Browning,it'is resolved that the minutes of September 9 and September 11, 1968 be and they hereby are approved. 68-35UP Mr. John A. Gates, Jr. comes before the Board requesting a Use Permit to sell antiques in the basement of his home on a parcel of land of irregular shape fronting 850 feet on Old Buckingham Road and extending northwestwardly 450 feet, more or less, being situated on the western corner of the intersection of Old Buckingham Road with Falling Creek in NTidlothian Magisterial District. Refer to Sec. 16-10 (1) par. 11 and Sec, 16-10 (2) par. 19, which request was deferred from September ll, 1968 and there again appearing no opposition to this request and it was reported that the Supervisor of the District had investigated the matter thoroughly, it is on motion of iv1r. Dietsch, seconded by N1r. Purdy, resolved that a Use Permit to sell antiques be given to Mr. John A. Gates for his use only, upon the condition that if there be an advertising sign used that same be limited to 6-sq. feet. There was read a request from the Crippled Children's Hospital and the Educational Therapy Center. Upon consideration whereof and on motion of l:r. Apperson, seconded by Mr, Purdy, it is resolved that the sum of $3285.00, the amount requested, be given to the Educational Therapy Center and the sum of $500.00 bc; given to the Crit~pled Qlildren•s Hospital. And be it further resolved, that the Treasurer of the County be requested to transfer $500.00 from the unappropriated surplus of the County 's General Fund to 11-086-144. On motion of Mr. Purdy, seconded by ivtr. Dietsch, it is resolved that upon the request of the citizens of the area, the Highway Department be requested to study the speed limits existing on Rt. 145, immediately south of the Railroad crossing near Kingsland Elementary School. %' , ' • On motion of r~r. Apperson, seconded by Mr. Dietsch, it is resolved that Logan Street and the streets in Cameron Hi11s are recommended to the Highway Department for acceptance into the State Secondary System. Dietsch, it is resolved that this Board accepts a deed from the Appomattox ~uater Authority conveying the North ~~.ccess Road from the Brasfield Dam to State Rte. 604, provided said deed is changed according to the Commonwealth's Attorney recommenda- tions. And be it further resolved, that the State Highway Department upon recordation of the deed to the ~~ccess Road from the intersection of Rt.602 and Rt.669 southwardly and westwardly .85 mile --- be reques~ed to take said road into the State Secondary System. Apperson, it is resolved that the invitation for Chesterfield to join the Virginia Travel Council be and it hereby is accepted. It is understood that the prmotion of the County by this organization w211 cost approximately $100.00 per year. On motion of Per. Browning, seconded by I~~ir. Dietsch, it is resolved that the Purchasing Agent be authorized to hate printed some 50,800 brochures giving the officers of the County and something of the operation of the County. On motion of Mr. Dietsch, sedonded by I•~r. Apperson, it is resolved that this Board approves the reciuest of the County School Board for the employment of 14 teachers to relieve overcrowded classes resulting from the under estimation of students for the year 1968-'69. It is understood that funds will be appropriated only if the budgeted amount turned back at the end of the fiscal year will not cover the employment of fourteen teachers, There was presented a proposed change in the County's Ordinance for licensing vehicles. Upon consideration whereof, and on motion of Nir. Apperson, seconded by Mr. Browning, it is resolved that said ordinance be advertised for hearing on October 24, 1968 at 2:00 P.M. Mr. Piorris Gordon comes}efore the Board reque:sing a Variance from the Subdivision Urdinance to construct a home on a proposed 50-f t. right of way leading into Rt. 617, approximately 600 feet wdst of its intersection with Rt.620 and it was pointed out that Nir. Gordon had presented his request to the Planning Commission which had, by resolution, recommended that the Board grant a Variance for this site. Upon consideration whereof, and on motion of Mr. Purdy, seconded by Nir. Apperson, it is resolved that a Variance be granted to N1r. Gordon on the aforedescribed parfel of land and the Building Inspector be authorized to issue a building permit at this location. WHEREAS, the General Assembly for the State of Virginia has provided for the establishment of Hi<;hway Safety Commissions for each locality, and [wHER;~;A~~, it is the desire of this Board to comply with the directions of the General Assembly, NC-'., THER.i'Ur:i, BL IT RL:SGLVi;D, by the Board of Supervisors of Chesterfield County, that there is hereby established for this County, a Highway Safety Commission, which Commission shall consist of nine (S) members of whom one (1) shall be a member of the Board of Supervisors. The Commission shall meet at least four (4) times each year and make studies and reports in regard to plans and programs for the improvement of highway safety within the County of Chesterfield, Said High4vay Safety Commission shall conduct its affairs, perform such duties, and make such reports as are provided for in 2.1-64.18 through 2.1-64.20 Code of Virginia, 1966, as amended. -3- ;~ • On motion of ri1r. Dietsch, seconded by P4r. Apperson, it is resolved that Contract AC-623 for the install~.tion of water in the 3rookfield Subdivision in the amount of b22,i399.20 be and it hereby is approved. On motion of Nir. Dietsch, seconded by Mr. Purdy, it is resolved that contract 5-68-39D for the installation of sewers in 'rdorsham Trailer Park be and it hereby is approved. On motion of P~~r. Apperson, seconded by P•ir. Dietsch, it is resolved that the County Engineer be requested to move a fire hydrant from the north property line to the south property line of P`ir. Charles E. Jones of 5000 Southmoor Drive. On motion of Mr,, Dietsch, seconded by P4r. i°:artin, it is resolved that completed plans bg requested on Projects 6511-208 and 6511-57A, and the trunk sewer from the Courthouse to the site of the I-Sowell property below Centralia and to obtain an option on Site "C" for the proposed lagoon and have test borings On motion of I~lr. Dietsch, seconded by Pr. Apperson, it is resolved that the Treasurer be and he hereby is requested to establish a special reserve in the Sewdr Improvement, ReplacemEnt and Extension Fund to which funds will be transfcr;:ed by gener.l voucher intermittently from the Sewer connection charges to be used to correct overloaded sewerage facilities caused by hi-density development. The County Engineer presented several studies showing how water could be supplemented to the Courthouse complex frog ti:Te central system and it appears that running a water line from Centralia Gardens to the Courthouse would be the cheapest route., Upon consideration whereof, and on motion of DYr. Apperson, seconded by P-'ir. Purdy, it is resolved th,.t the County Engineer draw plans for this construction and the project at an estimated cost of $125,000.00 be approved vaith the understandin that the contribution of the School Board for water to three differ~.~nt schools be negotiated. On motion of Mr. Dietsch, seconded by Tyr. Purdy, it is resolved that a contract with Professional Data Service, In for the collecting of old Utility accounts be re-written by the Commonwealth's ~+ttorney to cure certain defects in this proposal. Mr. Maynard Elrod comes before the Board stating that Mr. Weinstein had agreed to :ay $20,000 of the estimated $31,000 cost of putting in storm sewers between 'r~ainwright Drive and Radio station WXGI. He stated further that 'Weinstein & Associates had tried to get the necessary right of way to construct an open ditch to drain this area but could not do so. Upon consideration whereof, and on motion of c^ir. Dietsch, seconded by C~:r. Apperson, it is rya olved that if 520,000 is advanced from the Builder or the people adjacent thereto, the County t~~ill pay the remaining charge for this project. -4- Pir. Elrod raises the question of the cost of engineering in the recent drainage agreement with Dir. +sch, the developer of the land south of Jahnke Road, Upon consideration whereof, and on motion of I~ir. Dietsch, seconded by Nir. Martin, it is resolved that the County will charge l:r. ~`.sch 21% of the cost of engineering which is his proportionate cost for the installation of a storm sewer in this area. Cn motion of i~;r. Purdy, seconded by 't1r. Iietsch, it is resolved that the Treasurer be requested to transfer the funds remaining in the Water Bond Fund from the recent sale of the $4,000,000 Bond Issue to the Improvement, Replacement and Extension Fund as set forth in the 1968-'69 budget. On motion of P'ir. Appe~tson, seconded by N.r. l~fartin, it is resolved that the Utility Department allow existing commercial property to pay for sewer connections on the inst~almerrt plan similar to the residential plan with a maximum of t4aenty (20) payments, plus the cost of recording the lien. It is here noted that I:r. Dietsch votes No. The Utility L~partment stated that a petition had been received requesting the extension of water mains on Coghill Road along Rte. 10 to the ': vicinity of 'vdilmoth Drive, which petition promised approximately 23 connections and it was cited that the regular cost of this line, not including the oversized pipe expense would be $32,500.00 And it was enerally agreed that this matter be investigated further and the number of guaranteed connections be ascertained. On motion of Mr. Browning, seconded by Mr. Purdy, it is resolved that the Engineering Department be authorized to condemn the property of Julian tid. and Ruth P, Nunnaly for a sewer easement on Project 6511-3/7. There appears a delegation requesting the extension of Rt.743, presenting a petition sined by some twenty-seven persons. i~5r. ~pearson explains `' the history of this road and his efforts to have sflme improvement made on the road and the road extended to Courthouse Road. Dlr. Ashby says that tie has maintained a one-half mile stretch of this road to his home for twenty years and presented pictures to show the dust and the ~•aidth of the road. After much discussion of the plight of the citizens in this area, I'<iro Apperson states that the Hi~jhway Department has plans for the road extension and will submit a price to the County in the near future, P-ir. R, 6J. Mann comes before the lsoard requesting the use of the horse tr<_ck for the racing of motorized vehicles and st~aed that if approxi- mately `-020,000 is spent th<i, he and his =association would pay one-half of this amount over the course of five years. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA: 1. That Chapter 6, Article 10, Sections 6-213 through 6-226 inclusive of the Code of the County of Chesterfield be and they are hereby amended and reordained to read as follows: Section 6-213 LICENSES REQUIRED; EXCEPTIONS There is hereby imposed by the Board of Supervisors a license tax upon every person, firm or corporation owning a motor vehicle, trailer or semi-trailer, regularly housed or stored in the County, and used or intended to be regularly operated upon the streets, highways or roads in the County, except as otherwise specifically provided in this ordinance. The provisions of this ordinance shall not apply to any vehicle exempted by the .provisions of sections 46.1-45 through 46.1-48 or section 46.1-66 of the Code of Virginia, nor shall the. provision of this ordinance apply to any vehicle licensed "pursuant to sections 46.1-49 or 46.1-50 of the Code of Virginia. Section 6-214 APPLICATION FOR LICENSE; ISSUANCE OF PLATE, ETC. Every person, firm or corporation owning a motor vehicle, .trailer or semi-trailer, regularly housed or stored in the County and used or intended to be regularly operated upon the streets, roads or highways in the County, shall make application, for and procure a County motor vehicle license. Application for the license herein prescribed shall be made to the Treasurer of the County on forms providing for the name and address of the applicant and a description of the motor vehicle for which the license is to be issued. The application along with the applicants current validated state registration certificate shall be presented to the treasurer-before any license for such motor vehicle may be issued. The lic ense tax shall be paid to the Treasurer,, and upon payment of the license tax, the Treasurer shall issue to the applicant a license plate, tag or other indicia of License for such motor vehicle. Section 6-215 PASSENGER VEHICLES -GENERALLY On each and every passenger vehicle there shall be an annual license tax of Ten Dollars ($10.00); and on each and every motorcycle a license tax of Three Dollars ($3.00). Section 6-216 TRUCKS, TRAILERS, ETC. (a) On each and every truck not designed and used for the transportation of passengers, and not exempt from taxation as other- wise herein provided the .license tax shall be as follows: With gross weight of 6,000 pounds or less - $10.00 With gross weight of 6 001 founds to 12,000 pounds - $13.50 With gross weight of 1~L,001 pounds to 20,000 pounds _ $17.00 With gross weight of 20,001 pounds to 30 000 pounds $20.00 With gross weight of 30,001_and.over - $L5.00 ~r~ - ~ (b) On •ch trailer and semitraile#he license tax shall be $12.00, except one and two wheel trailers of a cradle, flat-bed or open type with a body length of not more than nine feet and a width not greater than the width of the motor vehicle to which it is attached at any time of operation, and to be attached to the owner's own motor vehicle and used only for carrying property belonging to the owner of such trailer .the license tax shall be $3.50. (c) In the case of a combination of tractor-trailer, or semitrailer, 'each vehicle constituting a part of such combination shall be licensed as a separate vehicle and separate license indicia shall'be issued therefor. (a~) On each and every motor vehicle, trailer or semitrailer upon which well-drilling machinery is attached and which is' permanent- ly used solely for transportation of such machinery, there shall be a' license tax of $10.00. (e) Each and every motor vehicle used exclusively for transporting passengers to and from school, Sunday School, or Church, or other place of divine worship shall be exempt from paying a license tax. Section 6-217 ANTIQUE MOTOR VEHICLES Upon receipt of an application on a form prescribed by the treasurer, the treasurer shall issue appropriately designed license irdi.cia to owners of antique motor vehicles as defined in Title 46,1-1 (15a) of the Code of Virginia. Such license indicia shall ~.~ be valid for as long as title to such vehicle is vested in the `~ applicant. The license tax for any such vehicle shall be five dollars. Section 6-218 REFUNDS; PRORATION. Qnly one-half of the annual tax prescribed by this ordinance shall be collected whenever any license is issued during the period beginning on the first day of October in any year and ending on the fifteenth day of January in the same license year, and one-third of such fee shall be collected whenever any license is issued after the fifteenth day of January in any license year. Any person, firm or corporation holding a current registra- tion certificate and license under this ordinance who disposes of the vehicle for which it was issued and does not purchase another vehicle may surrender the license plate or other indicia of license - along with a certificate from the Division of Motor Vehicles tha t the State license and registration certificate have been surrendered, and request a refund for the unused portion of the tax paid, In cases where the applicant purchased his license prior to the license tax year and surrenders them prior to the commencement of the license tax year for which they were purchased, the Treasurer shall make full refund to the, applicant upon paynnent of the fee of one dollar. If application for refund is made prior to the first day of October of the current license year, the Treasurer shall make refund to the applicant of one-half of the license fee paid. If application for refund is made subsequent to the first day of October of the current license year and prior to the first day of January, the Treasurer shall make refund to the applicant of one-third of the license fee paid, No refund shall be made when application therefor is made after the first day of January of the current license year. Refunds made by ( • • • • the Treasurer under this section shall be paid from the treasury of the County. Section 2-219 TRANSFER OF LICENSE PLATES FROM ONE VEHICLE TO -" ANOTHER OF A DIFFERENT CLASS An owner who sells or transfers a registered motor vehicle, trailer or semitrailer may have the license plates assigned to another vehicle titled in such owner's name according to thq provisions of this chapter which is in a like vehicle chss as specified in section 6-215 and 6-216 and which requires an identical license fee upon application to the Treasurer accompanied by a fee of one dollar. If such other vehicle requires a greater license fee than""that for which the license plate was assigned, then upon payment of a fee of one dollar and the amount of the difference in license fees between the two vehicles. Section 6-220 DISPOSITION All fees collected pursuant to this ordinance shall be deposited by the Treasurer in the General Revenue Fund of the County. Section 6-221 LICENSE NOT TO BE ISSUED UNTIL PERSONAL PROPERTY TAXES ON VEHICLE PAID No vehicle taxable under the provisions of this ordinance shall be licensed unless and until the applicant for such license shall have produced ,satisfactory evidence that all personal property taxes upon the vehicle to be licensed, which personal property taxes have been assessed or are assessable against such applicant have been paid, .Section 6-222 LICENSE TAX YEAR The license year under the terms .of this ordinance shall commence on the fifteenth day of April and shall expire on the fifteenth day of April of the following calendar year. • Section 6-223 DISPLAY OF LICENSE PLATE, ETC. Metal license plates issued to the licensee pursuant to this ordinance shall be displayed with the State license plate at the front or rear of the vehicle. Decalcamania or other stickers issued pursuant to this ordinance shall be attached to the lower right-hand side of the front windshield, or to such other location as the treasurer shall direct on vehicles m t equipped with wind- . shields. Section 6-224 TRANSFER OF LICENSE PLATE, ETC. It shall be unlawful for any person to whom a license plate or other indicia of license is.issued under the provisions of this ordinance to give, loan, rent, sell, assign, or transfer such license plate or indicia of license to another or to otherwise permit another to use in any manner such license during the license tax year for which the same is issued. Section 6-225 REPLACEMENT OF LICENSE; FEE. In the event that any license plate or other indicia of license issued under the provisions o£ this ordinance shall be lost or m~.~tilated, or shall have become illegible, the person, firm, or corporation who is entitled thereto shall make immediate application for and obtain a duplicate or substitute therefor upon/furnishing information of such fact satisfactory to the Treasurer, and upon payment of fifty cents." Section 6-226 PENALTY, Any person,' firm or corporation who shall fail to procure any license and pay the tax prescribed by this ordinance or who shall violate any of the provisions of this ordinance shall, upon conviction, be punished by a fine not exceeding three hundred dollars or by imprisonment in the county jail for not more than thirty days, or both such fine and imprisonment. The license inspector, as well as the-police of the county, are hereby authorized to issue summonses in writing to violators of this ordinance for their appearance befor® . the County Court. As early as September 5, it was noted that nine elementary schools and one combined school with seventh grade sections had a total of twenty-six sections with thirty-five or more pupils each. Since that time, a considerable reassignment of teachers in one school has made possible the formation of a combination class without increasing the number of staff members. No tabulation has been made since 9/5/68; so the record indicates twenty-six sections with 35 or more pupils each, and it is expected that the September 30 report will show a marked increase in pupils throughout the county. The proposed ordinance makes no basic change in the tax rate schedule except that under Section 2-219 a transfer credit is allowed, where the license plate is being transferred from one vehicle to another vehicle in a higher-tax rate class, and also provides for collection of a. fee of $1.00 for making the transfer. The other small change under the tax rate schedule is a provision under Section 6-218, providing for full refund to the applicant where he purchases his license prior to the license tax year and surrenders them before the commencement of the license tax year. The principal change in this proposed ordinance is the provision for issuing decals for certain motor vehicles in the place of metal license plates. Quaiff SUBJECT: Special Reserve for Sewer Connections to be held in Escrow Dear Bob: The procedure outlined below was discussed with Mr. Condrey, and agreed, would be the proper manner in which to handle the special reserve fund which was set up when the sewer; connection fees were revised. ' I quote the paragraph pretaining to the special reserve fund, "All revenue received from apartments and other high density developments in excess of $1,000.00 per acre (3-.1/3 units per acre) shall be placed in a special reserve fund. This fund will be used to correct overloaded sewerage facilities caused by the high density development." there shou d~beonorproblemdinctheemechanicstof~hisoprocedure. The following is the procedure as outlined above: (1) All Sewer connection fees will be placed in the Sewer Service Installation Fund (76-000-709). (2) At the end of each monthly accounting period an accounting of connections received on apartment projects which are applicable to the above quoted requirements will be tabulated and a Journal Voucher made transferring the required amount to a special reserve in the Sewer Improvement, Replacement and Extension Fund (73-78). I propose that three additional men be employed and two additional vehicles be purchased, to enable sufficient enforcement of this new Ordinance.
