03-28-1968 Packet.i. r. e r . . _ ~ .... , THIS AGREEMENT, Made this '6th day of October, in the year 1967, by and between GULF OIL CORPORATION, hereinafter called party of the first part, and CHESTERFIELD COUNTY, VIRGINIA, here- inafter called party of the second part. WHEREAS, Party of the first part owns fee simple title to a 3.37 acre tract of land in Bermuda District, Chesterfield County, Virginia, at the intersection of United States Route 95 and State Route 619 and Walthall Interchange; and, - WHEREAS,, Said property has been. previously zoned for general business purposes by the Board. of Supervisors of Chester- field County prior to the party of the first part acquiring the same; and, WHEREAS, party of the first part is.desirous of erecting ~~ . a service station on a portion of said property and has applied for a building permit for such station on the property and has further been denied issuance of said permit until such time as Gulf Oil Corporation would convey a ten (10) foot strip of the 3.37 acre tract on State Route 619 which borders the property to Chesterfield County, Virginia; and, WHEREAS, The parties in order to reach an understanding on this matter do agree to the following: Gulf Oil Corporation hereby agrees in consideration of Chesterfield County, Virginia, issuing it a building permit on said 3.37 acre tract of land for a service station to dedicate by deed to Chesterfield County a ten (10) foot strip of land immediately adjacent to State Route 619 on property of said Gulf Oil Corporation to said Chesterfield County, Virginia, at such time as Chesterfield County will improve, widen and pave said roadway and Chesterfield County, Virginia, does hereby agree to issue Gulf Oil Corporation a building permit for a~service statio on the 3.37 acre tract as above mentioned in consideration of the promise of Gulf Oil Corporation to dedicate to said County by deed a ten (10) foot strip of land adjoining State Route 619 in the event that Chesterfield County will widen, improve and pave said road adjoining said property. Gulf Oil Corporation further agrees to pay any and all costs that may or will be incurred by ,~ L~ Chesterfield County in removing any signs, lights~.or other improve ments constructed on said strip of land except pavement of areas for purposes of ingress and egress to the station. Purdy, it is resolved that the minutes of March 13, 1968 be and they hereby are approved. 78-7UP Mrs. Phyllis Leite comes before the Board seeking a Use Permit to groom dogs on a parcel of land of irregular shape fronting 500 feet on Rte. 10 and extending southeastwardly 751 feet, being approximately 4740 feet southwest of Beulah Road in Dale A;agisterial District. Refer to Sec. 79- A parcel 18. There appearing no one to oppose this request, it is on motion of Nir. Apperson, seconded by Nir. Browning, resolved that a Use Permit be given to Mrs. Phyllis Leite on the above describe.parcel of land, provided there be no signs displayed and provided further that the Use Pe~Cmit be subject to review if complaints from the adjacent property owners are received. •. Mrs. Charles Elmore comes before the Soard speaking in behalf of the Parent-Teacher Association and states that the Lounty is willing to pay for good services rendered and gives an outline of needs which are paramount on the view of the P.T.A. Mr. ibbert Van Vleck speaks on behalf of the P.T.A. on the school budget and emphasizes the need for Kindergartens, improved maintenance and good salaries for teachers. The Board agrees to consider the request of the P.T.A. when the CAUnty budget is adopted. Mr. Frank Landrum and Nir. Olin Taylor, representing the Nluseum Committee come2~fore the Board requesting that NIr. L.A.Gravatt be appointed to the Museum Committee in place of Mr. John B. t;atkins (deceased), that Mr. Harold T.Goyne be appointed for a 3-year term as an additional member and that a member from the Board be appointed to the Museum Committee. On motion of Mr. Apperson, seconded by Mr. N`iartin, it is resolved that that this matter be deferred to the next meeting of the Board to give time for a study of this request. On motion of P•'ir, Purdy, seconded by Nlr. Apperson, it is resolved that the Standard Water Contract A-466 for the installation of water in 4eentworth Street in the amount of $2700.00 be and it hereby is approved. On motion of Nir. Dietsch, seconded by P~'x. Purdy, it is resolved that Special Water contract IC-443B for the installation of water in Lake George Hamlet and Bexley Subdivision in the amount of $11,715.00 be, and it hereby is approved. On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that Contract RC-468 for the installation of water in Cherry Gardens Subdivision he awarded to Stamie E. Lyttle Company in the amount of $7693.95 and the ,pipe awarded to the Glamorgan Pipe company in the amount of $7293.18. The valves to be furnished by the County for the sum of $1811.61 or q total cost of ilie project of $16,798.74. On motion of Mr. Purdy, seconded by rir. Dietsch, the following resolution is adopted: Be it Resolved by the Board of S upervisors of the County of Chesterfield, Virginia, in r<:gular meeting assembled that the Chairman of said Board be and he hereby is authorized to enter into an agreement with the Seaboard Coast Line Ft3ilroad Company and to sign same on behalf of said County, whereby, said Railroad Company grants unto said County the right or license to install and maintain, for the purpose of a water main, a line of 24-inch steel pipe across the right of way and underneath tracks of said Railroad Company near Walthall, Virginia,at a point 1020 feet southeatwardly, measured alone the center line of said Railroad Company's ea:>t track, from I~iile Post 16; as more particularly described in said agreement, which agreement is dated r^ebruary 15, 1968, a copy of which agreement is filed with the Board of Supervisors. On motion of 1~Ir. Dietsch, seconded by P'ir. Purdy, it is resolved that this Board allows the Southside Builders Supply Company to connect with 'the City of Richmond for water service and provided further that the Engineerinc Department be requested to investigate the possibility of serving this business with County sewer.. There was a short discussion held concerning the study of the industrial water rates for the County and it was generally agreed that this matter be deferred for further study. ' The County Engineer advises that the contract with the City of Richmond will terminate within two years provided proper notice is given. Upon consideration whereof, and on motion of I~Ir. Britton, seconded by I'~ir. Martin, it is resolved th~.t the County Engineer be and he hereby is authorized to notify the City of Richmond that the contract will be terminated as soon as possible. -2- • i On motion of NTr. Upon consideration whereof, and on motion of NIr. Purdy, seconded by Mr. Dietsch, it is resolved that the rec;;uest of Mrs. Dodd be approved. On motion of Mr. Dietsch, seconded by Nir. Purdy, it is resolved that the request for street lights in the Subdivision of Hollyberry Hills be referred to the Street Light Committee. Tle ~cecutive Secretary reports that Mr. Robert G Byrus had met with the Fire Committee and othc-r officials of the County and presented a proposal to study the needs of the Chesterfield Fire Departments, and cites thatthis matter had been discussed at length on pre~iious occasions. Now, Therefore, Be it Resolved, on motion of Mr. Dietsch, seconded by Mr. Apperson, that this Board employ the services of NTr. Byrus to study the fire fighting needs of the County and to make report to the Hoard of :izpervisors as soon as feasible. There was presented an audit of the County Court's office prepared by the Atditor of Public Accounts which report is filed vrith the Board's papers. Tt was reported that the resolution formerly passed by the Board on March 13, 1968 to request the Highway Department to close Happy Hill Road, had run into difficulty with the Highway Department and that the requirements to closing the road were too strenuous to be borne by the contfactor. Ther were presented bids for a hydraulic crane, truck mounted and the low bidder of five was the Phillips Pachinery Company, in the amount of $6716.07. On motion of Mr. Apperson, seconded by lvir. Martin, it is resolved that the award be made to the Phillips Machinery Company., It is here noted that Nir. Brownin•• does not vote. The matter of hiring a central accountant again co•es before the Board and it was cited that Mr. James A. 2ondrey was the recommendation of the Committee investigating the applicants for this position, it is on mota.on of Mr. Apperson, secnded by Ns. Purdy, resolved that Mr. James M. Condrey be employed as of April 1, 1968 at a salary of $14,000.00 per annum. _5_ • Pr. Morris E. Mason, Assistant Commonwealth's Attorney, comes before the Board and explains the circumstances attendant to an objection in the title of Lot 5, Block A, Bryan l~.dge Subdivision, Bermuda District, owned by Dorothy T.Bennett, divorced, taho is unable to proceed with construction of a 'come on that lot due to t.e title objection, being a drainage easement given by the ~wncr of Lot 5, Block D, in said subdivision erroneously described as Lot S, Bloclc A, and recommends that the Board airman and Clerlc be authorized to sign an instrument removing the title objection on said lot, On motion o~ T~~r. Mason reported that the Gulf Oil Co3npany had agreed to sign an agreement dedicating to the County a 10-f t. widening strip if the roadway were to be widened in front of its property at the Walthall Interchange. Since this matter is in court and it is apparent that no great advantage can be gained in further pursuing this matter, it is on motion of ilr. Purdy, seconded by Mr. Apperson, resolved that the Qzairman and Clerl: be authorized to sign said agreement on behalf of the County. On motion of Nlr. At the request of the Board of Supervisors of Chesterfield County, Virginia, we have examined into the validity of an issue of $14,600,000 School Bonds of Chesterfield County, Virginia dated March 1, 1968, numbered from 1 to 2920, inclusive, of the denomination of $5,000 each, payable serially in numerical order $730,000 bonds on March 1 in each of the years 1969 to 19&8, inclusive, without option of prior redemption bonds maturing in the year..: 1969 to 1984, inclusive, bearing interest at the rate or four and thirty hundredths per centum per annum and bonds maturing in the years 1985 to 198:, inclusive, bearing interest at the rate of four and forty hundredths per centum per annum, payable semi-annually I=:arch 1 and September l; said bonds reciting that they ;ire issued for capital school improvement purposes, the acquisition of future school sites and such other school con- struction, as may be required by the actual educational needs in Chester- find County, Virginia, pursuant to and in full compliance vaith the Consitution and statutes of Virginia, including Chapter 5 of Title 15.1 of the Code of Virginia, 1950, as amended, and an election duly held under said chapter in the said County on the 26th day of 5eptemiaer, 196E1y 49e have examined the Constitution and statutes of the State of Virginia and certified copies of proceedings of the County School Board of Chesterfield County,, Virginia, and of the Board of Supervisors of Chesterfield County, Virginia authorizing the issuance of said bonds, also an executed bond of said issue. It is also our opinion that the interest on said bonds is exempt from taxation by the United States of ~rnerica under the Constitution of the United States as now in force, unless such tax is consented to by the State of ~.rginia, and that such interest is exempt from taxation under the eri5ting .;cts of Congress. Apperson, seconded by N'r.Iietsch, it is resolved that this Board approves the request of the School Board to advance the sum of $22,222.00 to Item 17b3 in the School budget which sum represents funds allotted for Library demonstration project under Public Law 89-10 and the Treasurer of the County is requested to transfer said sum from the unappropriated surplus of the County to item 17b3. On motion of Mr. Apperson, seconded by Mr. Iietsch, it is resolved that this Hoard. approves the School Board request to increase the Sci~ool budget for the current ;year in the amount of $43,068.88 to Item 17b3 which amount represents Federal funds given to the County for school purposes. And the Treasurer of the County is requested to transfer said sum from the unappropriated surplus of the County to Item 17b3. It was generally agreed that the resolution of the School Board passed on March 27, 1968 raisi~ig the revenue side of the Scho:.l budget $169,054.00 be noted in the forthcoming budget. This provided an opportunity to visit several fire stations, to have a 'quickie' tour of the County, and to meet the members of the Board of Supervisors and yourself, As a result of this visit there would be no hesitancy on my part to accept a committment from the County to do these things: A. Prepare a policy criteria as to the types of fire appar- atus indicated as necessary for the adequate protection of Chesterfield County. B. Prepare a standard set of specifications for major items of fire apparatus suitable for use in advertising for bids. These specifications will be designed to assure delivery of soundly engineered apparatus capable of meeting the rigorous performance requirements of fire ground operation, C. Prepare a long range apparatus schedule of replacements and service testing. This would permit costs to be anticipated on an annual basis, and budget planning made accordingly, D. Analyse the need and desireability for adding a skeleton force of salaried fire fighters. Included would be recommendations as to numbers involved and suggested locations to which they might be assigned, E. If the above item of adding salaried fire fighters proves acceptable, I would prepare, (1) Suggestions for job descriptions of the positions involved, (2) Recommendations for the rules, re uiations, and working assignments for the salaried force, (3~ Recommendations for standards of conduct and performance of the members of the Chesterfield County fire departments, paid or volunteer. 2 Mr. M. In connection with the making of a fire defense study with 'the accompanying recommendations for your County, there are three factors that would be prime governing criteria for my guidance. These are: A. The caliber of the fire safety program for the citizens of the County is of paramount significance. This must be of the highest order to meet the tragic situations that prevails on the fire ground on occasion. B. The responsibility of the Board of Supervisors for wise and judicious expenditure of public funds must be recog- nized. C. The volunteer character of the County fire departments must be recognized and every consideration given to it's continuance and augmentation. I anticipate that approximately 20 man-days will be involved on my part to complete the study and submit the recommendations. WHEREAS, the County of Chesterfield has purchased a parcel of land to•construct certain water facilities in the triangle bounded by the intersection of Routes 1, 620 and 619 in Chesterfield County. WHEREAS, this plot of land is only of sufficient size to contain the facilities. WHEREAS, additional room is needed during construction for storage of materials, equipment, etc. WHEREAS, Happy Hill Road, Route 619, between Route 1 and Route 620, is used very little by the traveling public. WHEREAS, this Board does not feel that temporary closing of the road will inconvenience the traveling public. NCR,i, THEREFORE, BE IT RESOLVID, on motion of Mr. Purdy, seconded by Mr. Apperson, that this Board does hereby request the Highway Department to allow the County to close this road for a period of approximately one (1) year during the construction of the facilities involved, it being understood if this request is granted, certain damages will be done to the road. First, by virtue of the type of operations being carried on, and also by virtue of fact that the unused portion will not have traffic on it to keep alive the surface, which is also detrimental to the road.. The County will, upon completion of the work, restore the road to original condition, including a seal treatment; this restoration to be done at no cost to the Highway Department. Department for the Treasurer's Office. We have been advised by Mr. John Resnick, Executive Secretary, State Compensation Board, that the State will not participate in the cost of any I.B.M, forms and the entire cost of the forms, etc, used for this office must be born by the County. Since it is more economical to purchase these forms in large quantities, the total cost incurred during the current fiscal year has far exceeded the amount estimated which was included in Services and Supplies from the Data Processing Section and was approved by the State Compensation Board for the fiscal year ending June 30, 1968. I respectfully request an additional appropriation of $3,000 for Stationery and Office Supplies, all of which will be paid by the County for the current fiscal year, It is understood that this appropriation is only to purchase supplies, etc. used by the I.B.M.
