On motion of Mr. Browning, seconded by Mr. Dietsch, it is resolved
that certain resolutions of the Board minutes of January 25, 1968 be
amended to read as follows:
On motion of Hr. Purdy, seconded by Mr. Dietsch, it is resolved
that the Treasurer of the County be and he hereby is requested
to borrow on a short term basis in anticipation of the sale of
the approved water bonds up t? $500,000 for the Improvement,
Replacement and Extension Fund for the construction of water mains
as the money is needed.
On motion of !'Ir. Apperson, seconded by Hr. Browning, it is resolved
that the following motion appearing in the minutes of January 25,1968,
be, and it hereby is rescinded:
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved
that the sum of $5,000.00 be appropriated from the unappropriated
surplus of the General Fund to the Street ~gn Fund, Item 16,
County Road Sign Fund in the ~unty budget.
On motion of ~rr. Apperson, seconded by Mr. Browning, it is resolved
that the minutes of January 25, 1968 be and they hereby are approved
as amended.
Mr. Garland Dodd comes before the Board requesting consideration of
reducing his sewer connection rate to the $100.00 rate which was in
effect prior to May la, 1967. Mr. Dodd states that his construc~ion
had started well before thts date and had County sewer been available
at that time he would have been able to purchase his sewer connection
at the $100.00 rate. Mr. Dodd further states that all of the
construction was geared for connection to the County sewer system.
Upon consideration whereof and on motion of J,"lr, Purdy, seconded by

Mr. Browning, it is hereby resolved that Hr. Dodd be given the 44
connections to the County sewer system at the rate of $100.00 per
connection.
On motion of ~~. Purdy, seconded by hr. Apperson, it is resolved that
water contract A-591C in Gay Farms, Section 3, in the amount of
$2,272.00 be, and it hereby is approved.
On motion of hr. Purdy, seconded by Mr. Apperson, it is resolved that
Project 6602-3C for the Happy Hill,Route #1 Hater Pumping Station,
in the amount of the base bid of $148,282.00 be, and it hereby is
awarded to C.L.Hartman Contracting Company, Inc., subject to the
approval of the Consulting Engineers and the County Engineers to select
the alternate bid on equipment.
i4hereas, the water pressure on Piedmont Avenue, Matoaca District, has
been below normal; and
Whereas, at a prior meeting of the Board of Supervisors the County
Engineer was requested to make a study of this low water pressure,
the County Engineer presents to the Board alternate means for improving
the pressure to ,Piedmont Avenue.
Upon consideration whereof, and on motion of Mr. Browning, seconded by
(ItJr. Nartin, it is hereby resolved that the water line be extended from
DuPuy Road along a new road and along Piedmont Avenue.
On motion of Mr. Browning, seconded by Mr. Martin, it is resolved that
P~. Roy Ward on River Road and Mr. R. S. Swagger in Longwood Acres
Subdivision, be allowed to connect to the County's water system for
the connection charge of $500.00 each.
The request of Mrs. Lillian T. Winbourne for one (1) watef meter
installed to serve two homes comes before the Board. After some
discussion, it was the general consensus of the Board to study this
matter further.
On motion of Mr. Martin, seconded by Mr. Browning, it is resolved that
the sewer agreement S-67-25D for Archway Subdivision, Section A, be,
and it hereby is approved.
On motion of (ItJr. Appe~son, seconded by Mr. Dietsch, it is resolved that
the contract for Project 65ll-20A for the trunk sewer along Falling
Creek, from Hopkins Road to Route la, be awarded to the following:

The awarding of this contract is based on prompt delivery of subaqueous
pipe and based on special occasions that the gates of the dam will be
closed on March 31, 1963.
The County Engineer reports that the cost of serving twelve units
on Rt. 161, across from the McGuire Hospital with sewer would be
approximately $11,250.00. Upon consideration whereof, and on motion
of Mr. Dietsch, seconded by Mr. Martin, it is resolved that this
service be provided subject to the necessary easements being donated.

The request of a small group in Warwick Acres, Section B, concerning
sewers is brought to the Board's attention. It is noted chat of
29 lots, 19 have signed for sewers, 5 have indicated a desire, 1 did
not sign and there was no response from others. Mr. Painter cites
that the project will cost approximately $20,000.00 and has been
scheduled to be advertised May 24, 1970. It is the consensus of the
Board that the people be so notified.
On motion of l'jr. Apperson, seconded by I'Ir. Dietsch, it is resolved
that we proceed with condemnation, if necessary, of the following

On motion of Mr. Apperson, seconded by Mr. Dietsch, it is hereby
resolved that the County Engineer be allowed to purchase a back-hoe
loader combination tractor for the amount of $12,999.57 in accordance
with Bid No. 68-11221-1252.
On motion of ~~. Apperson, seconded by Mr. Browning, it is resolved
that $2109.19 be paid to the employees working overtime for the
annexation suit from the General Fund Code 11-180~199.2.
On motion of Mr. Martin, seconded by hr. netsch, it is resolved
that the County Engineer be empowered to proceed with bids for a
reprloduction machine and that he be authorized to purchase from the
most acceptable bidder.

The revised Highway Policy governing gas or petroleum products trans~
mission lines to subdivisions where streets are expected to become a
part of the Secondary System of the State Highway WdS read to the Board
of Supervisors.
On motion of ~rr. Apperson, seconded by Mr. Browning, it is resolved
that said Policy revision be received and filed with the Board's papers.
On motion of Mr. Apperson, seconded by r.ir. Hartin, it is resolved that
the following roads be requested to be taken into the State Secondary

the State Highway Department be requested to make a study of the cost
for improving a portion of Boroughbridge Road, adjacent to the Forest
View Rescue Squad, and to give the results of this study at the
March 13, 1968 Supervisors' meeting.
On motion of !Vir. Martin, seconded by Mr. Apperson, it is resolved that
the State Highway Department be requested to establish and post speed
limit signs in Greenfield Subdivision.
On motion of hr. Apperson, seconded by l'':r. Martin, it is resolved
that the Highway Department be requested to take in that portion of
Cogbill ~ad west of Rte. 10, not at present in the State System,
through to Belmont Road as a rural addition.
The letter of Master Mike Cecil of Beulah School was read before the
Board of Supervisors. On motion of Mr. Apperson, seconded by Mr.
Dietsch, it is hereby resolved that the project of Master Mike Cecil
of the Sixth Grade Class at Beulah Elementary School to clean some
of the roads of our County be and it hereby is approved.
On motion of Mr. Dietsch, seconded by Mr. Martin, it' is resolved that
the recommendation of the Planning Commission to ask the Highway
Department to create a storage lane at the intersection of Warwick
Road and Rteo #60, be endorsed by the Board of Supervisors and that
said recommendations be forwarded to the Highway Department.
On motion of f'lr. Apperson, seconded by Lr. Browning, it is resolved that
the State Highway Department be requested to place a 45-mph speed limit
beginning atJessup Road intersection with Rte.10 and extending to
the intersection of Belmont Road with Rte. 10.

Mr. Spooner HUll, r2presenting the Electoral Board of Chesterfield
County, comes before the Board requesting that voting machines be
purchased for the County of Chesterfield. Upon consideration whereof,
and on motion of Hr. lVlartin, seconded by hr. Dietsch, it is resolved
that the County of Chesterfield enter into a lease-purchase agreement
with the Shoup Voting Machine Company for seventy-five (75) voting
machines on a one year trial basis, subject to the revision of the
Warranty period of five to 10 years prior to purchase agreement.
It is here noted that lVrr. Dietsch asked the Electoral Board to more
clearly identify the Precinct and District lines within Manchester
District.
Dr. Reckrey, representing the Educational Therapy Center of Richmond,
comes before the Board explaining the operation of said Center and the
source of funds for this operation.
It is pointed out that an average of 10% of this Clinic's patients
are residents of Chesterfield County.
Upon consideration whereof, and on motion of f-'ir. Browning, seconded by
Mr. Martin, it is resolved that this Board take into consideration the
amount of $3285.00 for the Mental Hygiene Qinic in the 1968-'69
budget of the County.

Mr. John McDonald comes before the Board, repres2nting Doris M. Hooper,
et als, requesting the rezoning in Manchester Magisterial District from
Agricultural to Residential-2 on a parcel of land of irregular shape
fronting 350 feet, more or less on Warwick Road, and extending 1200 feet
more or less westwardly, being 100 feet northwest of Holdcroft Drive.
Refer to Sec. 19-16 (2) Blk.C, Lots 2, 3, 4 5 and Sec. 19-15 parcels
2 and 2-1.
This case was deferred from January la, 1968.
Mr. McDonald points out that the drainage problem in this area is under
study by the County at the present time and requests deferral of this
zoning request until the County completes this study.
Upon consideration whereof, and on motion of l"k. Dietsch, seconded by
Mr. Martin, it is resolved that this ccse be deferred for a period of
four (4) months until the second wednesday in June, 1968.

Mr. Rmkle comes before the Board representing the Kinsley Oaks Nursing
Home, Inc. requesting a Use Permit to construct and operate a Nursing
Home on a parcel of land of irregular shape containing 2.016 acres,
having a southern depth of 200 feet, more or less, and a western width
of 500 feet, more or less, bounded on the west by ROlando, Sec. C and
on the north by Rolando, being accessible by Kinsley ~venue 130 feet,
more or less, south of McKay Avenue in Manchester Magisterial District.
Refer to Sec. 30-12, 27-28.
After a brief discussion of the operation of the Nursing Home, it is on
motion of j"rr. Dietsch, seconded by hr. Hartin, resolved that the Use
Permit be granted to the Kinsley Oaks Nursing Home.

~tr. ovarren Chapman comes before the Board, representing Dr. George W.
Thomas, requesting the rezoning from Residential-2 to General Business
(C-2) on a parcel of land of irregular shape fronting 190.62 feet on
Route 10 and extending southeastwardly 200 feet, more or less, being
opposite the intersection of ~ok's Road and Route 10 and better known
as 2125 Broad Rock Road in Manchester Magisterial District. Refer to
Sec. 30-7 par. 33.
~~. Chapman states that approximately 15,000 passenger cars pass this
location per day and that this area is adjacent to other general business
zoning and th~t such zoning would be proper.
Two letters were read from neighbors adjoining the property stating that
they were in favor of the rezoning.
After some discussion, Mr. Dietsch asked Mr. Chapman if he would consider
agreeing to the rezoning to C-l. Mr. Chapman agrees.
On motion of Iv~. Dietsch, seconded by Fer. Martin, it is resolved that
the rezoning from Residential-2 to Local Business (C-l) of this parcel
of land be and it hereby is approved, subject to the site layout, plans
and use being approved by the Planning Director.

In Manchester Magisterial District Executive Professional Building, Inc.,
requests the rezoning from Hesidential-2 to General Business (C-2)
on a parcel of land of irregular shupe containing 1.00 acre, having an
easterly width of 210 feet, more or less, and extending northwardly
207 feet more or less, being 76.26 feet north of Forest Hill Avenue and
260.15 feet east of Chippenham Parkway. Refer to Sec.11-2, part of
Par. 3l.
It is learned that this rezoning is requested to provide for additional
parking area in the rear of the existing building with the proposed new
construction in the area of the present parking lot.
Upon motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved
that this Board approves the rezoning of this parcel of land from
Residential-2 to General Business, C-2.

In Gover Hill Magisterial District J.E.Hancock and vv. M. Gillispie
request the rezoning from Agricultural to Local Business (C-l) on a
parcel of land of irregular shape containing 0.49 acre fronting 490.43 ft.
on U.S.Rte 360 and extending northwardly 75 feet, more or less, being
500 feet more or less southwest of Swift Creek. Refer to Sec. 62
par. 25-1.

Mr. Weinstein comes before the Board, requesting the rezoning from
Agricultural to General Business (C-2) of a parcel of land of irregular

Mr. ltJeinstein states that this parcel is a(ijacent to the parcel rezoned
at the Supervisors' meeting on June 10, 1967.
Upon consideration whereof, and on motion of Mr. lietsch, seconded
by Mr. Martin, it is resolved that this Board approves the request for
rezoning from Agricultural to General Business (C-2) of this parcel
of land subject to approval of site layout and plans being approved
by the Planning Director.
On motion of l''Jr. Apperson, seconded by IVjr. Browning, it is hereby
resolved that this Board approves the payment of $300000 to Mr.
Oliver D. Rudy for his services in examining the title and representing
the County in the purchase of the Cpgbill property in the Courthouse
area.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
the request of the 4-H Horse and Pony Club to install a PA System
in the County's horse ring-stables area be and it hereby is approved.
On motion of Mr. Apperson, seconded by l'lr. Purdy, it is resolved that
the request of the 4-H Horse and Pony Club to install a meeting place
at the Fair Grounds stables be and it hereby is approved.
Mr. John S. Hansen, Delegate to the House of Representatives, comes
before the Board and presents copies of House Bil~ No.828, 696 and
494. Following some discussion of these Bills it is on motion of
Mr. Dietsch, seconded by Mr. Martin, resolved that this Board supports
House Bill No0828, concerning the employment of full-time County
Court Judges.
It is here noted that Mr. Jlpperson votes No and that Mr. Purdy and
Mr. Horner abstain from voting.
On motion of Mr. Purdy, seconded by Mr. Browning, it is resolved that
this Board requests Dele~ate John Hansen to prepare the necessary
amendments to the Sales Tax Law to provide for the exemption from
Sales Tax contractors who are doing work for governmental agencies,
in the purchase of materials for this construction.

Mrs. Ada Flippen comes before the Board requesting a Use Permit to
conduct an accounting service in her home on a parcel of land of
irregular shape fronting 307 feet on Beechwood Avenue (Rte. 1130)
and extending northwestwardly 550 feet, more or less, being 935 feet
northeast of \iJhi tehouse R>ad (Rte. 1129) in Jermuda Magisterial
District. Refer to Sec.163-5 par. 13 and 14.
Mrs. Flippen states that there will be no signs.
Upon consideration whereof, and on motion of Mr. Purdy, seconded by
Mr.Browning, it is resolved that this Board grants a Use Permit to
Mrs. Flippen, subject to no exterior signs being permitted.

Mrs. [I',oneta Y. Tuck and Mrs. Cecile S. Yeatts come before the Board
requesting a Use Permit to operate a Beauty Shop on a parcel of land
of irregular shape fronting 75 feet on Dowd Lane and extending west-
wardly 200 feet mor or less, being 705 feet more or less north of
Hicks Road and better known as 2522 Dowd Lane in Manchester Magisterial
District. Refer to Sec. 39-11 par. 100
Mrs. TUck states that her shop will handle no more than four customers
at one time.
Mr. William F. Craven, adjacent property owner comes before the Board
opposing the granting of this Use Permit.
Mrs. Yeatts presents a petition signed by several of the neighbors
who support the request for this Use Permit. .

Mr. David L. Posenau comes before the Board requesting a Use Permit to
have a business office in his home on a parcel of and of irregular
shape fronting 100 feet on Swanage Road and extending eastwardly
160 feet more or less, being 380 feet more or less south of Highgate
Road and better known as III Swanage Road in Midlothian Magisterial
District. Refer to Sec. 28-1 (3) Blk.G, Lot 8.
Mr. Posenau states that the home will be used only as a mailing address
and for the telephone, that no construction materials, etc. will
be stored at this location.
Mr. Martin states that he would prefer having some time to talk with
some of the neighbors in the area. Upon consideration whereof, and on
motion of [llr. Martin, seconded by hr. Dietsch, it is resolved that the
request for a Use Permit be deferred to February 29, 1968 at 7:30 P.M.
Mr. John Thomas comes before the Board asking for the reconsideration
of the support of House Bill No.828 concerning County Court Judges.
Upon consideration whereof, and on motion of Mr. Apperson,seconded by
Mr. Purdy, it is resolved that this Board rescinds the execution of
its prior motion until such time as the Judges can be heard at 9:00A.M.

are not unmindful of the continuing: rise in ratables in the
County, it must also be said that there is still considerable
room for development in.the County and moreover the debt levels
have not only kept up with the grovrth but have been at somewhat
slightly higher rates responding both to the continuing need for
:;.,' SchoolS and other necessary faci+ities. While it may seem an
q old story to him, we can only repeat that we have great confid-
ence in the future of the County as he does and certainly seems
that credit will be improved and that this will be reflected in
our rating.

County, held in Room 218, Henrico County Office Building, 21st and
Main Streets, Richmond, Virginia, on Wednesday, the 7th day of

On motion of Edwin H. Ragsdale, seconded by Linwood E. Toombs,
the following resolution was adopted:
WHEREAS, the 1968 Virginia General Assembly is now considering
the creation of a State supported university in the Richmond
Metropolitan Area by merging the Medical College of Virginia and
the Richmond Professional Institute, and
WHEREAS, the proposed expansion of RPI's 9 acres to 193 acres
in downtown Richmond to create the major portion of this university
will cost the State of Virginia millions of dollars in land acquisition
alone, and
WHEREAS, removing this large parcel of land from the tax roles,
which contains many homes, businesses and churches, will either
financially burden Richmond residents within the central city, or
cause local officials to request the State for supplemental
appropriations as the result of this expansion program, and
WHEREAS, the recent U. S. Federal Court ruling, which bars
federal impact funds from being computed in the State aid formula
for public school systems, will require the taxpayers of Virginia
to make up the next biennium's deficit of over $21 million
dollars, and
WHEREAS, the State of Virginia has already invested a half million
dollars worth of operable utility improvements on the Elko Tract
site, which lies between two major rivers, is convenient to all
residents in the Metropolitan Richmond Area, and is ideally suited
for environmental health studies and has the space to accommodate
specialized laboratories in chemistry, biology, physics and geology.

NOW, THEREFORE, BE IT RESOLVED, that the Henrico Board of
County Supervisors hereby urges local officials across the State to
request their representatives' in the 1968 Virginia General Assembly
to abandon the costly plan of expanding RPI to the James River across
193 acres in the high density area of downtown Richmond, since the
State will be financially hard pressed as never before, and
BE IT FURTHER RESOLVED, that the 2,372 acre State-owned Elko
Tract in the Metropolitan Richmond Area be utilized as a third site
for the State University without expending State funds for site
acquisition, to form a tri-campus site for a great State University
utilizing existing facilities and locations of MCV and RPI as parts
the reoL

Gentlemen:
By letter of November 23,1964 Mr. ,H. G. IJlundon furnished you a
copy of the Highway Commission's policy gover:1i..g gas or petroleum
products transmission lines through subdivisions when streets are
e;cpected to become a part of the Secondary System of State highways..
It has been felt for some time that the policy adopted on
November 19, 1964 has been too restrictive and waS in need of revision.
With this being the case, the Highway Commission felt that it should
review the situation and revise the policy slightly in order to
prevent undue hardship being placed on the gas or petroleum products
companies. resultins in their having to give up all their rights on
the main transmission lines. This covers those facilities traver$ing
areas being developed or to be developed where the street systems are
expected to become a part of the State~aintained system of Secondary
highways.
This was reconsidered at the Highway Commission's meeting on
January 18, 19613 and was revised to the eJctel1t of item 2 (c) and the
addition of item 2 (d). Attached is a copy of this revised policy
adopted by the Highway Commission, effective January 18, 1968, which
is an addition to the subdivision policies you now have on hand.

WHEREAS, it is felt that the above-noted policy adopted on November 19.
1964 is too restrictive and is in need of revision.
NOW. THEREFORE, BE IT RESOLVED. that the State Highway Commission,
effective this date, rescinds the policy adopted by the State Highway Com-
mission on November 19, 1964; and
BE IT FURTHER RESOLVED. that the State Hight-1ay Commission hereby adopt~
the following policy entitled "Policy Governing Gas or Petroleum Prodl',cts
Transmission Pipelines Through Subdivision Streets When Streets are to be
Taken into the Secondary System of State highways," effective January 10.
1968:
1. When a gas or petroleum products transmission pipeline is to be
constructed through an existing subdivision, the street right of
way may be utilized under the followine conditions:
a. Provided the pipeline is constructed in conformity with
standards, specif:l,cations, and safety regulations of the
applicable pipeline code for the ultimate use of pipeline
and for the ultimate development. traffic volume, and
population density of the area.
b. Provided the pipeline is not constructed under the pavement
or shoulders of the street (except for crossings). The
pipeline may be constructed in the median or sidewalk areas
of nonlimited access streets if it will not 'conflict with
other utilities, drainage facilities, or other roadway
features.
c. Provided the pipeline is covered by a permit which places all
liability for the pipeline and any damage to person or property,
and the responsibility for future adjustments of the pipeline,
upon the public service corporation.
2. When a gas or petroleum products transmission pipeline is existing
through an area which is to be developed as a subdivision. the
developer may layout the streets to include the pipeline under the
following conditions:
a. Provided the pipeline was constructed in conformity with
standards, specifications, and safety regulations of the
applicable pipeline code for the ultimate use of the pipe..
line and for the ultimate development. traffic volume, and
population density of the area.

b. Provided the pipeline will not be located under the pavement

(1) That the transmission pipeline may continue to occupy such

(2) That the public service corporation will be responsible
for such pipeline and for any damages to persons or
property resulting therefrom, and
(3) That in the event the Virginia Department of Highways
should later require for its pu::poses such public service
corporation to alter. change,'l;:;j'Jst. or relocate such
transmission pipeline. the nonbetterment cost of any such
alteration, change, adjustment, or relocation will be the
responsibility of the State.
d. In the event the above conditions cannot be met, the developer
shall layout and develop the subdivision so that the pipeline
is contained in a distinct and separate easement and/or right
of way of its own. In this case it will still be necessary for
the public service corporation to comply with Section 2 (c)
above, where the pipeline crosses any streets, insofar as the
crossing is concerned.

We, the undersigned, do hereby petition for sewerage in our sect-
ion of Wanvick Acres, which is the original Wanvick Acres.,
The annex which was constructed in the last few years and is still
under construction has sewerage and its level is lower. than ours.
Sewer lines' h?Ye been installed all around us, and we do not under-
stand why our few blocks were bypassed since we were the first owners
in this area.
We understandF.R.A. no longer considers septic tanks as per-
manent sewerage and will not handle loans on such properties unless
permanent sewer,~ines are installed within two years. Should we ever
wish to sell we would be unable to do ~o, as most people wish F.R.A.
loans; therefore, we would appreciate your prompt attention on this

Dear Mr. Burnett:
This in reference to your letter to us dated January 18, 1968,
in regard to the status of certain subdivision roads, which are as follows:
Trampling Farms, Business Acres and Salem Roads have been submitted
to the Highway Department for acceptance and we should receive confirmation
on these in the next week or two.
Meadowbrook West is being held in our office until Mr. John Longmire
receives a release from the School Board on the entrance to be constructed
to Falling Creek Elementary School. As soon as we receive this information,
we will submit this subdivision for acceptance into the system.
With reference to Coxendale - Resolution from the Board of Super-
visors dated June 13, 1967, was received and necessary forms to accept the
roads into the system were prepared. However, we have not received the
required bond or maintenance fee from the developer. Since we are unable to
get bond and maintenance fee on these roads, we will not be able to accept
them until July 1. 1968. At that time we can accept them without the bond
or maintenance fee, provided the roads have been maintained to acceptable
standards. You will recall that the County spent some funds on these roads
during the summer to fill "pot holes". However, this did not waver the
requirement for posting bond prior to acceptance.
If we can be of any further assistance, please advise.

"\Vhereas, Mr. David Meade White, Jr. has been an outstanding'
member of the Chesterfield-Colonial Heights Welfare Board since
July 1, 1955, and
Whereas, Mr. David Meade White, Jr.'s keen knowledge of law in
the field of public welfare has been an immeasurable asset to
the Welfare Board and staff, and
Whereas, Mr. David Meade White, Jr.'s understanding and empathy
for people in trouble and his ability to approach these problems
have contributed to the effectiveness of the welfare program here
and in the State, and
Whereas, Mr. David Meade White, Jr.'s presence on the Board has
been an inspiration to each member of the Board and staff,
Now therefore, be it resolved:
That the Chesterfield-Colonial Heights Board of Public Welfare
records with a great sense of loss, that Mr. David Meade White, Jr.
will no longer serve as a member of the Board; that this Board
publicly thank Mr. White for his meritorious service and his many
contributions which have been above and beyond his call as a member
of the Board; that we thank Mr. White for his continued service to

Having experienced an increase in prisoners confined to the Chesterfield
'County jail during the past months, it has become n~cessary that we be
granted an increase to operate the jail the last five months of current
fiscal year.
Each week-end we have approximately '(10) prisoners reporting for week.end
sentences. The week-end of February 9th thru 11th we had a population of
(53) prisoners of Whom (12) were sleeping on the floor.
Two-thirds of cost of operation except for medical expenses the state pays ,

The ,Chesterfield County Board Of Supervisors, the county governing
body, have agreed to appropriate one-third of a deputy's salary not
to exceed Two-Hundred Dollars per month toward the salary of a deputy
assigned to handle prisoners to and from the jail ~mile attending trial.
This deputy will work Chesterfield County Court and Circuit Court, along
with all duties assigned to him.
~~. Jesse C. Douglas, the applicant we have in mind, is a retired state
trooper with twenty-eight and a half years experience. To employ this,
person we would have to classify him on part-time basis and pay him by
the day. The suggested salary would have to be at least TWENTY THREE
DOLLARS ($23.00) per day. In all probability this man would work three
or more days per week.

13 1. That the Code of Virginia be amended by adding a section numbered
14 16.1-50.1, as follows:
15 ~ 16.1-50.1. In any county having a population in excess of seventy
16 thousand, but not exceeding one hundred thousand persons, according to
17 the last preceding United States census, the judge of the county court of
18 such county shall not practice law during his continuance in office nor hold
19 any other office of public trust during his continuance in office.
20 Notwithstanding provisions in ~~ 14.1-40, 14,1-41, 14.1-42 and 16.1-50
21 to the contrary, the salary payable to such judge shall be fifteen thousand
22 dollars annually.
23 The provisions of this section shall be deemf'~ to take effect in any
24 such county only upon the expiration of the term of office of the county
25 judge in office in such county on the effective date of this section,

Be it enacted by the General Assembly of Virginia:
1. That SS 29-184.2, 29-184.3 and 29-184.4, as amended, of the Code of
Virginia be amended and reenacted as follows:
S 29-184,2, Enforcement of dog laws in counties by dog wardens;
17 license tax rates and disposition of proceeds,-(a) Notwithstanding any
other provision of law, except S 29-184,3, in any county or city, the
enforcement of the dog laws and local ordinances enacted pursuant to
S 29-184:4 * shall be vested in a dog warden and deputy dog wardens,
and upon the appointment therein of a dog warden and deputy, dog
wardens the game warden shall have no jurisdiction as to the enforcement
of the dog laws. * The judge of the circuit or p01'Poration court of the
county 01' city shall appoint an officer to be knowh as the dog warden, who
25 shall have exclusive jurisdiction as to the enforcement of the dog laws in
26 such county 01' city; the judge may also appoint one or more deputy dog
27 wardens to assist the dog warden in dog inspection activities and in dog
28 law enforcement. Provided, however, that in any county having a popu-
29 lation in excess of twenty-three thousand three hundred fifty but not in
30 excess of twenty-three thousand three hundred seventy, the circuit court
31 shall appoint the dog warden and any deputy recommended by the gov-
32 erning body of such county. Provided, further that in any county having
33 a population of not less than seventeen thousand three hundred nor more
34 than seventeen thousand four hundred, the circuit court shall appoint the
35 dog warden and may appoint any deputy recommended by the dog warden,
36 and shall fix the salaries of such dog warden or deputy so appointed; the
:37 maximum and minimum salary brackets shall be determined by the gov-

erning body. Provided, however, that any county which has adopted the
county manager form of organization and government provided by chap-
, ,
tel' 13 (~ 15.1-582 et seq.) , Title 15.1, or any county having a population
of more than ninety-eight thousand but less than ninety-nine thousand,
shall appoint such dog warden and deputy dog wardens in the same
manner as are other employees as provided in~ 15.1-634, and that in any
county which has adopted the county manager form of organization and
government provided by chapter 14 (~ 15,1-669 et seq.) , Title 15,1, shall
appoin.t such dog warden and deputy dog wardens in the same manner as
are other employees as provided in ~ 15.1-687. Such deputy dog warden
shall have the powers and duties of a dog warden. The dog warden and
deputy dog wardens shall have all the powers and duties of a game warden
in the enforcement of the dog laws where such dog wardens and deputy
dog wardens serve only one county or city. In all other cases, such dog
warden and deputy dog wardens shall have all the powers and duties of
a game warden, The dog warden and deputy dog wardens shall be paid
such compensation as the governing body of the county may Pl'escribe.
Provided that in the county of Wise such compensation shall not be less
than four hundred dollars per month nor more than five hundred dollars
per month; and provided, further, that in the county of Dickenson such
compensation shall be not less than three hundred thirty-three dollars per
month nor more than four hundred dollars per month. The governing
body of any countJ\ in which a dog warden or deputy dog wardens have

been appointed may contract with one or more additional counties for
enforcement of the dog laws in such counties by such dog warden or
deputy dog wardens. Any such contract may provide that the county em-
ploying such dog warden or deputy dog wardens shall be reimbursed a
portion of the salary and expenses of such dog warden or deputy wardens.
(b) The appointments shall be made by the court or judge thereof
in vacation on or before the thirtieth day of June for one, two, three, or
four years, whichever is deemed appropriate in the sole discretion of the
court or judge thereof in vacation, commencing on the first day of July
and expiring on the thirtieth day of June of the year of expiration,
(c) In such county the amount of the dog license tax, which in no
event shall be more than five dollars per dog, shall be fixed by ordinance
adopted by the governing body of such county, and thereafter the tax
imposed under S 29-184 shall not apply therein, The funds collected for

dog license taxes shall be paid into a special fund and may be disposed
of as provided in this section and in ~~ 29-206 and 29,209, except that
the county treasurer shall not be required to remit any portion of such
funds to the State Treasurer nor shall the governing body be required to
supplement the salary of the game warden. The county shall pay the
salaries and expenses of the dog warden and deputy dog wardens from
such special fund. Any sum remaining may be transferred, in whole or
in part, to the generaI.fund of the county at the end of the fiscal year.
(c1) The Governor is hereby authorized to transfer at one time' or
from time to time from the unappropriated balance in the Game Protec-
tion Fund such sum as may be necessary and recommended by the Director
of the Budget for the revision of the salary of the game warden in any
county adopting the provisions of this section.
(d) All other provisions of chapter 9 (~ 29-183 et seq.) of this title
shall apply. mutatis mutandis to any such county and dog wardens and
deputy dog wardens,therein,
~ 29-184.3. Same; certain counties,-(a) Notwithstanding any other
provision of law, in the counties of Augusta and Roanoke, and. in the
counties of Orange, Fairfax, Giles and Spotsylvania, * the enforcement
of the dog laws shall be vested in a dog warden,and deputy dog wardens,
and upon the appointment therein of a dog warden and deputy dog wardens
the game warden shall have no jurisdiction as to the enforcement of the dog
laws. In such county the judge of the circuit COUl:t shall appoint from a

list of not less than three nor more than five pe'rsons nominated by the
governing body of the county an officer to be known as the dog warden,
who shall have exclusive jurisdiction as to the enforcement of the dog
laws in the county; the judge may also so appoint, from a similar list of not
less than three nor more than seven persons, such number of deputy dog
wardens as are requested by the governing body. Such deputy dog
wardens shall have the powers and duties of a dog warden. The dog

body of the county may prescribe.
(b) The lists of nominations so made by such governing body shall
be submitted to the court or the judge thereof in vacation not later than
the fifteenth day of June of each year and the appointments shall be made

19 of two hundred forty thousand or more persons shall appoint such dog
20 warden and deputy dog wardens in the same manner as are other em-
21 ployees as provided in ~ 15.1-634, or as prescribed by the form of govern-
22 ment in effect in such county which. has a population of two hundred forty
23 thousand or more persons.
24 ~ 29-184.4, E\ocal ordinances in counties and cities to which ~~ 29-
25 184.2, 29-184,3 and 29-184,5 are applicable.-The governing body of any
26 county or city to which the provisions of ~~ 29-184.2, 29-184,3 and
27 29-184.5 are applicable " shall enact local ordinances corresponding in
28 nature and scope" and not in conflict with, the provisions of this chapter,
29 and may.repeal, amend or modify such ordinances; provided, no govern-
30 ing body of a county or city may provide penalties for violating a provi-
31 sion of an ordinance adopted pursuant to this section which is greater
,32 than the penalty imposed for a similar offense under the provisions of
33 this chapter.

23 Female,-For a female dog, three dollars.
24 Kennel, for twenty dogs.-For a kennel of twenty dogs, fifteen dollars.
25 Kennel, for fifty dogs,-For a kennel of fifty dogs, twenty-five dollars.
26 Provided that the governing body of any city or county, which has
27 assumed responsibility for enforcement of the dog laws under '~ 29-184.2
28 or 29-184.5, may prescribe by ordinance a single license tax for all dogs
29 regardless of sex, the amount of which shall not exceed five dollars.

30 In any county having a population of more than twenty-one thousanq
31 but not more than twenty-one thousand two hundred the governing body,
32 may, at such time as it deems proper, increase such tax, but in no event.
33 shall such tax exceed the following amounts:

36 Female.-For a female dog, four dollars; provided that no ordinance
