On motion of W. E. Redmon, seconded by G. L. Crump, the fol lowing resolution
was adopted:
WHEREAS the sewerage disposal system for the elementary school now under con-
struction in the vi Ilage of Chester must be of the treatment type requiring an
outfal I and must be therefore located off the school site,
AND WHEREAS the engineering firm of R. Stuart Royer and Associates and the
Chesterfield County Sanitarian determined the best available site for same to
be situated west of the Thomas Da Ie High Schoo I,
AND WHEREAS the method of sewage disposal (sub surface) in use at Thomas Dale
High School has given a great deal of trouble over the past 15 years and
presents an annual problem incapable of being solved properly by any extension
of the present installation,
AND WHEREAS a recent study conducted by Royer and Associates of the needs of
the new elementary school and of the high school, both separately and jointly,
indicates that one large plant can be engineered and constructed to serve both
schools for $14,157.68 less than would be required if separate plants were
bui It,

AND WHEREAS projects included in the 4t mi Ilion dollar bond issue voted in
1957 did not provide for sewerage disposal faci lities at Thomas Dale High School,
NOW THEREFORE, BE IT RESOLVED that the Board of Supervisors of Chesterfield
County be requested to approve the transfer of sufficient funds, not to exceed

The superintendent advised the Board that a request had been made by Mr. R. J.
Britton, Supervisor for Manchester District, for the dedication to the county
of a parcel of land fifty (50) feet in width along the southerly boundary of
the property whereon the E. S. H. Greene School is located for the purpose of
extending Cranford Avenue to Catalina Drive, thus eliminating Some of the
hazards experienced by pupi Is in making their way to school each day.
N~I THEREFORE, on motion of Robert p. Eagles, seconded by G. l. Crump,
BE IT RESOLVED: That the County School Board of Chesterfield, Virginia,
agrees to dedicate the aforesaid parcel of land to the County of Chesterfield
for road purposes and the Chairman and Clerk of this Board are authorized to
do any and al I acts necessary to accomplish the purpose of this resolution.

MATOACA DISTRICT
1. Matoaca Baptist Church requests a variance from the setback requirement
along a thirty (30) foot street to allow construction of an Educational
Building.--Construction to front Ferridale Avenue with a setback of fifteen
(15) feet therefrom.
2. Dr. James Smith requests a variance from th~ 9~d@ line setback require-
ment to allow construction of a residence on~ib~~a~land Avenue within
four (4) feet of either side line. A previous variance granted December
1958 allowed a five (5) foot setback from either side. Supporting papers all
sanction the four (4) foot setback.
MANCHESTER DISTRICT
1. Mrs. ~uzie F. Hines-2221 Windsor Road-requests a variance from the lot
usage requirement to permit the remodeling of an addition to the family's
private garage at the rear of the main residence on the lot and approximately
thirty (30) feet therefrom for the purpose of providing living quarters for

2. J. A. Hall requests a variance from the lot size requirement in an R-2

3. Mrs. Orvin C. Shank-1802 Hidden Road-requests a variance from the side
line requirement in an R-2 Zone to permit an addition of a room and bath to

DALE DISTRICT
1. Richard J. O'Neil~requests a variance from the required front line setback
from the highway in an Agricultural Zone to permit construction of a residence

PROPOSED BUDGET
1959 - 1960
It is gratifying to check the work program submitted with
last year's budget and see that the Commission is right on
schedule. The street-naming, house-numbering report was completed,
and progress is being made; the Reqional Inventory was prepared
and published; a tentative regional highway plan prepared; and
now in the spring of 1959 preliminary regional land use planning
is in process - exactly as programed in last year's budget.
The two major efforts of the year were the Reqional
Inventory report and the special $25.000 consultant study of
governmental organization. This latter PAS study was financed by
an independent appropriation, but it did incur additional expenses
from the regular funds.
Last year's budget assumed that the balance of $5,847.16
from the previous year would act as a reserve for hiring a
summer intern, a consultant, or publishing an additional report

if needed. However. only $1,000 was used for summer employ-
ment of the planning student, and it is, therefore, estimated
that approximately $4,800.00 will be on hand June 30, 1959.
This balance is again requested as a reserve for future needs
during the coming year.
The greatest deviation of expenditure from budget
allocation during the current year occurred in the personnel
account. This was due to the summer intern, additional
stenographic cost during the PAS study, and due to the increase
created by the Commission assuming full payment of the
stenographer's salary, rather than receiving part payment from
the City of Richmond.
ANTICIPATED ACTIVITIES FOR THE BUDGET YEAR
Preliminary fact-finding and base map preparation is
complete. The time for decision-making, for pOlicy determination
has arrived. During the coming year the Commission should pre-
pare, adopt and distribute a future land use plan for the
Region. Many important and difficult questions concerning
densities, open space needs, arrangements of land uses, desires
of the people, etc., must be studied, but progress toward a

regional plan should not wait for every answer to every
possible question. There would no no beginning and no end.
Time is a critical factor, and the faster a conception of the
future Richmond Region can be formalized, the sooner its
objectives can be recognized and appreciated by the forces of
activity within the area. As more detailed studies are made,
the plan would be adjusted and refined.
The Commission will prepare the future land use plan
for the Region by following a logical step-by-step procedure:
(1) clearly define the regional objectives and
goals the future plan should achieve.
(2) consider existing uses of land, physical
conditions and other factors of current
development.
(3) study alternate patterns of future regional
development in the light of the objectives
stated and the existing conditions and trends.
(4) determine future land use requirements,
based on population.
(5) assemble local future highway and land use
plans (the Chesterfield Plan will soon be
completed) and study relationships to each
other. the regional patterns. and the area-
wide land use requirements.
(6) prepare regional future land use plan;
outline its proposals.
(7) recommend development controls or means of
implementation of the Plan.

No effort is made to attach a time schedule to the
above outline. If the Commission becomes involved in further
study of the PAS report, the Regional Plan may progress slowly.
If full time can be applied to this work, however, it should be
completed, or nearly so within the year.

WHEREAS the Community of Bon Air has experienced a
growth in population, thus creating a problem insofar as
the delivery of mail into the Area is concerned, at the
present time mail is being delivered from five different
sources -
1 - R.F.D. No.1, Midlothian, Va.
2 - R.F.D. No.8, Richmond, Va.
3 - R.F.D. No.9, Richmond, Va.
4 - Rouse-to-house delivery to a number of homes
from Richmond 25, Va.
5 - Bon Air Post Office, Bon Air, Va., and
WHEREAS many people of the Bon Air Area use the Bon Air
Post Office for mailing.packages, securing Money Orders,
purchasing postage stamps, Federal Revenue Stamps, mailing
letters and other types of service, and
WHEREAS there are more than nine hundred families living
in the Bon Air Area and more than 1000 acres of land being
rapidly developed for residential purposes, and
vrnEREAS there is a great deal of confusion resulting from
the present situation to people of Bon Air Area and the
people serving the Bon Air Area, and
WHEREAS the continuance of the present situation and trend
will tend to destroy the present Post Office and the valuable
serve it is now rendering the Bon Air Area Community,
and the very name of the BON AIR COl~~NITY, therefore be it
RESOLVED--that the proper Postal Authorities be requested to
re-organize the present plan of mail delivery to the Bon Air
Area, to provide for mail delivery direct from the Bon Air
Post Office to the people living in the Bon Air Area. That
a copy of this resolution be mailed to Ron. J. Vaughan Gary,
and the proper Postal Officials at WaShington, D. C., with
a resolution from the Board of Supervisors of Chesterfield
County, Virginia.

We were very pleased that you could participate in the Urban County Congress
to see for yourself the work that the National Association of County Officials
is doing for county government. We hope that you found the meeting worthwhile
and that we can look forward to having your county subscribe to our County
Information Service.
The subscription fee, based upon your county's 1950 population, entitles the
county to the full range of the Association's 12 major services as described
in the enclosed letter. vie are also taking the liberty of enclosing a bill
for the 1959 subscription fee.
We built our Urban County Congress and our entire service progroam on the
premise that the collective wisdom of county officials is capable of solving
the most difficult problems. Acting together through the National Association
of County Officials, officials in every part of the nation are finding that
they receive valuable ideas and inspiration from their fellow officials. Just
as important, they are finding that through united action they are gaining for
county government and themselves the prestige and dignity so necessary to sound
local government.

I have received and carefully noted your letters of March
16 and 18, along with enclqsures.
I also have talked at sOlUe length with your Mr. A. n. Eure,
Fiscal Director of the Department of nigh~vays.
From your letter:;, encloGures, and my talk with Mr. Eure,
three facts seem apparent:
1. There will be a subs tantial increase in highway 'revenue
for the current biennium over and above the amount anticipated ~'lhcn .-
the Legislature ulet last January. Part of tIlls increaze "Iill be
from federal funds, but, and this is most significant, approximately
$9 million more will be realized from fLmds derived wholly from

I am concerned about l,ever.al aspects of this situation.
First, I am concerne.d that too great attention, and too large a Ghare
of the highway funds, are being given to the Federal Interstate High-
~~![lY!; to the detr.i~nt of the State's own ,road system. Secondly, I .3111
,concerned that the IUglwmy Department is, on its 01iffi initiative, pre-
paring toollocate an additional $9 million for the Interstate High-
\Jay System, this amount being over and 'above the amount app;ropriated
by the Legislature.

The Federal Interstate Highway System, of course, has
importance to the nation as a whole, but is a long-range program',
and should be considered as such. While I am,not downgrading the
Federal Interstate Highways, I am very anxious as a member of the
Legislature that our own road system not be made to suffer in order
to expedite a small part of the federal System.
The general impression seems to prevail that there will be
lesS funds available for the use of the Highway Department 'for the
present biennium than was envisioned. The fact is, according to in-
formation I received from the Department itself, there will be mOre
funds available than the Legislature had anticipated. But the De-
partment plans to use this additional money for the Federal Inter-
state system. It does not plan to allocate any of this additional
money, I am informed, for the three other categories; farm-to~market
roads, the primary highways of, the State, or'the city streets. The
point I am suggesting is this:
Is it wise to allocate all of the additional funds to the
Federal Interstate System and leave completely out in the cold all
the ,other roads within the State? The Federal system within the
State represents only 2% of the State's road mileage.
Virginia maintains 50,000 miles of road bed, more than any
other State in, the Union, with one exception. I would deeply regret.
to ,see our Highway Department jeopardize our own road system in order
to speed up the Federal program which was originally envisioned as a
thirteen year plan and which many competent authorities feel in reality
should be a twenty year plan.
Your allocations for the coming fiscal year, as I understand
it, still are tentative. Before you make effective the tentative
allocations I should appreciate your careful consideration of the
facts mentioned above.
I want to strongly urge that the Highway Department proceed
cautiously in expediting the Federal Interstate program at the expe~
of the StateVs primary and secondary road systemS.

THIS AGREE}illNT, made this 27th day of March, 1959, by and
between
FAYE REALTY CORPORATION, a DeBware Corporation,
hereinafter referred to as "Owner", parties of the first part; and
the COUNTY OF CHESTERFIELD, VIRGINIA, as the governing body of
said County, hereinafter referred to as "County" party of the
second part.

That for and in consideration of the mutual benefits re-
suIting from the undertakings of the parties hereto set forth in
this contract, the Owner and the County covenant and agree with
each other as follows:
1. That the Owner shall have the right to construct and,
install sewage disposal lines and mains to dispose of sanitary
sewage originating on the premises situated in the County within
the subdivision of "Westover Hanor", situated south of Jahnke Road
and west of Atlantic Coast Line Railroad Company, , shown enclosed
in red lines on the copy of the plan by LaPrade Brothers, . Civil
Engineers, Richmond, Virginia, dated February 12, 1959, entitled:
"Vicinity Maps Showing Westover Manor Subdivision", attached to
contract between City of Richmond and County of Chesterfield dated
Z!l!! day of IlP~"/ , 1959, to which reference is here made

for an accurate description of the property included in this
contract, provided the County has the right to dispose of sanitary
sewage into the City of Richmond sanitary sewer system.
2. The installation of the sewer lines, sewer mains, force
mains, pumping stations, laterals, lines, pipes and other appur-
tenances for the collection of sewage in the aforesaid area and
the mains and extensions thereto necessary to transmit the said
sewage to the sanitary sewage system of the City of Richmond, in-
eluding the inspection thereof and engineering costs, shall be
done at the sole cost of the Owner and in accordance with the
specifications and requirements of the County and the City of

Richmond, Virginia. The location, character and size of the mains
and the materials used in the installation, replacement, mainten-
ance and repair thereof shall be as specified by the County and
City. The County will be furnished as built drawings by the
Owner.
3. The County shall supply sewer service to the owner and

Richmond's sanitary sewer system.
4. In the event the contract between the County and the
City of Richmond, Virginia, to dispose of sewage into the City's
sewage disposal facilities shall be 'terminated, then o\mer or
users will provide and install such facilities, devices and equip-
ment necessary properly to treat and dispose of the sewage. The
character and capacity of such facilities, devices and equipment
shall be of such standards as prescribed by the County and the
cost of providing, installing, maintaining and operating'such
facilities, devices and equipment shall be borne by the o\mer. In
the event the o\mer fails, refuses, or neglects to provide the
facilities as required by the County, or fails, refuses or neglect
to dispose of the sewage in a proper or ,efficient manner, then,
after notification by the County, the County will provide the
necessary facilities properly to dispose of the sewage at the cost
of the owner. The owner and grantees of such rights herein shall
be responsible to pay a proportionate share of the costs of pro-
viding such facilities based upon the following proportion:
user's cost: total cost = user's service; total
service rendered by facility.
5. The title to this system shall vest in the County in
fee simple, upon completion of the construction of the system or
any additional construction and the responsibility for the main-
tenance and operation thereof shall be that of the County, and the
County will dispose of the sewage in the area covered by this con-

tract, subject to the terms of this contract. County assumes no
responsibility for maintaining laterals from sewer mains.
6. The County shall have the right to make or permit ex-
tensions of or additional connections to the sewer or sewers.
7. When the County shall take title to the sewage disposal
facilities, the customers of these facilities shall pay to the
County such charges or special charges as may be fixed by the
County, which may be changed or modified at any time or from time
to time by the County. Each individual place of business, separat
facility, customer, user, house, tenant or lessee located within
the area defined herein, shall pay to the County a connection fee
to connect the service from their property to the system in accord
ance with the prevailing rate charged by the County or such rate
as may be determined by the County. The grantees of such rights
herein shall be responsible for the pa~nent of all charges for
such services.
8. The owner shall be bound by, observe and comply with
all laws, ordinances, resolutions, rules and regulations of the
County heretofore or hereafter adopted, governing the furnishing
of sewer service. Sewer service may be suspended by the County
at any time without notice, whenever, in the judgment of the pro-
per officials of the County, they deem an emergency exists.
9. The owner shall first obtain a permit from the Virginia
State Department of Highways before any lines or mains are install
ed in the roads and streets of the county and shall replace such
portion of any road or street, including the resurfacing thereof,
which is disturbed by the construction or installation of any such
mains or lines of this system.
10. The duties and obligations of the parties to this con-
tract shall be binding on their devisees, successors in title and
assigns.
11. (a) The Owner will not discharge, cause to be discharg
ed or permit the discharge into the sewage system any of the follol

ing waters, wastes or effluent:
I
1. Any liquid or vapor having a temperature higher
than 1500 Fahrenheit;
ii. Any water or waste which contains more than
100 parts per million by weight of fat, oil
or grease;
iii. Any flammable or explosive liquid, solid or gas;
iv. Any raw garbage, ashes, cinders, sand, mud, straw,
shavings, metal, glass, rags, feathers, tar plastics,
wood, paunch manure, or any other solid or viscous
substance that causes obstruction of the flow in
sewers or interferes with the operation of the
said sewer system;
v. Any water or waste having a concentration of
acidity and alkalinity of less then pH 5.5 nor
more than pH 9.0, or having any other corrosive
property that causes or is likely to cause damage
or injury or constitutes or is likely to constitute
a hazard to structures, equipment or personel
employed in the operation of the said sewer system;
vi. Any water or waste containing a toxic poisonous
substance that injures or is likely to injure
or interfere or is likely to interfere with any
sewage treatment process, or constitutes or is
likely to constitute a hazard to persons or animals
or creates or is likely to create any hazard in
the waters receiving the effluent of the main
sewage treatment plant;
vii. Any noxious or malodorous gas or substance that
creates a public nuisance; or
viii. Storm water sewage or surface or subsurface water.

(b) In the event the County finds any of such waters,
wastes or effluent are being discharged into the sewer system the

Owner will cause such discharge to be discontinued, or will pro-
vide and install such facilities, devices and equipment as are
necessary to prevent the consequences resulting from the dischar
ge of such waters, wastes or effluent into sewer system. The
character and capacity of such facilities, devices and equipment
shall be of such standard as shall be prescribed by the County
and shall be installed in such place or places as will be read-
ily and easily accessible for observation, maintenance, operatio ,
sampling, cleaning and inspection. The cost of providing, in-
stalling, maintaining, cleaning and operating such facilities,
devices and equipment shall be borne by the Owner. In the event
the Owner fails, refuses or neglects to provide, install, main-
tain, clean or operate such facilities, devices and equipment or
fails, refuses, or neglects so to do in a proper and efficient
manner, the Owner will pay to the County such charges as the
County may prescribe for treating the effluent discharged by the
Owner into the sewer system to prevent the consequences result-
ing from the discharge of such waters, wastes or effluent into
the sewer system.
(c) All measurements, tests and analyses of the characte -
istics of such waters, wastes, or effluent shall be determined
in accordance with the latest edition of "Standard Methods For
The Examination of Waters and Se'vage" as prepared, approved and
published jointly by the American Public Health Association and
the American 'vater Works Association, when applicable.
12. Owner will not discharge into the sewage system any
matter prohibited by any appropriate ordinance, resolution, rule
regulation and penalty heretofore or hereafter adopted by the
County or any other appropriate governmental agency having juris
diction herein.
13. That the OlVner shall indemnify, keep and hold the
County free and harmless from liability on account of injury to
or damage of any person or for damage to property of any person
incurred in the construction and installation of said sewage sys

tern or to the Owner or to any other person or property directly or
indirectly resulting from the failure of the County to supply such
service in "hole or in part, and in the event that suit shall be
brought against the County, either independently or jointly "ith
the Owner onuaccount thereof, the Owner will defend the County in
any such suit at the cost of the Ol{ner, and in the event of a
final judgment being obtained against the County, either independ-
ently or jointly with the Olmer, then the Owner will pay such
judgment with all costs and hold the County harmless therefrom.
14. County shall have the right to inspect or cause to be
inspected the se"er connection or connections through which such
service is supplied at any time and any violation of the provision
of paragraphs 11, 15 and 16 of this contract shall be deemed
sufficient cause to discontinue such service.
15. Se"age shall not be discharged into the sewer system at
a rate greater than 100 gallons per minute through a single sewer
service connection "ithout the ,-;ritten approval of the County.
16. The installation of each se"er service connection
between the property line and the building or buildings in the area
shall be installed according to the County's plans and specifica-
tions, and approval thereof shall first be obtained.
17. That the Owner shall pay to the County all charges made
for sewage services rendered and upon the failure or refusal or
eglect so to do, the sel{er service shall be cut off by the County
giving the O,mer the same \\'I'itten notice to that effect as is
iven consumers of water in the County before I{ater service is cut
ff for non-payment of water bills, and sewer service shall not be
estored until such charges are paid.
