 100-year peak discharge rates,
respectively.
c. The existing pond shall remain and receive an

engineering and geotechnical and hydraulic
clean bill of health from a qualified
professional. The conversion of the existing
pond to a stormwater facility shall be subject
to documented geotechnical approval. The
services provided by the independent
geotechnical engineering firm shall include
full-time geotechnical inspection paid for by
the developer. In addition, the stormwater
facility certification process shall be
performed by a licensed professional approved
by the County at the owner’s expense.
9. Cash Proffer. For each dwelling unit the
Owner/Developer/Applicant shall pay a cash proffer
to the County of Chesterfield for road improvements
within the service district for the Falling Creek
Property. Each payment shall be made prior to the
issuance of a certificate of occupancy for a dwelling
unit, unless state law modifies the timing of the
payment. The amount of the cash proffer payments for
each unit shall be as follows (with corresponding
titles provided per Exhibit A for clarification):
townhouse (“FOR SALE TOWNHOMES”) and single family
rental (“RENTAL SINGLE FAMILY AND MULTI-FAMILY”)
$5,922, and single family detached (“FOR SALE SINGLE
FAMILY LOTS”) $9,400. Should the County impose impact
fees at any time during the life of the development
that are applicable to the property, the amount paid
in cash proffers shall be in lieu of or credited
toward, but not be in addition to, any impact fees,
in a manner determined by the County. At the option
of the Transportation Department, cash proffer
payments may be reduced for the cost of road
improvements, other than those improvements
identified in the Transportation Improvements
Proffered Condition, provided by the
Owner/Developer/Applicant, as determined by the
Transportation Department. (T)
10. Transportation Improvements. Prior to the issuance
of an occupancy permit, the following shall be
completed, as determined by the Transportation
Department: (T)
a. Construction of a separate right turn lane off
of Genito Road into each access point into the
development.
b. Dedication to Chesterfield County, free and
unrestricted, of any additional right-of-way
(or easements) required for the improvements
identified above.
11. Protective Covenants. Prior to or concurrent with
the final approval of the initial subdivision or plan
of development for the Falling Creek Property, a
document setting forth covenants (the "Covenants")
shall be recorded in the Clerk's Office of the
Circuit Court of Chesterfield County, Virginia,
setting forth controls on the maintenance of the
Falling Creek Property and establishing an owners'
association (the "Association"). The Association may

be a part of a larger association encompassing more
property than just the Falling Creek Property. The
Covenants shall provide for high standards of uniform
maintenance of individual sites, common areas, open
space, landscaping and private streets, in
accordance with industry standards for similar
communities in the greater Chesterfield County area,
as determined in the reasonable discretion of the
Director of Planning at the time of plan review. Any
maintenance provision in the Covenants shall not be
deleted or modified without the written consent of
the Director of Planning. The Covenants shall contain
a notice that there is an industrial area in the
proximity of the Falling Creek Property. The
Covenants shall also prohibit boat, boat trailer and
recreational vehicle storage on the Falling Creek
Property. (P)
12. Uses (P)
a. Commercial Area. In the area designated as
“COMMERCIAL” on the Concept Plan attached
hereto as Exhibit A (the “Commercial Area”),
the following shall apply:
(i) The only C-3 Community Business District
uses permitted shall be an alcoholic
beverage store, and the residential uses
included in Proffered Conditions 15(b),
15(c) and 15(d) herein.
(ii) All uses permitted by right within the C-
2 Neighborhood Business District shall be
permitted, except the following shall be
prohibited:
1. Automobile rental;
2. Automobile self-service station;
3. Automobile service station;
4. Commercial kennels;
5. Funeral home;
6. Mortuary;
7. Motorcycle, Go Cart, All-Terrain
Vehicle, or similar type vehicle
track or operation; and
8. Veterinary clinic or hospital with
accessory kennel for overnight stays.
(iii) No one user shall exceed 20,000 square
feet.
b. Multi-Family Residential Area. In the area
designated as “RENTAL SINGLE FAMILY AND MULTI-
FAMILY” on the Concept Plan attached hereto as
Exhibit A (the “Multi-Family Residential Area”),
uses shall be limited to uses permitted with
restriction in the Residential Multi-Family (R-MF)
District.
c. Townhome Residential Area. In the area designated
as “FOR SALE TOWNHOMES” on the Concept Plan attached
hereto as Exhibit A (the “Townhome Residential
Area”), uses shall be limited to uses permitted with
restriction in the Residential Townhouse (R-TH)

District.
d. Single Family Detached Residential Area. In the
area designated as “FOR SALE SINGLE FAMILY LOTS” on
the Concept Plan attached hereto as Exhibit A (the
“Single Family Detached Residential Area”), uses
shall be limited to single family dwellings.
13. Signage. In the Commercial Area, no signage attached
to the rear of any commercial building facing the
Multi-Family Residential Area shall be lit. (P)
14. Trash Receptacles. Solid waste storage areas, not
including convenience containers, shall be screened
from public view at ground level from the adjacent
properties and/or the public right of way with an
enclosure constructed with materials to match the
building it serves. The area shall have an opaque
door which shall remain closed when not being
accessed. Solid waste storage in the Commercial Area
shall not be located along Genito Road or the
adjacent Multi-Family Residential Area, unless
otherwise approved at the time of plan review. (P)
15. Street, Parking Lot and Site Lighting. Street lights
shall be provided along roads and drives at a maximum
height of fifteen (15) feet. Internal site lighting
shall be of a pedestrian scale, and parking lot
lights shall be provided for pedestrian safety. All
site lighting, including parking lot and roadway
standards, sign lighting, walkway lighting and
accent lighting, shall be of such design and/or
location so that the light source is substantially
shielded from view and glare is minimized. (P)
16. Architectural Standards and Exterior Materials. All
buildings on the Falling Creek Property shall be
designed as follows: (P)
a. Commercial Area
(i) Any buildings constructed in the
Commercial Area shall generally be in
conformance with the buildings shown on
the Commercial Elevations attached hereto
as Exhibit B with respect to quality of
design, massing and architecture, unless
otherwise approved at the time of plan
review. All buildings in the Commercial
Area shall incorporate equal four sided
architecture such that no building
exterior (whether front, side or rear)
shall consist of inferior materials or be
inferior in quality, appearance or detail
to any other exterior of the same building.
The exterior portions of the wall surfaces
of any building within the Commercial
Area, excluding windows, doors,
breezeways, gables and architectural
design features, shall consist of 70% of
masonry material (brick, stone, or brick
veneer). EIFS shall consist of no more than
15% of the exposed portion of any wall of

any building, shall not be located less
than six (6) feet from the ground adjoining
the building, and is permitted to be used
primarily as an accent material.
b. Residential Areas. Any buildings constructed
within the Multi-Family Residential Area, the
Townhome Residential Area, and the Single
Family Detached Residential Area, shall be
subject to the following:
(i) Any buildings constructed in the Multi-
Family Residential Area, including the
clubhouse, shall generally be in
conformance with the Hamlet Elevations
attached hereto as Exhibit C with respect
to quality of design, massing and
architecture, unless otherwise approved at
the time of plan review. Additionally, the
exterior portions of the wall surfaces of
the clubhouse, excluding windows, doors,
cornices, accent bands, breezeways, gables
and architectural design features, shall
consist of 70% of masonry material (brick,
stone, or brick veneer). Any buildings
constructed in the Townhome Residential
Area shall generally be in conformance
with the For Sale Townhome Elevations
attached hereto as Exhibit D with respect
to quality of design, massing and
architecture, unless otherwise approved at
the time of plan review. Any buildings
constructed in the Single Family Detached
Residential Area shall generally be in
conformance with the For Sale Single
Family Elevations attached hereto as
Exhibit E with respect to quality of
design, massing and architecture, unless
otherwise approved at the time of plan
review.
(ii) All buildings shall have exterior wall
surfaces constructed of brick, stone or
cultured stone, architectural masonry, and
cementitious siding and trim, or other
materials comparable in quality as
approved by the Director of Planning, all
exclusive of windows, doors, cornices,
accent bands, and architectural treatments
which may be constructed of metal,
fiberglass, stucco, or other materials
comparable in quality as approved by the
Director of Planning. No vinyl siding or
EIFS shall be permitted. The exposed
portion of all exterior wall surfaces
(front, rear and sides) of any building
shall be similar in quality as to
architectural treatment and materials.
Unit foundations shall be brick or stone
and shall extend a minimum of eighteen (18)
inches above final grade. The roofs shall
be sloped or flat and the roof materials
shall be standing seam metal, TPO, or

thirty (30) year architectural dimensional
shingles.
(iii)In the Townhome Residential Area,
architectural materials will vary every 40
linear feet to provide diversity in
material, and to minimize visual
repetition of buildings, no two adjacent
townhouse units shall have the same
identical individual elevation sequence
pattern across the front of the building,
unless otherwise approved at the time of
plan review.
(iv) In the Single Family Detached Residential
Area, to minimize visual repetition of
buildings, no two adjacent single family
detached homes shall have the same
identical individual elevation sequence
pattern across the front of the home,
unless otherwise approved at the time of
plan review.
(v) All dwelling units in the Townhome
Residential Area and the Single Family
Detached Residential Area shall have
either a porch or a minimum 4’ x 4’ covered
stoop. All such porches shall be a minimum
of four feet (4’) deep unless otherwise
approved at the time of plan review.
(vi) All dwelling units in the Townhome
Residential Area and the Single Family
Detached Residential Area shall have a
minimum of a one (1) car garage. Front
loaded garage doors shall have a minimum
of two (2) enhanced architectural
features. Enhanced features shall include
windows, raised panels, decorative panels,
arches, hinge straps or other
architectural features on the exterior
that enhance the entry (i.e., decorative
lintels, shed roof overhangs, arches,
columns, keystones, eyebrows, etc.). Flat
panel garage doors are prohibited.
(vii)A minimum of a three (3) foot wide concrete
walk shall be provided to the front
entrance of each dwelling unit in all
residential areas, to connect to
driveways, sidewalks, or streets.
17. Setbacks. The minimum required setback for all
structures, parking areas, drive aisles and public
and private access roads shall be as follows: (P)
a. 50 feet from Genito Road, other than as needed
to access Genito Road;
b. 50 feet from the eastern boundary line of the
Falling Creek Property; and
c. 25 feet from the western boundary line of the
Falling Creek Property.

18. Irrigation. In the Single Family Detached
Residential Area, an irrigation system shall be
provided in all front yards and street side yards on
corner lots. An irrigation system shall also be
provided at each vehicular access entrance on Genito
Road. All irrigation systems on the Falling Creek
Property shall include water conserving components
and features such as, but not limited to, soil
moisture and rain sensors and micro and drip type
systems. (P,U)
19. HVAC Unit and Generator Screening. HVAC units and
generators located on the roof shall be screened from
view from the adjacent public right of way. HVAC
units and generators located on the ground shall be
screened from view by landscaping or low maintenance
material. (P)
C. The Applicant hereby proffers the following conditions,
applicable to the portions of the Property to be rezoned
District I-1, as shown on the Concept Plan attached hereto
as Exhibit A (collectively, the “Industrial Property”).
The following proffers shall apply only to the Industrial
Property, to be rezoned District I-1, which proffers shall
be in addition to proffers A(1)-A(3):
1. Access Limitations. There shall be no vehicular
access to and from the Falling Creek Property from
and to the Industrial Property. Further, no access
to and from the Industrial Property shall be
permitted from Creek Bottom Way or W. Providence
Road. (P)
2. Building Setback. Any building on the Industrial
Property shall be set back at least two hundred (200)
feet from the boundary lines of any residentially
zoned or residentially developed property. (P)
3. Lighting. Any new parking lot or storage area
lighting on the Industrial Property, within two
hundred (200) feet of any agriculturally or
residentially zoned property, shall not exceed
twenty (20) feet in height as measured from the grade
of the base of the lighting standard. All site
lighting on the Industrial Property, including
parking lot and roadway standards, sign lighting,
walkway lighting and accent lighting, shall be of
such design and/or location so that the light source
is substantially shielded from view and glare is
minimized. Lighting within any site that
unnecessarily illuminates or substantially
interferes with the use and enjoyment of any other
site, particularly any adjacent residential or
agricultural districts adjacent to the Industrial
Property shall be prohibited. (P)
4. Storage Area Screening. Any areas used for storage
shall be screened from public view by the building
on the Industrial Property, an opaque fence or wall,
supplemental landscaping, or existing vegetation, as
approved at the time of plan review. (P)

5. Sound Levels. The sound levels from any outdoor
operations on the Industrial Property shall be
limited to a decibel level that does not exceed a
day-night average sound level (“DNL”) of 65 decibels
as measured on the Decibel A Scale (“dBA”), as
measured at the Industrial Property boundary line.
Sounds as required by law, ordinances, rules or
regulations, such as but not limited to, back up
alarms on vehicles, shall be exempted from such sound
limitations. (P)
6. Vehicle and Equipment Storage. All vehicles and/or
equipment shall be stored with all parts lowered to
their minimum height (bucket trucks, fork lifts,
buckets, etc.) to reduce visibility from surrounding
properties. (P)
7. Buffer. A one hundred (100) foot buffer shall be
maintained along the east property line where
adjacent to residentially or agriculturally zoned
property. No buildings, parking or other facilities
shall be permitted within this buffer. (P)
8. Roofs. Special treatment shall be provided for any
rooftops visible from Powhite Parkway. Such special
treatment shall ensure that any heating, ventilating
and air conditioning equipment located on rooftops
are screened and/or incorporated into the building
design. (P)
9. Signage. All building mounted signs visible from
Powhite Parkway shall utilize a uniform background
color and the same color of letters. No such
building mounted signs visible from Powhite Parkway
shall be lighted in any fashion. All such signage
shall be submitted to the County Planning Department
for review prior to the installation of any such
building mounted signs. For those businesses whose
lots adjoin Powhite Parkway right-of-way, no
freestanding business signs shall be located between
Powhite Parkway and the closest façade of the closest
building on that lot to Powhite Parkway. (P)
10. Loading Areas. Sites shall be designed and buildings
shall be oriented so that loading areas are not
visible or are screened from residential or
agriculturally zoned properties or from any public
right of way. (P)
11. Public Water and Wastewater. Public water and
wastewater system shall be used. Prior to any site
plan approval, a utility plan for the Industrial
Property shall be submitted to and approved by the
Utilities Department. Utilities for this
development, and phasing thereof, shall conform to
the approved utilities plan or as otherwise approved
by the Utilities Department. (U)
12. Building Design. Buildings shall be designed and
located in such a manner that architecture and site
layout do not project the appearance of typical strip
development. Architectural renderings/elevations
shall be submitted to the Planning Department for

approval in conjunction with schematic plan review.
There shall be no unpainted metal buildings on the
Industrial Property and no untreated masonry units
visible from a public road or any agricultural or
residentially zoned property. (P)
13. Stormwater. The maximum post-development discharge
rate for the 100-year storm shall be based on the
maximum capacity of the existing facilities
downstream, and shall not increase the recorded
and/or established 100-year backwater and/or
floodplain beyond pre-development discharge rate.
On-site detention of the post-development 100-year
discharge rate to below the pre-development 100-year
discharge rate may be provided to satisfy this
requirement. In addition, no impervious surfaces
shall sheet flow toward the Providence Creek
subdivision. (EE)
14. Slopes. Disturbance for the purposes of development
on slopes greater than 20% shall be permitted only
upon approval by the Environmental Engineering
Department. In locations where the disturbance of
slopes greater than 20% is unavoidable, enhanced
erosion and sediment control measures will be
provided as directed by the Department of
Environmental Engineering at the time of plans
review. The Department of Environmental Engineering
shall approve the exact design and implementation of
these standards. (EE)
15. Utilities. Except for junction boxes, meters and
existing overhead utility lines and any wetlands
crossings, if any, all new utility lines shall be
underground. All junction and access boxes shall be
screened with appropriate landscaping. All utility
pad fixtures and meters shall be shown on the site
plan. The necessity for utility connections, meter
boxes, etc., shall be recognized and integrated with

COUNTY’S MAGISTERIAL DISTRICTS AND FROM THE STATE’S
REDISTRICTING OF CONGRESSIONAL AND LEGISLATIVE
DISTRICTS; TO ESTABLISH POLLING PLACES FOR NEW
PRECINCTS; AND TO MOVE PRECINCTS REDISTRICTED INTO NEW
MAGISTERIAL DISTRICTS
Mr. Mincks stated this date and time has been advertised for
a public hearing for the Board to consider an ordinance to
amend County Code Section 7-3 (precinct boundaries and polling
places) to cure voting precinct splits resulting from the
redistricting of the county’s magisterial districts and from
the state’s redistricting of congressional and legislative
districts; to establish polling places for new precincts; and
to move precincts redistricted into new magisterial districts.
He further stated Section 24.2-307 of the Code of Virginia
requires that each voting precinct be wholly contained within
a single magisterial district, congressional district, Senate
district, and House of Delegates district. He stated the
county’s November 17, 2021 adoption of an ordinance
redistricting the County’s magisterial districts resulted in
three existing voting precincts being split between
magisterial districts. He further stated the Skinquarter
precinct is split between the Matoaca and Midlothian districts,
the Pocoshock precinct is split between the Dale and Midlothian
districts, and the Woolridge precinct is split between the
Matoaca and Clover Hill districts. He stated the State’s
December 28, 2021 adoption of redistricting plans for
congressional, Senate, and House of Delegates districts has
resulted in six existing voting precincts being split between
congressional districts, one existing voting precinct being
split between Senate districts, and five existing voting
precincts being split between House of Delegates districts. He
further stated staff is proposing two alternative ordinances
to amend County Code § 7-3 (Precinct Boundaries and Polling
Places) in the event the Attorney General does not render a
decision by the March 9, 2022 public hearing date. He
stated the first ordinance (Alternative A) cures all splits
resulting from both the County’s magisterial redistricting and
the State’s congressional and legislative redistricting. He
stated the second ordinance (Alternative B) cures only those
splits created by the State’s congressional and legislative
redistricting (and not the splits created by the County’s
magisterial redistricting).

17.C. TO CONSIDER CHANGES TO THE CHESTERFIELD COUNTY PARKING
ORDINANCE, COUNTY CODE 13-41
Corporal Morton stated this date and time has been advertised
for a public hearing for the Board to consider changes to the
Chesterfield County parking ordinance, County Code 13-41. He
further stated County Code 13-41, Sections (a)(2) and (b)(2)
currently prohibit motorists from parking directly in front of
a public or private driveway, on the same side of the street
as that driveway. He stated there is currently no prohibition
of parking on the opposite side of the roadway, directly
opposed to a driveway, in such a way to prevent ingress and/or
egress from that driveway. He further stated County Code 13-
41, Section (a) prescribes that police officers, uniformed law-
enforcement department employees, and Sheriff’s deputies may
issue notices of parking violations on County-owned or other
public property in violation of section (a). He stated Section
(b), however, currently prescribes that only police officers
and uniformed law-enforcement department employees may issue
notices of parking violations on private property in violation
of section (b). He further stated staff is proposing that
Sheriff’s deputies be permitted to also issue notices of
parking violations on private property under subsection
(b). This will assist in a more efficient use of staff and
resources in both the Police Department and the Sheriff’s
Office. He stated the proposed code changes would not require
any alterations to the Police Department or Sheriff’s Office’s
issued parking tickets or any other standardized forms. He
further stated the minor revisions will give the Police
Department and Sheriff’s Office additional tools to help
relieve some of the ever-changing challenges facing our
community members in a growing suburban environment.

In response to Ms. Haley’s question, Corporal Morton stated an
offense would include parking a vehicle more than 18 inches
from the curb or roadway edge, or in any direction other than
parallel to the right edge of the curb or roadway edge where
parking is permitted.
Mr. Mincks noted the ordinance also includes the enforcement
of parking of vehicles on private property.
In response to Mr. Carroll’s question, Mr. Mincks stated there
is an existing state code that authorizes the county to enforce
the conditions, specifically in front of a homeowner’s
driveway.
Mr. Winslow called for public comment.
Ms. Renee Eldred suggested providing additional information
for citizens regarding the recent proposed ordinance.
In response to Mr. Winslow’s question, Mr. Mincks stated the
ordinance would be effective immediately.
Discussion ensued relative to the importance of promoting the
parking guidelines on social media platforms and ways citizens
can report various parking infractions.
There being no one to speak to the issue, the public hearing
was closed.
On motion of Mr. Carroll, seconded by Mr. Ingle, the Board
adopted the following ordinance:
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD,
1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 13-41
RELATED TO UNLAWFUL PARKING GENERALLY
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 13-41 of the Code of the County of Chesterfield, 1997, as amended,
is amended and re-enacted to read as follows:
Sec. 13-41. Unlawful parking generally.
(a) No person shall park a vehicle on county-owned or other public property in violation of
any of the provisions of this subsection. Any person who receives written notice from a
police officer, uniformed law-enforcement department employee, or sheriff's deputy that
he has committed any of the offenses listed in this subsection may waive his right to
appear and be formally tried for the offense. The waiver shall be effective when the
person (i) voluntarily pays $25.00 to the county treasurer's office within five days after
receipt of the notice, except that a violation of section 13-41(a)(4) or section 13-
41(a)(16) shall require a payment of $75.00 or (ii) voluntarily places $25.00 in the reply
mail envelope on which the notice of violation is printed and mails it to the county
treasurer's office so that it is postmarked within five days after receipt of the notice,
except that a violation of section 13-41(a)(4) or section 13-41(a)(16) shall require a
payment of $75.00. Such person shall not thereafter be required to appear before the
general district court for trial upon the offense set forth in the notice. Such offenses shall
include parking a vehicle:

(2) In front of a public or private driveway or directly across from a public or
private driveway in such a way that causes obstruction to the ingress or egress
of such driveway.

(15) More than 18 inches from the curb or roadway edge, or in any direction other
than parallel to the right edge of the curb or roadway edge in areas where
parking is permitted., except that a vehicle may be parked within 18 inches of
and parallel to the left curb or roadway edge on a one-way street or at an angle,
where permitted.

(b) No person shall park a vehicle on private property, including private parking lots open
to the public and designated to accommodate more than 50 vehicles, in violation of the
provisions of this subsection (b). Any person who receives a written notice from a police
officer, uniformed law-enforcement department employee, or Sheriff’s deputy that he
has committed any of the offenses listed in this subsection (b) may waive his right to
appear and be formally tried for the offense. The waiver shall be effective when the
