Connelly, comes before the Board requesting a Use Permit to sell fertilizer and other related materials in conjunction with a nursery on a parcel of land of irregular shape fronting 600 feet, more or less, on Hickory Road, (Rte. 628) and exte~iding northeastwardly 2820 feet, more or less, and being 5100 feet more or less ,, northwest of Southlawn i~venue in Nlatoaca Magisterial District. Refer to Sec. 181-2 par. 12 ~: 13. There appearing no one in opposition to this request, it is on motion of Mr. Browning, seconded by Nir. Martin, it is)resolved that a Use Permit for the sale of fertilizer on the aforedescribed property, be,and it hereby is .granted. 68-2n U.P. Nlr. Richard L. ilotley comes before the Board requesting a Use Permit to oper:ae an auction barn on a parcel of land of irregular shape fronting 1750 feet, more or less, on the north line of Iron Bridge Road (Rte. 10) and 2300 feet, more or less, on the east line of Challcley Road, being situated on the northeast corner of said inter- section in Dale Magisterial District. Refer to Sec. 11~-7 par. 5. There were presented petitions sined by a large number of citizens signifying they have no objections to the requested Use Permit. Upon consideration whereof, and on motion of Mr. Purdy, seconded by Nir. Downing, it is resolved that a Use Permit to operate an auction barn on the aforedescribed parcel of land be and it hereby is granted to Nir. There was a short discussion concerning the cost of an addition to the Library Building which was reported to be much higher than the original estimate. It was generally agre..d that tl;is matter be checked more thoroughly before any action is taken. Them was read a resolution from the School Board requesting the interfund transfer of X25,000.00. Gn motion of Nir. Purdy, seconded by Mr. Dietsch, it is resolved that the Treasurer of the County be and he hereby is requested to transfer $25,000 from 17b (Instruction) to 17d(Auxiliary ~.gencies) in the School Budget. Dietsch, it is resolved that the Treasurer of the County be and he hereby is requested to transfer $36,000.00 from 17b(Instruction) to 17d 'cafeterias) in the ~cl~ool budget. There !vas read a letter from the Honorable David E;. .Satterfield, III, who reported that the funds for the County Nursing iiome had been released by the Federal Gov:~rnment. Upon consideration whereof, and on motion of lvir. Purdy, s:.•conded by rlr. P~iartin, it is resolved that this Board expresses its thanks publicly to the Honor able David E. Satterfield, III, for his diligent and effective representation to the County of Chesterfield, particularly in the rescue of the Nursing Home Funds. Nir. Richard Robertson comes before the Board indicating that the Richmond Regional Planning Commission has several objections to the Rt. 147 project and suggested that the County go on record with the Highway Department concerning said objections. Gn motion of I-ir. Martin, seconded by Mr. Dietsch, it is resolved that -3- the Executive Secretary be authorized to inform the Highway officials of the reservations held by the County concernin. the proposed plans of the Rt. l~'_~7 project. Nir. Conrad Bareford, representing the majority of 108 Beer Licensees in the County comes before the Board requesting that the hours for the sale of beer be increased to 12:00 midnight. Also on Srnday from 12:00 Noon to 12:00 Midnight and states that restaurant oGVners and beer sellers are put at a disadvantage where many of the adjacent areas allow beer to be sold on Sunday and to 12:00 o'clocl: midnight, that the extension of time in Qzesterfield would be a convenience to the County citizens, a ::;oom to licensees, more revenue to the County , would further control bootlegging, would tend to reduce accidents on the highways, and v:ould cause fewer beer cans to be thrown on the highways. NIr. G. ~~~arthen Downs, Attorney, states that many customers leave early to go to adjacent localities due to the early closing of alcoholic sales and states further th~~t he has several thousand petitions but does not present same at this time. Nir. Fidocl from the Buford Road Shopping Center, states that the County wants to be independent from other localities, lengthen the hours for the sale of beer and let the County people stay in the County. Nir. Martin states that he came prepar d to vote against such a proposal but believes now that: some injustice exist. Upon consideration whereof and om motion of Pir. Purdy, seconded by Nir. Dietsch, it is resolved that this Board request the Commonwealth's attorney to draw an Crdinance to cover the requested hours for the sale of beer and wine end that said ordinance be advertised for public hearing on July 15, 1968 at 7:30 P.NI. Nir, Parl Grcutt presents pictures of s~ver~a schools in the Manchester District and states th~.t most of the children in his area have to go to P-idlothian to practice baseball and requested that the County do something in the way of improving school sites for baseball and football little leagues. Gn motion of 'ir. Dietsch, seconded by Nir. Purdy, it is resolved that a Committee be organized if the School Board approges, which Committee would formulate plans for the increased use of school grounds as recreation areas, Che Chairman asked each Supervisor to brinr~ a suggested name as a possible Committee appointee, to the next meeting of this Board. The County Engineer states th~.t there were. some 58 notices sent to the owners in the proximity of Forest ilcres requestin;~ that they conne~Et to a proposed water system. Thirty-nine out of the original 54 home owners requesting water service returned signed contracts. Upon consideration whereof, and on motion of P•ir. Martin, seconded by Pair. Dietsch, it is resolv~;d that the County Engineer be and he hereby is authorized to install water lines in Forest f.cres as per the plan of the Engineering Department. -4- u On motion cf ri_r. Purdy, seconded by I`ir. Browning, it is resolved that water contract 136-B for the installation of water in the Fan Court Subdivision, Section 7, be and it hereby is approved. On motion of i"_r. Browning, seconded•by Pir. Purdy, it is resolved that contract C-483 for the installation of water on Piedmont Avenue in the amount of $13,949.OObe and it hereby is approved. There arose a discussion concerning, the installation of a 6'' water main on Downland i2oad in which 7 families agreed to ;;ay $300.00 connection, the total cost of the project being $3800.00. On motion of I~r. Browning, seconded by I~:r. Purdy, it is resolved that additional information be secured before action is taken on this request, Cn motion of 1`ir. Purdy, seconded by i~ir. Bro~,ming, it is resolved that the following sewer extensions be and they hereby are approved: 5-6816-D - idestover, South 5-6828-D - Chippenham 3zoppinc Center, Phase 1. 5-6829-D -Garland Heights 5-6830-D - N:eadowbrook, :lest, Section "F" There was held a discussion concerning the easements for 6leinstein on Reedy Creelc and it was generally agreed that the County should help. in this situation insofar as possible by requesting the Engineer to get a firmer plan for this project. The County Engineer reported that the City of Colonial He-fights had requested a hearing by the 4Jater Control Board on the County's request for the installation of a sewage lagoon which would empty into the Gld Town Creek. On motion of I•:r. Purdy, seconded by Pir. Browning, it is resolved that the County Engineer be authorized to issue the following permits for underground utilities tor:he stated companies: The CS:P Telephone Company -(Installation of underground cable and conduit) 1. London Square Apartments On motion of I°ro Purdy, seconded by I~ro Dietsch, the following resolution is adopted: Be it Resolved by the Board of Supervisors of the County of Chester- field, Virginia, in regular meeting assembled that the Chairman of said Board, be and he hereby is authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, and to sign same on behalf of said County, whereby said Railroad Company gr ants unto said County the right or license to instc,ll and maintain, for the purpose of a ~a;.ter main, a line of 16-inch asbestos cement pipe across the right of say anti underneath the main track of said Railroad Company at Chester, Virginia:, as more particularly described in said agreement, which agreement is dated i~iay 31, 1968, a copy cf urhich agreement is filed with this Board of Supervisors. On motion of 1`Jir o Broti-aning, seconded by I•'ir o 'urdy, it is resolved that the Treasurer be and ha her._by is requested to transfer to the Utility ~;orkmen's Cornpenseaion Fund (83-01) the sum of :5284e50 from Item 64-240-213.0. i~nd be it further resolved that the followinc~ sums be transferred to the Utility Liability Reserue Fund (89-01) the following amounts from the stated accounts: 66-260-211.1 71-310-211,1 76-360-211.1 $1000.00 5199.57 50.00 56,249.57 On motion of 1"iro Purdy, seconded by I~iro Browning, it is resolved that the amount of 510,576.00 be appropriated from the unappropriated surplus of the Seu!er Debt Fund to the Sewer Debt Fund (72-320-803). And be it further resolved, that the sum of 55000000 be appropriated from the unappropriated surplus of the 'eater Gperating Fund to the -6- • beater Operating Fund (61-210-406). On motion of I°Tr. Martin, it is resolved that the Treasurer of the County be requested to increase the a a:ropriation of the stated amounts from the unexpended surplus of the beater Improvement, Replacement and Extension Fund (63-230) to the follocaing categories: $310,000 to Construction contracts - 63-230-234 175,000 to Materials ~: Supplies - 63-230-323 Gn motion of T~~r. Dietsch, it is resolved that the Treasurer of the County be and he her:_by is requested tc borrow on a short term basis in anticipation of the sale of the approved water bonds up to $500,000 for the Improvement, Replacement and Extension Fund for the construction of water trains as the money is needed. Shat Chapter 7, Section 7-2, paragraphs 1 and 2 of the County of Chesterfield be and they are hereby amended and reordained to read as folbws: SECTION 7-2 SALE AND CONSUMPTION OF BEER AND WINE PROHIBITED DURING CERTAIN _ HOURS OF EACH DAY; PENALTY FOR VIOLATION. It shall be unlawful for any person licensed under the provisions ` of the.Alcoholic Beverage Control Act or his agents, servants, or employees, to sell beer or wine or permit the consumption thereof- - on the premises mentioned in such -license between the hours of 12:00 P. M, and 6:00 A. M. of each calendar day. Each such offense shall constitute a separate violation punishable by a fine not exceeding five hundred dollars or by confinement in jail not .exceeding twelve months, or both, in the discretion of the jury or of the trial justice or of the court trying the _ case without a jury. Brooks, Jr. to serve a two year term on the Board of Directors of the Richmond Metropolitan Authority beginning on the first day of July, 1966 and accordingly, his term of office will expire on the last day of June, 1968. It would therefore seem appropriate for the Board to give the matter its attention in the near future. §33-255.4+:12 of the Act creating the Authority provides for the new term of office to be for a term of four years and until a successor has been appointed and has qualified. I might also say that Mr. Brooks is eligible for reappointment should this be the pleasure of the Board.
