Purdy On motion of Mr. Britton, seconded by ~~.Goyne, it is resolved that the minutes of December 13, 1967, be and they hereby are approved. On motion of fJ~. Britton, seconded by Mr. fJlartin, it is resolved that the following ordinance be and it hereby is approved, subject to the approval of the Commonwealth "s Attorney: WHEREAS, Falling Creek Hills Subdivision as shown on plats in Plat Bomk 11, pages 5, 6 and 7 in the Clerk's Office of this County was approved by the County and recorded on January 15, 1959; and WHEREAS, on October 30, 1963, land for Route 892 was deeded to theCommonwealth of Virginia and this highway has now been built through the subdivision in such a way as to take most of the lots in Block K, leaving only one usable lot and five piece of lots that cannot be used for building sites as shown on plat hereto attached and entitled "Map showing the residue of Block K, Falling Creek Hills, Bermuda District, Chesterfield County, Virginia, Proposed to be Vacated along with a portion of Grinton ~ad and a portion of Allerton street and easements shown hereon" made by LaPrade Bros., and dated November 10, 1967; and, WHERSAS, no lots in Block K have been sold; and, WHEREAS, the layout or the lots in the remaining portion of Bloc~ K is not satisfactory to the owner or the County, and, WHEREAS, the vacation of the remaining portion of Block K, the parts of Grinton Road and Allerton ~reet and the easements shown on said Map attached to be vacated will not cause any damage or inconve~ nience to the owners of any of the remaining lots in said subdivision provided the easements for wa er and sewer lines ahown on said plat to be dedicated are reserved. . . " NOW, THERLFCRL:, K; IT R,::;SOLifccD: That the Board doth approve the vaccction of the plat or the remainder of Block K, Falling Creek Hills ~bdivision, the lots vacated being Lors 1 through 6, both inclusive, Block ~, and the vacation of the parts of Griton Road and Allerton street and the easements shown on the map attached to this resolution to be vacated subject to the reservation by the County of the easements ror sanitary sewer and water lines shown on said map as " to be dedicated" and copy of said map is to be filed in the C12rk's Office of the arcuit Eourt of the (bun ty . iVlr. Grady Prentice and Fir. A.L.Davis come .before the Board suggesting that the Fair Association merge with Amelia and Powhatan Counties on a one year trial basis and pointed out certain advantages which might accrue to each County. Upon consideration where,of, and on motion of t"lr. Apperson, seconded by hr. Goyne, it is resolved th t this Board herewith records its approval on such a merger for a trial period of one year. There were read two resolutions concerning the operation of the Richmond Regional Planning Commission, the first of which advocated a payment by the State of $10,000 for ,25,000 population in each region for planning purposes. The second resolution would make it possible for more of the governing body of each locality to be on the Hegional Planning Commission. Upon consideration whereof, and on motion of l';r. Britton,seconded by Ivlr. Hartin, it is resolved that this Board endorses the concept of the aforementioned resolutions. There was read a request from r'lr. \/J. W. Mabe requesting the continued use of the horse barns and race track facilities at the County Fair Grounds by those devotees of trotting ponies. Upon consideration whereof, and on motion of fJ~. Apperson, seconded by Mr. Browning, it is resolved that this request be denied since it would be somewhat unreasonable to allow individuals continued use of County facilities. This day the matter of improving State Rte.1003 and hard-surfacing same comes before the Board and the estimated cost of the Highway Department for hard-surfacing this road is $2500. Upon consideration whereof and on motion of hr. l"lartin, seconded by Mr.Gcyne, it is resolved that this Board requests the Highway Department to consider this one-half mile stretch of Salisbury frive in the next year's budget for surface treatment. There was read a letter from Judge R.S.vveaver concerning the sidewatks in Ettrick, which letter stated that the Highway Commissioner for this district agreed with the Highway administration that the sidewa+ks in Ettrick were not the responsibility of the Highway Department~ -2- . . and that this opinion was based on the fact that a careful search of the records in the Qerk's Office would prove this to be true. On motion of Hr. Browning, seconded by l'ir.Goyne, it is resolved that this Board requests the High\vay Department to meet vJi th the Commonwealth's, ~torney to examine the ~ight of way records of Chesterfield Avenue in : Ettrick. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that the erroneous tax claims cf N.E. and Meda M. Boguess, 5118 Snead Road, RiChmond, Va. in the amount of $84.24, be and it hereby is approved for payment. There were presented six (6) bids on furnishing insurance for the fleet of County cars Dot including the School Board behicles. And it was point~d out that alternate bids on a higher rate of insurance were sought and that the price paid for the higher coverage justified the purdhase of Bodily Injury liability in the amount of $100,000 limit each pe~son and $250,000 limit each accident and an increase in Property damage liability to $25,000. Upon consideration whereof, and on motion of I''ir. Britton,seconded by lVir. Browning, it is resolved the.t the bid of Goddin, Goodridge and Robertson, the lowest submitted, in the amount of $24,809.00 be and it hereby is accepted, which amount purchases the higher insurance coverage. Mr. Sonny Sneed comes before the Board requesting the abandonment of a portion of Evansway Lane in Holliday Hills, Sect. 2, in Midlothian District and authorized the ~airman and Qerk of this Board to sign a quitclaim conveying the rights of the ~unty to the adjacent property O\vner s . There was presented a petition signc:d bjT a number of citizens of the Willow Caks Subdivision, which petition had been presented to the Board some weeks ago and referred to the County Planning Commission for its recommendation. There was read a resolution from the Planning Commission recommending that the stub road leading eastwardly from Briarwood Road into the property of the ~Jillow Oaks Country Club not b~ closed as requested in the petition presented. It was further pointed that this road may some day be needed as an access road and good planning dictates that the right of way be left as presently dedicated. Upon consideration whereof, and on motion of lir. Britton, seconded 9Y Mr. Martin, it is resolved that the request of the citizens of Willow Oaks Subdivision for closing the stub road known as Eppington Road, be and it hereby is denied. -3- . . There was again presented the request of fJir. Douglas Bethel to sell approximately II-acres of land in the Gravel Hill area to the County for a proposed park or recreation center. fJ1r. Howard Mayo, County Planning, states he has viewed the property and presents pictures showing certain aspects of this location. On motion of Mr. Britton, seconded by Mr.Goyne, it is resolved that this matter be delayed for further study by the in-coming Board of Supervisors. There was read a letter from Mr. C.T. Marks, stating that the 24 Chesterfield families who now are served from the Powhatan Exchange will be given service from the ~,idlothian Exchange before the end of 1968. Upon consideration whereof, and on motion of Mr. Horner, seconded by Mr. Browning, it is resolved that the letter be received and a letter of thanks ~for the cooperation of the Telephone Company be sent to hr. Marks. It was cited that the Court had awarded ~rs. John 0gbill the sum of $38,500 should the County wish to purdhase this .65 of an acre at the corner of Lori Roads and Rt. 10, and that the County had sought the purchase of this land by condemnation. On motion of Mr. Apperson, seconded by Mr.Goyne, it is resolved that the John Cogbill property be purchased at the sum of $38,500.00. The matter of constructing an addition to the Health Department comes before the Board and it was cited that the estimated cost of the proposed addition would be $436,700, and that the County's cost of this improvement would be $200,040,00. Upon consideration whereof, and on motion of Mr. Martin, seconded by ~~. Goyne, it is resolved that this :,oard appropriates the sum of $200,04U.00 for the construction of an addition to the present Health building at Chesterfield Courthouse and requests the Treasurer ro set aside this amount from the Capital Outlay budget for this purpose. On motion of Mr. Browning, seconded by Mr. Goyne, it is resolved that Mr. John Longmire, Assistant to the Executive Secretary and Mr. C.G. Manuel, County Purchasing Clerk, be and they hereby are authorized 50 sign all papers for the addition to the Health Department at Chester- field Courthouse. On motion of Mr. Apperson, seconded by Mr. Britton,it is resolved that the following water contracts be and they hereby are approved: A-465 - Mayfair Subdivision $1352.50 A-502 ~- Meadowbrook Plaza 31o)ping Center 4262.00 On motion of r'Jr. hartin, seconded by ~1r.Britton, it is resolved that the Chairman and Clerk of this Board be and they hereby are authorized to sign an agreement with the Southern Railway Company to construct and maintain a 16" water line across the right, of way on said Railroad -4- . . at Bon Air, adjacent to and south of Lot 10, Block D, of the Englewood Subdivision. On motion of Mr. Britton, seconded by Mr. 1'1artin, it is resolved that contract S-68-4D for the instullation of a sewer line on LaBrook Drive be and it hereby is approved.. On motion of Mr. Apperson, seconded by Mr.Goyne, it is resolved that the Purchasing ~ent be authorized to purchase street signs aceording to a list of intersections prepared by the House Numbering Department. It is understood that where there is opposition to the proposed names that no street sign be purchased at this time. WHEREAS, plans have been generally approved for the construction of a sewage treatment plant on the James River to serve the are$of Powhite Creek and the Upper James; and vlliEREAS, it has been suggested that the sewerage from these areas could be treated by the City of Richmond when its trunk line up the James RiMer is completed; and WHERLAS, the treatment of this sewerage by the City would obviate the necessity of building a sewage treatment plant at a location presently being sought for an interchange by the Metz;opolitan Toll Road huthority, and WHEREAS, the County for many months has been unable to ascertain what price the City would charg~ for treating the County's sewerage at this point, NO"';' THJ:.:RLFOfL, Bi:. IT RESCLV;;;D, on motion of hr. ~ritton, seconded by Mr. Goyne, that this Board requests the Council of the City of Richmond to give to the County, within the next b'lirty days, a pric2 for treating aewer.cge from the Upper James River area. There was read a letter of commendation and appreciation for the services of Mr. Robert Eanes, Fire Marshal of the County, from the Bechtel Corporation, which letter was ordered received and filed. There arose a discussion concerning the necessity of coordinating the street naming in the southern part of the County and in a similar fashion as in the northern part of the County. Upon consideration whereof, and on motion of fJ~. Br~wning, seconded by Mr.' Goyn'e, it is' resolved that this Board request '\;he County of Dinwidd4", to cooper~,te wtth the County of Chesterfield to see that the names of new streets in both area are not duplications of existing street names. _5_ . . The Chairman states that this Board has not accepted the resignation of the Executive Secretary and stat0s he has talked with a number of people who indic~ted that it would be in the best interest of the County if ~r.Burnett would withdraw his resignation. Other members of the Board speak to t;-'e point that citizens in their area have requested that all erforts be m~de to eetain the servic~s of the present Executive ~ecretary. Upon further consideration, 2nd on motion of hr. Martin, seconded by Mr. Goyne and hr. Britton, it is resolved that this Board asks the Executive Jecretary to reconsider bis resignation and to give an answer on or before January 10, 1967. It is here noted that Mr. Apperson abstains from voting. The Chairman commends lVir. Goyne and Lr. Britton for the ir many services to the Board during the 32 years of Mr. Goyne's tenure of office and the 16 years for hr. Britton. Mr. Apperson states that he has been greatly enriched by the association of both of these gentlemen. Mr. Britton says he will miss the fellowship and association attendant to the office of Supervisor and praises Mr. Dietsch and expresses his sincere hope that the County will continue to expand and progress. Mr. Rldy states that he has been given the:: cooperation from every official in the County and thanks everyone for their help while he was Commonwealth's Attorney. Mr. Goyne states he has received great cooperation from everyone, that he leaves the office of Supervisors of Bermuda District with respect for all of the officials of the County, and has had the thrill of his life for the last 32 years. Mr. Goyne wishes all of his f~llow Supervisors Godspeedo WHEREAS, Mr. O. B. Gates has been Sheriff of the County of Chesterfiela for 43 years and is retiring from office on December 31, 1967; and, WHEREAS, Mr. O. B. Gates has sustained serious injury resulting from an automobile accident on December 24, 1967, New, THEi1LFc'iE BL IT R;:';SCLV,~D, on motion of F:r. Apperson, seconded by Mr. Browning, that due to the esteem and affection that f-'lr. Gates enjoys from everyone, this Board sends its sympathy and solicitude for the injury roceived and wishes him a speedy recovery and a pleasant and happy retirement. WHEREAS, regional planning commissions ore currently charged with pre- paration of comprehensive plans for the social, economic and physical growth of various regions within the Commonwealth of Virginia; and WHEREAS, the burden of this task has increased in complexity with the pas- sage of ti me; and WHEREAS, being creatures of the state, regional planning commissil)ns ore likely to be given the added burden of coordinating and detail0' ing state plans within their jurisdictions in the future; an~ WHEREAS, it is becoming increasingly difficult to ask participating member jurisdictions to make larger contributions to finance such opera- tions; and WHEREAS, it has been recognized that it is not sound fiscal policy to rely upon federal dollars for this purpose; and WHEREAS, the current state annual appropriation is inadequate and in- equitably allocated among the various regional planning com- missions; THEREFORE, be it resolved that the Richmond Regional Planning Commission I recommends to the 1968 General Assembly that the state in- crease its financial support to such agencies to the amount of ten thousand dollars ($10,000) per twenty-five thousand popu- lation in each region, thus accomplishing 0 more equitable allocation of funds. WHEREp,S, regional planning commissions are currently carrying on comprehensive planning for the future growth of the various regions of the state; and WHEREAS, the burden of this task has been increased in complexity with the pos- , sage of time; and WHEREAS, such agencies continue their efforts out of context with a metropolitan decision-making process and functional implementing agencies, thus increasing the frustrations of this task; and WHEREAS, planning is most effective when carried on integral to some definitive form of metropol itan governmental process; and WHEREAS, progress can be made to better this situation, even if only for an in- ,terim period, through a slight change in existing regional planning legislation; THEREFORE, be it resolved that the following sentence be deleted from the first part of Article II on Regional Planning Code No. 15.1-432: "Not more than one member of the governing body of each participating political sub-division shall be a member of such Commission. " ' so that said article would then read as follows: "15.1-432. Establishment, members, rules, etc., of regional planning commissions; cooperation of participating counties . and municipalities; bonds of employees. - (a) The governing bodies of any two or more counties or municipalities which authorize the establ ishment of membership in, and suppart of, a regional planning commission shall determine the number and qualifications of the members of any such commission, their terms of office and method of appointment or removal. Members of regional planning commission shall serve without salary but may be reimbursed for expenses incurred in the performance of their duties. The commission shall elect a chairman who shall serve for a fixed term not exceeding four years and who shall not be eligible for reelection as chairman for the ensuing term. Mabe, Sr. 3933 Warwick Road Richmond, Virginia ~' , :-~ '...-,--,- . ,...- , ....-...... --~,..."'.......-~....... .~.. . ....::..:'.:. .,~---'~""-- .-~_., -. . . . 3933 Warwick Road Richmond, Virginia December 11, 1967 Mr. Howard Mayo Dear Mr. Mayo: A group of local members of the Souths ide Virginia Trotting Pony Association, Inc., which is affiliated with the National Trotting Pony Association, has asked me to write to you concerning the use of certain facilities at the Chesterfield County Fairgrounds, Chesterfield Cour thouse, Vi rginia. Specifically, it is respectively requested that the aforementioned members be allowed to utilize the race horse barns and track at the Fairgrounds on an overnight basis. As you know, they have been granted permission to use these facilities during daylight hours. However, most of the members are employed and do not now have the sufficient daylight hours required to transport their ponies and equipment to and from the Fairgrounds. ,;~"'.< The purpose of this request is to obtain these facilities so that the' members can train and condition trotting ponies for early racing events to' be conducted in Chesterfield and 50uiiliside Virginia. It is anticipated tlul,t these facilities would be used through March 1968. If, during this period, other horse or pony groups required the use of the same facilities, the ponies and equipment, would ,be removed so tlli~t no conflict could occur. These members have agreed to keep the track in good condition and to maintain the horse stalls in an ord~rly fashion. They would provide a lock so tha~ they might secure the 5ecretaryts room in order to keep carts, harness and other tack therein. You would be given a duplicate' key so thatt the room would be available to the Commissioners toinsnect at any time they so desired. ' It :.=;hould be pointed out that pony harness racing is a rapidly growing, wholesome sport participated in by family groups throughout the entire United States. In most instances, each race includes events far children as well as wives and owners. It is felt that, with intensive, daily training, our local association will be able to compete nationally and give recognition for Chesterfield County as well as, Southside, Virginia. If this request is favorably considered, it is requested that you inform me of any rules or regulations which might guide us in the use of these facilities. H., Virginia 23832 Gentlemen: With reference to your resolution of November 8, 1967, requesting a price to surface treat Salisbury Drive for a distance of .2 or .3 of a mile. This is to advise that I have reviewed this request and submit the following information. (I am assuming that the road in question is State Route 1003 between the intersection of Route 1007 and dead end.) A distance of approximately .55 of a mile. It serves approximately twelve (12) houses. Traffic count for a twenty-four, (24) hour period is 61. I would estimate the cost to surface treat this at $2,500.00. This would be a prime and seal course. , If the Board elects to surface treat this road from their own funds, I would like to know in advance so that the Highway Department can do some preliminary work. Burnett Executive Secretary County of Chesterfield Chesterfield, Virginia Dear Mr. Burnett: Your letter of October 23, 1967 arrived in my office while I was on a month trip to Salt Lake City. You speak of sidewalks in the village of Ettrick. While I am sympathetic with your problem it seems to me that the letter of Mr. L. R. Treat, Jr., District Engineer of the Richmond District, is the answer to the situation so far as the highway department is concerned. Mr. Treat in the con- Cluding paragraph of his letter to you dated July 20, 1967 states that the highway department is not responsible for the mantenance of these sidewalks. Mr. Treat states further that after consider- ab1ekesearch of the files in the county clerk's office he can only conc1ude that the sidewalks in question are not the responsibility of the highway department. Upon consideration whereof and on motion of Mr. Taylor, seconded by Mr. Vaughan, it is resolved that the Commission recommend the request to vacate the stub road, known as Eppington Road to the east of Briarwood Road, be denied. ': PETITION TO ABANDON PLATTED STREET To The Board of Supervisors, Chesterfield County: Your petitioners, residents of the Willow Oaks subdivision, located in Chesterfield County, Virginia, request the abandonment of the eastern-most portion of the platted, but physically unopened, Eppington Road, more-fully described below. In support of their request, petitioners allege as follows: I. The area known as Willow Oaks is a subdivision located in the Manchester District of Chesterfield County, Virginia, the plan for which subdivision is located on a plat prepared by J. K. Timmons, dated December 21, 1956. II. That portion of Eppington Road which petitioner seeks to have abandoned, or closed, is located on the above-described plat between Lot 31, Section C, Block C and Lot 4, Section C, Block D, on the one hand, and between Braidwood Road and the easternmost boundary of the Willow Oaks subdivision on the other. It is colored in red on attachment A to this petition. III. Although platted, the described portion of Eppington Road has never been physically opened as a street. IV. The described portion of Eppington Road is approximately 103 feet in length, and leads only to an area of the property of the Willow Oaks Country Club on which there is no connecting street. V. To petitioners' knowledge, there is not now, nor has there ever been, any person desiring the opening of the described portion --.....; r , . .. . . , ( - 2 - of Eppington Road, even though the Willow Oaks subdivision has been a residential area for more than 10 years. VI. Recently, two new roadways into the Willow Oaks subdivision were opened physically and, because of these openings, automobile traffic within the area will be increased. Further, for the first time, the Willow Oaks subdivision will have through traffic traversing its streets. Because of the nature of those streets, the County already has been advised of the dangerous condition which has been created by the new street openings. That condition would be aggravated further by the opening of the previously described portion of Eppington Road. VII. Opening of the described portion of Eppington Road would serve no public purpose; and the residents of Willow Oaks, which the street would serve if opened, have no need for the roadway. WHEREFORE, your petitioners ask that the county records, including the plan of the Willow Oaks subdivision, be so amended as to abandon the platted portion of Eppington Road described in this petition. Kiepper City Manager City of Richmond Richmond, ,yirginia 23219 Dear Alan: During the developnent of the design for the Powhi te park- . way and James River Bridge crossing a problem was encountered in-:- volving the future, location for a proposed sewage treatment plant , being planned by 'Chesterfield, County. The,location of the Parkway and the bridge approach occu- pied property that we have acquired by agreement ,from Mr. Jno. C. Goddin including some 35 acres of'land. When this fact bec'ame known to the Board of Supervisors of Chesterfield County they were quite concerned about their plans for a future Treatment Plant to be ,located on this property. A suggestion was made with regard to the construction of a possible connection in the future of the Chesterfield County sanitary sewerage system to the interceptor "being planned and constr,:!cted by the City along the south bank of . the ,James River which will teDtlinate just east of the corporation line and the Goddin property. , Following up on ,this suggestion I agreed that on behalf, of the,Authority I,would approach the City Manager and the Council representatives on my Board to deteDtline whether such a connec- .'tion would be possible through a direct agreement between the City and the County. This was done and the foDtlerCity Manager indi- cated a willingness to explore the possibilities and designated a Committee of Technicians to,pursue the technical aspects in- yolved. Chesterfield County , Chesterfield, Virginia Dear Sir: We would like to express our appreciation to Mr. Bob Eanes, Fire , Marshal of Chesterfield County, Va. for conducting classes on fire prevention at our jobsite. To assure a successful construction operation, our foremen and men must be aware of the ever existing dangers of fire. In a re- cent class, Mr. Eanes discussed the proper use of the different types of ';.extinguishers. We have not had a major fire on our jobsite, and we feel this is partially due to a better understand- ing of our men from information gained through Mr. Eanes I presenta- tion during fire prevention classes. Most of our people live in Chesterfield County, and it gives all of us a better feeling lmowing that the men ~ho protect our community from the danger of fire have such an outstanding man as Mr. Eanes to direct them in the proper methods of fire prevention.
