Dietsch, it is resolved that the minutes of A~ay 8, 1968 be and they hereby are airproved. This day and hour is the time set fcr public discussion on the proposed Capital Region Park Ruthority Ordinance. Nirs. John Dorsett, representing the Bon i~ir ~~~oman's Club speaks in favor of the adoption of this ordinance. Nir. Thomas ~;linston, ~;ttorney, speaks in favor of the Ordinance. P~ir. Richard Robertson, Executive Director of the Richmond Regional Planning Commission states that Richmond and Henrico have withdrawn the ordinances originally proposed so that Chesterfield county be a part of this park program and asked for unanimous support. Nirs. Jerry Finch asked for unanimous support and states that she is shocked at the lack of parks in the area. Nir, Zane Davis, Vice--President of the Richmond Regional Planning Commission urges caution in procedure but heartily recommends the County's coopera- tion in this program and states that the localities would have to pay only 20¢ of each dollar spent and Chesterfield would pay only 5a since it is one-fourth of the total population> Nirs. Thomas G. Harper, representing the idoman's Club of .Gon 13ir, state-s that we cannot afford not to join in this program. '. Nir. Jerry Jewett states that he realizes his minority status at this time but this issue is most important; the issue being can the Board of Supervisors govern the County or must it resort to an Authority. • He cites the Richmond-Petersburg 'l~rnpil:e Authority and the Richmond Nietropolitan Authority and states that local governments have given much of their power to these Authorities, that Authorities do things that Supervisors backed by citizens would not think of doing, that the citizens can talk to a Board but not to an 1~uthority and pleads finally that we do not need another level of government, Pir. J. K. Timmons states that the best thing the County has ever done was not to create a Sewer E=.uthority, that Chesterfield is now operating 1000 better than other governments in the area as far as utilities are concerned, that the best government is still the one closest to the citizens. He states further that the Board of Supervisors can do more for parks than any Authority, that most County people pay ~~ • i taxes to Richmond by way of licenses and sales tax and other fees, why shouldn't County people use the City's parks, He suggested that people provide their own recreational areas in some instances and that school yards could be used as playgrounds. Pocahontas and other parks be used for camping and other recreation but in no event to rely on the Federal Government to prcvide the money or controls to set up a Park System. Col. Hancock Reid states that the County should not turn over any of its rights to others and that he has great confidence in the Board of Supervisors. Nir. t-1. 4d. l~iorris, Bon Air, is impressed with the progress of the County without the service of authorities, that land should be reserved for park areas, that the City does not need to come out in the County since it is going to develop those islands in the James River, and that the County should develop its own park system under the jurisdiction of the r.Jo~aerning body, hir. Richard Robertson states that Richmond would not operate the Park Authority, that the State Highway Department did not relinquish its rights to the Richmond-P etc-rsburg To11 Road Authority, particularly, in the location of Rte. 6~, that the Board would not relinquish its authority in the County in that it can veto any project of the Park Authority within the County. Pair. Zane Davis states that the County should proceed to take care of its responsibilities before some other level of government takes over our responsibilities, Upon further consideration by the Board, P,r. Dietsch makes the following motion, which was seconded by lair. Ippersonc Be it resolved that the Ordinance concerning the establishment of the Capital Region Park .~thority, pursuant to the Virginia Park Authority's i;ct, be, and it hereby is adoptedo Whereupon, 1~Ir. Martin offers a privileged motion, which was seconded by 1'~ir. Browning: That the Park Authority Ordinance be deferred so that further efforts could be made to search out the truth. A vote being taken on the privileged motion- Yeas - P4r. NTartin, i:r. Browning and 1%ir. Hornar. Nays - Pair. Apperson, I~~.r. Dietsch and i!r. Purdy. Whereupon Plr. l~iartin withdraws his privileged motion and the original motion was again discussed. P~r. Apperson states that the Federal and State authority controls come into being when localities do not function. That it is not easy to find a plce for Scout meetings, that this is an o;~portunity to cooperate, that private capital will be limited with the 50~ tax increase which will result in limited land being given do the County for park purposese P'ir. Martin states that he ha~~ not found it difficult to find a place for Scout meetings, that there is plenty of areas not now being used. -2- Nir. Dietsch states that the-re have been cases in which the owners have denied the use of land for scouting purposes, that he is appalled at the limited areas available for such use, Mr. Browning states that there will be 800 scouts on the Albright farm this week and that Lake Chesdin will offer opportunities in future years, I~Ire Horner states thzt the County will lose its right of eminent domain for the expansion of utility systems if an :~.uthority purchases land in the County, that the City of Richmond blocked Chippenham Parkway for about one year without the Hi:hway Department or the City notifying the County, that the 18 member Park authority is too large and that such action is putting up a road block against the establishment of public parks in the County, that this is another spending group without the power of taxation, and that the County can estaalish its own indiv_dual Park Authority. Apperson, seconded by r:r, Purdy, it is resolved that the Treasurer's request to the Compensation Board for expenses during the fiscal year 1968-'69 be and it hereby is received. On motion of Nir. Apperson, seconded by ivir. Purdy, it is resolved that the request of the Gdillow Oaks Country Club for a pyrotechnic display on July 4, 1968, be and it hereby is granted. P`ir. George Farley a~jain comes before the Board ~n behalf of the citizens of the Elack Heath Subdivision in regard to their request to close Kilrenny Road, and requested that Kilrenny Road be closed temporarily and if so the citizens in .he area would not seek its abandonment. Mr. J.K.Timmons states that he is neutral since he owns a subdivision adjacent to it. It was further cited that the present construction of the road would deteriorate if the road were blocked for a long period of time and the County could not legally block a dedic~:.ted public right of way without abandoning same properly. r1r. Martin states that he sympathizes a gr•_at deal with the people in the area and wishes that he could work out some way to accomplish their aims. However, upon consideration whereof and on motion of T:r. Martin, seconded by 14ir. Apperson it is resolv~:d That :ilr~:nny Road remain open at this time. 68-36 & 37. Mr. Je~r. Keith again comes before the Poard seeking the rezoning from Residential-:agricultural to Residential-1 on a parcel of land of irregular shape fronting 1385 feet, more or less, on Rte. 711 and extending southwestwardly 2600 feet, more or less, to the Southern Railroad right of way and being 1200 feet, more or less northwest of Rte. 147. Refer to Sec. 8-16 pt. par. 1. -4- In Midlothian Magisterial District, Je Vdo Keith requests the rezoning from Residential-Agricultural to Local Business (C-1) on a parcel of land of irregular shape fronting 100 feet, mono or less, on Rteo 711 and extending southwestwardly 1150 feet to the Southern Railroad right of way and being 1100 feet northwest of Rteo 1470 Refer to Sece 8-16 pte paro 1, both of which cases were deferred from May 8, 1968a Mre Keith states that he does not want to re-argue the case in its entirety and is willing to restrict the use of the area sought to be zoned to a plan drawn by JoKaTimmonso Mro Fred Gray, Attorney for the opposition, explains that the new plat shows 20,000 square feet minimum with 120 fto frontage at the building line and states that the living area in each house will be at least 2000 feete He agreed that Niro Keith can restrict the land adequately and states that the business use can be done on a Use Permito tn'hereupon, Mro Keith states that he can restrict the use of the Club land to the same as that of the residential land in the went the club is not built, that he will not accept a Use Permit because in his opinion same is invalido Mre Gray states thgt there are other recreational clubs currently operating under a Use Permit and to avoid the issue at this time, may raise questions as to the legality of their operationsa Mro Lee Gordon, Commonwealth's Attorney, states that the Use Permit procedure is entirely legalo Mro JeJ,Jewett states that restrictive covenants could be rescinded by the parties to same, that the rights of creditors should be considered in the matter, that the restrictions will not benefit adjacent property owners and that said restrictions will terminate on a stated dated There are some 65 people present to protest the requested zoning, Mr> Timmons states that the people in the area want the recreational club to be built and most of them agree that certainly a Variance could be given to accomplish the aims of the developer in tk~e residential subdivision and yet keep the R-A zoning intacto Mr, Keith states he will not accept a Variance for a residential development and he will not accept a Use Permit for the recreational used He states further I~hat the Board can rezone the land back to R-A if he does not live up .to his agreemento Mro Jewett states that once substantial improvements have been made that the Board could not zone back to its original zoning and that the control of the property should be under the Board of Supervisorso After much donsideration, mire Keith finally agrees to accept a Use Permit, On motion of Mro Martin, seconded by MroBrowning, it is resolved that this Board grant a Use Permit for the operation of a private recreational club on the aforedescribed parcel of land, It was pointed out that the Board of Supervisors could not give a Variance from the zoning requirements, that this would have to be granted by the Board of Zoning fppeals, After much consideration of the problems of zoning the land to be developed in residential sites, it is on motion of Mro Martin,seconded -5 -. by NTr. Browning, resolved that the aforedescribed parcel be rezoned to Residential-1 with the understanding thar Nir. Keith will follow the plan presented and covenant to restrict the use of the lots in accordance with this plan. It is here noted thc..t P~ir. Dietsch votes No. On motion of NIr. Apperson, seconded by Nir. Browning, it is resolved that this Hoard grants a Variance from the Subdivision Ordinance to Nir. S. F. Sneed to allow the construction of a dwelling on a parcel of land between the end of Concho Road and Kingsland Creek. This day Ntr. John Hates comes before the Board presenting an agreement bettiaeen the County of Chesterfield and TIr I•_orton T•1. Zedd, with the request that the County vacate two drainage easements 10' wide dedicated across and under a portion of Elkhardt i-Iome Sites and particularly vacate that portion cf the two ea:>eri~ents located on his property and states that the drainage as relocated has been approved by the Engineering Department. ~. Upon consideration of this agreement and the accompanying plats filed with the Board's papers, it is on motion of Nir. Dietsch, seconded by Mr. Apperson, resolved that this agreement be approved and the Chairman and Clerk be and they hereby are authorized to sign said agreement. There was read a request from the School Board for an addition to the 196F3-'69 school budget in the amount of $40,000, of which the Vocational- Rehabilitation Department of the State will return to the County $30,000. Upon consideration whereof and on motion of PIr. Dietsch, seconded by i~ir. Apperson, it is resolved that the amount of the School budget be~increased :1;30,000 and if the School Board could not arrange to pay the extra $10,000 from other funds, the Board would consider this at a later date, It is here noted that Nir. Browning does not vote. There was read a resolution from the School l;oard requestin_ the sum of :~~7~3.00 for the purpose of paying to Central Accountin.; the cost of preparing and maintainin; payroll records for the School Board, Upon consideration whereof, and on motion of N1r. Purdy, seconded by Nir. Browning, it is resolved that this request be and it hereby is denied. There was discussed the matter of a change in policies of design criteria for subdivision roads and it was pointed out that under the recommended pavement design for secondary road construction revised iipril 24, 1967, that some subdivision roads would be constructed at interstate standards. Upon consideration whereof and on motion of 1~`:r. Apperson, seconded by N_r. Dietsch, it is resolved that this Board authorizes the installation of sewer mains in accordance oaith Alternate B so that the Reams Road School can be served in the most feasible manner. Approved as t.o form and legality by Commonwealth's Attorney WHEREAS, the Richmond Region is rapidly urbanizing wi~~. more and more land being converted from farm and woodland into resi- dential subdivisions and other forms of urban development, and with a population now exceeding 48,000 persons; and WHEREAS, the Richmond Regiona-~ Planning Commission has made a survey and repo~~~c in which it was found little, if any, systematic provision to preserve some of the natural landscape as permanent open space, as a result of which failure thc~c is now a serious and growing s::.,:~rtage of proper regional recreation areas and public preserves tc :..^.e et the needs of the expanding metropolis; and WHEREAS, there appears to be a considerable demand on the part of citizens and civic organizations for a region~:_ program of open space preservation and a desire to assist in such program by contributing lands and other gifts; and . ~.. ' ~ - 2 - WHEREAS, in order to meet a need of this kind, the General Assembly of Virginia has provided through the Park Authorities Act of 1950 for the voluntary creation by any two or more political subdivisions of a Regional Park Authority, having the powers necessary to provide for public open spaces on a regional basis; NOW, THEREFORE, THE COUNTY OF CHESTERFIELD HEREBY ORDAINS: 1. That the Chairman of the Board of Supervisors be and is hereby authorized and directed to enter into and execute, for and on behalf of the County of Chesterfield, the following agreement which is in all respects approved, providing for the cooperation of the County of Chesterfield in the creation of a Capital Regional Park Authority for the region lying within the boundaries of the County of Chesterfield, the County of Henrico and the City of Rich- mond as authorized by the Vi~~ginia Park Authorities Act (Chapter 27, Title 15.1 Code of Virginia of 1950, as amended) to be known as"the Capit~I Regional 'r'ark Authority, for the purpose of acquir- ing developing, constructing, operating and maintaining a system of Regional Parlcs within or partly within the geographical limits of any one or more of the political subdivisions composing the ••~ said Authority, and for the purpose of exercising other powers conferred by said Act in relation to the foregoing. 2. ARTICLES OF INCORPORATION OF THE CAPIT~L REGIONAL PARK AUTHORITY In compliance with the Virginia Park Authorities Act (Chapter 27, Title 15.1 Code of Virginia, 1950), as amended, the Board of County Supervisors of %~-~;~sterfield County, Virginia, the Board of County Supervisors of Hen-ri.co County, Virginia, and the City Council of the City of Richmond, Virginia, pursuant to a concurrent • f ~; - 3 - • resolution signifying their intention to create a regional park authority, which shall be a public body politic and corporate, hereby certify: (a) This Authority is formed under the Virginia Park Authori- ties Act; its name shall be "CAPIT¢~L REGIONAL PARK AUTHORITY" and the address of its principal office shall be Richmond, Virginia. I believe it is urgent that we join the Park Authority and participate in such away as to perserve our most precious scenic resources as parks for the present residents and generations ou residents to come. The citizens of Chesterfield County need parks. We need places and spaces to enjoy the simple and wholesome forms of outdoor recreation: hiking: (or simply strolling) in Nature, away from traffic; fishing in our beautiful rivers; canning and exploring along the waters; studying or merely enjoying the beauty and miracles of our natural landscape. We are blessed with areas of great and even unique scenic beauty. These areas in this time of mushrooming populations are coming to be regarded as merely square feet of real estate and their natural features as obstacles in the path of progress. Unless we act now to preserve them, all will be ultimate- ly bulldozed out of existence and built or paved over. The tragic fate planned for our exquisite James River South Shore is an example of what happens to scenic treasures that have not been appreciated or guarded;~°will be htripped of every tree and flowering shrub and buried deep beneath a hideous replica of the six lane New `'ersey Turnpike. The wall of green that now greets us as we cross over to Chesterfield County will be a barren stretch of concrete on an artifical wall. What could have been a glory will become instead a blight. If there is anyth:cng of beauty left along the shore, or any access feasible, it should be saved. Other areas, remnants of virgin forests and unspoiled water- ways should be considered for their value as natural parks. There are those who fear parks because of the mi"ority who might misuse them. They overlook both the feasiblity of guarding and maintaining parks and the needs of the responsible majority. If the argument that no one should have parks because a few would litter and vandalize is a valid one, then all of the community, state, and national parks in the country should be sold to developers and resort owners or used as public dumps. That parks have met~l: the needs of citizens elsewhere and have been successfully maintained is an example to us that we need not make our policies through fear. In an editorial in the May issue of Virginia Wildlife the editor points out," Honest, law-abiding, friendly people want,and need, access to the outdoors. They are the salt of the earth. The opportunity to enjoy a stretch of the river, some open skr, an uncluttered landscape, is their birthright...Denying the public access to the outdoors because of the misdeeds of a few misguided members is unthinkable." Another has said, "Today's heroes, honored by tomorrow, are those who Beak to preserve the rare scenic treasures of this country." •~. The actions you take today may have a lasting affect upon Chestefield County. The citizens of tomorrow cannot speak today on their own behalf. They cannot make this decision because if we wait the land will not be there. If anything is to be preserved it must be done now and well. You have the authority to do it, and the responsibilty, and the public trust. Chesterfield Court House Chesterfield, Virginia 23832 Dear Mel: RICXMON D, VIRGINIA 23219 This will confirm our conversation today regard- ing the joint use of utility trenches by Chesterfield County and our Department of Public Utilities. The Council Utilities Committee is prepared to recommend to the City Council that natural gas rates to Chesterfield County users be reduced to the same level as those for City customers. However, if we are prohibited or restricted in our use of Chesterfield County utility trenches for making gas ex- tensions, this would throw a different light on the subject and would undoubtedly make it necessary for the Committee to reconsider its proposed recommendations. If Chesterfield County will agree to continue to permit the joint use of trenches as in the past, I feel confident that the Utilities Committee and the Council will approve the reduction of natural gas rates for cus- tomers in your County. At the present time residents of Chesterfield are supplied gas service under Schedule RS-C. Customers within the City limits are supplied gas service under Rate Schedule GS-R. You will note that the minimum bill in the City is $1.20 per month and the minimum in the County is $1.36 per month. The rate blocks are also higher in the County than in the City. We have analyzed typical bills for a residential user with gas for heating and hot water and find a difference of approximately $16.00 per year between the City rate and the County rate. A small commercial store would have a difference of approximately $35.00 per year. Apartment units would have a difference of $13.00 per year. Larger users under Schedules SS-C and CIS-C would also have sub- stantial reductions if the City rates are applied. If Chesterfield will continue to permit the joint use of trenches and the use of utility easements, I believe that Council's Utilities Co~mRittee would recommend a reduc- tion in gas rates with the result in savings similar to those listed above for the citizens of Chesterfield. In addition to the savings in annual bills to customers, the subdivision developers would have less cost in the installa- tion of water mains since we share the cost of the trench, Mr. M. W. The use of one trench for two utilities also permits better use of the street for future construction and does not create problems with connections to the mains since the grades can be adjusted at intersections to avoid any conflict in tapping gas and. water mains. This procedure has been followed in Henrico County for over twenty years and will continue under our recently negotiated contract. I hope that you can discuss this matter with your Board within the next ten days. The consumer has installed and in regular use during the off-peak period equipment, which shall be described in the contract, having a gas-consum- ing capacity of not less than 3,000,000 B.T.U. per hour and agrees to use the gas supplied hereunder only in the operation of such equipment; 2. Gas delivered hereunder shall be separately metered and shall not be used interchangeably with gas supplied under any other schedule; . 3. The use of gas for boiler fuel shall not exceed 2,000,000 cubic feet on any day; provided, however, such limitation shall not apply to gas used for space heating or air conditioning; 4. The maximum daily quantity of gas to be delivered hereunder, expressed in cubic feet, shall be specified in the contract and may be increased only by the execution of a new contract. MONTHLY RATE: 4.5¢ per hundred cubic feet. MINIMUM MON'PHLY CHARGE: Each monthly bill for gas shall not be less than $225.00, except in months when the city delivers less than 500,000 cubic feet as hereinafter provided. When less than 500,000 cubic feet of gas is delivered in any month by reason of interrup- tion or curtailment of service by the city, the monthly bill shall be computed on the basis of actual gas delivered at the rate of 4.5¢ per 100 cubic feet. The term "month", as used in this section, shall be deemed to mean the period between any two consecutive readings of meters by the city, such readings to be made as near as practicable every thirty days. H., VA. 23832 May 23, 1968 Chesterfield County Board Supervisors Chesterfield C. H., Va. Gentlemen; It is necessary for me to again ask for additional funds to operate the sheriff's office. It appears some of the items in the budget were not set high enough at the beginning of the fiscal year to cover the expense of the office. There is $11,535.00 in the budget for salaries of the deputies assigned to the jail. Eleven thousand four hundred seventy one dollars and sixteen cents is needed to cover the fixed salaries of the ,jailors. The budget only allows $63.84 for part time help to relieve for vacation and sick leaves, already $1,122.40 has been spent for part time help, $1,000.40 before January 1, 1968 and $122.00 since January 1, 1968. It appears we will need another $286.00 to cover the salar~ie~ula~t the iail., X63 ` ~~~ of the $1,122.40 paid for part time help, the county pays oneltthird which amounts to $374.14. It becomes necessary to ask for $40.00 to cover the salaries of the deputies 8(, 2-IO`f assigned to the sheriff's office. We do not use part time help in this office to relieve deputies when sick or on vacation. This item in the budget was too low from the beginning. This department also needs another $42,00 to meet the vavroll of our office ~ ~ 2 '~D 9 secretary, This will include one day we owe for part time help when the secretary was out, due to death in family; and will allow for another day, if needed, between now and the end of the fiscal year. This department pays a part time secretary $16.00 per day of which the county pays one third ($5.33). We stand in need of $900.00 to cover medical expensesl of the prisoners through- Q ~ 3 -~I ~~ out the remainder of the fiscal year;~which includes approximately $450.00 in outstanding bills. The reason for our medical bills being so high is chiefly due to the increase in jail population and Long awaiting trials. All jail physicians have a service charge of $8.00 per patient and $7.00 for each additional patient treated.
