12-30-1968 Packet ~) , ~ ~ r_ VIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on December 30, 1968 at 2:00 P.M. Engineer Absent: Mr. J.Ruffin Apperson There was presented a plat of an easement, the vacation of which was requested by Mr. H. L. Hobson along with a suggested easement for the relocation of the proposed drainage system. Upon consideration whereof and on motion of Mr. Dietsch,seconded by Mr. Martin, it is resolved that subject-to the receipt of a new easement the following ordinance be and it hereby is adopted: AN ORDINANCE to vacate an eight (8) foot alley easement in the subdivision of Manchester Heights, plat of which, made by J.K. Timmons, is recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Plat Book 11, page 11, said easement being along the sest line of the reserved parcel at the southwest intersection of U.S. Route 360 and Lancers Boulevard. WHEREAS, Hartman L. Hobson and Marjorie F.Hobson, his wife, have petitioned the Board of Supervisors of Chesterfield County, Virginia, to vacate a certain 8-foot alley easement as shown on the subdivision plat of Manchester Heights~ along the west line of the southwest intersection of U.S. Route 360 and Lancers Boulevard, plat of which, made by J.K.Timmons, Richmond, Virginia,is recorded in Plat Book 11, page 11, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, and notice of the adoption of such ordinance has been given in accordance with Section 15.1-431, Code of Virginia, 1950, as amended. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of tbe County of Chesterfield, Virginia: as on 1. That pursuant to Section 15.1-482, Code of amended, that the 8-foot alley easement described fhe aforesaid plat, is hereby vacated. Mr. Bennie llinkum comes before the Board presenting a plat of a 15-ft. proposed alley easement, lying east of Logan Street and presented a proper notice that an ordinance for the vacation of said easement had been advertised and Mr. Martin stated that he has investigated the matter thoroughly and states that the drainage will not be impaired by the closing of this alley. On moti6n of Mr. Martin, seconded by Mr. Browning, it is resolved that the following ordinance be and it hereby is adopted: AN ORDINANCE to vacate a fifteen (15) foot alley shown on the plat Plan of Bon Air Square No.5, Plat Book 3, Page 65, in the Village of Bon Air, Midlothian District, Chesterfield County, Virginia, and also shown on the plat entitled '~roposed Resubdivision of Lots 1, 2, 3, & 4, Squar~ No. 5 in the Plan of Bon Air, Midlothian District, Chesterfield County, Virginia, made by LaPrade Bros.,Civil Engineers, & Surveyors, dated February 28, 1966, revised October 30, 1968, a copy of which is attached hereto amn made a part hereof. WHEREAS, J. Ferman Irby and Katherine Wamack Irby have petitioned the Board of Supervisors of Chesterfield County, Virginia to vacate a certain 15-foot alley shown on the Plan of Bon Air Square No. 5,Plat Book 3,page 65, in the Village of Bon Air, Midlothian District,Chesterfield County, Virginia, and also shown on the plat entitled "Proposed Resubdivision of Lots 1,2,3,& 4,Square No.5 in the Plan of Bon &r, Midlothian District, Chesterfield County, Virginia, made by LaPrade Bros., Civil Engineers & Surveyors, dated February 28, 1966, revised October 30, 1968, a copy of which is attached hereto and made a part hereof, and notice of the adoption of such ordinance has been given in accordance with Section 15.1-431 Code of Virginia, 1950, as amended. NOW, THEREFORE, BE IT ORDAINED by the BoarN of Supervisors of the County of Chesterfield, Virginia: 1. That pursuant to Section 15.1-482, Code of Virginia, 1950, as amended, that the IS-foot. alley described above, as shown on the Plan of BOQ Air aforesaid and further shown on the plat of LaPrade Bros. ,aforesaid, is hereby vacated. This ordinance shall be in full force and effect in accordance with Section 15.1-482 of the Code of Virginia, 1950, as amended, and a certified copy thereof shall be recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia. Mr. John Plyler comes before the Board seeking a Variance for Joseph Coleman to construct a dwelling on Sheila Lane. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that a Variance from the subdivision ordinance be granted to Mr. Joseph Coleman to construct a dwelling on Sheila Lane, approximately 500 feet south of Forest Hill Avenue. -2- e . Mr. Joyner comes before the Board again requesting some consideration of the alleyway east of Route 1 and south of Chester Hill Circle, in which Mr. W. P. Oliver had constructed a retaining wall adjacent to Mr. Joyner's property. It is here noted that Mr. Purdy would investigate this matter further. On motion' of Mr. Dietsch, seconded by i"Ir. Purdy, it is resolved that the minutes of December 11, 1968 be and the same hereby are approved. On motion of the entire Board, the following resolution is adopted: WHEREAS, Almighty God in His infinite wisdom has taken Mr. Raymond J. Britton from this life, and WHEREAS, Mr. Raymond J. Britton was an esteemed member of this Board from 1952 to 1968 and served diligently with unbounded optimism and unwavering confidence toward attaining the highest level of governmental services possible, and WHEREAS, Mr. Raymond J. Britton was for many years the Chairman of the important Utilities Committee which laid the ground work for the excellent facilities the County has today, and WHEREAS, Mr. Raymond J. Britton was the Supervisor of the most populous district in the County, Manchester, and was loved and respected by every citizen, NOW, THEREFORE, BE IT RESOLVED, that this Board spread upon its minutes its extreme sorrow at the passing of such a warm and generous friend and expresses the sorrow of all citizens, co-workers and acquaintances who will always remember him as an esteemed public leader and christian gentleman who vigorously and effectively served his fellowman at all times. Mr. Cashmere, Mr. Jerry Harris and others of the Ralph Johnson & Associates, of Raleigh N. C., come before the Board seeking the approval of the Malibu Apartments on the Bemiss property at the corner of Rt. 360 and Warwick Road. After a lengthy discussion concerning this and other projects, it is on motion of Mr. Dietsch, seconded by Mr. Martin, resolved that the plans for the 344-units on the stated property, be, and they heceby are approved. On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that a lease agreement with the Virginia State Department of Health for the rental of the County Health Department, be, and it hereby is approved. On motion of Mr. Browning, seconded by Mr. Dietsch, it is resolved that this Board accepts the sum of $3532.50 from the Health Department as the County's share of funds collected in the Home Health Services Program during the fiscal year 1967-'68. -3- '-- e . On motion of Mr. Purdy, seconded by Mr. Martin, it is resolved that the sum of $8000.00 be transferred from 21-081-104 to 21-084-102. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the ordinance for the licensing of the sale of mixed alcoholic beverages be published according to law for a public hearing on March 12, 1969. It is here noted that Mr. Browning and Mr. Martin abstain from voting. There were presented bids for a fleet insurance coverage of the County and Goddin, Goodridge and Robertson, Inc. presented the lowest of six bids, $24,611.00 for increasing the County's accident coverage to $100,000 per personand $250,000 per accident. Upon consideration whereof, and on motion of Mr. Purdy, seconded by Mr. Browning, it is resolved that the Purchasing Agent be and he hereby is authorized to accept the low bid submitted for the increased coverage. On motion of Mr. Martin, seconded by Mr. aetsch, it is resolved that the following water contracts be and they hereby are approved: AC-638 - Olde Coach Hills, Section "A" $38,581.10 35,019.25 AC-649 - Briarwood On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that this Board awards contract C-498 for the installation of a 16" water main in the vicinity of Happy Hill Road from Route L to Harrowgate Road to the Halifax Builders who submitted the low bid of $54,180.93. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the County Engineer be and he hereby is authorized to install a water line on Navarone Avenue, which area lies north of Walmsley Boulevard where citizens are experiencing a lack of water. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that sewer contract 68-47D for the installation of sewers at the corner of Rt.360 and Turner Road, by the Union Oil Company, be, and it hereby is approved. On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that the Chairman of this Board is hereby authorized to sign an agreement with the Southern Railroad Company for an easement across the Southern Railroad near Robious for the installation of a sewer line. On motion of Mr. Dietsch, seconded by Mr. Browning, it is resolved that this Board authorizes condemnation proceedings against Mr. and Mrs. Charles F. Morton,Jro for sewer project 6511-63/3, since Mr. Morton has refused the County's offer of $125.00 for a sewer easement. -4- On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that Old Gun Road be changed to Old Gun Road, East and Old Gun Road,west to facilitate the House Numbering Program in the County. . . On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that the following permits for the installation of public utilities be and they hereby are approved: C&P Telephone Company 1. On motion of Mr. Browning, seconded by Mr. Dietsch, it is resolved that the Virginia Department of Highways is requested to take into the Secondary System of roads, the roads in Westover,South, Bon &r Terrace, Edgehill and the J.C. Little Road. The Board was notified that there would be a hearing on Jan.23, 1969 at 10:00 A.M. at the State Corporation Commission on a request for a eommon Carrier by O1ar1es Jenjamin. On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that the Executive Secretary be authorized to se~k information concerning the possibility of constructing a County hospital here at the Courthouse, with particular emphasis on the financing and the planning -5- i . . in the area. Hobson, his wife, respectfully represent: 1. - That they are the owners of a parcel of land shown on the subdivision plat of Manchester Heights, along the west line of the southwest intersection of U. S. Route 360 and Lancers Boulevard, across which there has been dedicated to the County of Chesterfield a 8-foot alley easement. This alley easement is more particularly shown on plat made by J. K. Timmons, recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Plat Book 11, page 11. 2. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA: 1. That Chapter 5 of the Code of the County of Chesterfield, Virginia, be amended and reordained by adding thereto a new article numbered V.l, containing four new sect~ons numbered 5-64.1, 5-64.2, 5-64.3, and 5-64.4, as follows: ARTICLE V.l MIXED ALCOHOLIC BEVERAGES Section 5-64;1 Definition. ,The terms defined in 5-55 of this Code shall have the same meaning when used'in this article and the term "mixed alcoholic beverage" shall mean a drink composed in whole or in part of alcoholic beverages having an alcoholic content of more than 14 per centum by volume and v served to an individual in a quantity less than the quantity contained in a closed package for comsumption on premises licensed ~der this chapter. Section 5-64.2 Restaurant; Amount of license tax. (a) Every person engaged in the business of operating restaurants, including restaurants located on the premises and operated by hotels or motels, and serving mixed alcoholic beverages and licensed under Chapter 98.18 of Tit~4 of the Code of Virginia, shall P2Y an annual license tax as follows: (1) Two hundred dollars for each restaurant with a seating capacity at tables for fifty to one hundred (,\, persons , ..:..~ . . . (2) Three hundred fifty dollars for each restaurant with ,a seating capacity for more than one hundred but not more tha~ one hundred fifty persons, and (3) Five hundred dollars for each restaurant with a seating capacity at tables for more than one hundred fifty persons. It is proposed that the County of Chesterfield in conjunction with Hill-Burton Funds or some other Federal Program construct a hospital of at least a 200-bed capacity at the Courthouse complex. There is currently sufficient surplus to finance one-half of a $6,000,000 progfam. This proposal has been discussed briefly with the Chairman of the present Hospital Commission who believes that his group could work with the County giving aid in many places toward accomplishing this goal. To implement the program it would be necessary to - (1) Secure an adequate staff of competent doctors. In the three or four years it would take to plan and construct such a facility it is believed that this could be accomplished with ease. (2) Hire a Land Planner with some imagination to plan the Courthouse complex locating the hospital in conjunction with the present Nursing Home and other planned facilities. (3) Increase the sewers to the area. I am sure there is adequate water supply.
