He recommended that the County ,along with the City of Richmond and the County of Henrico, also the Regional Planning Commission ,to ;JC responsible for the gatherin~ and up-dating of all data collected For this purpose, It was pointed cut that if the necessary data were not collected that ;! Martin, it is resolved that this Board approves the application of the Bellwood-Drive-In Theatre for a pyrotechnic display on July 4, 1968, provided it is cleared with the proper authorities. On motion of Nir. Dietshh, seconded by P=fir. :~pperson, it is resolved that the request for a pyrotechnic display by lair. Safferwich of the Dutch Village Town House be and it hereby is denied, due to the congestion in the area. On motion of rir. Browning, seconded by Pir. Niartin, it is resolved that this Board requests the Treasurer of the County too give to the Delinquent Tax Collector the 1966 Per:~onal Property bills as soon after July 1, 1968 as possible. On motion of Nir. Piartin, secondc-d by Mr. Purdy, it is resolved that the preliminary plans for the Health Department expansion be and they hereby are approved and the firm of E. Tucker Carlton and associates be authorized to complete the working drawings. -2- I • There were read a number of letter:; from various citizens concerning the recent stat`ments in the papers of the Board's proposed stand on the confinement of dogs. most letters were in support of this ordinance. Gn motion of 1`ir. Partin; sc-conded by 1`_r. Dietsch, it is resolved that the recommendation of the Fire Committee to purchase 1000' of hose for the ~iagstaff Fire Department be and it hereby is approved. There was read a notice that a public hearing would be held at the Bon Air Elementary School on July 2, 1968 at 9:30 r~.P:, to discuss the proposed Rt. 147 and Robious road intersection. On motion of I~:r. Dietsch, seconded by f•r. A:ar~in, it is resolved that the request of the- I-Iigh~:~ay Department for the County to seek permits fcr utilities on all roads before said roads are accepted into the State Secondary System be and it hereby is referred to the Commonwealth's Attorney for investigation, Gn motion of i~ir. Purdy, seconded by Pair. Dietsch, it is resolved that the Highway Department be and it hereby is requested to extend the 35-mph speed limit on Rt. 10 at Chester eastwardly to Parker Lane. On motion of I;r. Purdy, seconded by Pr. Dietsch, it is resolved that this Board authorizes the installation of 700 f t. of sidewalk in the Enon area on ?-Talnut Drive and charge same to the 32 ::oad Fund of the County. P~irs. Cline of the Penn Acres :iabdivision comes before the Board objecting to the operation of Plr. Hugh Hawthorne, who at present runs a business in said subdivision and stat:_s that the starting up of trucks in the early morning has wrecked her end of the neighborhood, that the debris is unsightly and detrimental to the neighborhood. P~lr. Hugh Hat~thorne states that he has purchased a lot on Rt.360 and will move as soon as he can comfortably do so, that P:rs. Cline has no real complaint and approximately eight (8) women from the Subdivision come in support of T~ir. Hawthorne. Nir. P`,artin apologies for not getting in touch with T~irs. Cline and letting her know that the problem had been solved and that I~~Ir. Hawthorne would move. No action was taken. Gn motion of Pair. Dietsch, it is resolved that the water contract AC-466 for North Gak Apartments in the amount of y7162.55 be and it hereby is approved. It _was reported that the cost of a portion of the Focoshock sewer line would be $265,000 of which approximately 1150,000 had been promised in prepaid connections. The County Engineer recommended most heartily that this portion of the trunk sewer be installed as soon as possible. On motion of P~r. Dietsch, seconded by ri4r. Partin, it is resolved that the County Engineer be and he hereby is authorized to install a trunk sewer line up the Pocoshock Creek to Turner Road, subject to the satisfactory guarantees from the individuals promising prepaid connections. Gn motion of }°!r. }~etsch, seconded y P;r. Furdy, it is resolved that the Treasurer be and he hereby is request:d to transfer the sum of X200,000 from the Sewer Service Installation Fund 76-360 tc the Sewer Improvement, Replacement and Extension Fund. -4- • • On motion of I~Ir. Browning, seconded by i``.r. Appersen, it is resolved that the Treasurer of the County be and he hereby is requested to appropriate the sum of X50,000 to the i7ater Operating Fund 61-210 from the unapt~ropriate surplus of said fund. There was a short di3cussion concerning the request of Nir. ~arles Stigall for the use of the County's water treatment plant at Swift Creek as a meeting place for the Central Q~esterfield Masonic Lodge. There was read a letter from N':r. Alan ICiepper, City Manager of the City of Richmond, requesting the County to reconsider its decision to disallow the use of a single ditch for both water and gas lines and promised an approximate 13`! saving to the County citizens 4Jho use gas from the City of Richmond. i`~ir. Painter states th,t in most other localities in Virginia the use of one ditch by these two utilities is not allowed and present~:d a list of thirteen reasons why the County should not allow the City of Richmond to install gas and water together in the County. There was no action taken by the Board to change its previous decision. On motion of ivir. Browning, seconded by I~ir. Hooper, et als for rezoning to Residential-2 on a parcel of land on 'i•Jarwick Roa 6jarwick :acres in T~lanchester District, is subject to which has not been completed. Fred Gray, Attorney, comes before the Board requesting the rezoning from iagricultural to General Business (C-2) in Dale P~agisterial District, on a parcel of land of irregular shape fronting 150 Tact on Hopkins Road and extending westwardly 814,27 feet along the south line of Bonnie Bank Road to the northeast line of Chipi~enham Parkway, being situated in the southvaest corner of Hopkins Road and Bonnie Banl: itoad. Refer to Sec. 52-11 part par. 3. r~ir. Gray states that the highest and best use of the land in question is for the expansion of the parkinc~ area for the shopping center, that Nieadowbrook Club does not object, that the owner would cut one tier of parking spaces and a driveway to same, and plant the approximate 50-ft~ in grass and shrubbery. i-ir. Fred Pack who resides at 5024 Prestonwood, states that he represents the Beachwood citizens and that a buffer zenc- was previously given for appeasement for the rezoning, that in the previous plan it vvas stated that the dwelling vaculd b~ constructed facing Bonnie Bank road and expresses concern for the undeveloped lots in the northeast corner of Prestonwood and Bonnie Bank Roads. He submits a petition signed by 114 citizens, 49 of whom reside on Prestonwood Road and presents a delegation of 8 perscns to oppose a shopping center, Pirs. Ed Ray opposes the proposed zoning. stating that a buffer zone had been allowed in the pravious zoning, that the minutes of the said meeting did not reflect the actual statements concerning the buffer zone. 1•'ir.Fr~ct Gray states it would be harmful to the traffic pattern to force all the people on Hopkins I:oad in order to get to the Shopping Center. 1`~ir. Apperson states that he is concerned about the covenant given to the neighborhood and th~~t the County should uphold this covenant. He states further that the Board should uphold the Planning Commission's decision. Pir. I~iartin and t~ir. Dietsch state that they have not examined the property in detail. On motion of 1~-ir. Apperson, seconded by t•ir. Browning, it is resolved that the decision without .debate be deferred to .7uly 10, 1968. -b- 68-38 I~ir. C. D. Kidd comes before the Board requesting the rezoning from :agricultural to General Business (C-2) in T•ianchestc-r NIagistarial District on a parcel of land of irregular shape fronting 340 feet, more or less, on German School P,oad and extending westwardly 315 feet, more or less, being 80 feet north of Rte. 60 and being presently zoned General Business for a tioidth of 220 feet from the southern property line. Lowell VeSmith comes before the Boar~.~ requesting the rezoning from hgricultural to General i~usiness (C-2) on a parcel of land of irregular shape fronting 75.5 feet on 4dar~~~ick Road and extending eestwardly 283 feet, being 350 r'eet south of U.S.Rte. 60, in Manchester Pacisterial District. Refer to Sec. 19-15 par. 12.1. There appearing no one in opposition to this request, it is on motion of iv.r. Dietsch, seconded by Nir. Tiartin, resolved that the aforedescribed parcel of land be and it hereby is zoned for General Business with the specific understanding that plans and spF.cifications will be approved by the County Planner and that the County a•,ill not maintain the narrow right of way north from 6~7arwick Road into the property in question. It is here noted that Mr. Rpperson abstains frorn voting. 68-40 Nir. 13. E. Harris, represented by 1`•iY'. George Farley, comes before the Boars requesting the razoniny from Residential-2 to General Business (e-2) on a parcel of land of irregular shape fronting 334.77 feet on Covington Road and extending eastwar:ay 200 feet, being 230 feet north of U.S.Rte. 60 in Manchester Tiagisterial District. Refer to Sec. 20-5 (2) lots 107 and 108. Mir. Farley st~aes that the area is not developed, that c10,000'will heve to be spent in piping Reedy Creek through the property. T•.r. and Mrs. Loser state they object to the rezoning because of the drainage condition of Reedy Creek and show pictures of water backing up and flooding the general area. It ~~~as pointed out that the Planning Comm:.ssion had red.ommended that the area south of the Creek only be approved for rezoning. Upon consideration whereof, and on motion of Mir._Dietsch, seconded by I~ir. Purdy, it is resolved th<:;t the aforedescribed parcel of land be and it hereby is rezoned to General Business as requested, provided p the plans,and site layout be approved by the County Planner, that the proper channelization of Reedy Creek be controlled by the :ngineering Department, that parking be on the south side only of Lot 107, and that a fence be placed on the north line of Lot 107, which would be - 7- mutually agreeable to the a~ner and the Panning Department. Deaner nor his representative is present. Upon consideration whereof, and on motion of Nir. Dietsch, seconded by I'~r. Nir. Joseph G. j;Joodfin and i•ir. David P. t-~oodfin, represented by D`:r. George Farley come before the Board requesting the rezoning from agricultural to General Business (C-2) on a parcel of land of irregular shape fronting 200 feet on U.S.Rte 360 and extending northwestwardly 240 feet being 1000 feet nor thea;st of ~valmsley Boulevard in Manchester r'iagisterial District. Refer to Sec. 39-12 par. 6. Mr, rarley pointed out that the property has been. used for business for 30 years or more and is presently non-conforming, that the Planning Commission had recommended a;~~~roval, that Pir. t;JOOdfin plans to raze the present building and is estopped from doing so under the present non-conforming use. N,.r. Dietsch states that this is spot or strip zoning and should not be allowed to expand. P4r. Graham Jennings states ih~t the character of the land involved prohibits its residential use and that the present owner put a life time in building the business and should be allo~~;2d to sell same. bJhe~eupon, P:r. Upon discussion of the question, I~r.tiJoodfin's counsel withdraws the application for rezoning. U~~on considera~~ion of which and on motion of P;.r. Dietsch seconded by I••ir. Piartin, it is resolved that this withdrawal of the zoning request be accepted. 68-21U. The application of T~~ir. Russell L.Connelly requesting a Use Permit _ in Matoaca 1`'~agisterial District to sell fertilizer was deferred to June 27, 1968 in the absence of anyone supporting this request. _9_ 68-22U, t-7r. Viers comes before the Board requesting a Use Permit to operate a television repair service in their home on a parcel of land of rectangular shape fronting 150 feet on Rte, 618 Bermuda Hundred Road and extending northwardly 30G feet, being 600 feet, more or less, east of Dau en Drive in Bermuda Magisterial District. Refer to Sec. 118-10 (5) lot 1. There appearing no one in opposition to this request, it is on motion of rvir. Purdy, seconded by Pir.Dietsch, resolved that the Use Permit to operate a television repair service be granted to Gorge T. and Janie C. Viers on the aforedescribed parcel of land, provided there be no outside signs displayed at any time. 68-23U. rvir. Richard L. and iorothy P. Shockley come before the Uoard requesting a Use Permit to operate a beauty salon in their home on a parcel of land of irregular shape fronting 107,47 feet on Triton Drive and extending westwardly 211.12 ft. being 96.04 feet north of Thor Circle and better known as 2410 Triton IX~ive in Niidlothian Magisterial District, Refer to Sec. 9-10 (2) Blk. C G lot 16. Mr. Shockley states that he will change his driveway to allow off-street parkin~~, there will be no signs and one operator, his wife. Nir. Thomas Thornton who lives in the area requested that the operatirn be limited to one chair and one operator and it apply to the owner only. On motion of Nir. Martin, seconded by Mr. Dietsch, it is resolved that a Use Permit for a Beauty Salon on the aforedescribed parcel of land be and it hereby is approved, with the understanding that there ieill be no signs, that the Use Permit applies only to the present owner and that there be no more than one operator and the site layout and plans be approved by the County Planner. Purdy, it is resolved that the Treasurer be and he hereby is requested to transfer the sum of X13.00 from 035-215 to 035-220 in the Data Processing Department. On motion of Nir. Apperson, seconded by T'ir,Browning, it is resolved that the Treasurer be and he herby is requested to transfer the sum of $111.S0 from the unappropriated surplus of the County to 052-319 for the purpose of purchasind} Judicial robes for the County Cburt. There was presented a letter from the Policemen's Pension and Retirement Board requesting some change in the basis appropriation from the County to said fund. On motion of rr. Dietsch, seconded by P:r.Apperson, it is resolved that this request be referred to the Police Committee of the Baard. On motion of D!r. Robertson, Executive Director SUBJECT: Continuing, Coordinated, and Comprehensive Transportation Planning Process This memorandum is written at the request of Mr. Burnett in an attempt on my part to explain what is required under the 1962 Federal Aid Highway Act in the Continuing, Coordinated, and Comprehensive Transportation Planning Process (CCCTPP). Once the Richmond Regional Area Transportation Study (R-RATS) has been adopted by each local governing body and the State Highway Commission, the Virginia Depart- ment of Highways (VDH) will work with representatives of this area to establish a CCCTPP. This is required by law and the failure to act would result in the elimination of federal- aid highway funds for all highway facilities in the urbanized area of the jurisdiction not agreeing to participate in this program. The CCCTPP may be established in one of two ways: (1) by separate contract with each political subdivision within this region, or (2) by a single contract with an agency such as the Richmond Regional. Planning Commission (RRPC), if that agency has been delegated by resolution of each local governing body as its representative in the CCCTPP. The VDH will not try and influence Iota{ judgement as to which approach it should elect over the other, but internally there is complete support for the regional one-contract approach, The main reasons for this arethe ease in coordination, uniform data gathering and forecasting techniques, a better assurance that the data needed will be received`~on time, and an elimination of much duplication of effort. __- _ _.. ~. ~ ~ 2. At the present time there are three urbanized areas in the Commonwealth which have signed agreements with the VDH and are participating in the CCCTPP. Northern Virginia is represented (along with the District of Columbia and Montgomery and Prince Georges County in Maryland) on a Transportation Planning Board (TPB) which has a per- manent staff operating out of the Metropolitan Washington Council of Governments (M-WCOG). The TPB itself has representatives appointed by the local jurisdictions of the two states and the District of Columbia, a{ong with state and federal representatives. There is a common memorandum of agreement which has been executed by each local government indicating that the TPB represents them in the CCCTPP with the several states. The Roanoke area (Roanoke, Salem, Vinton, and Botetourt and Roanoke Counties) is represented in the CCCTPP by the Roanoke Valley Regions! Planning Commission (RVRPC) and the Southeastern Virginia area (Norfolk, Portsmouth, Chesapeake, Virginia Beach, Suffolk, and Nansemond County) is represented by the Southeastern Virginia Regional Planning Commission (SVRPC). Thus, for all continuing processes established in the Commonwealth at this time in three of the four largest urban areas, a regional type agency is representing the local governments in the CCCTPP. As most of you may know I was employed by the VDH from June, 1958 through September, 1967, with asix-months leave of absence for service in the U.S. Army and anine-month and twenty-one month leave of absence with pay at two graduate schools. The U. S. Bureau of Public Roads furnished certain Instruction Memorandums to the VDH with regard to the CCCTPP, which were used as the basis for the establish- ment of that process. The development by VDH of just what data would be required in the CCCTPP and the form and content of the agreement were designed by three men - Mr. K. M. Wilkinson, Mr. J. P. Royer, Jr., and myself. Paul Royer handled the engineering considera;i~ns, I handled the planning considerations, and Mr. Wilkinson handled all policy decisions and had final approval of our recommendations. In the relations with local areas where the VDH was conducting major transportation studies, Mr. Royer was res}~onsible for engineering factors and I was responsible for planning factors. In April of 1966 this was further structured by creating two sections to handle the urban transportation program where one had existed before. Mr. Royer was in charge of the Urban Transportation Engineering Section from its creation and I was in charge of the Urban Transportation Planning Section from its creation. The reason I have given you a resume of sorts in the preceding paragraph is to point out that I do have one unique area of knowledge and ability to offer this metro- politan areas as Executive Director of the Richmond Regional Planning Commission. I submit that because of this and in conjunction with the normal advantages of having a regional agency represent the local governments in the CCCTPP, that the RRPC should be delegated the responsibility of representing each local government in the CCCTPP. ~: ~~ LJ 3. To this end, I have prepared and attached a proposed agreement which would be executed separately between each local government and the RRPC. Several of the data items have an asterisk ,because there is some chance that they will be eliminat- ed from the requirements of the CCCTPP in Virginia. I would appreciate your comments on this agreement at the earliest possible date. If agreeable, to each jurisdiction, a final and separate (but identical) agreement would be prepared for each locality to be represented by the RRPC and then each executed by the Chairman of the RRPC. These agreements would then be sent to the local governing bodies for final execution by signature after formal resolution agreeing to same. For your information I have attached a copy of the CCCTPP agreement and explanatory document executed between the SVRPC and the VDH, which is the latest agreement for a CCCTPP. This wil{ serve to explain in greater depth what is required by the VDH in its interpretation of the BPR Instructional iVtemorandums and the 1962 Federal Aid Highway Act. There are a number of important modifications which should be made in this document prior to the RRPC entering into its agreement with the VDH. I - ~ ~• ORDINANCE N0. 7-34 To empower and authorize the Chief of Police of Chesterfield County, or his designate, to make regulations for the preservation of the safety, health, peace, good order, comfort, convenience, morals and welfare of the County of Chesterfield and its inhabitants and to provide penalties for violation thereofo Whereas, there has been disorderly conduct, disturbances and disorderly assemblages in public places within this County which constitute a danger to the safety, health, peace, good order and welfare of the citizens of this County. Whereas, the aforesaid acts commenced on the evening of Monday, April 8, 1968, and have persisted and continue to exist all of which present a clear and present danger to the citizens of this County, and their property; NOW THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD DO HEREBY ORDAIN: That the Chief of Police, or his designate, is hereby authorized and empowered to regulate, restrictior prohibit any assembly of persons or the movement of persons and. vehicles in the said County and said power and authorization shall include the banning of persons and/or vehicles from the streets and sidewalks during such hours as said Chief of Police, or his designate, may deem proper in the necessary protection of persons and property. Burnett, Executive Secretary County of Chesterfield Chesterfield Courthouse Chesterfield, Virginia Dear Mel: Subject: Use of County Water Trenches for City Gas Lines Your letter of May 29 contained disappointing news. We had hoped that the Board of Supervisors would agree to continue to allow the City to use County Water Trenches for the installation of gas lines. We are at a loss to understand Mr. Painter's position in opposition to this practice. We have had joint use of trenches within the City and in Henrico County for years with great advantage. Anticipating that the Board of Supervisors would grant approval for continued joint use of water trenches , we introduced on May 27 amendments to existing rate ordinances which would reduce the rates to Chesterfield County natural gas consumers to the same level of that charged to City customers . This places us in quite a quandary since it obviously is going to be more expensive for us to serve Chesterfield County's customers if we have to provide our own trenches. We would like very much to offer this substantial reduction in rates to the citizens of your County who use natural gas . As you know, it will amount to approximately 13 per cent on the first $12 .00 of gas con- sumed. However, the time is drawing near when I will be receiving an appropriation from Chesterfield County on be- half of the Richmond Regional Planning Commission. For that reason I would like to receive a firm estimate from your office. Based on a statement from your office I estimated the July 1 , 1968 population figure for Chesterfield County to be 118,000. However, I have always maintained that if your official estimate is different from this, the Commission will accept a different estimate. Please send me, as soon as possible, the official estimate of population in Chesterfield County for July 1, 1968 as used by your office. This is the figure which will be used in determining Chesterfield County's appropriation to the Richmond Regional Planning Commission, which is in accord with each of our member jurisdictions. This figure will be supplied to the appropriate state and federal agencies by the Richmond Regional Planning Commission as your official population estimate for July 1 , 1968. An Ordinance to vacate an alley in Bon Air, said alley being approximately ' 220 feet in length and approximately 20 feet in width and lying 188 feet . southwest of the intersection of Larkspur Road and Buford Road. - t WHEREAS, the Board of Supervisors of Chesterfield County on its own motion desires to locate an alley in`Bon Air, said alley being approximately 220 feet.in length ,and approximately' 20 feet in width, lying 188 feet south= E west of the intersection of Larkspur. Road 'and Buford Road: Now, Therefore, Be It Ordained by the Board of Supervisors of the County of Chesterfield 1. That pursuant to Sec. 15.1-364, Code of Virginia, the alley, being approximately 220 feet in length and approxim.atel.y 20 feet in width, lying 188 feet southwest of the intersection of Larkspur Road and Buford Road is hereby vacated, reference being made to the plat attached hereto and made a portion hereof for a more definite description. Ths'Ordinance shall be in full force and effect in accordance with Section 15.1-364, Code of Virginia 1950, as amended, and a copy hereof shall be recorded in the Clerk's Office of the Circuit Court of Chesterfield County.
