The Executive Secretary called for nominations for the Chairmanship
of the Board of Supervisors. Whereupon, Nir. Browning nominates
Nir. Horner for a four-year term. Mr. Purdy seconds this nomination.
Mr. Apperson moves that the nomination be closed which motion is
seconded by N1r. Browning. A vote being taken, Mr. Apperson, Mr.
Browning and NIr. Purdy vote Aye.
Nir. Dietsch and r1r. Martin vote Nay.
A vote being taken on the nomination of Nir. Horner to be Chairman
for a four-year term - Mr. Browning, Nir. Purdy and Mr. Apperson vote
Aye.
Nir. Dietsch and Mr. Martin vote Nay.
On motion of N1r. Apperson, seconded by P4r. Purdy, it is resolved that
I~ir. Herbert Browning be and he hereby is elected Vice-Chairman of the
Board of Supervisors for a 4-year term.
It is here noted that Mr. Dietsch and P4r. 1`'lartin vote Nay.
On motion of P_r. Apperson, seconded by P-:r. Brownin<7, it is resolved
that Contract No.6602-3B for the construction of a water storage
tank and connections on Route #1 be and it hereby is awarded to
Capital City Iron P1orl:s who submitted the low bid of $85,034.00.
Un motion of Mr. Martin, seconded by t•`r. Apperson, it is resolved
that this Board authorizes the Engineering Department and the
Commonwealth's attorney to make the following bona fide offers and
take such steps as are necessary to condemn such property if same
cannot be acquired at the offered price:

There was presented a settlement of an insurance claim to Paul H. bdeeks
in the amount of $309.35. Upon consideration whereof, and on motion
of N!r. Apperson, seconded by Nir. Browning, it is resolved that the
County hereby accepts the terms of this agreement.
Cn motion of NIr. Dietsch, seconded by Mr. Apperson, it is resolved
that this Board requests the Virginia Depa tment of Hi•:~hways to take
into the State Secondary System of roads, ~ucker Lane.
NIr. J.K.Timmons comes before the Board citing the fact that the
Highway Department had held a public hearing in the re-routing of
Rt. 147 at the Robious crossing and that the Richmond Regional
Planning Cc;mmission had represented at the public hearing that the
Board of Supervisors of Chesterfield County had agreed with the
proposed eastern alignment of Rt. 147 and proceeded to explain that
the bulk of the traffic rJOUld be on Robious Road and Rt.711 in years
to come and that a new study should be given t?is intersection.
Upon consideration whereof, and on motion of 1"IL=. Martin, seconded by
Mr.Browning, it is resolved that a delegation visit with officials of
the Highway I~partment to discuss this matter.
Mr. Browning requested I~ir. Lancaster, Resident Engineer of the Highway
Department to continue the snow removal westwardly beyond the end
of Rt.36 on Rt.602.
It is generally agreed that the following street light requests be
referred to the Street Light Committee:
Intersection of Cromwell and Huguenot Roads
Midlothian Fire Dep~irtment
Woodpecker Road - Northwest of Timsbur.y Cfeek.
On motion of NIr. Martin, seconded by P'ir. i~owning, it is resolved that
the Executive Secretary be requested to present a proposed set of
criteria by which the street li<~hts can be erected.

There was presented a request from the Bensley Fire Department for
a new pumper. Upon consideration whereof, and on motion pf Ar.
Apperson, seconded by Nir. Brorming, it is resolved that this matter
be referred to the Fire Committee.
On motion of Nir. Apperson, seccnded by Nir. Browning, it is resolved
that the County accept the- low bid submitted by the Central National
Bank in t;~e amount of $3299.60 for acting as Paying Agent for the
County in the sale of $14.6P1 School Bond Issue.

that the meetings of the Board of Supervisors be started at 7:00 P.Ni.
on January 25 and February 29, 1968.

that this Board approves the Court Grder to pay $90.00 to Mr. John
Daffron for examining the title to property recently acquired from
Thomas Jefferson, Jr.

week end auction sales,
Upon consideration whereof, and on motion of Nir. rpperson, seconded by
Nir, Browning, it is resolved that i~ir. P4otley be contacted for additional

On motion of Nir. Martin, seconded by Nir. Apperson, it is resolved that
the plan of oper<aion for the mining of clay by the Borden Brick and
Tile Company as requested in 67-18U be and it hereby is approved as
presented wYiich includes a 6:00 Iy.Ni. starting time.
There was read a letter from Mrs. Alice Crenshaw T•iartin citing certain
conditions existing in private graveyards, and it ~~.ras generally agreed
that-the Police Department be notified of this situationo
The Executive Secretary notified the Board that the Appomattox River
1JJater ~ thority had set its rates at 19¢ per 1000 gallons .of water and
were at this time ready to sell water to all of the localities.

Mr. idilliam Shelton, representing Nir. Robert F. Harmon, comes before
the Board and states that since his request for the rezoning from
Agricultural to CQner.al ~siness (C-2) on a parcel of land of irregular
shape in N~idlothian Magisterial District, fronting 770 feet on Ue5.
Rte. 60 and extending southwardly 1150 ft. more or less, being 485 feet
more or less west of Grave Road. Refer to Sec. 16 par.43-3 & 39-2, had
been held over from last month there had been nothing new concerning
the request.
Upon consideration whereof, and on motion of T~ir. NIartin, seconded by
Mr. Browning, it is resolved that the aforedescribed parcel of land be
and it hereby is rezoned for General Business purposes, provided no
trailer park, junk yard, truck terminal or service station be allowed
on this site and the-plans and site layout be approved by the County
Planner.

Nir. Harold L.Cole, represented by Tir. Robert Porter, comes before the
Board requesting the rezoning from Residential-2 to General Business
(C-2) on a parcel of land fronting 90 feet on N.Arch Road and extending
eastwardly 1060 feet, being 480 feet southwest of UeS.Rte. 60 in
Midlothian Magisterial District. Refer to Sec. 28-1 parts of par.2 and 6.
Mr. Porter introduces Mr. Stewart, ~.ce-President, of the B&G Clsen
Company, who states that the proposed building will have a masonry
front and part masonry metal sides.
Mr. Phillip Perdue, Nir. Gerlr.nd Farnsworth, Nir. Cliver Burton, Nir,
James Ridgeway and others speak against the proposed zonings stating
that such industrial nse would start a blight in the area and cites
possible noise and extra trafL-ic.
Mr. Harold Cole states th~;t there is no way in which the proposed building
cculd hurt the adjacent area and it is not nearly as bad as the

the Shopping Center planned much closer to the subject property; that
the proposed use will bring in approximately 200 high salaried employees.
Upon consideration whereof, and on motion of Pir. Martin,seconded by
Mr, Bro~•ming, it is resolved that the aforedescribed parcel be and it
hereby is rezoned for C-2 purposes, subject to the original restrictions
imposed on the first parcel fronting on Rt.360 and that no service
station be placed on said property.

Mr. Douglas Bethel, representing Boxes to Size, Inc., comes before the
Board requesting the rezoning from Residential-2 to Industrial (M) on
a parcel of hnd of irregular shape containing 18 acres, more or less,
fronting 400 feet more or less on the north line of Kingsland Fbad and
fronting 1350 feet more or less on the East right of way line of the
A,C.L.Railroad right of way, being in the northeast corner of said
intersection in Bermuda Magisterial District. Refer to Sec. 81-2
parcels 19 & 20,
Mr. Crostic and Tr. Cordle state that they did not receive registered
notices of this meeting, both of whom o~an property adjacent to the
property sought for rezoning.
There were five letters presented for the proposed zoning and three
against same.
Upon consideration whereof, and on motion of Per. Purdy, seconded by
Mr. Dietsch, it is resolved that this zoning request be continued to
January 25, 1968 at 7:00 P.M.
67-88.C.
Nlr, William Miller, representing Marcus M. Weinstein comes before the
Board requesting the rezoning from Residential-2 to General Business
(c-2) of a parcel of land of regular shape containing 21.6 acres, more
or less fronting 523 feet on the i~iidlothian Pike and extending southwardly
1900 feet, more or less, being 720 feet west of Pember Lane in Manchester
Magisterial District. Refer to Sec. 20-9 parcel 52, and cites the
history of the development in the area and states that his client plans
a business subdivision with curbs, gutters, sewers, storm sewers, etc,
Mr. John Nioore, attorney for the Estate of Mr.Garrett,wishes a buffer
strip to be set aside to guard the property to the east of the property
sought to be rezoned,
Mr. William F. Tompkins, official from the State Planters Bank, requested
that the zoning be limited to 1000 feet deep.
Upon consideration whereof, and on motion of Mr, Iietsch, seconded by
Mr, Martin, it is resolved that the aforedescribed property be and
it hereby is rezoned for General Business purposes,

Mr. Walton Downs, representinq,Mr. Fred A. Muse, comes before the Board
requesting the rezoning from Residential-2 to General Business (C-2)
on a parcel of land of irregular shape containing 0,046 acres fronting

more or less, being 297.43 feet west of Cherokee Road in ~anchester

recommended approval, it is on motion of Er. Dietsch, seconded by Mr.
Martin, resolved that the aforedescribed parcel of land be and it hereby
is rezoned to General Business, subject to the same restrictions
recommended by the Planning Commission.

before the Board requesting the rezoning from Residential-2 to General

on Walnut Drive (Rte.641)and extending northwestwardly 200 feet, more
or less, being 100 feet iil:::re or less southwest of Route 10 in Bermuda

station in any event and wants the additional land in order to do a
better jOb in planning this proposed business.
Mr. Wallace Davenport and wife state that the lot proposed to be
rezoned was set aside as a buffer lot when the adjacent land was
rezoned about 3 years ago.

comes before the Board requesting the rezoning from Agricultural to
General Business (C-2l on a parcel of lan~ of irregular shape fronting
244.16 feet on the JViidlothian Pike and extending southwestwardly
348 feet more or less, being 212 feet west of Grove Road in hidlothian

There appearing no one in opposition to this request and the Planning
Commission having recommended approval, it is on motion of Mr. Martin,
seconded by Mr. Purdy, resolved that the aforedescribed parcel of land

Mr. John McDonald, Attorney, representing Doris M. Hooper, et als,
comes before the Board requesting the rezoning from Agricultural to
Residential-2 on a parcel of land of irregular shape fronting 350 feet
more or less on Warwick Road, and extending 1200 feet more or less
westwardly, being 100 feet northwest of Holdcroft Drive in Manchester
Magisterial District. Refer to Sec. 19-16 (2 Blko Clots 2, 3, 4, & 5,
and Sec. 19-15 parcels 2 & 2-1.
There was raised the question concerning the drainage at this location
and on motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved

There was advertised a request from the Chester Home Builders, Inc.
requesting the rezoning from Agricultural to Residential-2 on a parcel
of land of irregular shape fronting 670 feet more or less, on South
Chester Road (Rte.616) and extending westwardly 737 feet more or less,
being 860 feet more or less north of Happy Hill Road in Bermuda
Magisterial District. Refer to Sec. 132-7 par. 9.
There appearing no one objecting to this request and the Planning
Commission having recommended approval, it is on motion of Mr. Purdy,
seconded by Iv,r. Apperson, resolved that the aforedescribed parcel
of land be and it hereby is zoned for R-2 purposes.

Mr. James Sowers comes before the Board requesting the rezoning from
Residential-2 to General Business (C-2) on a parcel of land of triangular
shape fronting 250 feet on Hopkins Road and extending westwardly 200 ft.
more or less, being 350 feet northeast of Belt Boulevard (Rte.16l) in
Manchester Magisterial District. Refer to Sec. 30-8 pt. par. 18 and
18-1, and cites the history of the zoning of the area.
Mr. Lewis Pierce, Jr., presented a petition against the requested
rezoning.
Mr. Hey, Ivlr. O'Brian, rjr. Eastman and !'ir. Pinchbeck all speak in
opposition to the request.
Upon consideration whereof, and on motion of Hr. Dietsch, seconded by
Mr. hartin, it is resolved that this request be and it hereby is
denied.

l'1r. James F. Hubbard comes before the !bard requesting the rezoning
from Residential-2 to Local Business (C-l) on a parcel of land of

extending northwestwardly 285 feet more or less, being 275 feet more or
less north of Route 60 in Manchester Magisterial District. Refer to

Mr. B. F. Hogston comes before the Board requesting a Use Permit to

fromting 200 feet on Rte. 10 and extending southeastwardly 300 feet,
being 350 feet more or less southwest of Cascade Street, and better
known as 5231 Iron Bridge Road in Dale Magisterial District. Refer to
Sec. 52-6 (2) par. 5 & 6, and cites the need for facilities to house
the aged and sC3tes that he can get from 15 to 17 people in his present
building.
Mr. Apperson states th~t he has received a petition signed by all of
Lhe adjacent property owners opposing the requested use.
Upon consideration whereof, and on motion of hr. Apperson, seconded by
I-ir. Purdy, it is resolved that this request be and it hereby is denied.

Mr. W. H. Wingo, ~. comes before the Board in behalf of the request
of the Richmond Pavin0 ~ervice, Inc. for a Use Permit to construct
and operate an asphalt plant on a parcel of land of rectangular shape
fronting 200 feet on Bells Road and extending northwardly 460 feet,
being 473.50 ft. west of the AC.L. Railroad right of way in Manchester
Magisterial District. Refer to Sec. 42-2 par. 3-1.
Mr. Graham Jennings, representing Waco Corporation and others state
that the proposed use would be detrimental to the nice industrial
building presently being constructed in this area.
Mr. Wingo states he wishes to get along with his neighbors and
withdraws his application.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that
this Board accepts the withdrawal of this request.
On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved
that the Purchasing Agent be and he hereby is authorized to purchase
five (5) guns and other equipment and one (1) car for the Sheriff's-
Department.
On motion of Mr. Purdy, seconded by Mr. Browning, it is resolved that
Mr. F. F. Dietsch be and he hereby is appointed to the Richmond
Regional Planning Commission as this Board's representative.
On motion of Mr. Apperson, seconded by Mr. Dietsch, it is resolved
that the following named people be the citizen members to the
Chesterfield Planning Commission:

On motion of Mr. Apperson, seconded by hr. Purdy, it is resolved that
Mr. Browning be appointed to the Planning Commission as the Board's
representative.
On motion of Hr. Apperson, seconded by r'jr. Hartin, it is resolved that
this Board of Supervisors ex~resses publicly its approval of the
request of the Appomattox \Vat2r Authority to fluoridate the wa'cer supply
coming to the County of Chesterfield.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that
this Board of Supervisors expresses publicly its hearty support of
Mr. David Meade vvhite to fill the vacancy caused by the untimely
de~th of our beloved William Old. It is believed that the future
of Chesterfield County will be greatly enhanced by the appointment
of Hr. David Meade ,1hi te as the Circuit Judge of the 37th Judicial
Circuit. Therefore, Chesterfield's representatives in the General
Assembly and hereby request them to endorse and support the nomination
of Mr. David Neade ,mite to fill this important position.
On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved

petitioned the Board of Supervisors of Chesterfield County,
Virginia~ to vacate a portion of Poco shock Boulevard, which
.isshown on the revised map of pocoshock Hills, recorded in.
the Clerk's Office, Circuit Court of Chesterfield County,
virginia, in Plat book 8, at.page 25 and whereas notice of
'the adoption of such ordinance has been given in accordance
with section 15.1-431, Code of virginia of 1950 as amended. '
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF

That pursuant to Section 15.1-482 (b) Code of Virginia,

September. 26, 1967, and labeled "road to be vacated",
a copy of which plat is hereto attached, is hereby
vacated.

December, 1967, by DANIEL TINSLEY, unmarried, and GLENN G.
THOMPSON and JEAN M. THOMPSON, his wife,
WITNESSE TH:
Whereas, the parties hereto are the owners of all of the land abutting
an unopened alley, hereinafter described, said alley being shown on
Section Sheet 3B-6l, Bon Air, Midlothian District, Virginia, attached
hereto, which Section Sheet is of record in the Clerk's Office of the Circuit
Court of Chesterfield County, Virginia, in Plat Books 1-115, 3-50 & 51,
4-138 & 139, and
Whereas, it is the desire of the parties hereto that the hereinafter
described unopened alley be legally closed, that so much of the aforesaid
Section Sheet of record as shown the same thereon, be vacated and
annulled, and that the land embraced within said unopened alley be vested
in fee simple in them as the owners of the abutting lands, and
Whereas, the said unopened alley has never been open to public use
but has remained in the undisputed use, occupation and possession of the
parties hereto and their predecessors in title, and such alley is not
desirable for the development of the lands, abutting them, or any other
land, and
Whereas, the closing of said alley and the vacation of said plat showing
lots 1; 2, 6 and 7, of Block 63; as to them will n.ot abridge or destroy any
of the rights or privileges of other property owners within the bounds of
the area of land shown on Section Sheet 3B-6l, Bon Air Knolls, of record,
and
Whereas, the said vacation has been approved by the County of

Now, Therefore, the parties hereto, do by this declaration hereby
vacate an unopened alley in Midlothian District, Chesterfield County,
Virginia, being shown by Section Sheet 3B-6l, Bon Air, Midlothian District,
recorded in Plat Books 1-115, 3-50 & 51, 4-138 & 139, being attached hereto,
made a part hereof and to be recorded with this declaration, said unopened
alley being designated "20" Alley to be Vacated" and shown on said Section
Sheet 3B-6l as commencing on the north side of the unopened portion of
6th Street between Buford and McRae Streets running in a northerly directio
100 feet and designated to serve lots 1, 2, 6 and 7, of Block 63, Bon Air
Knolls, said alley being 20 feet in width, and terminating at the south line
of tract 29 of Bon Air Knolls.
And the parties hereto do assume full and absolute control, dominion,
possession and title of and to said alley as hereinabove set out.

Subject: Street Light at Cromwell Road & Hugenot Rd. (Rt. 1q7)
Dear Mr. Burnette:
With the advent of new additions or access areas to Hugenot
Road a mile or two south of Bon Air, various street lights have
been installed on Route 1q7.
The intersection of CroWwel1 and Hugenot does not have a light.
This seems of increasing importance, as the Cambridge addition
which Cromwell serves as access - is steadily being enlarged.
It is respectfully suggested a light at Cromwell and Hugenot is
at least as important as various others in the immediate neigh-
borhood installed quite recently.
One of your secretaries advised this request should be directed
to you. I will be interested in your reaction.

PLAN OF OPERATION FOR
MINING CLAY IN CONFORMITY WITH
SECTION 17-11 CHESTERFIELD COUNTY CODE

TO: BOARD OF SUPERVISORS:
In conformity with the granting of a use permit
conditioned on the applicant filing a plan of operation on
or before beginning said operation, the following is hereby
submitted as said plan in accordance with Section 17-11 of
the Chesterfield County Code, as amended.
(a) All equipment, buildings and premises used
for mining of clay shall be constructed, maintained and
operated in a manner far as practical as to elimnate
noise, dust or vibration which would be annoying or
injurious to persons living in the vicinity.
(b) The mining excavations shall be confined to
areas distant at least 100 feet from any and all adjoining
lines in any residential, business or agricultural district
and distant at least 200 feet from any dwelling or any and
all property lines of any plated subdivision, with such
exceptions as are permitted.
(c) The excavations shall be confined to areas
distant at least 200 feet from the right of way line of
any existing or plated street, road or highway, except,
that excavations may be conducted within such limits in
order to reduce the elevation thereof to conform to the
existing or established elevation of the adjoining or plated
street, road or highway.
(d) Any building containing power driven or power
producing machinery or equipment shall be distant at least
.

600 feet from all adjacent property in any residential,
business or agricultural district or the right of way lines
of any existing or plated street, road or highway.
(e) All roadways on, and all vehicular entrances
and exits from the private properties on which such operations
are conducted to any public roads shall be located to secure
safety, to lessen conjestion and to facilitate transportation
and shall be so maintained as to elimnate any nuisance from
dust to neighboring properties.
(f) The company obligates itself to do any and all
things necessary which shall provide in all respects for the
adequate safe-guarding and protection of any and all interests
general or private with regards to public health, safety,
convenience and prosperity and that such excavations that are
necessary for the purposes of carrying on this operation shall
be restored to a safe and usable condition, so as to reduce
the peaks and depressions, minimize erosion due to rairtall,
and be in substantial conformity to the land area immediately
surrounding.
(g) No excavation shall take place, or plant
operated on any of the property of the company except between
the hours of 6 o'clock a. m. and 9 o'clock p. m., or whenever
any reasonable or necessary repairs to equipment are requfred
to be made.
(h) The company obligates itself to do any and all
things as far as practical as the Board of Supervisors may
deem necessary and proper for the protection of the general
public health, safety, convenience, prosperity and welfare,
and to abide and adhere to the rules set forth in section 17-11
of the Chesterfield County Code and any other law applicable

The following is an extract of the minutes of a regularly scheduled
meeting of the Appomattox River Water Authority held on December 1, ~967
and is furnished for your information and guidance:

EXTRACT
The chairman presented the budget for the .period January 1, 1968
to June 30, 1968 based on estimated ~nnual consumption by Petersburg,
Fort Lee, Colonial Heights, Chesterfield .County and Binwiddie County
and the advice and recommendation of the Consulting Engineers in
complaince with Section 605, Paragraph (3) of the Bond Resolution.
Mr. Burnett moved that the said budget be adopted subject to final
approval after a Public Hearing as required by Section 605, Paragraph
(3) of the Bond Resolution. .
Mr. Klepper moved that in 'accordance with the requirements of .the
afllllesaid. budget a uniform rate of$c.l-9 per 1000 gallons o.f. water
be established and published by the Authority arid that all members
of the Authority be charged this uniform rate at tpeir re~pective
meter and delivery point; Motion was seconded by Mr. Ritchie.and.
after full discussion, was passed unanimously.

You will note that the uniform rate is established as a result of the
budget which has been approved by the Bond Holders at an announced
Public Hearing on December 15, 1967 in the office of the Authority.
It has been established that the Authority does not have the right
under the contracts with its members to charge other than a uniform
rate at the Filter Plant.

Bond Resolution and stipulated in the contracts bet~een the
Authority and each of the five participating municipalities..

This rate has been filed with the "Virginia State Corporation Commission.
The Authority has completed and flushed out all pipelines and will have
finished water at each outlet commencing January 1, 1968.
This rate will continue in effect for the period January 1 to June 30, 1968.
On or before July 1, '1968 the Authority shall analyze the finances of the
Authority and redetermine the rate to be charged for water in accordance
with Paragraph 9 (a) of the agreement by and between the Authority and
throughout the Fiscal Year and until revised.
Any future pipelines constructed by the Authority off its present mai.ns
or from the Filter Plant for any participating municipality or others
and f~nanced by the Authority will be based on the uniform rate at the
Filter Plant with an additional transporation and pumping charge to.
cover the cost of pumping and additional pipe1i.ne amortization.

Gentlemen:
The Virginia State Board of Health requires that the Appomattox
River Water Authority have on hand evidence of public demand
as shown by Ordinances or Resolutions by local governing bodies
that they approve and encourage the fluoridation of public
water supplies.
This office has received assurance from all of the participating
municipalities but does not have on file a copy of the resolution
authorizing the Authority to introduce sodium fluoride into the
water supply furnished by the Authority.
We shall appreciate a copy of the pertinent resolution from your
municipality so that we may comply with the regulations of the
Vlrginia State Board of Health.
