Lancaster the good Vaishes of the Board of Supervisors. Upon furtha~r consideration and on motion of T..r. Apperson,seconded by T~:r. I~':artin, it is resolv~d that this Board publicly expresses its aT>preciation for the many courtesies shown the County by Nir. Lancaster and thanks him for his cooperation in the past ten years of service in the County. The Board states its best wishes for his continued success in his new position. The Executive Secretary read a resolution from the Sci.ool Board requesting that a water line be extended so that the High School in T~iidlothian could connect to the County's water system and it was cited that this line was in progress and would be bid very shortly. On motion of Nir. Apperson, sc-conded by Pir. J~:nnings on the site, The natter of acquiring a quit•-claim decd from the Commonwealth Gas Company across ~ o~bill load comes before the Board anti it was cited that the Gas Company had requested rather extensive construction to safe guard the gas line in question. Upon consideration whereof, and on moticn of PAY'. Apperson, seconded by P•~r. Browning, it is resolved that the Executive Secretary be authorized to eJrite a letter to the Ccmmon~a~alth Gas Company offering a V~~riance from the rcatrictions r:~quirad in said quit claim. There was read a letter from the Highway Department stating that the requested 45mph speed limit on Rt. 10, between Jessup Road and Belmont Road had ..een denied. Upon consideration whereof, and on motion of Mr. Apperson, seconded by l~s.r. Purdy, it is resolved that this Board requests the Highway Department to in~tull a 45 mph speed limit on Rt. 10, bet,•:een Chippenham Parkway and Belmont Road, - 2- r~ u There was read a letter from Nir. J.E.Har~•aood, Deputy Commissioner and Chief Engineer, Virginia Department of Highways, stating that he agreed with the Board's request to defer further improvements on Rt.147, between ~,.ioodmont and Ia.360, and to promote the further improvements on ~ ippenham Parkway. The Highway officially notified the County that North Pinetta Drive, from the end of maintenance of Route 755 at the intersection of Routes 755 and 2070 and running south 0.42 mile to Route 60, in the Brighton Green Subdivision, fictions 6 and 8, had been taken into the State Secondary System of roads. There was read a lettc_r from the Highway Department stating that the Board`s request for sirnal licPubs at the intersection of Rt. 10 and Bryce Lane and Itt.360 and Bryce Lane was denied. On motion of Pir. Broeming, seconded by Pir. Martin, it is resolved that the Engineering Department make a study of Bremo Street and make recommendations to the Bo:~rc9 of Supervisors concerning its improvement. On motion of I~~r. Purdy, seconded by A:r.Broumin;, it is resolved that water contracts AC-315C-Park Lee Apartments in the amount of $12,676,00 and A-432C-Meadowbrook +-ves , Sction "F '° in the amount of b10,153.00 be and they hereby are approved. Vircinia Gordon come before the Board and iir< Hull presents a le~tcr outlining c,.rtain cha.ng~s in the handling of voter registrations in the County> It was pointed out th;:t the pres:~nt system was expensive and somewhat cumbersome and the office of the Central Registrar should bc_ changed to the office of the General .egistrar and a.ll Precinct Iregistrars would 'b :. classified as ,-assistant -registrars, each would be able to handle all registrations, howevar, transfers ---.nd absentee applications which bare to come through the General Registrar's office. All records would bo kept in the General r.egistrar!s office. H` further outlined a program for mass registrs.tion b=:ginning ijugust 24 ~Cnd ending Sept.28, 1968, using the facilities of the ir:= Department and a Trailer at the Southside Plaza. The allocation of funds for the inst_..llation of sewer projects cn Covington road, Lancers ,~oulevard, Pocoshock Creek and l,eams lead School were discussed by the County Engineer. It was generally agreed that these projects would be financed by sewer bond funds. -4- • On motion of iar. Apperson, seconded by l~~~r. i`,artin, it is r~:solved that this bard request the Commonwealth's i~.ttorney to advise the Hoard of the County's right to acquire adjacent localities to got pcrrnits before installing utility lines in the County's str~cts. There was read an exchang^ of letters betcae~~n the ~eriff and the Executive Secretary of the Compense,tion Board concerning the use of the Sheriff's car in the operation of the Sheriff's office. It was generally agreed that the Executive Secretary write to the Sheriff in-L-owning him of the County's policy concerning th~a use of County cars. On motion of Tir. P'iartin, seconded by P~ir. Purdy, it is resolved that the Treaurer of the County be and he hereby is requested to transfer the sum of X2550.00 from 061=102 to 061-400.1. ~`.nd the Treasurer is further requested to transfer the sum of :5000.00 from the unappropriated surplus of the Gener~_1 Fund to 061-400.1 in the budget of the Police Department. On motion of P.r. Apperson, seconded by P.r. i.artin, it is resolved that the Trea_~urer of the County be and he hereby is requested to transfer -9- • • \ the sum of $540.00 from the unappropriated surplus of the General Fund to 104-249 in the County Planner's budget. And be it further resolved, that the sum of $15,000,00 be appropriated from the surplus of the County Planner's budget in order to pay the Richmond P.egional Planning Commission. On motion of Phr. Browning and P~~r. A4artin, seconded by Mr. Apperson, it is resolved that the following Ordinance be approved for advertising for a public hearing at 7:00 P.P1. on September 9, 1960. AN ORDINANCE to repeal Chapter 2, Article 3, Sections 2-5.2 and 2-5.3 and to amend and reordain Section 2-5 to prohibit dogs from running at large in the County of Chesterfield, and Section 2-5.1 to provide for the i~apoundment of said dogs in violation of Section 2-5, and Section 2-11 to provide foY• a dog license tax, and Section 2_14 to provide for confinement and disposition of dogs. That Chapter 2, Article 3, Section 2-5 and Section 2-5.1 of the Code of the County of Chesterfield be and it is Hereby amended and reordained to read as follows: Section 2-5 DOGS RUtJNING AT LARGE It shall be unlawful to permit any dog to run at large within the boundaries of the County at any time during any month of the year, For the purpose of this section, a dog shall be deemed to run at large while roaming, running pr self-hunting off the property of its owner or custodian and not under its owner's or custodian's immediate control. It shall be the duty of the Dog Warden, Deputy Dog 6~?arden or Police Officers to enforce the provisions of this ordinance, and any person who permits his dog to run at large shall be deemed to have violated the provisions of this section, and shall be liable to a fine of not less than five nor .more than twenty-five dollars for each violation. Section 2-5.1 Ih1POUNDNIENT OF DOGS IP7 VIOLATION OF SECTION 2.5 It shall be the duty of the Dog Warden, Deputy Dog V;Tardens or Police Officers of the County of Chesterfield to cause all dogs found running at large in violation of Section 2-5 to be caught and penned up in the County Dog Pound. The Dog TrJarden, Deputy Dog T.~aardens or Police Officers shall rzal;e every effort to determine ownership of tl:e confined dog and notify the owner of its whereabouts. 2. That Chapter 2, Article 3, Section 2-11 of the Code of the County of Chesterfield ;3e and it is hereby amended and reordained to read as follows: Section 2-11 LICENSES ; TERP~i; FEES It shalt be unlawful for any person to o~an a dog four months old or over, unless such dog is licensed, as required by this section, Dog licenses shall run by the calendar year from January first to December thirty-first, inclusive, and the license tax shall be payable -10- • s on or before February 1 of each license year at the office of the County Treasurer and shall be as follows; Male-For a male dog, three dollars Unsexed Female _ For an unsexed female dog, three dollars Female - For a female doq, twee dollars Kennel, for twenty dogs - For a kennel of twenty dogs, fifteen dollars Kennel, for fifty dogs - For a kennel of fifty dogs, twenty five dollars. Funds collected in the enforement of this section shall be disposed of in the same manner as dog license fees, 3. (a) The Dog ?Darden strall cause to be constructed and maintained a pound or enclosure and shall require dogs running at large contrary to the provisions of this chapter to be confined therein. Any doq c:~Y,ich has been so confined for a period of ten days and has not been claimed by the owner thereof may be destroyed by the Dog Warden or otherwise disposed of in accordance with this section; provided, however dogs confined with tags shall not be destroyed until the .owner of such dog has been notified in writing by certif ied mail at least fifteen days prior to the destruction of the dog. Such notice requirement shall be deemed sufficient when mailed to the owner's address as it appears on record in the County Treasurers Office. tb) Any dog found in tyre County not vaccinated or not wearing an authentic vaccination taq or license tag as provided in this chapter shall be impounded by tY'ie Doq Warden, Deputy Dog Warden or Police Officer. (c) Any dog confined under any of the provisions of this Chapter may be redeemed by its owner at any time after confinement, if such dog has not been otherwise disposed of under ttre provisions of this section, upon payment of tyre proper fees, Pdo doq shall be released to any person claiming ownership until proof of current dog license receipt or tag and current valid vaccination certificate are presented, and by payment to tPre Doq FJarden of a fee in the amount of $1.50 if claimed dur- ing the first 24 hours of impoundment and $.50 for each additional day thereof ter . It is here noted that Mr. Horner votes No. -11- There was read a letter from Pir. P+I. W. Cosby requesting the right to dump in ttie Chesterfield landfills. It was generally agreed that this matter would be handled in routine fashion and an investigation be made of paying Personal Property Taxes on moving vans in question. There was discussed a proposal for parking spaces upon the completion of the new Court's addition. It was generally ae~reed that approval would be sought from the Hightaay Department. On motion of Pir. Martin, seconded by P.r.Purdy, it is resolved that Chesterfield County Board of Supervisors is in substantial agreement with the proposed alignment and design of: Route 147 - Project 0147-020-101 P.oute 711 - Project 0711-020.140 as presented by the Virginia Department of Highways on July 2, 1968, This resolution is passed to show the Board's support for the projects as presented and does not Change the July 10, 1968 resolution of the Board asking for a lower priority on these projects. A discussion was held concerning the request to purchase Post Office boxes for each Department and a further study caas requested on this matter. On motion of Mr. Browning, seconded by PRr. Purdy, it is resolved that the appointments of the Chairman of P-ir. f~artin and Mr. Apperson as additional members from the Board of Supervisors to the P.ichmond Regional Planning Commission be and it hereby is approved. On motion of tor. Martin, seconded by P9r. Apperson, it is resolved that the Building Inspector be and tae hereby is authorized to issue a bLiilding per- mit to Pair. Trammel who requested the right to construct a dwellinr~ on an unimproved section of Lucks Lane, subject to the granting by Mr. Trammel of sufficient right of taay for the construction of this road. On motion of Mr. Apperson, seconded by N~;:. Purdy, it is resolved that this Board request the Highceay Department to study the intersection of Selwood and Vauxhall roads and to erect a Stop sign to eliminate the traffic hazard presently existing. There was a brief discussion on the Committee to be appointed to promote the establishment of an airport in the County and it was generally agreed that a list of names would be presented by P4r. PRayo at the next meeting of the Board. On motion of PRr. Browning, seconded by Fair. Manuel Purchasing Clerk P.e: Bid For Accident Insurance For Volunteer Firemen By Ball-Martin Insurance Agency, Incorporated, 108 Cowardin Avenue, Richmond, Virginia Dear Mr. Manuel: T•;ith reference to your letter of June 12, 1968 enclosing the bid referred to in caption, we would like to explain first of all that rates for this type insurance are not regulated and there are no filings of such rates in this Bureau. The form and the rate are promulgated by the insurance com- pany concerned and obviously the bid of the successful bidder should agree with the policy issued as a result thereof. In checking the paper you submitted, we notice there is no insurance company named in the bid by Ball-Martin Insurance Agency, Incorporated but there was attached to the bid a brochure pertaining to "The Hartford`s Accident Insur- ance for Volunteer Firemen" which gave the basis for the premium calculations. Ede rechecked this entire matter with regard to the premium calculation and found that the annual rate bid price of $5600.00 and the three year premium bid price of $15,000.00 did not agree with the specific details. Therefore, we contacted The Hartford Insurance Group to determine whether the bid per- tained to some other company in the group rather than Hartford Accident and Indemnity Company. I have been advised by our Traffic and Planning Division that a detailed study was made of this section on March 5th and 6th of this year. This included the geometrics of the road, the accident rate and a speed check. Based on this detailed study and a review of the infor- mation with the State Police, it is recommended by Traffic and Planning that speed limit be retained as a 55/45 mile speed zone. J.\~- Thank you very much for your letter of July 12, We quite agree with the Board. of Supervisors of Chesterfield County that the need for upgrading Route 150 in Chesterfield County, Chippenham Parkway, is more urgent than the need for improving the section of Route 147 between Woodmont and Route 60. It is, therefore, our plan to defer-any further projects on Route 147 between Woodmont and Route 60 and proceed with the widening from the Huguenot Bridge out to the vicinity of Woodmont. Studies are now under way on Route 150 and priorities are being established and I am sure the State Highway Commission will give every consideration to the need. on this road in relation to the other needs in the Richmond District, Certainly there is no question but that this need. is urgent. Only a;~:o of theca could possibly be prevented by a signal.. ` .. lne general volume warrant for signals at the two intersections studied wary somewhat. At Route l0 and Route 1647 the minimum volume require- ment is an average of 500 vehicles per hour entering the intersection on the major route for at least 8 hours, while at the same time at least 150 vehicles m~.xst enter'on one leg of the minor route.. The volume warrant at the intersection of Route 360 and ,Route 1647 is increased to an average of 600 vehicles per hour for B hours on the major route whiz a aninis~wn of 150'.Vehicles per hour on the minor approach. The . difference is caused by the additional lanes on. Routes60. Accident warrants are satisfied when five or'nwre accidents of the type susceptible to correction by a traffic signal occur at the inter- - section within a 12 month period. Considering the precedir_g .information, traffic signals are not warranted at either intersection) therefore, it is recommended that . the request be denied. ', WHEREAS the County heretofore entered upon and took possession of the parcels hereinafter described after first deter- mining the necessity of the project and the necessity of beginning construction'of it promptly; and after giving due notice by regist ered mail to the hereinafter named owners of the property and rights of way the County intended to enter upon and take, which notice set forth the compensation and damages offered by the Coun to each property owner; WHEREAS none of the property owners contested the County's taking in such fashion within thirty (30) days after receipt of notice of the County's intention to so enter upon and take the property prior to institution of condemnation proceedings, nor have any of the property owners contested the County's entry and possession as of this date; WHEREAS the County and the landowners hereinafter named (were unable to agree as to the compensation and damages caused by such taking, and the County instituted condemnation proceedings after paying to the Clerk of the Circuit Court of this County for the benefit of the respective landowners such sum as .this Board estimated to be'a fair value of the easements taken and damages done; ' WHEREAS the condemnation petitions filed against the landowners were each dismissed on the ground that the County did not first .make a bona fide Affort to purchase the rights sought; ' WHEREAS the Supreme Court of Appeals of Virginia has denied he t County a writ of error to the action of the Circuit Court of this County in dismissing the condemnation proceedings; „~V WHEREAS the County desires to make new offers for the rights sought and to proceed promptly with condemnation if agree- went with the owners cannot be reached, NOW, BE IT RESOLVED by the Board of Supervisors of Chesterfield County: That the perpetual floodage easements to be acquired from tFne property owners shall provide for the mutual rights set forth in the "Swift Creek Easement Form" attached hereto and made a part hereof. Jones, Jr. on Southmoor Road concerning the off-plan-location of the :. fire plug on his property. Mr. Jones appeared at a recent meeting of the Board of Supervisors complaining that the fire plug was not located according to the plan of the water line. It was stated that Mr. Burnett had indicated that he would have the plug moved. Mr. Welchon had been to Mr. Jones' place and indicated that the plug was improperly located. Mr. Jones told me that Mr. Wallace while building the house was concerned about the location of this fire hydrant and offered to use his back-hoe for relocation of the hydrant. However, no one ever showed to take him up on this offer. Mr. Jones said that he wishes to pave his drive-way and wants to improve entry from the street. The fire plug is at the edge of his drive-way and prevents any such im- provement without being in the drive-way. I do not see Page 2 July 22, 1968 that Mr. Jones has any responsibility for movement of the plug since his builder had offered to do the work required for moving when he had equipment on the location. I recall that it was stated at the Board meeting that the inspector allowed this variation. A resonable explain- ation for this variation from the water line plan has never been. made to my satisfaction. I''ll have to observe, in general, certain fire hydrants in the County present to the public some rather rediculous situations. The firemen have complained o~f this from time to time. Until some system of correcting these errors the County will remain in an awkward spot as to its seriousness concerning fire protection. These situations can be avoided and should be in the future. We have a feeling of accomplishment in this office, due in large, as a result of your consideration and support. As a result of your support we now have our deputies equipped with revolvers, clothing allowance for the men not furnished uniforms (most have purchased their own uniforms to be worn on special occasions). We have a well equipped station wagon for handling prisoners. Radios in these vehicles have already proven valuable to us as well as the police department. The fence around the jail with an electrically controlled gate will help security immeasureably. I want to thank you gentlemen as well as all agencies at the court house for your consideration having shown this office, especially Co. Gill and the Chesterfield Police Department. We have ~a feeling of oneness. Our jail population has been down considerably lately with the exception of the week-end (19) were arrested at one time, (14) being confined to jail. This caused our population to rise from (28) to (52). In recent weeks we have been down to (22). RIEVES I would appreciate your approval of my using the county owned vehicle, furnished me in the carrying out the duties of the office of sheriff. The state Compensation Board, according to its Executive Secretary, Mr..Rasnick, WILL NOT PAY MILEAGE for the many times the sheriff needs his car, etc., visiting the jail at night, week-ends and meetings. I have been using my own automobile because of this. It is my understanding the Attorney General has ruled that a sheriff is on duty seven days a week, twenty-four hours a day. If this be true the sheriff needs his auto at home to enable him to respond. I serve papers in my neighborhood in order to secure transportation home. If there are no papers in my section I have no way to account for the mileage to and from my office. This has been called to the attention of Mr. Rasnick a number of times and have also been to see him in person, to no avail.
