POWELL, his wife, parties of the first part, hereinafter referred to as SELLERS, and the COUNTY OF CHESTERFIELD, VIRGINIA, party of the second "part, hereinafter referred to as BUYER; WITNE,[,[E!H~ That the said Sellers, for and in consideration of the sum of Ten Dollars ($10.00) to them in hand paid by the said buyer, the receipt of which is hereby acknowledged, as well as in consideration of the covenants and agreements and in particu1a that certain sewerage connection hereinafter mentioned, do hereby agree to sell and the Buyer agrees to purchase the following described property, to-wit: ALL of that certain tract or parcel of land with appurtenances thereunto belonging1 lying and being in Dale District, Chesterfield County, Virginia, containing 27.4 acres of land, more or less, as 'shown on sheet in of 4 sheets of a plat of survey made by J. K. T~ons and Associates, Civil Engineers, Richmond, Virginia, dated June 28) 1968, and revised February 18, 1969, to whiCh plat reference is made for a more accurate and complete description of the said land; for the sum of Five Hundred Dollars ($500.00) per acre, net, to the Sellers, payable in cash, and upon the following terms and conditions hereinafter set forth. The said Sellers agree to deliver within sixty (60) days hereafter as within a reasonable time thereafter allowing time to cure any defects in title to the said Buyer, its success- ors or assigns, a deed of general warranty for the said property in fee simple, free of all encumbrances, with marketable title, and simultaneously with said delivery, the Buyer agrees to pay 'the aforesaid cash payment less the amount deposited herewith, which sum shall be credited on the purchase price. Taxes to be prorated as of the date of the delivery of the deed. ~OOK 960 PAGE 594 The Buyer will cut or have cut such timber as in its judgment will be deemed necessary for the layout and construction of a sewer lagoon on the said property and will pay the Sellers 00 therefor the sum of $33 -- per acre cut. With reference to that part of the consideration herein- above mentioned concerning a certain sewer connection, it is agreed and understood between the Buyer and Sellers as follows: (l) The Buyer will construct or cause to be construct- ed and make avai1abilie to Sellers, their successors or'assigns, wit out cost to the Sellers, their successors or assigns, a sewer ,trunk line from the main trunk line, now or formerly to the lagoon, to the remaining property of the Sellers on the south side of the proposed circumferential Route #288 at or near the Sellers western boundary line, having a minimum capacity to serve 300 individual dwelling units. (2) The Buyer agrees that the Seller may connect such collector lines as will be necessary to serve the property to the said sewer trunk line without cost to the Sellers. (3) As and when the Sellers connect to the said sewer trunk line the Sellers agree to pay the then prevailing sewer connection rate for individual connections. The Sellers agree to give to the Buyer the right of ingress and egress to the said property over, through and upon an existing 25 foot right-of-way easement from Hopkins Road as shown on the aforesaid plat of survey; that if and when the said easement is disrupted by construction of the proposed circumferen- tial route #288 the said Sellers will grant and convey a new 25 . foot right-of-way easement~for purposes of ingress and egress to the said property along the north side of and parallel to the proposed circumferential route #288 without cost to the Buyer. 'The Buyer agrees to hold and preserve in a natural state a 300 foot wide buffer strip along the eastern portion of the said property running from the north side of the existing Virginia Electric and Power Company right-of-way easement to the south side of Proctor's Creek as shown on the aforesaid plat of survey. - 2 - liOOK 960 P~:GE 595 The Buyer agrees with Sellers that within ninety (90) days after notice of abandonment of the lagoon the sellers will have the exclusive right to repurchase the property at the same purchase price quoted herein; subject, however, to the granting of an easement for any and all sewer trunk lines in use or pro- posed for construction on the property without cost to the Bu~er. The Buyer will forthwith request the Judge of the Circui Court of said County to appnint a competent Attorney to examine the title of the property and will cause its attorney to complete, such examination with due diligence. In the event that title shall not be marketable in the opinion of the Buyer, and the Sell- ers shall fail to cure all defects in the 'title within sixty (60) days, then unless the Buyer shall waive such defects, this agree- ment shall be null and void and of no effect, and any considera- tion paid hereunder shall be returned. The Buyer reserves the right to determine for itself the effect of any and all easements on the marketability of the title. Possession of the entire premises shall be delivered to the Buyer on the date of settlement. Upon execution and delivery of this Agreement, the Buyer may inspect the property and make such survey, measurements, examinations and borings as it may desire, ,with the understanding that in the event the sale is not completed and the deed delivered, the Buyer will restore the premises to its former condition except for markings and cuttings made by land survey. On motion of Mr. Browning, seconded by Mr. Purdy, it is resolved that the Purchasing Ag~nt be and he hereby is authorized to purchase one (1) Ditch-Witch Model R-60 trencher from the Ditch-Witch of Virginia Company for the low bid of $13,385.00, less 5%. Mr. White, Attorney, representing Mr. Pepper, owner of certain property on the south s~de of Rto60, east of the German School Road, comes before the Board citing the fact that the ~unty had held up a building permit for the construction of several commercial buildings because his client, Mr. Pepper agreed to pay, under protest, a share of the cost of improving the drainage along Reedy Creek and states further that he does not believe that the County should hold up a building permit to enforce compliance of such a drainage policy. On motion of ~1ro Dietsch, seconded by Mro Browning, it is resolved that this Board pay $168.30 to Mr. lYjorris Nason as indicated by the Court Order for his examination of the Maynard R.Powell property in Centralia. On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that a street light be installed at the intersection of Sherman Road and Sherman Courto And be it further resolved that the Street Light Committee view the end of Shady Lane in Chester for the feasibility of installing a street light. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that at the request of the School Board the sum of $84,000 is transferred from the General Fund to the School budget, item 4l-421-Instruction, and the Treasurer of the County is hereby -5- . . requested to make this transfer. On motion of Mr. Purdy, seconded by Mr. Martin, it is resolved that the sum of $20,000 be transferred at the request of the School Board from the General Fund of the County to the School budget for the specific purpose of paying its bill for Data Processing, and the Treasurer of the County is hereby requested to make this transfer. I personally observed the smart turnout, attentiveness, and professional ap- proach displayed by your officers during a confrontation period at our Farmers Market, between demonstrators and policemen from five different local govern- ments. During this tense situation your officers certainly displayed a fine balance of enthusiasm, restraint, and a professional attitude toward what was, at times, a very provoking situation. During some later night and early morning activities of malcontents, the fact that we were able to retain the services of your officers and vehicles doubled our police patrol and response capability. It certainly held down the number of fire bomb attempts and window smashings to a minimum. You have every~ason to be as proud of their performance as I am grateful for it.
