On motion of lVir. Dietsch, seconded by ~'lr. Apper son, it is resolved that
the minutes of August 14, 1968 be and they hereby are approved as
amended.
On motion of Mr. Apperson, seconded by j"jr. Browning, it is resolved that
this Board receives the list of 1966 Delinquent Real Estate Taxes from
the Treasurer.
!VIr. Robert Nelson, Asst. hanager of the Virginia Travel Council, comes
before the Board citing the work that the Virginia Travel Council is
doing in the area, such as promoting Tourism and requests that the
County of Chesterfield become an active member in the Council at a fee
of $110.00 per year.
It was generally agreed that this matter would be studied further and
action t~ken at a later date.

Hessrs. David M. and Joseph G. Woodfin come before the Board again
requesting the rezoning from Agricultural to General Business (C-2)
on a parcel of land of irregular shape fronting 200 feet on U.S.Rte.360
and extending northwestwardly 240 ft. being 1000 feet northeast of
walmsley Boulevtird. Refer to Sec. 39-12 par.6, which request was
deferred from the meeting of August 14, 1968.
hr. R ndall, who owns two tracts of land across Rt.360 from the subject
land questions the duty of the Board membets in zoning cases. Should
not a Supervisor vote for the majority of the people in the area?
I"Jr. Dietsch explains the rea;~ons for his decision and states further
that he was voting for all citizens of the County. H further states
that commercialism of corridors should b~ held down and centralized
in areas instead.
rv~. Ritchie and ~~. Tom Jolly appear in favor of the request.
hr. Wallace LaPrade states that the area is developed in a residential
fashion and opposes the request.

Mr. Irvin Horner states that the character of~e land has already
been set.Mr. A. R. hartin states that in his opinion if the land is
zoned it would not necessarily be a precedent.
Whereupon, Mr. Dietsch offers the following motion:
That the zoning request on the aforedescribed land be and it hereby
is denied. JVir. hartin seconds the motion.
hr. Browning s ta tes that he c::cnnot vote for the motion since the
non-conformin0 business has been there for so long a time.
Mr. Horner adds that there is an exceptionally deep gully to the
rear of this property and that nothing else could be placed on the
location but such a business. A vote being taken on the motion,
fvir. Purdy, f'jr. Dietsch and fJIr. hartin vote Aye.

vJhereupon hr. C. Denny ihite, the County's 'rie-Breaker ~JaS called
and further consideration of the matter is deferred to 2;30 P.M.
on ~ptember 11, 1968 at which time the Tie-Breaker will be present.
On motion of hr, Purdy, seconded by IVlr. Apperson, it is resolved
that a Variance be granted to Mr. B.H.Jennings to construct a
second house on 19-acres of land situated on Lots 4 and 5 of
Rivermont Subdivision, off the Point O'Rocks Road.
On motion of i'lr. !Vlartin, seconded by Hr. Browning, it is resolved that
since there is no objection from the neighbors a Variance from the
subdivision ordinance be granted to hr. IN. A. Smith for the construction
of a second house on his parcel of land known as 8143 Brown Road.
There was read a request from the County School Board for advanced
permission to employ twenty (20) additional teachers, provided the
increased enrollment conditions necessitate same and for the roard of
Sup~rvisors to guarantee additional funds in the event the School
Board could not finance same from its present allocation.
Upon considerntion whereof, hr. Dietsch offers the following motion:
Be it Resolved, that this Board of Supervisors guarantees to the
School Board, in the event that there is not sufficient funds in the
School Board budget at the end of the current fiscal year tm pay
for the employmeht of twenty (20) additional teachers should same be
necessary, that the Board of Supervisors will advance the necessary
funds to cover the cost involved.

There was read a request from the County School Board requesting that
Krause Road be straightened, widened and surface-treated from
Route 10 bo the rear of the new School Administration building.
Upon consideration whereof, and on motion of ~~. Apperson,seconded
by ~~. Purdy, it is resolved that this Board requests the State
HighltJay Department to widen, improve and pave the existing right
of way on Krause Road.
It is here noted that hr. Dietsch votes No.

There was read a request from the School Board for the guarantee of
$9,000.00 to cover the cost of rentQl space to house school children
beginning September 3, 1968 until such time as the classroom additions
now under construction are available for use. This request was made
in the event there wa~ not sufficient money in the current budget of
the School Board.
Upon consideration whereof, and on motion of l"ir. Purdy, seconded by
Mr. Apperson, it is resolved that this Board approves the request of
the School Board and guarantees a sum not to exceed $9,000.00 for the
rentGl or school space in the event that there is not sufficient money
in the 0chool Board budget for said expense.
It is here noted chat ~~. Browning votes Nay.
On motion of ~tr. Apperson, seconded by Mr. Dietsch, it is resolved that
this Board requests the Judge of Circuit Court, the Honorable Ernest P.
Gates, to appoint George W. Frazier and Linwood S. Matthews as Police
Officers for the County of Chesterfield.
l'lr. i.-Jallace LaPrade and hr. John Bates come before the Board requesting
further consideration of his guarantee to install a 54;1 culvert under
LaBrook Concourse which may not be needed if drainage is diverted to
another area or if the State Highway Department does not enlarge the
culvert under Rt.60. Upon consideration whereof, and on motion of Mr.
Dietsch, seconded by Mr. Purdy, it is resolved that the Commonwealth's
l..ttorney be requested to work wit:", rvir. LaPrade to agree on such terms
that will be acceptable to fir. LaPrade and the County.
On motion of hr. Dietsch, seconded by l"lr. Apper son, it is regol ved that
this Board requestE; the Highway Department to accept into the Secondary
System of roads LaBrook Concourse.
Hrs. l'lelvina r'riend and others come before the Board requestin9 a
Variance from the subdivision ordinance to allow the construction of
a dwelling on the rear half of the lot known as 3001 Kingsdale H.oad
which parcel fronts on Proctors Road, a dedicated but unimproved road.
Upon consideration wher-c.oof, and on motion of hr. Purdy,seconded by
Er. Apperson, it is resolved that the Building Inspector be authorized
to issue a building permit on said pc::.rcel of land, provided it be
understood that the County would have no obligation in any way to the
construction or maintenance of this road.
On motion of l"ir. Brmming, seconded by hr. Iletsch, it is resolved that
on the advice of the Commonwealth's Attorney that the Chairman and
Clerk of this Boo.nl be authorized to sign a deed giving to l',rs. ;'~heat,
the present owner, of a well lot in Lake George Hamlet, all of the
County's rights, titles and interest in said well lot.

the Executive ;;ecretary bs authorized to write to the owner of a well
lot in Meadowridge seeking the proper dedication for recreational

On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
contract A-431C for the installation of water and gas mains in
lYieadowdale, Section "B" be and it hereby is awarded to the Stamie E.

contract S-68-37C for the installation of sewer lines to the Providence
Road Junior High School be awarded to the Roanoke Construction Company
in the amount of $27,968.75, provided the subdividers in the area pay a
portion of said cost and if said portion is not forthcoming to award
the bid at $22,349.55 for a lesser amount of work.
On motion of hr. Martin, seconded by Hr. Browning, it is resolved that
the sewer agreement S-68-35CD between the County of Chesterfield,J.K.
Timmons, Consolidated Sales Company, Julian B. Jacobs and the 1314
',iest hain Corporction for the installation of certain sewer lines and
pu~ping stations serving the Windsor Forest-Robious Road area be
approved as written with no change in assignments.
On motion uf Mr. l,artin, seconded by ~r. Dietsch, it is resolved that
the County Engineer be and he hereby is authorized to install sewers
in the Penn Acres Subdivision.
On motion of Mr. hartin, seconded by Mr. Dietsch, it is resolved that
the Jurchase of 2000 revised County maps be authoriz6d.

There were presented several letters complaining of the hazardous
condition created by the present dam on the Powhite Creek, just south
of Jahnke Road, which complaints generated considerable discussion as
to the best solution to the problem. Upon consideration whereof,
and on motion of i\r. Dietsch, seconded by Hr. Apperson, it is resolved
that the Engineering Department be requested to view this situation
and to give recommendations on the best course of action to remedy
the present conditions.
Official notification was given by the Highway Department to the County

On motion of !vIr. Apperson, seconded by hr. Purdy, it is resolved that
the contract to construct a roadway to the proposed Nursing Heme,
adjacent to the Courthouse buildings be awarded to Shoosmith Bros.
Company who submitted the low bid of $14,211.00.
On motion of hr. Dietsch, seconded by Fir. Browning, it is resolved that
the recommendations of the Fire Committee be and they hereby are
approved, subject to a discussion with the Fire Marshal on the volume
of the three pumpers from 1000 gpm to 1250 gpm, which recommendations
are as follows:
I. That the purchase of new equipment be standardized
according to the recommendations of the Byrus report with
certain small exceptions which are filed with the Board's
papers.

2~ That the County buy three pumpers with the same
specifications for Wagstaff, Bensley and Manchester
Fire Departments which pumpers would be mounted on
custom-built Diesel chassis and will cost approximately
$105,000.
3. To replace the fire alarm base station.
4. That the County promote a class in the Virginia
Commonwealth University on fire administration and
offer the class to at least one member of each fire
department with a maximum of 18 members and subsidize
the cost, a total of $25.00 per fireman.
5. That a combination sink, stove and refrigerator for the
fire alarm headquarters be purchased.
On motion of f'ir. Dietsch, seconded by l"Ir. Apperson, it is resolved
that the Police Committee recommendations be and they hereby are
approved, which recommendations are as follows:
1. That 3 off-duty Police officers assist in the general
election in November if any problems may arise with the
new voting machines.
2. That the Police Committee be authorized to review
accidents involving County cars and to recommend to
the Board necessary action against any County employees
who are guilty of negligence in the use of County vehicles.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that

authorized to make transferg of funds from the Sewer Revenue Wund
as needed to the Sewer Operating Fund and Sewer Debt Fund of the
County.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
the request of the Treasurer be approved for a mileage increase as
allowed by the action of the 1968 General Assembly be changed from
7~ to 9~ per mile which results in an additional appropriation of
$146.50 and the Treasurer is hereby requested to appropriate 1146.50
from the unappropriated surplus of the County to 11-031-220.
On motion of hr. Apperson, seconded by Er. Dietsch, it is resolved
that an easement be given to the Virginia Electric & Power Company
for an overhead power line to the new Court's addition, provided
the Power Company puts the installation where the Architects suggest
same to be located.
On motion of Mr. Apperson, seconded by Mr. Dietsch, it is resolved
that this Board accepts, with thanks, the check in the amount of
$11.00 from the Richmond Area Associ0tion for RetGrded Children,which
check represents past due rent for 11 years.
On motion of Mr. Apperson, seconded by ~r. Dietsch, it is resolved
that the Executive Secretary be authorized to have the weeds cut on
the vacant lot at Ecoff Street and Lunsford Road and to charge the
cost thereof to the property owner, as a lien on the land.
It is here noted that every effort has been made to contact the
owner..
On motion of l'-'lr. Apperson, seconded by Lr. Dietsch, it is resolved
that the Drainage Commission of the County of Chesterfield, in
cooperation with the Commonwealth ~ttorney's office, make a thorough
and extensive study of the drainage areas and problems in the ~unty
with a view toward establishing a policy on drainage, setting up
and establishing an ordinance provided for draina~e districts, on
sight and off sight drainage improvements, and the cost thereof,
and such guidelines as may seem mete and proper for the orderly
implementation of developing drainage areas and improvements.
On motion of rtr. Dietsch, seconded by Mr. Martin, it is resolved that
two street lights be approved for installation at Wakefield Drive
and Cherokee Road and Wakefield Drive and Marilea Road.

Courthouse.
vMEREAS, Mr. Harold T. Goyne was a member of the Board of
Supervisors of Chesterfield County for thirty-two years and contributed
immeasurably to the well-being of the entire County, and
viHEREAS, hr. Harold T. Goyne gave not only of himsolf but also
of his substance in gifts to the John Tyler Community College, to
the Bensley Rescue S~udd and to many other civic and religious
organizations, and
ltJHEHGAS, r'Ir. Harold T. Goyne was deeply loved and highly
respected by every member of the ~unty Administrdtion and in this
spirit of esteem, it is on motion of ['lr. Apperson, seconded by l1r.
Browning, resolved that this Board of Supervisors publicly expresses
its intense grief at the untimely death of ~tr. Goyne and sends his
family and friends the sincere condolence from every official at the
Courthouse.

There was read a letter from the Ettrick-Matoaca Rescue Squad thanking
the Board for its contribution of a water connection for the Squad

This easement is granted subject to the following conditions:

1. That all water mains, pipe, pipelines, meters and
other appurtenant facilities which are installed in said easement
and right of way shall be and remain the property of the County;
that no charge shall at any time be made by the owner for the use
of the property occupied by the County or for the privilege of
constructing, maintaining and operating said water mains and the
necessary appurtenances thereto; and the County, its agents and
employees shall at all times have full and free ingress to and
egress from said easement and right of way over the lands of the
o\~er in order to construct and efficiently maintain and operate
said water mains and appurtenances, and shall have the right to
inspect, build, repair, improve, re-locate, remove, replace, make
additions or extensions thereto, and make change\s, alterations
and substitutions t~erein, including the riGht to\install addition-
al water mains, in the easement.and right of way ~erein granted'
as the County may from time to time deem advisable 'or expedient.

or convenient for the full enjoyment or use, for any of the afore-
said purposes, of the easement and ri[?;ht of way herein granted.
2. That the County shall have the right to trim, cut
and remove all trees, limbs: undergrowth, shrubbery, landscape
plantings of any kindl fences, 'buildir:.gs, structures' or other
obstructions or facil~ties on or in said easement which it deems
in any way to interfere with the proper and efficient construc-
tion, operation and maintenance of the water mains in said ease-
ment; provided, however, that unless hereinafter otherwise agreed,

ings of any kind, the County shall repair, restore or replace any
and all facilities located on or in the said ea~ement which may be
disturbed, damaged or.removed to as nearly as possible their original

ment and shall r~store,the surface thereof to as nearly as possible
its original condition~

3. That the owner ,tes~rves the right t~~ake use of the
easement herein granted whi.ch may no~. be incotisist~htwith the rights
herein conveyed, or interfere with the Jse of the said easement by
the County for the purposes aforesaid; provided, however, that un';;'
less hereinafter otherwise agreed, the owner shall not erect any
building or other structure, excepting a fence, on the said easement
without obtaining the prior written approval of the County.
. 4. That during periods of actual construction, operation
or maintenance activities in the said easement whenever it becomes
necessary to use any land of the owner immediately adjoining and
abutting said easement, the County shall have the right to make
reasonable use thereof.

covers all the agreements between the parties and no representation
or statements, verbal or written, have been made, modifying, add-
ing to, or changing the terms of this agreement.

The owner covenants that he, she or they has or have the

and peaceable possession, use and enjoyment of the said easement;
and that the owner will execute such further assurances of the said
easement as may be requisite.

As requested in resolution by your Board on February 14, 1968, the fol-

The Police Committee held a meeting on August 21,
1968. The following items were discussed:
1. The County Electoral Board has asked for the
use of three police cars and three off-duty
officers to assist them in the General
Election in November. One member of the
Electoral Board will be assigned to a car
and an area of the County to be available
to assist the precincts with any problems
that may arise with the voting machines.
Each officer will be paid $25 by the
Electoral Board for the day's work--5:30 8.m.
to 7:30 p.m.
2. The Police Pension Fund Committee presented
a request to increase from 1% to 1\% the
rate used for calculating pensions. This

would require an increase in the annual $12,000
contribution to the fund now being made by
the County. Because of inflation the present
monthly pension rate is inadequate and below
tha~ of other county and state pensions.
After discussing the whole program, the
Police Committee found there a~e other areaS
that need revision. For example, if one of the
younger officers were to be killed in the line .
of duty, his widow's pension would be of the
order of $15 to $20 a month.
The Committee instructed the Pension Fund to :
review the whole program to make it current
with today's.cost of living and recent changes
in Social Security.
3.
Currently there is no committee or group
charged with the responsibility of reviewing
accidents involving County cars. The Committee
agreed that a board of inquiry' consisting of
three people should be appointed for this
purpose. It is recommended that the Board of
Supervisors make this a collateral responsibility
of the Police Committee giving them the right
to discipline those County employees who are
guilty of negligence.

Dear Mr. Burnett:
Chapter 711 enacted by the 1968 General
Assembly increased mileage allowances to nine cents per
mile for privately owned vehicles. The new rate will
increase the Treasurer's mileage allowance from $515.00
to $661.50. Therefore, I respectfully request an
additional appropriation for mileage in the amount of
$146.50, one-half to be paid by the State and one-half
to be paid by the County.
I shall greatly appreciate your presenting
this request to the Board of Supervisors and hope they
will give favorable consideration to same.

Chesterfield County actiDg by and through its County tloard of Supervisors
" ereinafter called "Owner"; and Virginia Electric and Power Company,
a Virginia corporation, hereinafter called "Company,"
WITNESSETH:
That for the sum of One Dollar ($1.00) and other valuab.le considerations, the receipt wherof is hereby
acknowledged, Owner grants unto Company, its successors and assigns, the perpetual right, privilege and
easement of right of way ten (10) feet in width to lay, construct, operate and maintain one or more lines of under-
ground conduits and cables and one or more lighting supports and lighting fixtures, as Company may from time to
time deem expediE;nt or advisable, located on the right of way hereinafter described, for the purpose of trans-
mitting and distributing electric power by one or more circuits; for telephone, television and other communication
purposes; and for lighting purposes; together with all wires, conduits, cables, transformers, transformer enclosures,
concrete pads, manholes, hand holes , connection boxes, ground connections, meters, attachments, equipment,
accessories and appurtenances desirable in connection therewith (hereinafter referred to as "facilities"), over,
under, through, and across certain lands of Owner situated in Chesterfield County, Virginia.

line of such right of way being shown in broken lines on such plat.
The facilities constructed hereunder shall remain the property of €ompany. Company shall have the right
to inspect, rebuild, remove; reP9ir, improve, relocate on the right of way described above, and make such changes,
alterations, substitutions, additions to or extensions of its facilities as Company may from time to time deem
advisable,
Company shall at all times have the right to keep the right of way clear 'of all buildings, structures and
other obstructions (except fences), trees, roots and undergrowth,. All treesand limbs cut by Company at any time'
shall remain the property of Owner. .
For the purpose of constructing, inspecting, maintaining or operating its fa~ilities, Co~pany shall have
the right of ingress to and egress from the right of way over the lands of Owner. Company shall exercise such
right in such manner as shall occasion the least practicable damage and inconvenience to Owner. Company shall
repair damage to roads, fences or other improvements and' shall pay for all other damage when such damage results
from the construction, inspection or maintenance of Company's fac'ilities, provided Owner gives written notice
thereof to C6mpany within thirty..(30) days after such damage occurs,
Owner, its successors and assigns, may use the right of way for any purpose not inconsistent with the
rights hereby granted, provided such use does not interfere with or endanger the construction, operation and main-
tenance of Company's facilities and provided that no buildings, structures or other obstructions (except fences)
may be constructed on the right of way,
Owner c()venants that it is seised of and has the right to convey the said easement of right of way, rights
and priVileges; that Company shall have quiet and peaceable possession, use and enjoyment of the aforesaid
easement of right of way, rights and privileges; and that Owner shall execute such further assurances thereof as
may be required,

with the Commonwealth Attorney's Office, make a thorough and
extensive .study of the drainage areas and problems in the County
with a view toward establishing a policy on drainage, setting
up and establishing an ordinance provided for drainage districts,
on 'sight and off sight drainage improvements, and the cost there-'
of, and such guidelines as may seem mete and proper for the
orderly implementation of developing drainage areas and
improvements.

Recently, there has been vandalism in our residential area.
During the early a.m. of August 10th my Volkswagon was turned
over in the dri vevlay. Prior to that other minor damage has been
done from time to time. Also, a neighbor has had similar difficulties
in the past few months.
It is requested that Wakefield Road between Cherokee and
Marilea be surveyed for strategically placed street lights. It is
felt that this would be helpful in preventing future vandalism.

Dear Mr. Burnett:
As indicated by the attached copy of order, the Board on today granted the extension
of hours of sale and consumption of wine and beer requested in the resolution of your
Board of Supervisors adopted on July 25', and the regulation shall become effective at
6:00 o'clock, A.M., August 26, 1968.
It will be noted that the wording of the regulation is not in accord in all respects
with the wording of the resolution of your board. However, the regulation is consistent
with the regulations of this agency now in effect which permit sales and consumption
generally until midnight.
The fact that no exception is provided for Sundays in the regulation would not mean
that licensees would be able to sell or allow the consumption of wine and beer in
violation of your county Sunday ordinance between the hours of 12:00 o'clock, P.M.,
of each Saturday and 6:00 o'clock, A.M., of each Monday, as the ordinance when considered
in the light of the enabling Section 4:~97, Code, would prevail insofar as those hours
are concerned over any hours of sale and consumption regulation adopted by this agency.

'IT IS ORDERED that the following regulation be. end 'the same is hereby. adopted:

Section 5.88. Restricted hours; County of Chesterfield.-Notwithstanding
the provisions of any regulations heretofore adopted affecting the hours
during which wine and/or beer. and/or beverages. shall not be sold or
consumed upon licensed premises in the Commonwealth of Virginia. the hours
during which wine and/or beer, and/or beverages. shall not be sold or
consum~d upon licensed premises in the County of Chesterfield. Virginia,
shall be as follows: Licensees in the County of Chesterfield. Virginia,
shall refrain from selling wine and/or beer, and/or beverages. or permitting
the consumption of the same. upon their licensed premises during the hours
between 12:00 o'clock, Midnight, Eastern Standard Time, and 6:00 o'clock.
A.M.. Eastern Standard Time. next ensuing.

contribution of our water connection for the Rescue Squad Headquarters.

the meter toward completion of the job, of which he also donated to the
squad - both labor and materials. ,
