Niartin, it is resolved that the minutes of March 28, April 8 and April 10, 1968 be and they hereby are approved. There was read a request from the Tri-Cities Cable TV, Inc. requesting a franchise from the County for the installation of Cable TV service. There was also read a letter from the Commonwealth's Attorney stating that the County did not have the right to grant franchises. On motion of Mr. Partin, seconded by Mr. Dietsch, it is resolved that the sum of $150.00 be paid to Mr. R. S. Tomlin, of 9000 Midlothian I~~ike, for 6 pigs killed by dogs. On motion of Mr..Purdy, seconded by F~'Lr. Browning, it is resolved that this Boated request the Highway Department to improve Ida Avenue to the minimum specifications of the Highway Department at a cost not to exceed $1200,00 and to take said road into the State Se~Eondary System of roads when completed. It is here noted that ..he County has received a 51200.00 check from the subdivider to pay for this improvement. • The following roads have been taken into the State Secondary System of roads: Fawnbrook Subdivision. Sections "A", "B", & 1fC" Fawnbrook Boulevard -from a point on Route 1660, 0.23 mile north of Route 2164 and running west 0.06 rule to St.riortiz Drive 0.06 Mi. 5t. ri;ortiz Drive -from a point on Fawnbrook Boulevard 0..06 mile west of Route b60 and running north 0.05 mile to Zurich Drive and South 0.02 mile to a dead end 0.07 " Zurich Drive- from a point on St. iv:orttz Drive 0.05 mile north of Fawntrook and running west 0,06 mile to Susten Lane then 0.03 mile to a dead end 0.09 " Susten Lane - from a point on aarich Drive 0.06 mile west of St. roritz Drive and running south and west 0,12 mile to Susten Court then west 0.08 mile to Geneva Drive 0.20 Susten Court -from a point on Susten Lane 0.12 mile ~ west o Zurich Drive and running north 0,03 mile to a cal-de-sac 0.03 There way read a notification from the Highway Department that $1,842,550.00 would be allocated to the County of Chesterfield for the construction and maintenance of the Chesterfield road system. On motion of Per. Dietsch, seconded by Mr. Purdy, it is resolved that this Board requests the Highway Department to improve the approach to Rt.892 from Rt.60 and across Rt.60 to eliminate the existing hazard. Mr. Tom Daniel, i-1sst. County %ngineer, gives a written report on the study for sewer service to the Courthouse area and the Centralia Gardens area, He pointed out that thu entire capital cost was eu4timated at $532,477.00 and it was generally acreed that connection charges and savings from capital outlay at the Courthouse would amount to about $161,150.00. A delegation from the Centralia Gardens area again comes before the Board requesting action on their previous requests to put sew~trs in this area. ~~fter some discussion of the matter, it is on motion of DYr. Apperson, seconded by i~~ir. Dietsch, resolved that the Cr~unty proceed with Schedule "C" as outlined by i'ir. Daniel and to request the County Engineer to put this project on the Schedule of sewer projects and start within one year. It is understood that the sewer program in this area is to be financed from the Sewer Bond Fund. t~irs. Peake, sirs. Ashworth and others come before the Board requesting some improvement to the drainage ditch running from Hopkins Road to -2- i~iarquette Road. Nir. I~iaynard Elrod, t`sst. County Engineer, gies an estimate of `;21,807.00 for the cost of improvement as drawn by the Engineering Department. After much discussion of this matter, it is on motion of Nir. Apperson, seconded by Nir.Brownin~, resolved that this Board requests the Highway Depe:rtment to examine the proposed plans and to give to the Boarcl the amount cf participation which the Highway would give toward the completion of this project; to ask the subdivider to share in the cost of this ,.project; and for the necessary easements drawn and signed for additional rights of way necessary for this project, i~ir. Hepburn comes before the Board requesting a Variance to allow the construction of a dwelling on a 1-ache parcel of land in Bermuda District on a proposed SO-f t. right of way belonging t iris mother,Mrs. Virginia Hepburn. Upon consideration whereon, and on motion of Mr. Purdy, seconded by Nir. Apperson, it is resolved that this request be granted, provided no other land be sold by the Hepburn Estate until such road is built and that there be stated on the building permit, "No obligation of the County to build or maintain this private drive." N•ir. and Dirs. Clarke and others come before the Board ree~uesting some improvements to conditions in Penn Acres. Mre Mayo states that he and Nir. N•iartin have been on the site and have noted the debris around the business operation of Nir. Hugh Hawthorne and others and states that sufficient action will be taken within the next few days to eliminate this objection. Nir. Angelo Hajacos comes before the Board reque stirr:_; a Variance to allow the construction of a building on Ramona Avenue in Half tiday House Heights, which road is unimproved and presents a statement signed by the owners of the property on Ramona Avenue sta ing that they do not request the County to improve or maintain this right of way. Upon consideration whereof, and on motion of N1r. Purdy, seconded by Nir. Apperson, it is resolved that a Variance be granted and that a building permit be issued to Nir. Hajacos with no obligation of the Count; to construct said road, N'irs. Elwood M. Gentry comes before: the Board requesting some improvement to the water syst:m in Forest :-+cres, statine~ that teach individual home has a well which in most cases gices bad water. Nir. Painter presents several studies showing ho~~t w~aer can be brought to this area from adjacent areas and it wasc~nerally agreed that Mrs. Gentry would contact the residents in the area to ascertain the interest in the connections to the County water system. i~ir. Ii.A.Farrell, Chairman Governmental i~ffairs Committee of the Chestdr- .. . field Jaycees comes before the Board and presents a lette=: requesting the Boarcx to continue night meetings so that interested citizens can attend same without undue obligations. After some discussion b-~- the Board concerning this matter, Nir. Dietsch, makes the following motion, which was seconded by Nir. Apperson: "Be it Resolved, that this Board continue night meetings for the second monthly meeting of the Board." A vote being taken on the motion _3_ those voting Yea - Nir. P~.artin, it is resolved that this Board award contract :aRC-317A for the installation of a 2011 water line in Cedarhurst Road to Holland, Howard and Cochrane for the installation in the amount of $5413.96; for )hhe pipe to the Lynchburg Foundry Company :12,025.00 and the County will furnish valves and fittings amounting to $3347.75. Purdy, it is resolved that the following sewer contracts be and they hereby are approved: 5-68-13D UJestover Terrace 5-68-17D walnut Drive 5-68-21D Bridgewater-Point On motion of NIr. Dietsch, seconded by N'Ir. Purdy, it is resolved that this Board award contract 65-11-63 for the installation of sewer lines in the Cherokee Road, Chippenham Section to F.L.Showalter in the amount of $205,102.00; for the pipe in this project to Flinkote in the amount of $24,737,02y manholes to the Concret:_ Pipe & Products Company for $16,539.00; castings to the Virginia N:iunicipal Service in the amount of $3,141.50 in a total amount of $249,519.52. and NIr. On motion of Mr. Apperson, seconded by C-~r, Purdy, it is resolved that the sum of x2851.14 be transferred from the Item - Permanent Employees to Temporary Hiployees in the budget of the County Treasurer. There was read a Notice from the State Corporation Commission that a hearing will be held on May 13, 1968 at 10:00 A,P~I. concerning a request of Maitland Bros. Tins Lines for a common carrier franchise on certain rogds in Matoaca District. There was regd a memorandum from the `t'ennis Committee citing certain deficiencies in the condition of tennis courts in the County and giving certain recomi;~endations for th::ir improvements. Upon consideration whereof, and on motion of Iuir.Browning, seconded by T~Ir. Attached is a copy of the allocations which are available for use within each of the several counties in Virginia. As you will note, the Secondary funds available have decreased $2,100,000. This decrease is due to the fact that the 2% titling tax which was enacted by the 196b General Assembly has not brought in the revenues which were anticipated. Further, the 1968 General Assembly required a $5 million allocation for the right of way revolving fund to be used to purchase right of way well in advance of construction in order to hold the future right of way cost to an absolute minimum, It is well to note the increased cost in all phases of our economy, and this is reflected in our highway maintenance,. maintenance-replacement, and improvement programs. In reviewing our work during the past twelve months, we feel that we are making as much progress as we possibly can with the funds available. We expect to continue this progress and are looking forward to an ever-improved Secondary System. Our Resident Engineers will discuss our plans and funds with you at any time, They have been instructed to prepare the budgets for the coming year and will be conferring with you. Weather conditions during the period of survey were generally dry except for ~ inch of rain- fall on Saturday, September 2. There are eighty (80) homes in this subdivision. Six (6) homes were not visited due to absence of occupants. Seventy-four (74) homes were visited and questionnaires were completed by interviewing one or more adult members of each family. A copy of the questionnaire is attached as enclosure number 1. Homes in the subdivision were constructed during the period 1945-1958. Upon completion of the survey, and consolidation of results, it was deemed necessary to conduct a soil correlation of the areas in which soil and/or topography contributed to the malfunctioning systems. This study was completed and the results are incorporated in the report.• A consolidation of results are shown on the chart attached as enclosure number 2. Forty-two (42) of the seventy-four (74) homes covered in the survey were experiencing malfunctioning septic tank systems, either seasonally or con- tinually. Eighteen (18) of the forty-two (42) systems cannot be repaired due to soil and/or topography. The homes in this subdivision are nine (9) to twenty-two (22) years old. Since the original construction, seventeen (17) systems have been repair- ed. The normal life of a septic tank system, with proper maintenance, is approximately fifteen (15) years. The results of this survey reveal that an environmental health hazard does exist in this subdivision. Partial correction of the environmental condition can be made to twenty- four (24) homes of the forty-two (42) with failing septic tank systems. We purchased our home here in October, 1967 from Messrs. S. T. Wagstaff and D. A. Hodgins for the sum of $25,000. We questioned the well water before buying and were told the water was crystal clear. From the day we moved in, we have had nothing but trouble with our water. We were told later by our neighbors that the water had iron in it but to the best of our knowledge, there is more mud than iron. There is a filter on the incoming water supply. We change the cartridge in this at least once a week at a cost of $1.68 each. This alone will amount to $87.36 per year. However, even with this filter system the water is far from satisfactory. When clothes are put in the automatic washer, they will still come out streaked with mud. Our children do not even want to bathe or brush their teeth with this "muddy" water. In addition, we have the embarrassment of explaining this situation to guests who want a drink of water. We certainly feel when you purchase this price home, or any price home, you do expect to have a decent, usable water supply. We are not an isolated case. We know personally of ten families in our immediate vicinity that have to use these filters and have been told of many others. Some of these people have been here nearly three years and Messrs. Wagstaff and Hodgins still keep telling them the water "will clear up." Isn't there anything that Chesterfield County can do to protect the buyer from a situation like this? Why aren't the builders required to furnish a decent water supply? They are well aware of the problem in this area but still are able to get permits, build homes and sell to unsuspecting buyers. They built and sold four new homes in 1967 in this subdivision--all having the water problem. Some of our neighbors have been told that the accumulation of the mud and iron will eventually ruin the plumbing and heating systems. Most of the heating systems in these homes are the hot water baseboard type. There are 79 homes in the Forest Acres Subdivision and 4~ homes in Crystal Lake Farms. It might be well .to note that at a pre- vious meeting of the Board a resolution was passed by the Board on a four to two count, approving the county s entry into a Metropolitan Park Authority. Creation of such an authority is provided for by Section 15.1-1230. This section provides in part that such an authority may be created by ordinance or resolution, or by concurrent ordi- nances or resolutions if more than one political subdivision is involved. It further provides that the ordinance or resolution shall be published at least one time in a newspaper of general circulation, the purpose is to appraise the public and give notice of date for a public hearing. If at the public hearing csu~b_-...•- stantial opposition is heard, the Board may, in its discretion, call for a referendum on the question of establishing such an authority. If-such referendum is called for, it must be held not less than thirty nor more than sixty days from the date of adop- tion of the resolution. After much discussion, the ,committee agreed to make four recommendations in order of preference: PLAN I Paint all courts a cypress green, this would total to seven areas, Midlothian, Thompson, Elkhardt, Carver, Thomas Dale, Matoaca and Meadowb rook: This would complete construction of all the courts. PLAN II Paint three areas in green, Thompson, Meadowb rook, Midlothian. The remaining four would be painted black. PLAN]:III Paint three black (same one's mentioned in Plan II). These three must be painted to cover mistakes in previous paint. PLAN IV Paint one court green (Thompson Intermediate) the other two to painted black. The painting mentioned includes line working in each case. It should be noted that the cypress green color is double £he cost of the black paint. Mr. Burnett -2-. April 24, 1968 Mr. Terrell of School Board, Construction Department had a bid of $630.00 to paint an area 100' X 120' in green. This price includes the paint and labor. He also has a price of $35.00 to paint one court with the proper lines. In summery it will cost $700.00 to paint one area in green (2 .doubles courts). W I T N E S S E T H: That for the sum of One Dollar ($1) and other valuable considerations, the receipt whereof is hereby acknowledged, Com- pany releases and forever quitclaims unto County a portion of the easement on land in Chesterfield County, Virginia, granted to Com- pany by M. A. Coghill and wife by agreement dated December 7, 1946, recorded in the Clerk's Office of the Circuit Court of said County in Deed Book 304, page 533, which portion is described as follows: A 50-foot portion of said easement, the center line of said 50-foot portion being coincident with the property line dividing lands of M. A. Coghill and of Eddie A. Taylor as described in said agreement dated December 7, 1946. For the considerations aforesaid, Company further re- leases and quitclaims unto County a portion of the easement on land in said County, granted to Company by M. A. Coghill and wife by agreement dated July 22, 1949, recorded in said Clerk's Office in Deed Book 356, page 407, which portion is described as follows: , A 50-foot portion of said easement, the center line of said 50-foot portion being coincident with the property line dividing lands of M. A. Coghill and of Walter A. Horner as described in said agreement dated July 22, 1948. Company excepts herefrom and reserves unto itself, its successors and assigns, the right and privilege to construct, operate and maintain lines for transmitting and distributing electric power, upon such portions of said easements of right of way, in accordance with the terms and conditions of said agree- ments dated December 7, 1946, and July 22, 1949, until such time Baox 926 ?acF 391 as the lands upon which such portions of said easement are located have been accepted into the state highway system and ,the Depart- ment of Highways of the Commonwealth of Virginia has granted Company permits for the electric line facilities now located upon such portions of said easement of right of way, the permits to be upon the terms and conditions set forth in Form CE-6 hereto attached and made a part hereof. The remainder of the easements granted by said agree- ments shall remain in full force and effect.
