Cosby of Shadycrest Lane come before the Board aSking that County water be supplied on Shadycrest Lane. On motion of hr. Dietsch, seconded by hr. Martin, it is resolved that the County Engineer survey the residents of Shadycrest Lane for' connections and make a study of the costs involved to supply water to this area. On motion of Mr. Dietsch, seconded by hr. Martin, it is resolved tha.t ' permits be granted to the C & P Telphone Compamy, Dominion Heatin] Company and the Commonweclth Gas Corporation, as filed with the Boa1;':d',s papers. On motion of Nr. Purdy, seconded by hr. Apperson, it is resolved that water contract No. AC-625, Bermuda Country Estates, in the amount of $10,939.00 and contract ,\C-624, Hidden Valley, Section I, in the amount of $14,820.20, be and they hereby are approved. On motion of Nr. Dietsch, seconded by ~,r. Purdy, it is resolved that the bid for Proj~ct No. 64l3-B1, for an additional pump for Elkhardt water pumping station be and it hereby is avmrded to Robert A. Thorpe in the amount of $5,365.22,subject to the approval or rejection of an alternate bid. Mr. Dietsch brings to the Board's attention a petition signed by 65 residents of Poco shock Boulevard in which these persons request the County to supply said area with County water. On motion of l';r. Dietsch, seconded by Mr. Purdy, it is resolved that the County Engineer make a study of Pocoshock Boulevard area and report recommendations to the Board. ! ~ The County Engineer p~nts out to the Board tha~he residents of Falling Creek Farms are ~lso asking for County water. After some discussion of the area, it is on motion of Mr. Apperson, seconded by Mr. Purdy, resolved that the County Engineer study the feasibility of placing water in Falling Creek Farms and survey area residents for water connections. On motion of iVir. Brmming, seconded by rir. iViartin, it is resolved that the County enter into an agreement with Professional Data. Inc.for the collection of delin~uent utility bills for a period of one year beginning Nov mber 1, 1968, provided that all names submitted to the Collectors be given to the Board members. Lynn Newcomb - School Board This Commission will submit to the Governor of our State a Highway Safety Program for Chesterfield County. On motion of Mr. Dietsch, seconded by hr. Purdy, it is resolved that the letter received from Mrs. J.D. Dixon, Jr., pointing out the urgent need for traffic signs in worthington Farms Subdivision be forwarded to the State Highway Resident Engineer with the request that the Highway Department favorably consider hrs. Dixon's request. Mrs. Joan B.Chalkley's letter which points out the need for traffic control lights at certain locations in the County is read to the Board. On motion of iVk. Dietsch, seconded by Mr. Browning, it is resolved that this letter be forwarded to the State Hishway DepartmentQfor consideration. -2- . . The Board is notified that on October 17th at Chesterfield County, the Division of State Planning and Community Affairs would like to discuss with the Board and certain other persons the formation of a Planning District of which Chesterfield will be a memberv A letter from Mr. A. D. Via of the Richmond Motorcycle Club, Inc. is read to the Board in which it is requested th<::t said Club be allowed to have a motorcycle race on Octobc,r 27, 1968 at the Chesterfield County r2ce track. The Board discusses the dangers involved and the scheduling of the race track, and on motion of Mr. Apperson, seconded by fir .Browning, it is resolved that the request of the Richmond Notorcycle ClUb, Inc. be, and it hereby is denied. On motion of MB. Purdy, seconded by Mr. Dietsch, it is resolved that the following erroneous tax claims be approved for payment: James P. Apper son, it is resolved that this Board recommends to the Judge of Circuit Court, the Honorable Ernest P. JK.Timmons for the Board of Supervisors to give consideration to participating in the improvement of Longview Drive is discussed by the Board. Upon motion of Mrv Dietsch,seconded by hr. [Vjartin, it is resolved that the E:xecutive Secretary ]:>2 and he hereby is requested to write to l"Ir. Timmons informing him that this Board sees no justification for the County's participation in said improvements. -3- . . On motion of r::r. Apperson, seconded by IIII'. Purdy, it is resolved that the request of Trinity Methodist Church to use the Fair grounds on October 19, 1968, be, and it hereby is approved. Mr. Dietsch reported on the past Police Committee meeting and presented to the members of the Board a proposed Ordinance for the Police Pension and f( etirement System. 68-60CS f1r. Leslie Saunders comes before the Board, representing Sarah Chamberlayne Pearce Est. requesting the rezoning from Residential-2 to General Business C-2 on a parcel of land of irregular shape fronting 300 feet more or less, on the south line of Route 10, 400 feet, more or less, on the east line of lJinfree Street and 330 feet, more or less, on the north line of Dodomeade Street, being situated on the eastern portion of said block in Bermuda Magisterial District. Refer to Sec.llS-7 (2) Blk. Q2 lots 412, 413, 414 and 413B. hr. Saunders cites the need for a lurge supermarket in Chester and explains the plans for the location. Mrs. J.G.Trum~n, in opposition to the zoning request cites the danger to school children at this location. hI's. L.A.l....rmstrong, also opposing this request suggested that there are other locations in Chester much more suitable for the supermarket and that proper planning would not allow the placement at this location. Mrs. Alley, ~rtis Elementary P.T.A.,also speaks in opposition to this request. Mr. Saunders states that increased traffic flow is not necessarily an increase in danger. All plans will be made to eliminate traffic hazards. The Planners will work closely with the ~unty Planner and any other persons recommended by the Board. f-Ir. Custis Cline speaks in behalf of the petition and states that the traffic situation is not as bas as stated here today. ['II'. Purdy reminds the Board that on April 10, 1968, commercial zoning for this area of Cllester was denied. He states that he felt the zoning should stop at the Railroad track, that apartments could serve as a buffer to the residendial areas of Chest0r; however, IItr. Purdy states that he owns commercial property in the Chester area and that since this may be considered competitive with the zoning request, that he would not oppose the request nor would be vote on this matter. Mr. Dietsch moves that the request be denied. There is no second. Mr. Dietsch withdraws his motion. Mr. Browning states that he feels that this is not spot zoning but a good place for business. Traffic to schools and to food stores ,are at different times. Mr. Martin recommends that the Board members view the site. Mr. Browning moves that the request be approved. There is no second). Mr. Tyser comes before the Board stating that he owns adjoining property and that business at this location would be hazardous to his and other children in the neighborhood. Mrs. Barker of Hollywood Drive, states that she has no objection to the granting of a Use Permit for a fabric shop but that she is against the rezoning of the property to C-2. It is pointed out that the Planning Commission had recommenced that the request for the rezoning be reduced to a Use Permit for a fabric shop. Mrs. Payne states that she would like the rezoning of the property and not a Use Permit, because it would restrict her to selling only fabrics and related products. Trevillian. 68-37U Mr. John Wilson, representing the Austin Powder Company comes before the Board requesting a Use Permit to store explosives on a parcel of land of irregular shape, frontin'; 250 feet on the south line of hidlothian Pike (Rte. 60) and extending southwardly to a depth of 2025 feet, more or less, being 4000 feet, more or less, west of the intersect on of Rte. 60 and Rte. 675 in Midlothian Magisterial District. Refer to Sea.17-l0 (1) parcels 12 & 15. Mr. Wilson cites the State's regulations controlling storage and handling of explosives. It is pointed out that these restrictions are very clear. Mr.Wilson states that he looked for a good site for this storage facility and the proposed area meets the State's requirements, that these facilities will be used by County contractors in their work. Mr. Pat Crowley states that he represents the opposition to the zoning request, that there are teenage vandals in this area who have caused property damage and difficulty recently and he asked questions about the storage facility. A general discussion about the type of storage and the hazards follows. Several persons come before the Board stating their opposition to this Use Permit request. On motion of hr. Martin, seconded by hr. Apperson, it is resolved that this Board grant this Use Permit to the Austin Powder Company. A vote being taken Mr. Martin, r'ir. Purdy and Er. Apperson vote Yea. (H'164) Approved Be it enacted by the General Assembly of Virginia: 1. That ~~ 2.1-38 as amended, and'~ 2.1-51.2 of the Code of Virginia be amended and reenacted, and that the Code of Virginia be amended by adding in Title 2.1 a new chapter numbered 7.2, consisting of sections numbered 2.1-64.15 through 2.1-64.21, the amended and new sections being as follows: ~ 2.1-38. Divisions in Governor's office: administrative assistants.-- In the Governor's office there shall be the fol- lowing divisions: Division of the Budget, Division of Records, Division of Industrial Development, Division of Personnel, Division of Planning, Division of Engineering and Buildings, HIGHWAY SAFETY DIVISION, and an office of Economic Opportunity. In addition thereto, the Governor may employ such administra- tive assistants as may be necessary and may fix their salaries within the limitation of funds appropriated for executive con- trol of the State. ~ 2.1-51.2. Same: powers and duties.-- The Commissioner of Administration shall supervise the Division of the Budget, the Division of personnel, the Division'of Planning, * the Division of Engineering and Buildings, and THE HIGHWAY SAFETY DIVISION and shall coordinate their activities with those of other divisions and agencies: all reports to the Governor from the directors of these divisions shall be made through the Com- missioner. In addition, the Commissioner shall exercise such powers and perform such duties as may be delegated to him by the Governor to execute the management functions of the Governor. All State agencies shall make available to the Commissioner any information, when requested by him, which they are required by law to provide to the Governor. The Commissioner shall be responsible only to the Governor. ~ ~- . 2 CHAPTER 7.2. HIGHWAY SAFETY ~ 2.1-64.15. There is hereby created the State Highway Safety Division which shall be under the supervision and direction of the Governor and shall be referred to hereafter as the Division. The Governor shall appoint a Director of the Division who shall hold his position at the pleasure of the Governor and shall be paid such compensation as the Governor may fix. The Governor shall also appoint a Highway Safety Commission, hereafter referred to as the Commission, consisting of eleven members who shall be appointed as follows: initially three members shall be appointed for two-year terms, four members for three-year terms and four members for four-year terms; and as such initial terms expire and thereafter, all members shall be appointed for four-year terms. No member shall be appointed to serve more than two full four-year terms. Vacancies on the Commission shall be filled for the unexpired term. Members of the Commission shall receive no salaries but shall be paid their necessary traveling and other expenses incurred in the discharge of their duties. The Director shall serve as an ex officio member of the Commission. ~ 2.1-64.16. The Division, under the supervision and direction of the Governor, is charged with the responsibility of carrying out the State's Highway Safety Program, and en- couraging, stimulating and developing highway safety programs and activities throughout the State, including specifically the duties to (a) assist the Governor in the formulation and administration of the State's Highway Safety Program. (b) assist the Governor in determining which local highway safety programs shall be approved as part of the State's Program and for pur- poses of federal highway safety legislation. (c) assist the localities in the development and formulation of local highway safety programs. (d) assist in the organization and servicing of local citizens' safety councils to the end that they may generate citizen interest and participation in highway safety activities. (e) review and report to the Governor on the enforcement of and compliance with State and local laws relating to highway safety and develop specific recommendations for administrative and legislative action to the end that such laws are fully enforced and complied with, and (f) assist the Governor in determining the benefits which may accrue to the State und0r the Federal Highway Safety Act of 1966, and the means to take advantage of the federal Act and federal programs in the field of highway safety. The Commission shall advise and assist the Division in the performance of its duties and shall assist the Division specifically through the review and evaluation of the State's Highway Safety Program. ~ 2.1-64.17. The Director shall, under the direction and control of the Governor and acting Uhrough the Commissioner of Administration, exercise all powers and perform all duties im- posed on him by law, and he shall perform such other duties as the Governor or Commissioner of Administration shall require of him. . . ,. . 3 In addition, the Director shall be charged with executive and administrative responsibility to (a) carry out the specific duties imposed on the Division under ~ 2.1-64.16, (b) report to the Governor annually on the status of the State's Highway Safety Program which shall include all activities of the State government directed to the promotion of safety on the highways of the Commonwealth, (c) formulate plans for the im- provement, coordination and further development of a unified, organized and centrally directed Highway Safety Program for the State, (d) develop standards for the evaluation of local highway safety programs, (e) review the activities, role and contri- butions of the various State agencies in the State's Highway Safety Program, and (f) maintain appropriate liaison with federal, State and local agencies so that the State's Highway Safety Program may function appropriately within the broad reach of highway safety activities from the national to local levels. The Director is authorized to employ such personnel and to contract for such consulting services as he may require to carry out the purposes of this chapter. Personnel employed by the Director shall be subject to the provisions of Chapter 10 of Title 2.1 of the Code of Virginia. The Governor may transfer to the Division the staff personnel of the Governor's Highway Safety Committee, which Committee shall be discontinued. ~ 2.1-64.18. There is hereby established a Coordinating Committee to be composed of the State Highway Commissioner, Superintendent of State Police, Commissioner of the Division of Motor Vehicles, the State Health Commissioner, the Super- intendent of Public Instruction, the Director of the Highway Safety Division who shall be Chairman of the Committee, and such other individual heads of State agencies as the Governor may appoint. The Coordinating Committee shall act to promote full cooperation by the State agencies represented in the ex- ecution of the State's Highway Safety Program and all activities related thereto and shall meet on the call of the Chairman. ~ 2.1-64.19. Each county and city within the State shall have a local highway safety commission which shall be appointed by the governing body thereof and which shall consist of such number of members as the governing body may determine, provided that at least one member shall be a member of such governing body. Such commission shall meet a minimum of four times each year and be charged with the responsibility for recommending to the governing body plans for the formulation of a highway safety program for the county or city and thereafter with the responsibility for a periodic review of the operation and effect of such program. ~ 2.1-64.20. There is hereby created a State Highway Safety Advisory Committee which shall consist of the chairmen of each county or city highway safety commission and such representatives of the State at large as the Governor may appoint, provided that the number of members shall not exceed one hundred fifty. Initially, one-half of the representatives of the State at large shall be appointed for two-year terms and one-half for ..,;; .. ... . . 4 four-year terms, and thereafter they shall be appointed for four-year terms. No such representative shall be appointed for more than two four-year terms. The Director of the Highway Safety Division shall serve as an ex officio member and staff of the Advisory Committee which shall meet at least once annually and at such other times as the Director may call meetings. The Committee may elect its own chairman, provide bylaws for its operation and divide into subcommittees. The Committee shall review and compare the operation of local highway safety programs and review and offer recommendations for the improve- ment of the State's Highway Safety Program. ~ 2.1-64.21. Each county and city shall, upon the advice and with the assistance of the local highway safety commission, prepare and submit to the Governor, through the Highway Safety Division, a program for highway safety within such county or city which shall be subject to the approval of the Governor for purposes of determining the eligibility of such county or city to participate in funds and grants available under the Federal Highway Safety Act of 1966 or such State funds as may be made available. Such plans shall specifically include, in addition to such matters as the Governor through the High- way Safety Division may require, material on the status of, need for and means to provide within such locality driver education and driver improvement courses for adults and out-of- school youths and identification of accident-prone-lccations on roads within the locality's jurisdiction and in cooperation with State agencies. Among these is the task of delineating planning districts in Virginia. Planning districts should be logical groupings of counties, cities, and towns which may organize into planning district commissions and work together to solve common problems. , We feel honored to have this responsibility but realize fully that it IS a serious undertaking. The law requires that all areas of. the State be included in a planning district. Because of this, we believe it is absolutely essential to discuss this project with elected officials of local governments throughout the Commonwealth before planning district boundary lines have been drawn. In order to do the best possible job, we need your help. We want to visit your community and meet with you and the other elected officials on your governing body. At this session, we will discuss planning districts in detail. Your reaction to the ideas we present will help us determine how local governments should be grouped to form a planning district in your area. Unfortunately, the problem of scheduling meetings with elected officials is extremely complicated because of the time limit for deline- ating planning districts. In order to maintain project deadlines, our meetings with elected officials must begin this October and be completed by mid-November. . . One hundred fifty-nine local governments in Virginia are eligible for member ship in a planning district. To meet with each of them we must be out in the State every week holding meetings each morning, afternoon, and evening. I wi sh it wer e pos sible to let the elected officials of each local government select the time and date for their meeting with us, but time does not permit it. Instead we must arrange a schedule of meetings covering the entire State and then notify officials of each local govern- ment when we will be able to meet with them. We realize that this is not the most desirable approach. We know also that circumstances will prevent some elected officials from meeting with us, but I urge you to make every effort 'to attend. We need your advice. These meetings will be informal work sessions--formal public hearings will be held early next year. We do not want to restrict attendance to elected officials. Please feel free to invite key employees of your government or other citizens you believe would have a genuine interest in planning districts. Also, we think it would be helpful to have present the members of any planning commission which functions in your area and any General Assembly members who reside there. I trust you will understand the difficulties we faced in scheduling 159 meetings in a six-week period, and I hope that you will be on hand to discuss planning districts with us. This road was opened many years ago by Mr. Gregory and was traveled by the general public. The county has in years pas sed placed a water line in this road. The road is still passable but needs certain improvements to be brought up to the county standards. The propetty on either side of this road is exceedingly low and this is the reason it has not been developed. The present owner would like to participate jOintly with the county in the improvements of the road. The owner would be happy to designate a lO-foot road widening strip to make the right-of-way 50 feet. Because of the shape of the remaining acreage, this lO-foot widening will make some of the land practically unusuable. A trip to the site is recommended and will reveal that because of topography, almost all of Parcel B is unusuable without extensive site improvements.
