~ 2008 PROCEDURES OF THE BOARD OF SUPERVISORS
BE IT RESOLVED by the Board of Supervisors of the County of Chesterfield in
accordance with Section 3.4 of the County Charter that the following rules of procedures shall
govern the conduct of meetings and work sessions of the Board of Supervisors during the 2007
calendar year.
Presiding Officer
Section 1. The Board's parliamentary procedures shall conform with law and the
historical practices of the Board of Supervisors. The County Attorney shall act as
parliamentarian to the Board. To the extent necessary to address any ambiguities in procedure,
the County Attorney may consider the most recent edition of Robert's Rules of Order., a Manual
of General Parliamentary Law for guidance. Any questions involving the application of rules of
procedure or the interpretation of Robert's Rules shall be decided by the County Attorney.
Section 2. The chairman, or the vice chairman, or in their absence the most senior
member of the Board alphabetically, shall preside at all meetings of the Board, and on the
appearance of a quorum shall call the meeting to order, and the Board shall then proceed with its
business.
Section 3. The presiding officer shall preserve order and decorum. He may speak, make
motions, and vote on all questions, and he shall decide questions of order and procedure. The
Chairman may set reasonable time limits for speakers and public hearings; provided that by
majority vote the Board may reject such time limits.
Quorum
Section 4. A quorum shall consist of at least three members of the Board. A majority of
a quorum shall be sufficient to carry any question except tax issues, incurring of debt and
appropriations in excess of $500, all of which shall require a majority of the full Board for
adoption. No Board member is required to vote on any question, but an abstention, although not
a vote in favor of carrying a question, shall be counted as a vote for the purpose of determining a
quorum. A tie vote shall defeat the motion, resolution or issue voted on, provided that all zoning
cases must be disposed of by a motion approved by a majority of those voting. An abstention is
considered a vote for all purposes and defeats a motion requiring a unanimous vote. The Board
shall not designate a tiebreaker pursuant to S 15.2-1421 of the Code of Virginia.

Order of Business
Section 5. The order of business at a regular meeting of the Board shall be as follows
beginning at 3 p.m. or an alternate specified meeting time:
(a) Approval of minutes of the previous meeting. Reading of the minutes shall be
automatically dispensed with.
(b) County administrator's comments.
(c) Board committee reports.
(d) Requests to postpone action, additions, deletions or changes in the order of
presentation with respect to any matter on the agenda.
(e) Special resolutions of recognition.
(f) Work sessions.
(g) Deferred agenda items not requiring a public hearing.
(h) New county business not requiring a public hearing, including deferred and new
appointments and claims against the Board or County.
(i) Reports.
G) Fifteen-minute citizen comment period on unscheduled matters involving the
services, policies and affairs of the County government.
(k) Dinner at 5 p.m.
(1) Non-sectarian invocations in accordance with the Clerk's scheduling policy
followed by the pledge of allegiance at 6:30 p.m.
(m) Special resolutions of recognition not heard at the afternoon session.
(n) Deferred public hearings.
(0) Zoning and mobile home public hearings placed on the consent agenda by the
Planning Department.
(P) Remaining public hearings or zonIng public hearings based on appropriate
meeting date.
(q) Fifteen-minute citizen comment period on unscheduled matters involving the
services, policies and affairs of the County government.
(r) Adjournment.

The Board shall confine their decisions to the matters presented on the agenda.
Section 6. Each citizen comment period shall be limited to 15 minutes and 5 speakers
and each speaker may not exceed 3 minutes. Citizen speakers shall abide by a lighting system
providing warning lights. Citizens may only speak once per meeting during the citizen comment
periods. No citizen shall speak on any matter of business that is a subject on the Board's agenda
for that day. Citizens may not yield time to other speakers. Any person desiring to speak may
notify the clerk to the Board no earlier than 7 days in advance of the meeting or shall sign up
prior to the afternoon or evening session if space is available. At the beginning of the citizen
comment period the clerk will read the names and comments will be given in the order of the
sign-up sheet. Each citizen comment period will end after 15 minutes, regardless of the number
of people who have signed up to speak.
Persons speaking before the Board will not be allowed to:
(a) Campaign for public office;
(b) Promote private business ventures;
(c) Use profanity or vulgar language;
(d) Address pending litigation or matters to be addressed at that meeting; or
( e) Make insults which tend to violence or breach of the peace.
Section 7. .L\.n)T person speal(ing to a matter during the meeting shall be limited to such
period of time as shall be allotted b)T the presiding officer "<<.yhen necessary to presenTe order and
the efficienc)T of the meeting. Any Board member may remove an item from the consent agenda
for comment by the Board. Any person may publicly speak to an item on that meeting's
"Consent Agenda" for up to three minutes, so long as the Board votes to remove a consent item
from the Consent Agenda for public comment. The Board may accept written comments in lieu
of oral statements.
Section 8. The order of business at a special meeting shall follow that of a regular
meeting to the greatest extent possible.
Minutes of Meeting
Section 9. The clerk of the Board shall prepare and maintain adequate minutes of the
proceedings of the Board in accordance with the requirements of the Code of Virginia, 1950, as
amended. Each recorded vote shall indicate how each member of the Board voted. Preparation
of minutes will not include every aspect of the Board's meetings relating specifically to
discussion and debate, but will include all significant events relating to official action. Minutes
shall be included as part of the agenda package for the subsequent meeting of the Board.
Section 10. The Board may correct its minutes after approval of the minutes only upon a
clear showing that a clerical or administrative mistake was made.

Agenda
Section 11. The county administrator shall prepare an agenda for each regular or special
meeting of the Board on which shall appear the title of each matter on which action is to be taken
at that meeting. The agenda for each regular meeting shall (a) be prepared at least five days prior
to the meeting, (b) be promptly mailed or delivered to each member of the Board or placed in the
repository assigned to such Board member, and (c) be distributed to appropriate officers and
employees of the county government and members of the public and media requesting copies.
Section 12. Upon a majority vote of the Board of Supervisors, any item may be added
when the agenda is voted on, and the chairman may allow any agenda item to be called out of
sequence.
Section 13. Any matter not on the scheduled agenda, may be heard after the agenda has
been approved by the Board only upon the unanimous vote of the Board members present. Any
such matter must be of an emergency nature, vital to the continued proper and lawful operation
of the county.
Section 14. No matter on the scheduled agenda shall be considered after 11 p.m. without
the unanimous consent of the Board. Any matter not heard shall be automatically continued to
the next appropriate scheduled meeting of the Board.
Motions
Section 15. When a motion is under debate, no additional motions may be made except a
motion to withdraw, defer, substitute, or to amend. If the maker of a motion and the member
seconding the motion agree, a motion may be amended or withdrawn. Such motions shall take
precedence in the order listed above. Only one substitute motion shall be in order for a principal
motion. All motions to defer shall be to a date certain. Prior to voting on a motion to defer, the
Board shall hear public comments on the issue of deferral if the scheduled item requires a public
hearing.
Reconsideration of Ordinances, Resolutions and Motions
Section 16. Any vote by a member of the Board is final once cast. Planning Commission
decisions are final once made. No ordinance, resolution or motion previously voted upon by the
Board shall be brought forward for reconsideration during the same meeting of the Board.
Debate
Section 17. Each member of the Board may participate in discussion of any issue only
after being recognized by the chairman. The chairman shall not recognize a motion to "call the
question" until every member desiring to speak has had a chance to speak. At the conclusion of
debate, the question shall be called and no further debate shall be in order.

Requests relating to critieisms or concerns regarding the administration of the county,
except "y"'lhen related to agenda items, shall not be presented or raised at a meeting of the Board
unless first submitted in \vriting to the county administrator" and unless his response fails to
resolve the issue.
Regular Meetings
Section 18. Each year at its organizational meeting the Board shall set the regular
meeting times and dates for the following year provided, however, that the Board shall meet at
least once each month. Whenever the regularly schedule<;f meeting date shall fall on a legal
holiday, the regular meeting of the Board shall be held on the following day in accordance with
S 15.2-1416 of the Code of Virginia, 1950, as amended. The chairman may cancel any meeting
because of inclement weather and should reschedule any canceled meeting at the earliest
possible date by sending written notice to each member of the Board.
Special Meetings
Section 19. Special meetings of the Board may be called by two members of the Board
or the chairman in accordance with SS 15.2-1417 and 15.2-1418 of the Code of Virginia, 1950,
as amended. Upon making such request, the clerk shall specify the matters to be considered and
shall notify in writing all members of the Board and the county attorney immediately. The
meeting may be held only if waivers are signed by every member of the Board and the county
attorney, or if every member and the county attorney attend the special meeting.
Appointments
Section 20. Appointments to committees of the Board and to authorities, boards and
commissions shall be made only by resolution adopted by a majority of the full Board at a
meeting subsequent to the meeting when the name has been offered to the Board for
consideration. Prior to consideration of the nomination, the nominee shall be notified to
determine his willingness to serve and to determine if he meets the minimum qualifications for
such appointment.
Committees
Section 21. The Chairman or the Board may create committees and shall appoint
members to such committees in the same fashion in which the committee was created.
Committees may hold hearings. and perform such other duties as may be prescribed. A
committee may be instructed concerning the form of any report it shall be requested to make, and
a time may be fixed for submission of any report.
Zoning
Section 22. With the exception of zoning cases that have been scheduled for a public
hearing before both the Chesterfield Planning Commission and the Board of Supervisors in the
same month, no zoning case shall be considered by the Board of Supervisors if amendments,

changes, withdrawals or proffers have been submitted by the applicant after the case has
appeared in the newspaper pursuant to the required publication. All such cases shall be deferred
to the next appropriate Board meeting for consideration after proper readvertising.
Section 23. If a majority of the Board is not reelected, no zoning case shall be considered
by the Board of Supervisors after November 6, 2007 'I 2011 until the organizational meeting in
January ~2012 unless such delay would exceed 12 months for that case.
Amendment of Rules
Section 24. The rules of procedure of the governing body may be amended at any time
during the year by a unanimous vote of the full Board. .
Section 25. The Board of Supervisors may suspend the application of any section of
these rules by a unanimous affirmative vote of all Board members present at any time during the
agenda.
Section 26. A Deputy Sheriff shall serve as sergeant at arms.

WHEREAS, Mr. Jim Albertson is a teacher and coach at Clover Hill
High School; and
WHEREAS, Mr. Albertson has been a teacher for 41 years, including
positions in Pennsylvania and New Jersey prior to coming to
Chesterfield County in 1983; and
WHEREAS, he has taught subj ects as diverse as World History,
Economics, Cultural Anthropology, American Government, Sociology,
Practical Law, Service Learning, Introduction to the Civil War and
United States History; and
WHEREAS, in addition to his classroom teaching, Mr. Albertson has
coached wrestling, track, junior varsity football, boys' tennis, golf,
girls' tennis, boys' soccer and boys' cross country; and
WHEREAS, as a coach, Mr. Albertson has distinguished himself and
gained a reputation for coaching excellence; and
WHEREAS, among the athletic acti vi ty distinctions he has earned
are three district wrestling championships; four district golf
championships and six district tennis championships; and
WHEREAS, he also was named Dominion District Coach of the Year 12
times and Central Region Coach of the Year three times; and
WHEREAS, Coach Albertson will be inducted into the Clover Hill
Athletic Hall of Fame on February 9, 2008; and
WHEREAS, Mr. Albertson's record of accomplishments as a teacher,
coach and mentor is truly noteworthy and indicative of an exceptional
,professional life of service and leadership; and
WHEREAS, Mr. Albertson will retire from Chesterfield County
Public Schools in June of 2008.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 9th day of January 2008, on behalf of all
Chesterfield County residents, offers sincere gratitude to Mr. Jim
Albertson for his service to young people, congratulates him on his
upcoming induction into the Clover Hill Athletic Hall of Fame, and

Award of a Contract for Management Consulting Services to Conduct a
Management Study for Chesterfield County
Refer to Budget and Audit for further consideration.
Summary of Information:
In August 2007, the Board of Supervisors approved for staff to proceed with
advertising a Request for Proposal (RFP) for an independent evaluation of
county management practices and procedures, contracting procedures and
processes, and to identify opportunities and make recommendations to make the
county more efficient in spending taxpayers' money. Staff was asked to
prepare a timeline for completing such an analysis concurrent with the change
in leadership, and in time to be available as soon as feasible for the
Board's review in spring 2008.
As a result of the Competitive Negotiation processr staff herein recommends
award of the contract to TATC Consulting for a fee of $135,000, if the Board
chooses to award the contract.
This item was deferred at the November 14, 2007 meeting to the January 9,
2008 meeting for the new Board to consider how to best proceed.

information, present conclusions and make recommendations for improvement as
needed for the following areas:
. Meet with each department director and review the County wide administrative
procedures they are primarily responsible for as well as others to determine areas
of improvement. This review should also identify areas where gaps and
opportunities exist in County Administrative procedures according to best
practices.
. Meet with each leadership team member to review County wide administrative
procedures, or other organizational improvements they state are needed. This
may include organizational changes they feel would improve and streamline the
organization.
. Review most recent State of Virginia AP A data to benchmark the county's cost of
services against other localities with populations in excess of 100,000. This
should be done on a summary basis as well as by major functional area on a per
capita basis. Data should also be presented on a per student basis for educational
expenses. Identify service areas that are higher cost than average that provide
opportunity for cost savings.
Contractin2 practices and procedures - Compile and review all necessary
information, present conclusions and make recommendations for improvement as
needed for the following areas:
. Review all County and School Board contracting and procurement policies and
procedures and determine if they are in compliance with the Code of Virginia
Public Procurement Act. Identify where policies and procedures have any
deficiencies or are in need of improvement. Determine if current procurement
policies, procedures and practices are designed to achieve the best value in
spending taxpayer money while maintaining compliance, efficiency and
effectiveness in the procurement process.
. Review and test a sampling of FY2007 or 2008 procurements, including School
Board procurements. The sample should be across a wide variety of types of
procurements (Construction Projects, Goods, and Services) as well as a varied
sample by dollar values. The sample tested should be large enough for the team
to draw conclusion if practices are following policies and procedures and if they
are in compliance with the Code of Virginia Public Procurement Act.

. Compare county contributions to community contracts and non-profits and
determine if the percentage of county's overall budget contributed is comparable
to its county and city peers in Virginia with populations over 100,000.
. Review data for all community contracts and non-profits for most recent year with
Budget Director. Make overall determination if the county is receiving good
value for funding provided. Determine if there are any specific community
contracts where it does not appear County is receiving good value in terms of
services to the community for the funding invested. Review the overall process
that is in place to ensure accountability.

Streetlight requests from individual citizens or civic groups are received in
the Department of Environmental Engineering. Staff requests cost quotations
from Dominion Virginia Power for each request received. When the quotations
are receivedr staff re-examines each request and presents them at the next
available regular meeting of the Board of Supervisors for consideration.
Staff provides the Board with an evaluation of each request based on the
following criteria:

2. There should be a minimum average of 600 vehicles per day (VPD)
passing the requested location if it is an intersection, or 400 VPD
if the requested location is not an intersectioni
3. Petitions are required and should include 75% of residents within
200 feet of the requested location and if at an intersection, a
majority of those residents immediately adjacent to the
intersection.
Cost quotations from Dominion Virginia Power are valid for a period of 60
days. The Board, upon presentation of the cost quotation may approve, defer,
or deny the expenditure of funds from available District Improvement Funds
for the streetlight installation. If the expenditure is approved, staff
authorizes Dominion Virginia Power to install the streetlight. A denial of a
project will result in its cancellation and the District Improvement Fund
will be charged the design cost showni staff will notify the requestor of the
denial. Projects cannot be deferred for more than 30 days due to quotation
expiration. Quotation expiration has the same effect as a denial.

The Northern Courthouse Road Community Plan amendment, once adopted, will

Instruct the Planning Commission to reconsider land use and water quality
issues relating to the recently adopted Upper Swift Creek Plan amendment.
Summary of Information:
On October 101 20071 the Board of Supervisors approved the Upper Swift Creek
Plan amendment I an amendment to the Plan for Chesterfield.
The Planning Commission had previously recommended amendments to the draft
Upper Swift Creek Plan amendment relative to levels of service for
transportation and schools I and then recommended denial of the Upper Swift
Creek Plan amendment. The Board of Supervisors approved the Upper Swift
Creek Plan amendment without the Planning Commission recommended levels of
service.
The Planning Commission has scheduled a public hearing on January 151 20081
to consider recommending levels of service for transportation and schools for
the Upper Swift Creek Plan amendment. Several Board of Supervisors members
have requested that the Planning Commission also be instructed to reconsider
land use and water quality issues relating to the recently adopted Upper
Swift Creek Plan amendment.

Request that the Board of Supervisors approve the creation of the Multi-
Cultural Advisory Commission.
Summary of Information:
At the board's public hearing on immigration issues, the idea of creating a
Multi-Cultural Advisory Commission to advise the Board of Supervisors on
issues related to the diverse communities that comprise Chesterfield County
was expressed.
The Board of Supervisors is requested to create a Multi-Cultural Advisory
Commission to advise the board on issues related to the various cultures
represented in the Chesterfield community. Staff recommends a five member,
"at-large" Commission who will raise awareness of the various cultures in our
community including the challenges and opportunities presented by increasing
diversity. Staff will solicit names for board consideration for appointment
to the commission and will bring those recommended names forward through the
regular board appointment process. Deputy County Administrator Pete Stith
will serve as advisor to the Commission.

commitment and have reached the long-sought goal of Eagle Scout
which is received by only four percent of those individuals
entering the Scouting movement; and
WHEREAS, growing through their experiences in Scouting,
learning the lessons of responsible citizenship, and endeavoring
to prepare themselves for roles as leaders in society, Phillip,
David, Steven, Robert and Byron have distinguished themselves as
members of a new generation of prepared young ci tizens of whom
we can all be very proud.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County
Board of Supervisors, this 9th day of January 2008, hereby
extends its congratulations to Mr. Philip Charles Gaspar, II,

Summary of Information:
On November 28, 2007, the prior Board held a public hearing to consider a
proposed impact fee program, including a draft impact fee ordinance. Staff
proposed that the ordinance 1) create impact fees for residential development
only, 2) establish a $5,820 impact fee per residential lot payable at the
time of the issuance of a building permit, 3) apply the impact fee solely to
property already zoned residential but not yet subdivided, and 4) exempt cash
proffer and CDA lots from the impact fee program.
During that public hearing, the Board discussed a number of issues, some of
which had also been raised during the previous Planning Commission public
hearing. These issues included:
1) Whether to exempt "family subdivisionl1 lots from impact fees.

2) Whether to exempt low cost uworkforce" housing constructed by non-
profit organizations;
3) Whether to impose impact fees on the older cash proffer lots that
have a transportation component below the $5,820 impact fee; and
4) Confirming that if existing small subdivision lots are combined into a
larger, more marketable lot, only the larger lot will be subject to
the fee, not the individual original lots.
To address these issues, staff proposes the following modifications to the
proposed impact fee ordinance:
1) Exempt family subdivisions from impact fees.
2) Exempt from impact fees homes built by non-profit organizations with
an assessed value at completion (lot and home) of less than $200,000.
This is the figure that has been used by the Planning Commission's
Workforce Housing Committee to define uworkforce housing".
Staff is satisfied that the current draft ordinance ensures that the
combination of multiple lots into a single lot will only result in a single
impact fee for the new lot. Accordingly, no additional ordinance change is
required for this issue.
The prior Board did not close the public hearing on the impact fee program
and continued the public hearing to this meeting. The original ordinance
discussed with the prior Board is attached as Ordinance A. An amended
ordinance reflecting the changes discussed above is attached as Ordinance B.
Staff recommends that the Board amend the Comprehensive Plan to add the"
attached uRoad Improvement Plan" and then to adopt Ordinance B.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY ADDING
A NEW ARTICLE XVII TO CHAPTER 9 OF THE CODE
RELATING TO TRANSPORTATION IMPACT FEES TO FUND AND RECAPTURE
THE COST OF PROVIDING REASONABLE ROAD IMPROVEMENTS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That the Code of the Countv of Chesterfield, 1997, as amended, is amended by adding the
following:

ARTICLE XVII. TRANSPORTATION IMPACT FEES
Section 9-250. Establishing a system of impact fees.
Pursuant to Code of Virginia S 15.2-2322, the county hereby establishes a system of
impact fees to fund reasonable road improvements benefiting new residential development. In
accordance with Code of Virginia 915.2-2320, one or more impact fee service areas shall be
designated by amendment to the county's comprehensive land use plan. Such plan amendment
may designate the entire county as one impact fee service area.
Section 9-251. When impact fees determined and collected.
(a) Pursuant to Code of Virginia ~ 15.2-2323, the amount of impact fees to be imposed on a
specific development shall be determined no later than final subdivision or site plan approval.
(b) Pursuant to Code of Virginia S 15.2-2323, the impact fee shall be collected for each
residential lot or housing unit at the time a building permit is issued for such lot or housing
unit.
(c) No building permit shall be issued for a lot or housing unit on which an impact fee has been
imposed unless the owner of the lot or housing unit, or his agent, has (i) paid the applicable
impact fee or (ii) has executed an agreement provided by the county and secured by a bond
or a letter of credit approved by the county, to pay the impact fee, in equal installments, over
a period of no more than 3 years. Ifpayments are made in installments pursuant to subsection
(c) (ii), interest on the unpaid portion shall accrue interest at the rate specified in S 9-6 of this
Code.
(d) The calculation of an impact fee may be appealed by the owner or his agent to the
Chesterfield County Board of Zoning Appeals. A notice of appeal shall be filed with the
director of planning within 60 days of the calculation of the impact fee amount by the county.
The owner or agent shall submit the substantive basis for his appeal to the director of

planning within 60 days of filing a notice of appeal. The decision of the Board of Zoning
Appeals may be appealed in accordance with state law.
Section 9-252. Determination of the amount of the impact fee.
a) The impact fee for a development shall be determined by dividing (i) the projected road
improvement costs within the impact fee service area in which the development is located
by (ii) the number of projected housing units within the impact fee service area when
such area is fully developed. This calculation shall be based on the number of trips
generated by each such housing unit. The projected road improvement costs for each
impact fee service area shall be calculated in accordance with the county's road
improvement plan as specified in Code of Virginia S 15.2-2321.
b) The value of any dedication, contribution or construction from the developer for off-site
road or other transportation improvements benefiting the impact fee service area shall be
treated as a credit against the impact fees imposed on the developer's project whether by
condition of zoning of other written commitment to the county. The county shall also
calculate and credit against the impact fees the extent to which (i) other developments
have already contributed to the cost of existing roads which will benefit the development,
(ii) new development will contribute to the cost of existing roads, and (iii) new
development will contribute to the cost of road improvements in the future other than
through impacts fees, including any special taxing districts, special assessments, or
community development authorities.

Chesterfield County Impact Fee Program Road Improvement Plan
Pursuant to Article 8, Chapter 22 of Title 15.2 of the Code of Virginia, (Va. Code
SS 15.2-2317 - 2327), the Chesterfield County Board of Supervisors has adopted an
impact fee program to pay, in part, the cost of transportation improvements necessitated
by certain residential development. As part of the impact fee program, the
Comprehensive Plan of the County must be amended to add a "Road Improvement Plan".
The Road Improvement Plan consists of a listing of transportation improvements
necessitated by 20 years of development, based on the County's current growth
projections. The listing is created by utilizing the County's Thoroughfare Plan and a
computer-based transportation model (TP+). The listing of projected transportation
improvements and a map showing such projected improvements are included below and
constitute the Impact Fee Road Improvement Program.
The schedule for the construction of road improvements using impact fees is the
same schedule currently used for the construction of road improvements using cash
proffer funds. The Transportation Department will review, on a quarterly basis, the
impact fees that are collected by the County. When sufficient funds have been collected
and/or future collections are anticipated in a timely manner to fund improvements, the
Transportation Department will request the Board of Supervisors to make appropriations
of the fees and give approval to proceed with the improvements. The Transportation
Department currently prefers approximately $500,000 to be collected before it will
proceed with road design and right of way acquisition. The Transportation Department
will usually need $1 million or more in order to construct a viable transportation project.
The Transportation Department will also consider supplementing VDOT funding on a
project with impact fees if the fees will allow the project to be constructed.

COMMENTS TO BOARD OF SUPERVISORS ON PROPOSED CODE
AMENDMENT RELATING TO IMPACT FEE ROAD IMPROVEMENT PLAN,
COMPREHENSIVE PLAN AMENDMENT AND IMPACT FEE ORDINANCE
I emphasized during the public hearing before the Planning Commission that this
proposed amendment was not ready to be advanced to this Board and asked
that the Planning Commission defer any recommendation until the public had a
proper opportunity to get answers to its questions. My inquiries to both the
Planning Department and the County Attorney's office went unanswered
After reviewing these suggested changes along with the bill that embodied the
state statute being implemented (HB 3202), I concluded that the staff work so far
has been inadequate. I speak as one who spent more than half of my 30-year
career in Defense contracting as an analyst involved with drafting policies and
procedures based in the law.
There are issues with the proposed code amendment that arise from failure to
comply with the plain English requirements of the statute, from inconsistencies
between the statute and the proposed code amendment, from questions about
the statistical process used to develop the proposed impact fee, from failure to
properly incorporate intentions stated in an official memo into the proposed code
amendment, and from ambiguities that will certainly cause confusion on the part
of those required to administer the proposed changes. Details are attached to
your copies of my remarks.
Other additions to state law effective July 1 sl of this year that have not been
implemented by Chesterfield appear to be related to these changes. HB 3202
provisions state that local transportation funding "shall be directed to the urban
development area" to the extent possible. However, I do not believe that
Chesterfield has adopted any such area as directed by Virginia Code (Section
15.2-2223.1) or a permitted alternative resolution. It appears as if the county is
ahead of itself. Why would you develop a procedure to specify a new fee for
road funding before you identify the area that, by state law, must receive all
possible funding? Until you have designated "urban development areas," it
appears you are not in a position to "exclude urban development areas... from
impact fee service areas" as allowed by Virginia Code (Section 15.2-2330). If

you follow the rules in the law, it appears you are working in the middle of the
road when you are required to start at the beginning.
I do not see that the new requirement that the county prepare and submit
environmental impact reports on all road projects costing $100,000 or more has
been addressed. There is much more work to be done before proceeding with
changes to the ordinance. Certainly, you should defer approving these
ordinance changes for at least the next 60 days to determine which of the
proposed statutory changes affecting impact fees will be enacted by the General
Assembly.

SOME OF THE ISSUES RELATED TO PROPOSED CODE AMENDMENTS
Some of the information required by statute is missing from the advertisement of
the code amendment. For example, the schedule of the improvements and new
roads was not provided in the road improvement plan. Neither did the public
hearing notice include all the required assumptions upon which the assessment
is based. See Va. Code Section 15.2-2321, Enactment clause 1. Neither did I
see the projections for road improvement needs for the county when fully
developed as required by 15.2-2321, Enactment clause 2. Where are the
assumptions that are to be presented?
The published draft ordinance is inconsistent with the stated assumption in the
October 1,2007, Memo from the Deputy County Attorney that "property for which
cash proffers ... will be paid for transportation improvements will be exemoted
from the payment of impact fees. (Emphasis added.)
Note: No information was provided in the advertised notice that there
were two versions of the ordinance and the notice did not specify that there were
to be two options and did not specify which option was being recommended to
the Commission. Also, "exemption" is not synonymous with being subject to
"credits."
The published draft ordinance does not make it clear that individual lots created
outside the formal subdivision process are not subject to the impact fee.
Section 9-251 (a): The authority is incorrectly cited. It is 15.2-2319 as stated in
the advertised notice and as shown in the Code of Virginia.
Section 9-251 (d): The applicant should be allowed to appeal both the amount
and the application of the impact fee to any specific lot. (There would not appear
to be a "housing unit" until a building is there.) Since the amount of the impact

fee has already been "calculated" and is put in the ordinance, it appears improper
to say that th~ appeal has to be filed within 60 days of "calculation." It would
make more sense to have the appeal within 60 days of formal notification to the
specific applicant of the amount of the fee to be collected.
More on the appeal: It is questionable whether the BZA is the appropriate
body to hear this type of appeal. Some other process should be considered for
something this detailed and technical.
Proposed ordinance at Section 9-252 states that the impact fee shall be
determined by dividing the projected costs by "the number of projected housinq
units within the impact fee service area when such area is fullv developed. "
(Emphasis added.) However, the documentation from the Transportation
Department shows the number of units to be those at end of twenty years-not
when the county is fully developed or at "buildout."
Section 9-254: Imposing revised fees on all who have not "paid" their fees as of
the date a revised (updated) fee is imposed is questionable. This area needs
more thought and more specific instructions to be fair. (This is a very different
process from that used with proffers.)
What constitutes "substantial" changes?
Section 9-255 is inconsistent with the designation of the entire county as the
"impact fee service area." Taking this approach to writing the ordinance and then
designating only one area in the comprehensive plan makes the guidance
unnecessarily confusing.
One important key to this entire process is the accuracy and validity of the
statistics incorporated into the Transportation Model used. Where are the figures
that show the track record of past forecasts as compared to actual figures (past
projections of proffer collections compared to actual proffer collections over that
period of time, etc.)?
How do you justify taking money from people who build on land in the
EttricklMatoaca area and applying it to building roads around Route 60 or other
roads far away from the area being assessed? How have you shown that
building roads in one area 40 miles away "benefits" new development in the
remote area? (See the definition of impact fee in Va. Code Section 15.2-2318
and 15.2-2319) How do you justify that the entire county has "clearly related
traffic needs" when the county is as diverse as it is and currently has several
transportation sheds?
Projections over 20 years are generally thought to be "guesses." What makes
these figures any different? The school system cannot even predict from one
)
year to the next how many students will enter Chesterfield's system. Just look at
the last few years of data.
It appears as if we are saying to the state, "Just ignore all those taxes that
Chesterfield residents send to the State Department of Taxation every year.
Never mind that the state is not fulfilling its legal responsibility to maintain the
roads in Chesterfield. We will just put the burden on a group of our citizens and
Jet you off the hook."
Where is the analysis of the cost of imposing this system on the citizens, the cost
of collecting and administering the impact fees, the costs of the additional
environmental impact studies required and the net proceeds to be applied to
building roads? Where is any analysis of alternative methods of raising the funds
to improve/build needed roads?

Dear Supervisors,
I'm writing in response to the public hearing, item 17 on the January 9, 2008 Agenda relative to Transportation Impact
Fees to Fund and Recapture the Cost of Providing Reasonable Road Improvements.
I would like my comments to be included in the Public Record and considered in YOUR deliberation of this issue.
1. Chesterfield County among other members of the Virginia Association of Counties has lobbied the General Assembly
for years to be able to impose IMP ACT Fees for previously zoned land that did not fall under the grandfathered "Proffer"
system enabled by the General Assembly. Impact fees can fill that void between the majority of undeveloped land and
that land currently accepted for development with proffers attached to it for schools, roads, and other infrastructure.
2. Cumulative Promised/Collected Cash Proffers show a delta which would preclude needed infrastructure for
development.
3. Ft. Lee BRAC expansion will not be drastically impacted by LACK OF AFFORDABLE homes as may be put forward
by Home Builders to stop this ordinance change. Recent study by VHB Consultants of Chesterfield indicate a 7%
increase in traffic for Woodpecker, 10% increase in Southlawn, 6% increase in Dupuy, and 6% increase in E. River
Road. 87% of trips analyzed would be within the Crater MPO area with Y2 Ft Lee Trips as interzonal.
4. Rich Napier, past president, HBA V will cry: "Your HBA V Legislative Committee and the Infrastructure Funding
Subcommittee concluded the marketplace has determined that the current out-of-control system of unbridled fees (the
proffer system) is killing housing affordability and housing sales, and the timeline seem right to deal with the issue." He
continues, "we hide the extorted (proffer) fees in our costs and pass them on. We still need to stand our ground on
housing affordability and attack the unfair system that currently exists." He concludes "don't forget to support the
HBA V Build-PAC Golf Tournament...All proceeds go to the NAHB Build-PAC".
Please use your newly authorized authority to pass ordinance which will apply IMPACT Fees to past zoning cases and
help stem the delta between newly zoned and grandfathered land. Please refer to attached comments from NAHB, and
07 V ACO Conf. Please advise your receipt of my comments and include in the record.

Dear Supervisors,
I'm writing in response to the public hearing, item 17 on the January 9, 2008 Agenda relative to
Transportation Impact Fees to Fund and Recapture the Cost of Providing Reasonable Road Improvements.
I would like my comments to be included in the Public Record and considered in YOUR deliberation of
this issue.
1. Chesterfield County among other members of the Virginia Association of Counties has lobbied the
General Assembly for years to be able to impose IMP ACT Fees for previously zoned land that did not fall
under the grandfathered "Proffer" system enabled by the General Assembly. Impact fees can fill that
void between the majority of undeveloped land and that land currently accepted for development with
proffers attached to it for schools, roads, and other infrastructure.
2. Cumulative Promised/Collected Cash Proffers show a delta which would preclude needed
infrastructure for development.
3. Ft. Lee BRAC expansion will not be drastically impacted by LACK OF AFFORDABLE homes as may
be put forward by Home Builders to stop this ordinance change. Recent study by VHB Consultants of
Chesterfield indicate a 7% increase in traffic for Woodpecker, 10% increase in Southlawn, 6% increase in
Dupuy, and 6% increase in E. River Road. 87% of trips analyzed would be within the Crater MPO area
with Yz Ft Lee Trips as interzonal.
4. Rich Napier, past president, HBA V will cry: "Your HBA V Legislative Committee and the
Infrastructure Funding Subcommittee concluded the marketplace has determined that the current out-of-
control system of unbridled fees (the proffer system) is killing housing affordability and housing sales,
and the timeline seem right to deal with the issue." He continues, "we hide the extorted (proffer) fees in
our costs and pass them on. We still need to stand our ground on housing affordability and attack the
unfair system that currently exists." He concludes "don't forget to support the HBA V Build-PAC Golf
Toumament...All proceeds go to the NAHB Build-PAC".
Please use your newly authorized authority to pass ordinance which will apply IMP ACT Fees to past
zoning cases and help stem the delta between newly zoned and grandfathered land.

Although Stafford County has. collected road impact fees since 2003. legislation amended i112007 has
signiticClntly expanded the number of counties authorized to impose such fees and to use the collected
fees to improve existing roads. 'While the impact fees will help improve the transportation netv\'Ork
\"ithin counties. they also can be a useful tool to direct grmvth. Panelists will discuss the experience
\"ith an existing road impact fee program and steps to bring it into compliance with the new
legislation. The panelists vdll also talk about what factors to consider when developing your local
ordinance.

FINAL REPORT
The members of the Chesterfield County Impact Fee Committee (members listed below)
submitted the following report on October] 7,2007 after extensive research and careful
consideration of the issue. We would respectfully request, in light of the impending
General Assembly session and possible action that will result, that the Board defers
decision on this issue or remand it to the new Planning Commission for further
consideration prior to adoption. We look forward to working with each of you in the
future to develop and implement creative, global solutions to our transportation funding
situation.

The Chesterfield County Impact Fee Advisory Committee respectfully presents the
following recommendations for your consideration. The committee wishes to express
appreciation for the generous support of county staff. As you will see from this report, we
are unanimous in our belief that current and future transportation funding is an issue that
must be addressed in a proactive, deliberate manner.
Due to the importance of this subject to the future of Chesterfield, it is crucial that all
stakeholders have a complete understanding of key issues, and that all possible funding
solutions be evaluated by a Transportation Task Force, prior to the adoption of an
ordinance. Therefore, the committee concludes that an administratively feasible,
equitable method of assessing impact fees is not possible without implementation of the
following procedural steps.
1. Select an independent firm having a national reputation to perform an overall
economic analysis to determine the total cost and revenue effects of both
residential and commercial development in Chesterfield County. Include within this
analysis the impact of proffers, impact fees and other infrastructure funding
mechanisms already implemented or being considered, as they relate to:
A. The affordability of housing
B. Total county revenues - real estate taxes, sales and other business taxes and fees
C. Employment opportunities
D. Impacts on the economic health of Chesterfield's business community

2. Appoint a task force consisting of key staff personnel, qualified professionals,
contractors and community representatives to review the findings of the
independent firm, evaluate all relevant information and recommend specific steps
to be taken, giving due consideration to the following:
A. Factors which have caused the escalation in the costs of providing transportation
facilities.
B. Quantify the impact of these factors on the county's ability to provide facilities
C. Identify alternatives which could reduce cost and maximize efficiency.
3. The task force should initiate the development of a comprehensive plan for
transportation funding which fully addresses the current and future shortfalls. This
plan should include the benefits and effects of utilizing the following sources of
revenue:
A. Sales tax
B. Gas Tax
C. Meals tax
D. Designating portion of the Real Estate Tax to transportation
E. Designating portion of the BPOL fees to transportation
F. Community Development Authority (CD A) and Special Assessment
districts
G. If increased funding from the state or changes in state statutes and policies is
required, a detailed action plan for seeking and obtaining favorable action from
the General Assembly should be included as one of the products of this task
force.
4. We recommend that the Board initiate actions through the task force, in cooperation
with the General Assembly, to create a Greater Richmond Regional Transportation
Authority to:
A. Address transportation issues on an integrated, comprehensive and
cooperative basis for the entire region.
B. Increase the political leverage our region has in competing for resources
within the General Assembly.

In the event the Board wishes to consider Impact Fees at this time, the following
recommendations should be considered. It should be noted however, that if the Board
should choose to initiate a complete evaluation as suggested by this committee, these
recommendations could change to reflect the findings of the task force.
1. The Impact Fee should be applied to Residential properties which were zoned
prior to the implementation of the Cash Proffer system.
2. The Impact Fee should not be applied to commercial properties because of the
potentially negative effects on the County's Economic Development initiatives
3. The Impact Fee should not be applied to properties which agreed to a cash proffer
in the past which was less than the current impact fee. At the time of zoning in
these cases, there was a good faith agreement made between the County and these
property owners based on the best information available at the time regarding the
cost of the infrastructure required to support development of their property. These
agreements should be honored by the county.
4. Community Development Authorities and Special Transportation Assessment
Districts should be exempted.
5. The Impact Fee Transportation Service Area should be county-wide
6. Property owners should have 60 days to appeal the Impact Fee calculated for their
property to the BZA and an additional 60 days to file the specific details of their
claim.
7. The Tax differential between land zoned as Residential vs. Agricultural should be
credited toward the Impact Fee calculated for each property.
8. Provisions should be made for crediting the costs of road improvements made to
thoroughfare plan roads, either on or off site, by any property owner.

9. Please note the requirements of the enabling legislation related to credits.
15.2-2324 states:
The value of any dedication, contribution or construction from the developer for
off-site road or other transportation improvements benefiting the impact fee service
area shall be treated as a credit against the impact fees imposed on the developer's
proiect. The locality shall treat as a credit any off-site transportation dedication,
contribution, or construction, whether it is a condition of a rezoning or otherwise
committed to the locality. The locality may by ordinance provide for credits for
approved on-site transportation improvements in excess of those required by the
development.
The locality also shall calculate and credit against impact fees the extent to which (i)
other developments have already contributed to the cost of existing roads which will
benefit the development, (ii) new development will contribute to the cost of existing
roads, and (iii) new development will contribute to the cost of road improvements in
the future other than through impact fees, including any special taxing districts,
special assessments, or community development authorities.
The committee feels the calculation of the credit warrants special attention in its
application that is not necessarily reflected in the staff presentation.

The committee remains optimistic when looking at the possibilities of future
transportation funding. We understand the pressing need and political pressures that
surround this issue. We thank you for the opportunity to provide input into this important
process and we hope these conclusions are beneficial to the Board in making future
transportation funding decisions.
