Bermuda Magisterial District North line of East Hundred Road Amendment to Conditional Use Planned Development to amend a condition relative to signage. (Condition 2 of Case 87S039) PROPOSED LAND USE: The property, in combination with an adjacent parcel to the west, has been developed as a convenience store with gasoline sales. This amendment will allow signage to comply with currem Ordinance requiremems. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. AYES: Unanimous STAFF RECOMMENDATION Recommend approval for the following reason: Amendment of the condition of zoning relative to signage would allow signs to conform t6 current' Zoning Ordinance standards. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLEY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION ARE.) CONDITION (STAFF/CPC) With the exception of signs, development shall conform to Corridor Overlay District Standards, except as otherwise noted in conditions of Case 87S039. (P) (Note: This Condition supersedes Condition 2 of Case 87S039 for the request property only.) GENERAL INFORMATION Location: North line of East Hundred Road, west of Kingston Avenue. Tax ID 818-651-7096 (Sheet 27). Existing Zoning: R-15 with Conditional Use Planned Development Size: 0.9 acre Existing Land Use: Commercial (conve. nience store with gasoline sales) Adjacem zomg and Land Use: North and East - R-15 with Conditional Use Planned Developmem; Commercial (under construction) South and West - C-3; Commercial or vacant UTII JTIES; ENVIRONMENTAL; AND PUBLIC FACILITIES The requested amendment will have no impact on these facilities. 2 01SN0272/WP/SEPT26S LAND USE ComprehenSive Plan: Lies within the boundaries of the Eastern Area Land Use Plan which suggests the site is appropriate for commerCial use. The .Eastern Area Plan is currently being updated. Area Development Trends: Area properties along the north and south lines of East Hundred Road are zoned for and/or developed as commercial uses. The current Plan anticipates that commercial uses will continue along this portion of East Hundred Road. Zoning History: On September 28, 1988, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved a rezoning of a 972.5 acre tract to Residential (R-15) with a Conditional Use Planned DeVelopment to permit a mixed use development to include residential, office, commercial, recreational and industrial uses commonly known as the River's Bend development (Case 87S037). Condition 2 of Case 87S037 required that development conform to the Corridor Overlay Standards which include sign standards~ On February 9, 2000,. the Board of Supervisors, upon an unfavorable recommendation from the Planning Commission, approved an amendment of Conditional Use Planned Development (Case 87S039) to permit use exceptiOns and exceptions to building size, architectural treatment, hours of operation and uses permitted outside of enclosed buildings (Case 00SN0173). These amendments did not affect the original conditions of Case 87S037 relative to signage. Site Design: The property in conjunction with'the adjacent C-3 property to the west has been developed for a convenience store with gasoline sales: Redevelopment of the site or new construction must conform to the requirements of'the Zoning Ordinance and conditions of zoning approval which currently address access, parking, landscaping~ architectural treatment, setbacks, signs, buffers, utilities, and screening of dumpsters and loading areas. Signs: Signs for the site are currently regulated by Condition 2 of Case 87S037 which requires compliance with Corridor Overlay District standards. These standards do not permit individual outparce'l signs. The applicant has requested that this condition be amended so as to allow signage to comply with current Zoning Ordinance requirements. The sUbject property is part of a shopping center or similar group of buildings. Currently, the Zoning 3 01SN0272/WP/SEPT26S Ordinance would permit individual businesses within such a development one (1) freestanding sign not to exceed an area of twenty (20) square feet and a height of eight (8) feet to be installed on the property. The area of the sign cOuld be increased with the incorporation of changeable copy (reader board) and the advertisement of fuel prices. In addition, Condition 2 of 87S039 regulates the mount of building-mounted signage. The Corridor Overlay District Standards limit the total mount of sign area to include the square footage of any building-mounted sign. Those standards limit the mount of total sign area to one (1) square foot for each two (2) feet of building frontage with a minimum of twenty (20) square feet and a maximum of 150 square feet of signage permitted. The current Ordinance standards will allow building-mounted signage based upon 1.25 square feet for each one (1) foot of building frontage with a minimum of thirty (30) and a maximum of 150 square feet of building-mounted signage allowed. These square footages do not include the permissible square footage for any freestanding sign. CONCLUSIONS Amendment of Condition 2 would allow for signs to conform to Zoning Ordinance standards. Further, this amendment will allow for the consistent regulation of signage for this development which includes the adjacent C-3 property to the west. That property is currently subject to Ordinance standards. Other development standards of the Corridor Overlay District would continue to be .applicable. (Condition) Given these considerations, approval of this request would be appropriate. CASE HISTORY Planning Commission Meeting (8/21/01): The applicant accepted the recommendation. There was one person present expressing concerns relative to the location of any proposed freestanding signs. It was noted that this request would allow the existing sign to be relocated further east. On motion of Mr. Cunningham, seconded by Mr. Litton, the Commission recommended approval of this request subject to the condition on page 2.
