Hr. Burnett gives the invocation.
On motion of Mr. Purdy, seconded by Mr. Apperson, it is resolved that
the minutes of August 29, 1968 be and they are hereby approved.
On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that
this Board accepts from the Estate of J.C.Little, a deed for a
roadway leading from the Jefferson Davis Highway to the County's
sewage treatment plant.
On motion of Mr. Dietsch, seconded by Hr. ~person, it is resolved
that the water contract .Ar-62l for the installation of water in the
Yardley Square Apartments in the amount of $378l.00 be and it hereby
is approved.
There was a brief discussion concerniny the installation of water
on Tarris Road and it was generally agreed that additional informa-
tion be obtained concerning the number of people who would defimitely
take wunty water if same were available.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that (
the plans presented by Mr. Tom Daniel for the installation of trunk \1
sewers on Pocoshock Creek and the financing thereof, be approved and
the Engineering Department is authorized to install sewers on
Pocoshock Creek to Turner Road.
Mr. John Hinson presented a program for the installation of sewers
from the Courthouse to Centralia Gardens and states that there were
several alternatives which involved further study and policy
determinations.
On motion of Mr. Apperson, seconded by l"ir. Browning, it is resolved
that the firm of J.K.Timmons and Associates be employed to draw the
final plans for the installation of sewer lines from the Courthouse
to the ~ntralia Gardens area, leaving the location of a sewage lagoon
or other treatment facilities to be determined at a later date.

There was presented a request from Hr. George Burruss, Jr., Chairman
Capital Regional Park Authority for a donation of $4624.00 as Chester-
field's part of financing the Park Authority.
l'1r. Richard Robertson, l'iir. 'iiJilliam E. Dutcher, Nr. Richard W. Sprouse,
Mr. Fred Jurgens, Jr. and Hr. Curtis C. Duke appear in support of the
suggested method of financing the Park Authority. Upon consideration
whereof and on motion of Mr. Dietsch, seconded by Mr. Martin, it is
resolved that the sum of $4624.00 be paid to the Park Authority.
The County was notified that the following roads have been accepted

There was read a letter from the Resident Engineer, Mr. W. R. Davidson,
stating that the request for a reduced speed limit on Rt.lO, between
Route #1 and Rte 8l0, is denied.
There was read a letter from the Resident Engineer, of the Virginia
Department of Highways, stating that the request of the Gbunty for a
reduction in speed limit on Route lO, between Belmont Road and
Chippenham Parkway, is denied.
There was a discussion on the drainage situation in the Marlboro
Subdivision, which caused recently some flood damage to the Beatty
property on Wimbleton Drive, and it was states that the Contractor

constructing a home adjacent to the subject property did change the
course of the vvater ditch, reducing the size thereof, and further that
the culvert urider the roadway was inadequate.
Upon consideration wheceof, and on motion of Mr. Apperson, seconded
by Hr. Browning, it is resolved that the Executive Secretary attempt
to work with the contractor and the County Engineering ~partment in
an effort to accomplish a better course for this drainage water and to
promote a discussion by the lawyers of the ~unty and the Highway
Department in an attempt to ascertain the legal responsibility in the
recent damage to the ~atty property.
There was a discussion on the request of Mr. S. B. Goodman for spreading
some dirt on Boroughbridge and Leicester ~ads by the drainage ditch,
and it was generally agreed that further information and a price be
obtained concerning this matter.
It was generally agreerl that the notice for a meeting of the state
Corporation Commission on the Groome Transportation, Inc. request
for a common carrier be filed with the Board's papers.
On motion of l\lr. Apperson, seconded by Er. Purdy, it is resolved that
the following erroneous tax claims be approved for payment:

that the appropriations in the amount of $l4,305,245000 be and the
same is hereby made for the months of October, November and December,
1968, from the funds and for the functions or purposes indicated.

On motion of Mr.Browninc, seconded by Mr. Dietsch, it is resolved that
this request be referred to the Fire Committee.

Messrs. Do M. and J.G. Woodfin again come before the ~ard requesting
the rezoning fro~ Agricultural to General Business (C-2) on a
parcel of land of irregular shape fronting 200 feet on U.SoRte.360
and extending northwestwardly 240 feet being 1000 feet northeast of
Walmsley Boulevard in Manchester Magisterial District. Refer to
Sec.39-l2 par. 6, which request had been deferred from the August l4th
meeting at which time the Board's consideration of this matter had
resulted in a tie vote.
Mr. C. Denny White, theCounty's Tie-Breaker is present to hear the
testimony in this case.
Mr. Mayo explains the location of the zoning request and presents maps
of the existing land use copied from Marcou & O'Leary Associates.
Mr. J. G. Woodin, Jr. states that he wishes to purchase this property
on which there is a non-conforming automobile repair shop, to demolish
the building and erect a modern auto repair shop. He states he now
owns several auto businesses along Rt.3GO and there is no opposition
from the adjacent property owners and has been none at any time,
and the purchase of this property would benefit Mr. Layman, the present
owner.
Mr. G. C. Layman states th&t he \vants to retire and sell the property,
that no one would build a home on this site due to the noise of truck
traffic, that he started the business in 1928 and it w,.uld be a gross
injustice not to allow him to sell the business at this time.
Mr. Wallace LaPrade states that there are several hundred acres in
close proximity being developed as nice residential property, that he
is interested in the zoning of the 360 Corridor and that people can
build residential homes on Rt.360.
Mr. Robert Bennett states that he lives adjacent to the subject property
and does not object and requested the Board to look out for Mr. Layman,
since it is necessary that he retire from this work.
Mr. C. Denny White on hearing all of the evidence stated that he
sympathizes with Mr. Layman but also the long range plan of the County
and cast his vote against the rezoning.

The request for rezoning on the Warwick Road by Doris 1'1. Hooper, et als,
having been deferred from a previous meeting, is on motion of Mr.
Dietsch, seconded by Hr. Hartin, resolved that this request be
deferred to December ll, 1968 for further consideration.

The request of Mr. Ira E. Wenger deferred from the August 14,1968
meeting of the Board,~which request is for the rezoning from Agricultura~
to General Business (C-2) on a parcel of land of irregular shape
fronting 135 ft. on U.S.Rte. 60 and extending southwardly 384 ft.
being l400 ft. more or less, eac;t of North Courthouse Road in Midlothian
Magisterial District. Refer to Sec. l7 par. 154.
Mr. James Hubbard, representing Mr. Wenger states that there is no
opposition to this requested rezoning and asked the Board to approve
this request.
On motion of l'tr. Martin, seconded by Mr. Browning, it is resolved that
the aforedescribed parcel of land be and it hereby is rezoned to

Mr. James Sowers, representing Francis H.Fenell and Lillian B. Angle,
comes before the Board requesting the rezoning from Residential-2
to General Business (C-2) on a parcel of land of irregular shape
fronting 86.5 ft. on the east line of Millenbeck Road, 180 ft. more or
less, on the northeast line of Wharton Road and 217 feet on the
south line of Plazaview Road. being situated on the eastern corner
of the intersection of said streets and better known as 4501 Millenbeck
Road. in Manchester Magisterial District. Refer to Sec. 20-ll(3)
Blk. 5 lots land 2.
There appearing no one in opposition to this request and the Planning
Commission having recommended its approval, it is on motion of Hr.
Dietsch, seconded by Mr. Martin, resolved that the aforedescribed parcel
of land be and it hereby is rezoned to General Business, with the
provision that the County Planner approve the site layout, landscaping
and plans for this project.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that
the County Planner be requested to advertise for rezoning to General
Business the entire area between Belt Boulevard and the Railroad.

Mr. Ocie D. Adkins and Mr. Glen W. Butler come before the Board request-
ing the rezoning from Residential-l to Residential-2 on a parcel of
land containing 84 acres of irregular shape, being 1000 feet south of
the intersection of Route 696 and Route lO; its approximately 3450 ft.
northern boundary being Babry Swamp and its eastern boundary extending
southwardly l250 ft., more or less, along Johnson Creek and its western

There appearing no one in opposition to this request and the Planning
Commission having recommended approval, it is on motion of Mr.Purdy,
seconded by Mr. Apperson resolved that the aforedescribed parcel of
land be and it hereby is rezoned for R-2 purposes.

Mr. George B. Little comes before the Board representing Glendale
Homes Incorporated, requesting the rezoning from Agricultural to
General Business (C-2) to General Business (C-2) on a parcel of land
of irregular shape containing 56.5 acres fronting 986.07 ft. and
Route 60 and extending southwardly l818.60 ft. to a width of l430.90 ft.
being opposite the intersection of German School Road and Route 60
in Manchester Magisterial District. Refer to Sec. 19-12 par.26,27,
28 and 29.
There appearing no opposition to this request and the Planning Commission
having recommended approval, it is on motion of Mr. Dietsch, seconded
by Hr. Martin resolved that the aforedescribed parcel be and it hereby
is rezoned to General Business upon the condition that the County
Planner approves the site layout, landscaping and plans on this project.

Mr. Hall of Hall & Harris, comes before the Board requesting the rezoning
from Residential-2 to General Business (C-2) on a parcel of land ~f
irregular shape fronting l400 ft. on Route 60 and extending northwardly
120 ft. being situated in the northeast corner of the intersection of
Route 60 and Route 714 in Midlothian Magisterial District. Refer to
Sec.l5-ll par. 2 & 3.
There appearing no one in opposition to this request and the Planning
Commission having recommended said property to be rezoned to C-l
instead of C-2, it is on motion of j'.;r. Martin, seconded by Mr. Dietsch,
resolved that the aforedescribed parcel of End be and it hereby is
rezoned for Local Business (C-l).

r1r. P.C.Bowery, Jr. comes before the Board requesting a Use Permit
to construct and operate a general contracting business on a parcel
of land containing 2.50 acres of rectangular shape fronting 245 feet
on Falling Creek Avenue and extending southwardly 445 feet being
l225 ft. west of U.S.Route 1 in Manchester Magisterial District.
Refer to Sec. 53-2 (2) parcel 13, and explains his request for an
office building to house his growing business.
r1r. Yeager of 2802 Falling Creek Avenue states that they are trying to
upgrade the community.
Mr. A. M. Coates, who lives in front of this property states that
the Trucking concern already zoned is too much noise and opposes this
request.
There is presented a letter from Hr. and Mrs. Booker of 2813 Falling
Creek Avenue opposing.
Mrs. Coates and Mrs. Johnson vigorously oppose the request.

Mr. Crawley Joyner, ~ manages the apartments ~acent to the subject
property states he B not against the zoning but would desire an adequate
screen for the protection of his clients.
Mr. Moss of 2816 Falling Creek Avenue opposes.
On motion of ~. Dietsch, seconded by Mr. Purdy, it is resolved that
this Board denies the,Use Permit requested by Mr. Bowery.
68-32U.P.
Mr. Earl S. Smith comes before the Board. requesting ~a Use Permit
to operate a lawn mower shop behind his home on a parcel of land of
irregular shape fronting 387.5 feet on Walmsley Boulevard and extending
southwardly 48 feet being l50 feet east of Ironwood Road in Manchester
Magisterial District. Refer to Sec. 42-5 parcel 48, and states that
he has had a lawn mower repair operation at this location for many
years, possibly as far back as 1944.
Mr. S. O. Swinson opposes, stating that this would be a mitake to
rezone this property to business with the way the land is presently
developed.
Upon further consideration and on motion of Mr. Dietsch, seconded by
~. Martin, it is resolved that a Use Permit be granted to Mr. Earl S.
Smith and to his son Samuel Lee Smith only, for his present operation
upon the condition that there be no expansion of the existing buildings.

Mrs. Betty J.Prindes comes before the ~ard requesting a Use Permit to
make, sell and teach ceramics in her home, on a parcel of land containing
1.53 acres of irregular sha~e fronting 208.7 feet on Hopkins Road and
extending northeastwardly 502.24 feet, being 730.30 feet northwest of
Conifer Road, and better known as 7733 Hopkins Road in Dale Magisterial
District. Refer to Sec. 66-12 par. 10.
There appearing no opposition to this request, it is on motion of Mr.
Apperson, seconded by Mr. Browning, resolved that a Use Permit be
granted to Mrs. Betty J.Prindes for her use only and further that an
advertising sign be limited to six (6) square feet.

Mr. John A. Gates, Jr. comes before the Board requesting a Use Permit
to sell antiques in the basement of his home on a parcel of land of
irregu~ar shape fronting 850 feet on Old Buckingham Road and extending
northwestwardly 450 feet, more or less, being situated on the western
corner of the intersection of Old Buckingham Road with Falling Creek
in Midlothian Magisterial District. Refer to Sec. l16-l0 (1) par 11'
and Sec. ll6-10(2), and states that ne wishes to sell antiques from his
home.
Upon consideration whereof and on motion of Mr. Martin, seconded by
Mr. Dietsch, it is resolved that this matter be deferred to September
26, 1968 for further investigation.

Mrs. Mildred Spencer comes before the Board requesting clarification
of her status concerning the conditions imposed on her property facin~
Route 10, north of its intersection with fuute 604, _which case was heard
July l3, 1966.
Mrs. Spencer states she wishes to build an office, country store and
a service station on business property which seemed to have some
restrictions against her proposed use. The Commonwealth's Attorney
advised the Board that under the existing zoning that the use Mrs.
Spencer proposed would seem to be in order.
Whereupon, the Board agreed that no further action was necessary in
this matter.
On motion of Mr. Dietsch, seconded by hr. Martin, it is resolved that
the Engineering Department be authorised to do certain work on the
property owned by the County on Powhite Creek and Jahnke Road according
to a plan presented by Mr. May~rd Elrod.
On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that
this Board accepts a deed of easement from the Meadowbrook Country
Club for a water line construction.
On motion of Mr. Apperson, seconded by ~. Martin, it is resolved
that this Boa~d of Supervisors records its great wish for m~rimonial
bliss and co~ubial felicity for Miss Judith Bailey who will soon be
married. Miss Bailey is a news reporter par excellence who has
written the news of Chesterfield County in a highly unbiased fashion
unrealized in the County for many years.
On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that
the following policy presented by the Building Inspector and the
County Engineer be approved in making connections from the house
sewer to the County's sewer systemiy shall be necessary to use one
of the following procedures:
1. Roll-on 0 Ring Mapter
2. Sealer gasket or equal (Neoprene rubber between two
stainless steel collars).
3. Asbestos cement sewer pipe jOints.
Tfie matter of moving a fire hydrant for Mr. Charles Jones in the
Meadowbrook Estates Subdivision and the County Engineer is requested
to view the south line of Mr. Jones' property and to make an estimate
of the feasibility of moving the fire hydrant to this location.
On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that
this Board grants to Mr. Louis E.Cheatham a Variance from the
Subdivision Ordinance to allow the construction of a second house on
the property ~nown as 8201 Forest Hill Avenue which new house would
face a private driveway.
On motion of ~. Dietsch, seconded by Mr. Apperson, it is resolved that
this Board adjourns at 6:05 P.M. to Septembe~ 26, 1968 at 2:00 P.M.

AN ORDINANCE to repeal Chapter 2, Article 3, Sections 2-5.2 and 2-5.3
and to amend and reordain Section 2-5 to prohibit dogs from running
at large in the County of Chesterfield, and Section 2-5.1 to provide
for the impoundment of said dogs in violation of Section 2-5, and
Section 2-11 to provide for a dog license tax, and Section 2-14 to
provide for confinement and disposition of dogs.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTER-
FIELD, VIRGINIA:
1. That Chapter 2, Article 3, Section 2-5 and Section 2-5.1 of the
Code of the County of Chesterfield be and it is hereby amended
and reordained to read as follows:
Section 2-5 DOGS RUNNING AT LARGE
It shall be unlawful~to permit any dog to run at large within the
boundaries of the County at any time during any month of the year.
For the purpose of this section, a dog shallbe deemed to run at large
while roaming, running or self-hunting off the property of its owner
or custodian and not under its owner's or custodian's immediate control.
It shall be the duty of the Dog Warden, Deputy Dog Warden or Police
Officers to enforce the provisions of this ordinance, and any person
who permits his dog to run at large shall be deemed to have violated
the provisions of this section, and shall be liable to a fine of not
less than five nor more than twenty-five dollars for each violation.

Section 2-5.1
IMPOUNDMENT OF DOGS IN VIOLATION OF SECTION 2.5
It shall be the duty of the Dog Warden, Deputy Dog Wardens or
Police Officers of the County of Chesterfield to cause all dogs found
running at large in violation of Section 2-5 to be caught and penned
up in the County Dog Pound. The Dog Warden, Deputy Dog Wardens or
Police Officers shall make every effort to determine ownership of the
confined dog and notify the owner oftts whereabouts.
2. That Chapter 2, Article 3, Section 2-11 of the Code of the County
of Chesterfield be and it is hereby amended and reordained to
read as follows:
Section 2-11
LICENSES; TERM;-FEES
It shall be unlawful for any person to own a dog four months old
or over, unless such dog is licensed, as required by this section.
Dog licenses shall run by the calendar year from January first to
December thirty-first, inclusive, and the license tax shall be payable

Funds collected in the enforcement of this section shall be disposed
of in the same manner as dog license fees.
3. That Chapter 2,.Article 3, Section 2-14, paragraphs (a), (b) and (c)
of the Code of the County of Chesterfield be and it is hereby amend-
ed and reordained to read as follows:
Section 2-14
CONFINEMENT AND DISPOSITION OF DOGS; REDEMPTION BY OWNER; BOUND
CHARGES.
(a) The Dog Warden shall cause to be constructed and ;maintained a
pound or enclosure and shall require dogs running at large contrary to
the provisions of this chapter to be confined therein. Any dog which
has been so confined for a period of ten days and has not been claimed
by the owner thereof may be destroyed by the Dog Warden or otherwise
disposed of in accordance with this section; provided, however dogs
confined with tags shall not be destroyed until the owner of such dog
has been notified in writing by certified mail at least fifteen days
prior to the destruction of the dog. Such notice requirement shall be
deemed sufficient when mailed to the owner's address as it appears on
record in the County Treasurer's Office.
(b) Any dog found in the County not vaccinated or not wearing an
authentic vaccination tag or license tag as provided in this chapter
shall be impounded by the Dog Warden, Deputy Dog Warden or Police Officer.

(c) Any dog confined under any of the provisions of this Chapter
may be redeemed by its owner at any time after confinement, if such
dog has not been otherwise disposed of under the provisions of this
section, upon payment of the proper fees. No dog shall be released to
any person claiming ownership until proof of current dog license receipt
or tag and current valid vaccination certificate are presented, and by pay.-.:
ment to the Dog Warden of a fee in the amount of $1.50 if claimed during
the first 24 hours of impoundment and $.50 for each additional day there-
after,;

passage as provided by law.

Dear Sir:
Recently the Board of Supervisors passed a resolution requesting a reduction in
the 45 M.P.H. speed limit on Route 10 between Route 1 and Route 810.
Special radar studies were made on Route 10 by technicians from the Traffic and
Planning Division of the Central Office. From results of these studies it was
recommended that no change be made of the 45 M.PIl. speed limit. This request and
the recommendation to maintain the existing speed limit was discussed with
Sergeant Bumgardner of the State Police, and he agrees that 45 M.P.H. is the
proper speed.
Therefore, from results of the study, no change of the existing speed limit is
justified at this time and said request is hereby denied.

Recently the Board of Supervisors made a request for a speed study to reduce the
speed limit on Route 10 between Route 651 (Belmont Road) and Route 150 (Chippenham
Parkway) .
This section is within the area recently studied at the request of the Board. Six
radar locations were set up on the original study with four of them between Belmont
Road and Chippenham Parkway.
Results of the speed data show that generally the 55/45 MPH speed limit is being
observed. If the speed limit is reduced to the requested 45MPH, approximately 50
per cent of.the drivers would v~olate the regulation. At the present time, less than
5 per cent of the motorists are exceeding the 55 MPH limit.
Reduction of speed limits should only be imposed when their use will facilitate traffic
or reduce traffic hazards. It is generally agreed that most motorists will drive at
a speed which they feel is reasonable and safe regardless of the posted limits. under
normal conditions, approximately 15 per cent of the motorists will drive in excess of
a safe and reasonable speed. Also, motorists tend to pay little attention to speed
limits which they consider unreasonable unless strict enforcement is evident.
Considering the information obtained in the speed zone study, it is recommended
that the 55/45 MPH speed limit remain.

Dear Mr. Longmire:
Enclosed you will find a petition signed by residents of
Shawnee Road asking that street light, pole # X29l77 - 5853-N,
located at 6840 Shawnee Road be in working condition again.
Every resident who would benefit from this light has signed
the petition, so there is no opposition.
This pole is located in a valley which, I understand, was to be
made into a street when this subdivision was developed; however,
plans were changed and a street was never opened. It is very
dark in this valley and the residents on both sides of the street
have heard what they thought were prowlers.
We would appreciate your prompt attention to this matter and
trust that the Board will see fit to have this light turned on
again as it is needed badly.

Dear Howard,
This letter will follow up our telephone conversation of
today at which time I advised you that the proposed lease on Lowell
Smith's property on Distributor Drive in Business Acres will not be
consummated. Lowell had submitted an application to your office
for a Use Permit in anticipation of this lease and also in an effort
to work on this permit simultaneously with the final details of the
lease.
I was advised this weekend that the F. L. Waite Corporation
is unable to make a commitment for a business location in Chesterfield
County at this time although there may well be a possibility that this
situation may change some time in the future.

Inasmuch as connections made to the public sewer from private pro-
perty are from cast iron, cement, or cement asbestos to cement or
cement asbestos, the Office ,of the County of Chesterfield Chief
Building Inspector shall require the following procedures be fol-
lowed in making the above connections:
1. Roll-on 0 Ring Gasket Adapter.
"Insta11 roll-on o-ring gasket adapter. Insert a layer
of jute or hemp into 'the base of the joint"ram tightly
against o-ring. Fill remaining space in one continuous
operation with a thoroughly mixed mortar composed of one
part cement and two parts sand, with only sufficient
water to make the mixture workable by hand.
2. Sealer Gasket (neoprene rubber' between two stainless
steel collars)
,Fit unit over pipe to be inserted and place in 6" lateral.
Tighten nuts to proper tension.
3. Asbestos Cement Sewer Pipe Joints.
Asbestos cement sleeve couplings of same co~ppsition as the
pipe to be installed accordin~ to manufactor's specifi-
cations.
