W, GUNN, JR., TRUSTEES, parties of the third part, - WHEREAS, the party of the first part desires that a forty foot road known as Boroughbridge Road., lying in Manchester Magisterial District, Chesterfield County be widened ten foot along the northeastern line of said road, and desires to convey to the County of Chesterfield said ten foot of~property immediate- ly adjoining said road as shown on the hereinafter mentioned plat. NOW, THEREFORE, for and in consideration of the premises and of the benefits accruing, the party of the first part hereby grants and conveys unto the said party of the second part, with GENERAL WARRANTY of TITLE, the following described real estate, to-wit: t That certain strip or~parcel,.of land lying and being in Manchester Magisterial District, Chesterfield County, Virginia, ten foot in width next adjoining Boroughbridge Road, all as more particularly shown on a plat by LaPrade Bros., Civil Engineers, dated Feb- ruary 10, 1964, revised June 26, 1968 and attached hereto and made a part hereof. BEING part of the same property conveyed to Forest View Rescue Squad, Inc, from Lawrence Voltaire, et al, dated November•6, 1963 and recorded March 6, 1964 in Deed Book 741, page 67, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia. In consideration of the sum of $1.00 and of the consent of First Federal Savings & Loan Association of Richmond, Note- holder, evidence by its joining in the deed consenting to the ~~release of that certain Deed of Trust from Forest View Rescue .Squad, Inc, to John H. Randolph, Jr, and R. W, Gunn, Jr., Trustees dated March 22, 1966, recorded June 7, 1966 in Deed Book 842, page 181 of the Clerk's Office aforesaid on the land conveyed herein, the said John H. The said County use tax shall be added to added to the rate of the State use tar, imposed by Chapter 8;1, Title 58, of the Cocae of Virginia, and shall be subject to all the provisions of that chapter, and all amendments thereof, and the rules and regulations published with respect thereto. Therefore, the purpose of this resolution is to impose the local use ibex authorized by Sece 58-441.49:1 of the Code of Virginia. 20 The effective date of the use tax imposed by this resolution shall be the first day of July, 1968, and the same shall be in force on and after that date, 3e The Clerk of the 13~ard of Supervisors of the County of Chesterfield shall forthwith forward to the State Tax Commissioner of the Cf~mmonwealth of Virginia a certified copy of this resolution so that it will be received vaithin five days after its adoption, On motion of lair. Dietsch, it is resolved that the sum d: $80,000 be transferred from the unappropriated surplus of the General Fund to the County's 3¢ Road Fund which amount represents the planned transfers in the current fiscal year and in the year 1966-~67 and 1967-'68. And be it further resolved, that the sum of $40,000 be transferred from the 3~ Road Fund to the General rund to repay the amount spent for the Hollandale drainage project. ^2- Gn motion of A~.r. llpperson, seconded by lair. Purdy, it is resolved that the Treasurer be and he hereby is request~:d to transfer $12,177,00 from the unappropriated surplus of the General Fund to the County's 4Jorkmen's Compensation Fund, which amount represents the money not spent in the appropriation for i~dorkmen's Compensation. Mr. Beecher Stallard, representing P~ir. Josh Grubbs, comes before the Board stating that his client had been awarded a contract to remove three (3) buildings at the Courthouse and that the throe buildings were removed by another concern and wishes to know the reason for this action. The Chairman ascertained .from Mr. Grubbs that no bid had been awarded, that no indication had beers given that he would get the bid except that he was the lowest of three bidding on the demolition of these buildings, It was pointed out that the Board had reviewed the three bids and had agreed to discard all three bids and approved a recommendation from the Executive Secretary to hire trucks and a front ;end lo~~der from the Shoosmith Bros. to accomplish this work. Judge Belton was asked to be present at this hearing since. he was in the adjacent office when ID1r. Grubbs came to present his complaints to the Executive Secretary, Nir.Grubbs was asked why he made certain statements to a Norfolk News Editor concerning junk cars having been oi`fered him to smooth things over. Mr. Grubbs denied ever saying anything at all about junk cars and stated that he had not been to Norfolk in three or four years, Whereupon, Mr. Apperson stated he was alarmed at the actions of the Executive Secretary in taking away a job from his political supporter and giving it to Shoosmith Bros. Whereupon, the Executive Secretary stated that he had reviewed the matter with the Board in his presence and was authorized to proceed with renting the equipment from Shoosmith Bros,, that he was carrying out the order of the Board of Supervisors. There was no further action t~.ken on this request at this time. On motion of l~ir. Martin, seconded by T~ir. Browning, it is resolved that this Board approves the request of Col, E.P.Gill and recommends to the Judge of Circuit (hurt, the Honorable Ernest P.Gates the appointment of Mr.George Frederick Paul, III, as Dog GJarden and Special Police for Chesterfield County. On motion of Mr. Purdy, seconded by Mr. Ihetsch, it is resolved that the sum ~f $1500.00 be appropriated from the unappropriated surplus of the County General Fund to 040-204- in the Circuit Court Clerk's budget, and the Treasurer of the County is hereby request•:d to transfer said sum from the unappropriated surplus to this account. Dietsch, seconded by Mr. Purdy, it is resolved that this Board signifies its willingness to close a portion of Pompey Springs lead and vacate same if the developer will build a new road and dedicate to the County a sufficient right of way and construct same to State's specifications and deed a right of way from Hopkins Road to Nir. Britton's home. On motion of Mr. Dietsch, seconded by I~ir. Purdy, it is resolved that this Board again request the Virginia State Department of Highways to study the situation at the intersection of 6,ialmsley Boulevard and the SCL RR. and to improve same if at all possible. -4- Mr. Trammel, owner of a Iot at the end of Luck's Lane comes before the Board seeking a Variance to build a home on his lot and some assistance in constructing said road. Apperson, seconded by Mr. Dietsch, it is resolved that the Nleadowbrook Country Club be allowed to connect at a cost of $500.00 per acre, using approximately 3-acres of its existing facility and provided further that the sewer line costing approximately $12,000 from the Club to the existing County facilities be paid by the Club. John Thomas, representing Dr. J.D, Griffith, comes before the Board requesting the rezoning from Residential-2 to Local Business (C-11 for use as dental offices on a parcel of land of rectangular shape fronting 75 fe~:t on Belt Boulevard (Rte. 161) and attending southwestwardly 125 ft. being 275 feet northwest of Stockton Street and better known as 800 East Belt Boulevard, in Manchester Magisterial District. N1r.DOUglas Moore comes before the Board stating that he was the first president, 17 years ago, of the Woodstock Civic Association and that said Civic Association is directly op~dsed to this 'zoning. , Mr. Thomas states that the people have no faith in the Board of Supervisors in that the request is only a slight alteration. Upon consideration whereof, and on motion of Nir, Dietsch, seconded by Mr. Martin, it is resolved that this zoning request be and it hereby is denied. 68-10 Nir. J. i7enis Tucker comes before the Board requesting the rezoning from Agricultural to General Business (C-2) on a parcel of land containing 3.45 acres fronting 956 feet on the southwest line of Chippenham Parkway and X50. feet and 205 feet on the north line of Cascade Street and being 600 feet east of Route 10 in Dale Magisterial District. Mr. Alan Long states that he does not agree with the proposal at all. Frank Wyche, representing ivr. Cbcil L.I,Jilliams, comes before the Board requesting the rezoning in Matoaca Magisterial District, from Agricultural to General Business (C-2) on a parcel of land of irregular shape fronting $75 feet on River Road (Rte. 602) and extending south- wardly 2460 feet to a frontage on Lake Chesdin of 920 feet, more or less, being opposite the intersection of .Eaves ~ River Roads. Refer to Sec. 179 part of par. 29-1, Mr.Wyche states that he is the Attorney for the Authority, that there is a need for access to this great body of water, that them is no possible chance for water pollution and if there is, there is an ordinance to cover the situation and it will be a matter of convenience to the people of Chesterfield and shows a tentative layout of this property. Mr. T+Jyche states further that he has been advised since he arrived at the meeting today that a petition has been drawn in favor of this zoning request. Mrs. Jo Ellen Renshaw presents a petition signed by 300 people for the rezoning of this property. Mr. Niinton speaks for the rezoning of this property, saying Chesterfield; needs the business and the people in the area need the access to the Lake. Mr. Frank Orrell reads a statement in opposition, stating that Mr. Williams owns 800 acres in the area and that he should find some other place rather than next to his home for a business location. Mr. Eaves, the operator of the business, speaks in general for the requested rezoning stating that no harmful effects can come to anyone by the operation of said business. Mr. Browning cites a letter from the Honorable Ben Bolen, Commissioner of Parks, calling for a State Park in this general location. It was cited that the Planning Commission had recommended that the zoning be denied. After considerable discussion, it is on motion of Nir. T,org, Executive Director SUBI7ECT; ADOPTION OF THE LOCAL OPTION USE TAX When the Virginia :Retail Sales and Use Tax was adopted in 1966, it provided localities with the option to adopt a 1'~G local sales tax. But it did not provide for a l~O local use tax to be assessed on items of tangible property purchased outside the State and brought into the State for use and consumption. During the two year interim between 1966 and 1968, the lack of the local use tax developed into a tax loophole. 'Tnat is to say, that a consumer purchasing tangible personal property items in Virginia paid a 2~O State sales tax and a 1~O local sales tax making a total of 3/ which was levied on the sale. But if the purchase was made outside the State, only the c^% State Sales tax Was levied on the sale. This p"laced many Virginia merchants near the State boundaries in a, non- competetive positioh. The 1968 Session of the Virginia General Assembly closed the loophole by enacting Sec. ;8m~+41.49:1 to make the local option l~ sales tax alocal option 1~O sales and use tax. In order for your county to obtain .revenue from the use tax and to equalize the competitive position of its merchants with those outside the State, your county should adopt the enclosed resolution sometime during the month of April. A copy of the resoluticn as adopted should be forwarded by the Clerk to Mr. C. A. Morrissett, State Tax Commissioner, within five days after its adoption. A copy of the suggested resolution is attached to this memorandum. There is need for uniformity across the State in levying a local option sales and use tax in those counties which have adopted the local option 1°~D sales tax. Thus, if you have previously adopted a l~ sales tax, you are urged to adopt a if use tax by adopting the enclosed resolution. We had moire than 430 complants during the month of March for the Dog Wardens. My suggestion is that we have John S, Thomas, Jr., who is now employed as a Dog Warden, to check houses for the next 90 days and after that time I will recommend him for appointment as a Police Officer. I will be able to let him use one of the spare police cars for checking houses during this length of time. I hope you can work this out for me at the regular Board meeting on the 10th of April. Although Mr. Garner has only been with this office since December, 1967, his experience as a police officer for six years and as a magistrate for eight years gives him qualities that are hard to find in experienced prosecuting attorneys. Mr, Garner has done an exceptional job in this era and this County would suffer a great loss if he should choose to leave us because of the nominal salary of $~t,200.00 he is now receiving. Because of the work load and his sincere interest, he devotes a minimum of forty hours per week to this position. Records will reveal that Chesterfield County has a population of approximately one half of that of the City of Richmond and approximately 75% of that of Henrico County, and that these two jurisdictions have six or seven assistants, some being part time and some being full time, with part time assistants who do not spend as much time in the Commonwealth Attorney's Office and are receiving an income equal to that which I am requesting for Mr. Garner. Mr. Garner, in addition to the duties outlined above, is on call, as well as the Commonwealth's Attorney, twenty-four hours per day and constantly called from his home nights, Saturdays,and Sundays. I am not asking that Mr. Garner be classified ae a full-time assistant, simply because he has some private practice in addition to the time he spends in this office and I feel that if we consider him full time this would eliminate his private practice, but since he in effect spends as much time as a full-time assistant, I feel that $9,500.00 is a reasonable request. Conditions This is a barren, unpaved, untreated dirt road. Objections For the residents living on N. Pinetta Drive and e ing on Road where the barren road begins, state d. very simply, we are living in a "dust bowl". Personal objections of writers Mrs. Foster suffers from a ronc is condi ion whit t is dust aggravates. Secondly, we can not have fresh air in the house by raising windows or opening doors. Thirdly, to hang out laundry is to get more dirt on clean clothes. Fourthly, to have much needed outside painting done would be a waste of time and money. The writer has talked with all of the above and has been able to draw. one definate conclusion - I have no idea as to whom the road belongs or with whom the responsibility for maintenance lies. Suggestions for corrective measures: Once responsibility is de- erm ne pave a road inasmuc as it more than meets the minimum requirement of 50 vehicles a day using it. This measure being impossible, have the party responsible keep the road watered down. It is recognized that either of the above suggestions would cost money. Too, it is also recognized that the party responsible might night not have the necessary funds or if available, might not want to disburse them. In this case, simply close the road - there are no people living on the barren stretch at this time. Dr. Martin, County Supervisor for my District, uses Pinetta, Drive from time to time and agrees that it is a disgrace to the County. At any rate, I have written a "to whom it may concern" letter, copy attached, and amy sending it to anyone who can possibly give us relief from the dust. Inasmuch as the road is in Chesterfield County, would it be possible for you to determine who is responsible? It is my understanding from neighbors that the developer assured them three years ago that the road would be paved. Very humbly, sir, we need help. Won't you please provide it for us?
