That the Board of Supervisors of Chesterfield County will on May 13,
1958, at 2:00 p.m., at its meeting room at Chesterfield Court~ouse,
Virginia, take under consideration the rezoning and/or granting of a
Use Permit on the following described parcels of lane:
1. In Bermudq Magisterial District, a parcel of land fronting
210 feet on the business area of Route #1 and extending
eqstwardly 2025 feet, said parcel being 1100 feet north of
Route #10, which property is proposed to be rezoned from
Agriculture to General Business on application of Mr.P.A.
Pederson.
2. In Manchester Magisterial District, a parcel of land
fronting 335 feet on the German School Road, and
extending eastwardly 213 feet, said parcel being 140 feet
north of Rt.60, which property is proposed to be rezoned
from Agriculture to General Business on application of
the B&B Oil Company.

CHESTERFIELD COUNTY, VIRGINIA, WISH TO OBJECT TO THE GRANTING Of AN APPLICA-
TION BY C. E. WYATT FOR THE PURPOSE OF REZONING 16.9 ACRES OF LANO LOCATED

IN THE MANCHESTER DISTRICT, SOUTH OF GRANITE ACRES. THE APPLICANT, C. E,
WYATT, IS ENDEAVORING TO HAVE THE AFORESAID PROPERTY REZONED FROM AGRICULTURAL
TO R-II WITH A USE PERMIT FOR THE CONSTRUCTION OF APARTMENT-TYPE DWELLINGS.
WE OBJECT TO THIS REZONING FOR THE FOLLOWING REASONS:
I. THE AREA OF GRANITE ACRES AND THE AREA SOUTH OF GRANITE ACRES,
INCLUDING THE 16.9 ACRES OF LAND WHICH IS SOUGHT TO BE REZONED, HAS iNADEQUATE
DRAINAGE AND POOR SOIL ABSORPTION. THERE ALREADY EXISTS IN THE AREA A SANITA-
TION PROBLEM DUE TO THE INADEQUATE DRAINAGE AND POOR SOIL ABSORPTION AND THIS
PROBLEM HAS RESULTED IN SEWAGE DISPOSAL DIFFICULTIES.
2. ACCESS TO THE 16.9 ACRES WHICH IS SOUGHT TO BE REZONED WOULD BE
THROUGH GRANITE ACRES FROM GLYNDON LANE. GLYNDON LANE AND THE SURROUNDING
ROADS ARE AT PRESENT UNPAVED AND ADDITIONAL TRAFFIC WOULD RESULT IN THE FURTHER
DETERIORATION OF THE ROADS AND WOULD INCREASE THE ALREADY VEXING PROBLEM OF
DUST. THIS IS A RESIDENTIAL AREA OCCUPIED BY FAMILIES WITH YOUNG CHILDREN AND
THE INCREASED TRAFFIC ON THE ROADS IN THIS AREA WOULD CREATE A GREATER HAZARD
TO THE SAFETY OF THESE CHILDREN.
3. A REZONING OF THIS PROPERTY WITH USE REQUESTED BY MR. C. E. WYATT
COULD RESULT IN THERE BEING CONSTRUCTED ON THE PROPERTY LOW-COST APARTMENT
UNITS WHICH WOULD TEND TO DIMINISH THE VALUE Of THE PROPERTY IN THE SURROUNDING
AREA.
4. THE WATER WHICH IS USED BY THE PERSONS RESIDING IN THIS AREA IS AT
PRESENT INADEQUATE RESULTING IN RESTRICTED USE OF THE WATER DURING THE SUMMER
MONTHS AND THE REZONING OF THIS PROPERTY WOULD ADD GREATER DIFFICULTIES TO THIS
SITUATION.

COUNTY, ESPECIALLY THOSE SCHOOLS LOCATEO IN THE NORTHERN AREA Of THIS COUNTY,
ARE AT PRESENT OVERCROWOED AND INADEQUATE TO PROPERLY SERVE THE CHILDREN RE-
SIDING IN THE HOMES THAT PROVIDE A GREAT PORTION Of THE TAX REVENUE THAT SUP-
PORTS OUR COUNTY. WE fURTHER BELIEVE THAT THE ADDITIONAL COST Of EDUCATING
THE CHILDREN THAT WOULD RESIDE IN THIS APARTMENT DWELLING, WHICH fOR THE MOST
PART WOULD UNDOUBTEDLY BE HOUSING TRANSIENTS WITHIN OUR COUNTY, WOULD AT LEAST
BE EQUAL TO AND IN ALL PROBABILITY EXCEED THE TAX REVENUE RECEIVED fROM SUCH
A PROJECT. WE fEEL THAT fiNDING ADEQUATE SPACE IN OUR SCHOOLS TO ACCOMMODATE
THESE CHILDREN WOULD ADD TO THE MANY VEXING PROBLEMS CONfRONTING OUR SCHOOL
SYSTEM, SUCH AS SHORTAGE Of CLASS ROOM SPACE, INADEQUATE fACILITIES AND SHORT-
AGE Of TEACHERS.

WITNESSETH: In consideration of the benefits accruing or to accrue to
the said grantors, by reason of the widening construction or other improvements
of Lewis Drive from its intersection with Club Drive to its intersection with
Hill Drive, a distance of 0.07 mile in Manchester District, Chesterfield County,
Virginia, along through or over the lands of the grantors, and other good and
valuable consideration, the said grantors hereby grant and convey unto the said
grantee with GENERAL WARRANTY of Title, each as to the land owned by him hereby
conveyed, a strip or parcel of land over the lands of the grantors needed for the
location, widening, construction or other improvement of said road in Manchester
District of Chesterfield County, Virginia, and briefly described as follows:

land to the grantee; that they have dons no act to encumber the said land; that

THIS AGREEMI!:NT, made and entered into by and. between
SOUTHERN RAILWAY COMPANY, a Virginia corporation, hereinafter styled
Railroad, party of the first part; and
CHESTERFIELD COUNTY, Virginia, a bOdy politic and corporate, of the
State of Virginia, acting herein by and through the Board of Supervisors of
Chesterfield County, hereinafter styled County, party of the second part;

That RAILROAD in consideration of the covenants of County herein contain-
ed hereby grants unto County, in so far as Railroad's present title enables it so
to do, the right or license to construct and maintain an eight (8) inch cast iron
water pipe line, encased in an eighteen (18) inch corrugated meiBlpi:peupon and acroe
the right or way or property and tinder the main track of Railroad at a point 3036
feet east of Milepost F-134, at or near BON AIR, Chesterfield CoUnty, Virginia,
substantially as shown in red on print of Drawing No. A-12790, dated Ootober 11,
1957, revised October 23, 1957, hereunto annexed and hereby made a part of this
agreement.
And COUNTY hereby covenants and agrees in consideration of said license:
1. That in the installation and construction of said pipes upon and
across the right; of way and under the track of Railroad, as aforesaid, County shal
conform in all respects to plans and specifications shown and noted upon said an-
nexed print and such other specifications, as may be prescribed by Railroad; it
being understood that the work of constructing and maintaining said pipes shall be
done at the sole cost and expense of County, and at all times during its progress
be subject to the inspection and supervision, and uppn its completion to the ap-
proval, of the proper officer of Railroad.
2. That County will maintain said pipes, at all times during the
existence of the same upon the right of way and under the track of Railroad, in
such condition that said pipes, or the use thereof by County, shall not be or be-
come an obstruction to, or interfere with, the safe and proper maintenance of the
roadbed of Railroad or the tracks or structures upon the same, or endanger life or
limb of employees of Railroad or other persons on the right of way of Railroad.
3. That in the event that Railroad shall, at any time hereafter during
the life of this agreement, make any change in its roadbed, or the structures
thereon, or construct any additional tracks or structures upon its said right of
way, and shall find it necessary or advisable to disturb said pipes or change the
location, grade or construction 'thereof in so doing, then and in such event County
will, at its own cost and expense, upon notice, in writing, so to do, served upon
it by Railroad, change the location, grade or construction of said pipes in ac-
cordance with the requirements of Railroad and thereafter maintain the same here-
under in all other respects as herein provided.
4. That the privilege hereby granted is tb be used and enjoyed at the
sole risk of County, and, in consideration of the benefit to be derived therefrom
by County, it covenants hereby that it will indemnify.and save harmless Railroad
from and against any and all risks, loss, injury, damage or expense accruing from
or by reason of the construction or maintenance of said pipes upon and across the
right of way and under said .track of Railroad, or the use of the same by County
hereunder, whether such los~, injury, damage or expense is due in whole or in part,
proximately or remotely, ,to the presence of said pipes on the right of way of Rail
road.
5. That in the event County shall make default in the performance of
anyone or more of its covenants in this agreement contained, or in the event that
said pipas shall by reason of improper maintenance or otherwise become a source of

danger to, or be likely to interfere with, the operations of Railroad on its said,
line of railroad, then and 'in either of such events the license hereby granted
may, at the option of Railroad, be deemed to be forfeited, and'County shall, at
its own cost and expense, upon being notified by Railroad, inwriting,- so to do,
forthwi th remove its said pipes from the right of way of Railroad and restore said
right of way to condition existing prior to the construction of said pipes there-
upon; or, in default thereof, Railroad may bring an action to re~uire the removal
of said pipes by County or may itself remove the same and restore the condition of
said right of way, at the expense of County.
AND IT IS MUTUALLY COVENANTED AND AGREED:
6. That this agreement shall inure to the benefit of and be binding
upon the respective successors and assigns of the parties hereto, as well as upon
the parties themselves.
IN WITNESS WHEREOF, the parties hereto have executed this agreement in
duplicate, each part being an original, and the same shall become effective as of
the 13th day of May , 1958, the Chairman and Clerk, respectively, of
the Board of Supervisors of Chesterfield County, Yirginia, executing the same by
authority of resolution hereto attached. .

That the Board of Supervisors of Chesterfield County will on May 13,
1958, at 2:00 p.m., at its meeting room at Chesterfield Court~ouse,
Virginia, take under consideration the rezoning and/or granting of a
Use Permit on the following described parcels of lane:
1. In Bermudq Magisterial District, a parcel of land fronting
210 feet on the business area of Route #1 and extending
eqstwardly 2025 feet, said parcel being 1100 feet north of
Route #10, which property is proposed to be rezoned from
Agriculture to General Business on application of Mr.P.A.
Pederson.
2. In /llanchesterMagisterial District, a parcel of land
fronting 335 feet on the German School Road, and
extending eastwardly 213 feet, said parcel being 140 feet
north of Rt.60, wpich property is proposed to be rezoned
from Agriculture to General Business on application of
the B&B Oil Company.
3. In Manchester Magisterial District, a parcel of land
fronting 105 feet on Walmsley Boulevard, and extending
southwardly 248 feet along the eastern line of the Smith-
Cottrell Road, which property is proposed to be rezoned
from Residential-2 to Gemral Business on application of
Hr.;!;.C.Perkins. '
4. In Manchester Magisterial District, a parcel of land fronting
101 feet on the Belt Boulevard, and extending eastwardly
397 feet, said parcel being 1500 feet southeast of the
intersection of Rt. 10, which property is proposed to be
rezoned from Agriculture to General Business on application
of Mr. C.R.O'Brien.
5. In Dale Magisterial District, a parcel of land fronting

300 feet, said parcel being 400 feet east of Berkley Road,
which property is proposed to be rezoned from Residential-2
to General Business on application of Mr. R.W.Stanley, Mr.
R.L. Saunders and Mr. F.R. Sterling.
