On motion of Mr. Browning, seconded by Mr. Purdy, it is resolved that
the minutes of May 28, June 11 and June 25, 1969 be and they hereby
are approved.
On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that
contract AC-935B for the installation of ....Iater in Pocono, a portion
of Section 'B", in the amount of $9,786.30 be and it hereby is
approved.
On motion of Mr. Martin, seconded by Mr. Purdy, it is resolved that
the following sewer contracts be and they hereby are approved:

There was a brief discussion on the requests for sewers on Piedmont
Avenue and ,it was generally agreed that this could be studied further.
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
the recommendation of the County Engineer and the County's Consulting
Engineer ahat the Larramore Construction Company be granted an ,.
extension of 104 days on their contract on Project 6511-58.
On motion of Mr. Dietsch, seconded by Mr.Browning, it is resolved
that the request of the owner of 1230 Keswick Lane for a reduced
charge for a sewer connection be denied.

On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
an emergency exists in the proposed construction of Project D-69-0lCD/13,
such that it is now necessary to condemn an easement of the properties
belonging to Paul A. and Opal M. Ferguson, and the County Engineering
Department is hereby authorized to institute condemnation proceedings
on the above property.
On motion of Mr. Purdy, seconded by Mr. Martin, it is resolved that
Contract C-650 for the instullation of a water line along Centralia
ROnd and Salem Church Road be and it hereby is awarded to the Stamie ~.
Lyttle Company, Inc., in the amount of $95,883.30.
On motion of Mr. Dietsch, secondes by Mr. Purdy, it is resolved that
since there is no maintenance on Deter Road, between German School
Road and the Exeter ~bdivision, and whereas the traffic on this
right of way is quite objectionable, the County Engineering Department
is requested to place a barricade across Deter Road at the northeast
corner of the Exeter Subdivision.
On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that
the contract for constructing parking lots in front of the new Court
facilities be and it hereby is awarded to the E. G. Bowles Company,
who submitted the low bid of approximately $15,000 with the item of
top soil and seeding to be negotiated.
There was cited a problem concerning certain rights of way across
property of Mr. Henshaw on vJakefield Road and it was agreed that
the Engineering Department would report on this matter at the next
meeting.
There was cited a letter from Mr. Paul Bock, City Manager of the
City of Colonial Heights, stating that the City would accept 16,000
gallons of sewage per day from the County from a connection on
Route #1. It was generally agreed that the matter would be pursued
with the residents of the area who need this sewage treatment and a
report made at the next meeting of the Board.
There was a brief discussion concerning the request of a new water
line along Oakland Avenue before said street is re-surfacedo
The Engineering Department is requested to investigate this situation.
There was read a letter from Mr. Douglas Fugate thanking the Board
for its letter on the naming of the James A. Anderson Highway.
On motion of Mr. Martin, seconded by Mr. Browning, it is resolved
that the roads in the Greenfield Subdivision are recommended for
inclusi6n into the State Secondary System o~ the Highway Department.
There was presented a request for some improvement to the alley which
is the entension of old Quarry Road. Upon consideration whereof

and on motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved
that the Highway Department be requested to investigate that portion
of the right of way on Quarry Road, south of its intersection with
l"lontauk Drive.
There was a brief discussion concerning the request of Mr. S.P.Goodman
about the removal of dirt from his lot facing Leicester Road and it was
agreed that Mr. Dietsch and Mr. Davidson would investigate this request.
Whereas, it appears that both Rt.360 and Rt.60 will eventually
be made a six lane highway, and
Whereas, it is understood,by':this Board that the b~idges
across Rts. 360 and 60 for Chippenham Parkway will be constructed
for only four lanes on these two highways,
Now, Therefore, Be it Resolved, on motion of Mr. Dietsch,
seconded by Mr. Martin, that this Board respectfully request the
Highway Department to consider enlarging the Chippenham bridges to
extend across 6-six ~nes for ~t;'60 and Rt. 360.
On motion of fJlr. Purdy, seconded by l'ir. Dietsch, it is resolved that
the budget for the School Board be changed to the extent that
$44,466.00 be added to the Revenue from the state under -Education-
Professions Development Act and said amount be added to the expenditure
side in item 41-423-236.0 - In Service Training.
On motion of Mr. Martin, seconded by Mr. Browning, it is resolved that
the erroneous tax claim of the Car Care Products Co. in the amount of
$10.00 be and it hereby is approved for payment.
There was read a letter from Mr. Carl Cimino resigning from the office
as Chief Probation Officer and thanking the Board of Supervisors for
its cooperation with his office in the last ten years.
The Board expressed regrets at Mr. Cimino leaving and wished him
great success and satisfaction in his new position with the State.
On motion of Mr. Martin, seconded by Mr. Browning, it is resolved that
a letter from Mr. Dave Satterfield, III, enclosing the opinion of
Mr. John W. Powell concerning the need for a Post Office at the
intersection of Genito Road and ~.360 be received and filed with the
papers of this Board and a copy sent to Mr. Williams.
There was presented by ~lr. Morris Mason, Asst. Commonwealth's Attorney,
a revision of the disorderly conduct ordinance of the County to bring ,
the County's ordinance up to date with the new State's legislation.
On motion of Mr. Martin, seconded by Mr. Purdy, it is resolved that
the amendment to the disorderly conduct ordinance be advertised for
publiu hearing.

Mr. <borge E. l"icDougall comes before the Board speaking in behalf of
a vacuum sewer system developed in Sweden and being installed in
Nassau.
Mr. Clyde T. Green and others speak on the necessity of changing
present methods of construction due to the high cost of labor, materials
and money and states that Mr. Louis Reynolds had some 900acres
in the vicinity of Coalfield Road on which he wishes to set up a
construction plant to prefabricate wall panels in modular components
in an effort to reduce the cost of labor.
He states further that Mr. Reynolds would like to investigate the
feasibility of installing the vacuum sewer system.
It was generally agreed that Mr. Reynolds would investigate both the
construction aspect and the sewer system and present further plans to
the Board9'
On motion of Mr. Purdy, seconded by Mr. Browning, it is resolved that
a Variance be granted on lOt 5, Block C, Section ;~", South Gardens
in Manchester District to allow one corner of the house to be not
less than 28.15 feet from Troy Road.

Mr. Lewis Maetin, Attorney, comes before the Board aad asks that
the request of Mrs. Doris M. Hooper, et als, requesting the rezoning
from Agricultural to Residential-2 on a parcel of land of irregular
shape fronting 350 feet, more or less, on Warwick Road, and extending
1200 feet, more or less, westwardly, being 100 feet northwest of
Holdcroft Drive, in Manchester Magisterial District, which request
had been deferred several times in the past, be deferred for another
120 days since the drainage problem had not been resolved.
On motion of Mr. Dietsch, seconded by Mr. l"lartin, it is resolved that
the request of Mrs. Hooper be deferred for 120 days.

Mr. Frank Holt, representing Mrs. Maude T. Bernhardt, comes before
the Board requesting the rezoning from Residential-l to Commercial
(C-l) of a parcel of land of irregular shape fronting 250.90 feet on
McRae Road, extending eastwardly to a depth of 179.21 feet, being
located in the northeast corner of r-icRae Road and Forest Hill Avenue
and better known as 2719 & 2735 McRae Road in Midlothian Magisterial
District. Refer to Sec. 10-2 (1) parcels 9 & 10.
There appearing no one in opposition to this request and the Planning
Commission having recommended ffits approval, it is on motion of Mr.
Martin, seconded by Mr. Dietsch, resolved that the aforedescribed
parcel of land be and it hereby is rezoned for C-l purposes with the
provision that all plans and specifications be approved by the Planning
Director.

the Board requesting the rezoning from Agricultural to Residential (R-2)

less on Centralia Road extending southwardly to a depth of 1200 feet,
more or less, having Crooked Branch as its southern most boundary, being
located 280 feet more or ~ss east of the intersection of Centralia '
Road and Shiloh Drive in Dale Magisterial District. Refer to Sec.

There appearing no one in opposition to this request and the Planning
Commission having recommended approval, it is on motion of Mr.
Browning, seconded by Mr. Purdy, resolved that the aforedescribed

requesting the rezoning from Residential-2 to General fusiness (C-2)
of a parcel of land of rectangular shape fronting 297.24 feet on

50 feet, more or less, west of the intersection of Jahnke Road and

downgrade the area and the residents want to keep these lots residential.
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
this Board follo~ the recommendations of the Planning Commission and
denies this zoning request.

Mr. Charles Kahl, representing Mr. steve and Katherine R. Slosjarik,
request the rezoning ffom Agricultural to Gmeral Business (C-2)
of a parcel of land of rectangular shape fronting 150.52 ft. on
Midlothian Pike (Rte. 60) extending northwardly to a depth of 306 feet
being located 350 feet, more or less, northeast of the intersection
of Rte. 60 and Granite ~rings Road (Rte. 781) and better known as
7318 Midlothian Pike in Manchester Magisterial District. Refer to

There appearing no one in opposition to this request and the Planning
Commission having recommended approvaw, it is on motion of Mr. Purdy,
seconded by Mr. Browning, resolved that the aforedescribed parcel of
land be and it hereby is rezoned for General Business purposes, subject
to the approval of the Planning Director of the plans and specifications
on this project.

Mr. Richard Repp, representing the Woodstock Home & Land Company
and Somers M.Wilton comes before the Board requesting the rezoning
from Agricultural to General Business (C-2) of a parcel of '. 'land
of irregular shape containing 22.38 acres fronting 983.4 feet on
Pember Lane extending eastwardly to a depth of 1401 feet, being
located 1000 feet, more or less, south of the ~ersection of Rte.60
and Pember Lane in Manchester Magisterial District. Refer to Seco

Mr. Repp states that the owners want to construct a "Business Acres'"
type development.
There appearing no one in opposition to this request, and the Planning
Commission having recommended approval, it is on motion of Mr. Dietsch,
seconded by Mr. Browning, it is resolved that the aforedesdribed
parcel of land be and it hereby is rezoned to General 'Business with the
approval of the Planning ftrector required on plans and specifications.

Mr. Herbert F. Garrett comes before the Board requesting the rezoning
from Agricultural to General Business (C-2) of a parcel of land of
irregular shape fronting 810 ft.,more or less on Rte. 360 and 485 ft.,
more or less on Genito, Road located on the northwest corner of the
intersection of Rte. 360 and Genito Road in Mid10thian Magisterial
Dis~rict. Refer to Sec. 49-9 & 13 (1) part of par. 16. "
There appearing no one in opposition to this request and the Planning'
Commission having recommended approval, it is on motion of Mr. Martin,
seconded by Mr. Dietsch, resolved that the aforedescribed parcel of
land be and it hereby is zoned for General Business purposes with the
recommendations of the Planning Commission as follows:
Approval to General Business (C-2) zoning for a depth of
250 feet on the east line and 875 feet onthe west line; the
rear line being approximately 400 feet. The purpose being to
prohibit business on Genito Road. Further, that site layout,
landscaping and plans being approved by Planning Director.

comes before the Board requesting the rezoning from Agricultural to
Residential- (R-2) of a parcel of land of irregular shape located
280 feet, more or less, bortheast of Second Branch Road extending
northeast to a depth of 1075 feet, more or less, being located 5800 ft.
more or less, north of the intersection of Second Branch Road and
Courthouse Road in Dale Magisterial District. Refer to Sec. 92 par.

There appearing no one in opposition to this request and the Planning
Commission having recommended approval, it is on motion of Mr. Dietsch,
seconded by ~tr. Browning, resolved that the aforedescribed parcel of
land be and it hereby is rezoned to Residential-2 purposes.

Mr. P.J. Liatos, representing the Malvern Construction Company comes
before the Board requesting the rezoning from Agricultural to Residential
(R-2) of a parcel of land of irregular shape containing 7.82 acres
lying north of Ul1swater Avenue and between the subdivisions of Derwent,
Sec. Band Larkwood, and being 300 feet, more or less, north of the
eastern terminus of Daytona Drive in Manchester Magisterial District.
Refer to Sec., 29-8 par. 10-1.
There appearing no one in opposition to this request and the Planning
Commission having recommended approval, it is on motion of Mr. Dietsch,
seconded by Mr. Purdy, resolved that the aforedescribed parcel of land
be and it hereby is rezoned for R-2 purposes, provided a satisfactory
plan for the drainage be submitted to the County Engineer.

Mrs. F. W. Villano comes before the Board requesting a Use Permit
to operate a day nursery on a parcel of land of irregular shape having
a combined frontage of 375 feet, more or less, at the interssection of
Banton Street and Atlantic Avenue and being located on the southwest
corner of said intersection in Manchester Magisterial District.
Refer to Sec. 42-6, Blk. 10, lots, 18, 19 and 20.
There appearing no one in opposition to this request, it is on motion
of , Mr. Dietsch, seconded by Mr. Martin, it is resolved that a Use
Permit to operate a day nursery on the aforedescribed parcel of land be
and it hereby is approved.

Mr. J.J. Via, represented by Mr. Lewis Martin, comes before the
Board requesting a Use Permit to operate a snack bar and to sell bait
on a parcel of land of rectangular shape fronting 210 feet, more or less,
on Genito ~ad, extending south to a depth of 400 feet, more or less,
being located on the southeast corner of the intersection of Genito
Road in Midlothian Magisterial District. Refer to Sec. 46 par 28.

Mr. Charles T. Armistead comes before the Board requesting a Use
Permit to operate an Optometrist office for approximately one year
on a parcel of land of rectangular shape fronting 110~85,feeton
West Hundred Road extending southwardly to a depth of 200 feet, more
or less, being located 160 feet, more or less, east of the intersection
of Old Centralia ~ad and ~st Hundred Road in Bermuda Maglsteriai
District. Refer to Sec. 115-7 (2) par. 370 ,
Mr. Armistead presents Dr. Wells, who is now in the military service
and wishes to use a portion of Mr. Armistead's building for one year.
Upon consideration whereof and on motion of Mr. Purdy, seconded by
Mr. Dietsch, it is resolved that a Use Permit to operate an Optometrist
office on the aforedescribed parcel of land be and it hereby is issued
to Dr. Wells for one year only.

Mr. Marion K.Bibb comes before the Board requesting a Use Permit to
maintain an office machine repair shop on a parcel of land of
rectangular shape fronting 150 feet, more or less, on Proctor's
Road extending westwardly to a depth of 80 feet, more or less, being
loca~ed on the northwest corner of the intersettion of Proctor's
Road and Cresswell Road and better known as 9508 Proctor's Road in
Bermuda Magisterial District. Refer to Sec. 81-15 (3) Blk.G,lot 90
There appearing no one in opposition to this request, it is on motion
of Mr. Purdy, seconded by Mr. Martin, resolved that a Use Permit to
operate an office machine repair shop on the aforedescribed parcel ,
of land be and it hereby is approved, provided that there are no signs
displayed or modification to the existing building and the Use Permit:
to be given to Mr. Bibb personally.

Mr. ~.W. Wade, III comes before the Board requesting a Use Permit to
construct quiet offices on a parcel of land of rectangular shape
fronting 245 feet, more or less, on Everglades Drive e~tending
northwardly to a depth of 160 feet, more or less, being located on
the northwest corner of the intersection of Everglades Drive and
Arcadia Street, and better known as 6800 and 6808 Everglades Drive,
in Manchester Magisterial District. Refer to Sec. 19-10 (2) lots
110, 111,112 and l13.

There appearing no one in opposition to this request, it is on motion
of Mr. Dietsch, seconded by Mr. Purdy, resolved that a Use Permit to
construct quiet offices on the aforedescribed parcel of land be and
it hereby is approved.
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
the County Planner notify Mr. W. E. Hall to appear at the Board meeting
on 3uly 23, 1969 to show cause why a Use Permit granted on May 8,1968
should be continued.
On motion of Mr. Dietsch, seconded by Mr. Browning, it is resolved that
the proposed amendments to the County's Motor Vehicle License Ordinance
be advertised for a public hearing.
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
this Board requests the State Highway Department to consider the
intersections of Chippenham Parkway with Rts.l, 10, 60 and 360, in
light of future traffic problems, the necessity for additional rights-
of-way and the advantages for planning immediately to meet tbese future
problems, and further to advise the County as soon as possible the
additional rights-of-way that will be needed so that the County can
assist in either acquiring the rights-of-way or havin~ same reserved
for future acquisition.
There was presented a request of the Capital Region Park Authority
for the County's share of $11,800.00 to meet the proposed budget
for said Authority for the year 1969-'700 Upon consideration
whereof, and on motion of Mr. Dietsch, seconded by Mr. Martin, it is
resolved that the County pay one-half of this amount and to negotiate
a new amount if annexation takes place in January,1970.
It is here noted that Mr. Browning votes No.
On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that
the name of the Chesterfield County Welfare Department be changed
to the Department of Social Services and that the title of the
Superintendent of Welfare be changed to Director of the Department
of Social Services.
On motion of Mr. Horner, seconded by Mr. Dietsch, it is resolved that
the following resolution be and it hereby is adopted:
I would like to turn for a moment to a question that I
think is uppermost in all of our minds and that is the effect
the annexed territory will have upon the remaining citizens and
magisterial districts of the County. Midlothian and Manchester,
in particular, will be reduced substantially in size and in
population: It is my thought that it would be appropriate and
in the best interest of the citizens of the County to move towards
a redistricting of the magisterial districts. I would, therefore,
like to move that the Commonwealth's Attorney prepare an appropriate
resolution for the Board to petition the arcuit Court for
redistricting the County along new lines that will accomplish
equal apportionment among the districts.

On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that
this Board requests the Commonwealth's Attorney to seek a written
opinion from the Attorney ~neral on the status of the Delegates
to the House of ~presentatives and the Senate of the State,
particularly in regard to the area that may be annexed on January 1,
1970.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that
this Board take over an existing street light on Shawnee Road,lying
west of scottview Driveo
On motion of Mr. Dietsch, seconded by !\'Ir. Browning, it is resolved
that this Board adjourn at 5:35 P.M. to 2:00 P.M. on July 23, 1969.

land of irregular shape fronting 1848.53 ft. on South Courthouse Road
extending southwardly to a depth of 1250 ft. ! being located 7900 ft. t
west of the intersection of South Courthouse Road and Nash's Road

WHEREAS, Julian E. Savage and John S. Smart,
Trustees, of Brighton Green Land Corporation
Profit Sharing Plan, are the owners of all real
estate fronting on the eastern and western lines
of a section of Long View Drive, between Club Lane
and a line across Long View Drive extended from the
northeastern corner of Lot 114, Fairway Subdivision
(western line of Long View Drive) to the eastern
line of Long View Drive in Chesterfield County,
Virginia, as shown on a plat by J. K. Timmons &
Associates, Civil Engineers and Surveyors, dated
March 14, 1969, and filed herein; and
WHEREAS, said Trustees have petitioned this Board
to abandon the aforedescribed section of Long View
Drive, deem said sect,ioI1 no longer necessary for
the pUBIQC use and authorize the conveyance by the
County of Chesterfield of the section sought to be
abanddhed to the, Petitioners in exchange for the
conveyance by the Petitioners to the County of a
new s~ction of Long View Drive between Club Lane
and the aforedescribed line across Long View Drive,
all of which is shown by broken lines on a plat
by J. K. Timmons & Associates, Civil Engineers,
date'd March 13, 1969, and filed herein; and
WHEREAS, the County of Chesterfield acquired the
fee simple ownership of the section of Long View
Drive sought to be abandoned, by deed from Constance
Heath Gregory, widow of George C. Gregory, dated
December 12, 1958, and recorded in the Clerkls Office
of the Circuit Court of Chesterfield County, Virginia,
in Deed Book 577, page 234; and
WHEREAS, Constance Heath Gregory acquired her in-
te~est in the aforedescribed section of 'Long View
Driv~ under the will of her husband, George C.
Gregory, who died August 25, 1956, said will being
dated December 2, 1938, and probated September 4,
1956, in the Clerkls Office of the Circuit Court of
Chesterfield County, Virginia, in will Book 53,
page 410; and
WHEREAS, the section of road sought to be abandoned
is not part of the virginia State Highway System
or Secondary System; and
WHEREAS, notice has been given pursuant to ~33-76.15
Code of Virginia (1950 as amended); and
WHEREAS, no public necessity exists for the con-
tinuance of the section of Long View Drive sought
to be abandoned; and
WHEREAS, the proposed abandonment and conveyance
will not interfere with any rights of any other
parties; NOW THEREFORE, WITNESSETH:
That the Board of Supervisors of Chesterfield County,
Virginia, does hereby approve the abandonment of the existing
section of Long View Drive as shown on said plat filed herein,
and hereby declare and deem said section abandoned and no longer
necessary for the public use.
Further, that the County of Chesterfield is hereby auth-
orized to convey to the Petitioners, Julian E. Savage and
John S. Smart, Trustees of Brighton Green Land Corporation Profit
Sharing Plan, the section of Long View Drive abandoned hereby,
in exchange for a conveyance to the County of Chesterfield the
new section of Long View Drive as shown on the aforesaid plat.

Dear Mr. Burnett:
I wish to re -confirm my previous letter to you and verbal
confirmation of our position regarding the acceptance of sewage from
the trailer court at Swift Creek and U. S. 301. City Council has agreed
to accept sewage from this area in an amount not to exceed 16,000
gallons per day and handle such sewage through our treatment plant in
order to eliminate the unsafe condition that exists as the result of raw
sewage being emptied into Swift Creek in this area.
Residents of the citywhose property borders on Swift Creek
are deeply concerned about the health hazard that presently exists and
are pressing me to take some action to remedy the situation.
Please let me know what steps Chesterfield County is taking
and approximate date we can expect corrective measures to be completed
to eliminate the disposal of raw sewage into Swift Creek.

As most of you are aware of, by this time, I have accepted a
new position with the Law Enforcement Administration, Com-
monwealth of Virginia. This is a new agency within the Gov-
ernor's Office and offers an opportunity that was impossible
to turn down. Though I will not have the title of Assistant
Dir~ctor I will be functioning in that capacity. My title
will be Program Officer and will carry the responsibility
of impl~menting the state's comprehensive law enforcement
plan under the provisions of the Omnibus Safe",Streets and
Crime Control Act of 196$. This is a challenging opportunity
and one that I hope you will be hearing more of in the future.
I want to take this opportunity to express my sincere ap-
preciation for all that you, as individuals and as a board,
have done for my office in the past ten years. Though I
cannot recall any occasion when I appeared before the board
to make a request, you have, as you well know, passed on
them as they were presented to you by Mr. Burnett or by
Judge Murphey. I might also mention that I appreciate the
fact that over the years I have been permitted to run this
department without any board member in any way attempting
to influence the operation of its overall program or in any
individual case, Needless to say the experience that I have
had in Chesterfield was quite instrumental in my getting my
new position.
I will always cherish my association with Chesterfield County
and will look on it as ten enjoyable employment years.

I am enclosing a letter I have received from
, the Office of the Postmaster General in response
to a request I made for a feasibility study of
the area of Genito Road and Route 360, Chesterfield
County, as a potential location for a branch post
office.
It is the decision of the Post Office Department
that requirements at this time do not justify the
location of a postal facility at this site. With
the growth in population anticipated for this area
it is likely this site will be reconsidered at a
later date.
I will, therefore, hold this matter in abeyance
for future review and hope you will notify the Board
that I will, gladly call for another feasibility study
at an appropriate time.

Dear Congressman:
I have your letter of April 30 to the postmaster at Richmond,
Virginia concerning the possibility of establishing a branch
post office in the area of Genito Road and Route 360 in Chester-
field County, Virginia.
A thorough assessment of the postal service requirements of the
Genito Road and Route 360 area has been made, and it has been
determined that the requirements at this time do not warrant
the establishment of a branch post office.
Although extensive development of the area has been planned
for the next 15 year period, the area at this time is ex-
clusively rural with only an occasional service station or
general store along the highway. At such time as the community
begins to develop in population density I can assure you that
appropriate consideration will be given to arranging or re-
arranging the postal service to meet the needs of the community.

Re: Disorderly Conduct
Dear Mel:
The disorderly conduct statute has been reo;enacted
by the legislature and the act allows the County to adopt
ordinances similar thereto. The act provides that we may
adopt all or any part of the statute and accordingly I
have drafted two sections to be added to the existing code.
I thing it would be well to present this amendment to the
Board for its consideration and adoption.

Ordinance
Dear'Mel:
On May 14th the Board requested the ~ommonwealth'Attorney's
Office to review the aboveardinance for the purpose of bringing
it in line with the state law.
The ordinance and state statutes have been reviewed and
they are in line with one another except that Section 6-218 of
the county ordinance makes a provision for full refund to
applicants where a license is purchased and not used if surrend-
ered prior to commencement of the license tax year. The state
statute makes no provision for full refund. Mr. Moore and I
gave great consideration to this full refund provision in draft-
ing the ordinance before settling on the final draft as now appears
in the ordinance.
The Commissioner of the Division of Motor Vehicles is given
broad regulatory powers by statute. The License Department has
a policy with regard to making full refund which it asserts under
this regulatory power. I am advised their policy is that whenever
an applicant purchases state tags and does not use them or attach
them to a motor vehicle, a full refund of the license tax will be
made. Apparantly there is no time limits on when a full refund
may be made. As a point of interest, I might add, that the three
people I talked with at Division of Motor Vehicles each had diffe-
rent ideas about the policy and when a full refund should be made.
They were .all inclined to agree that the policy was a little loose.

Mr. Moore, as Treasurer of the County, has no regulatory
power such as the Commissioner of Division of Motor Vehicles
and he must look to either the state statute or county erclinance
for his authority.
As you know, under our new ordinance the County issues
decals rather than plates. With decals it would be impossible
for the Treasurer to adopt a policy to coincide with the policy
of Division of Motor Vehicles even if he had such autherity.
About the only thing the Treasurer can do is disregard the condi-
tion of the decal whenever a request for full refund is made and
rely upon the evidence from the Division of , Motor Vehicles that
the applicant is entitled to a full refund. ,If the Board wishes
to parallel the Division Of Motor Vehicles policy by ordinance,
it may consider amending paragraph 3, Section 6-218 to the follow-
ing or similar language:
In cases where the applicant surrenders his
license and produces a certificate from the Division
of Motor Vehicles that a full refund of the license
tax has been made, the Treasurer shall make full
refund to ,the applicant upon the payment of the fee
of $1. 00.
The present ordinance provides for a transfer fee of $1.00
and a replacement fee of 509. If the ordinance is to be amended,
Mr. Moore and Mr. Williams request that the replacement fee be
amended to the same amount a3 the transfer fee.

that is the effect the annexed territory will have upon
the remaining citizens and magisterial districts of the
Count;. ~Midlothian and Manchester, in particular,
will be reduced substantially in size and in population.
It is my thought that it would be appropriate and in the
best interest of the citizens of the County to move towards
