On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that
the minutes of March 12, 1969 De and they hereby are approved.
There WQS read a resolution from the School Board presenting formally
a request for $28,488,361.00 for the School Budget during the fiscal
year 1969-'70.
On motion of Mr. Dietsch, seconded by Mr. Apperson, it is resolved
.that this Board receives the School Board request for the comihg
fiscal year.
Mr. Robert Mick, President of the County Council of Parent-Teachers
Association speaks in favor of passing the School budget without
reducing the total amount.
Mrs. Dawn Campbell, the next President of the Chesterfield County
Educational Association states that the total budget should be
passed and can see no categories which can be reduced.
Mr. Bernard Savage, speaking for the Huguenot Boosters' Club wants
schools to be the best in the area and state~ that if the budget
is cut that maintenance generally bears the heaviest cut and cites
the malfunctioning of a drainage system at the Huguenot School.
Mrs. L.E. Armstrong speaks for a new opproach in informing the
general public concerning the tiudget and requests a special meeting
to discuss the budget.
Mr. Browning states that he agrees with Mrs. Armstrong that the
budget should be discussed at one special meeting.
Mr. Dietsdh states that we need the maintenonce suggested by
Mr. Savage and it is unfortunate the Board cannot reduce the School
budget by items.
Mr. Apperson states that the School system may have lost in maintenance
but his prime concern is for education.
It was generally agreed that the budget would be discussed'at a
later date when introduced for advertising.
Mr. Thomas E. McCracken, Chairman of the Girl Scout Camp Sites
comes before the Board stating that the Girl Scouts own S8-acres
in Bon Air, that they have given to the County easements for a

sewer lagoon and sewer mains, that the land without additional sewer
connection has been appraised at $165,OOO,that the land with additional
sewer connection has been appraised for $420,000 and asked the Board to
allow additional sewer connections for multi-family use of this land"
Mr. Painter states that this would be more than the present facilities
can take, however, somethimg might be worked out if the construction
is stageE1.
Upon consideration whereof, and on motion of Mr. Purdy, seconded by
Mr. Dietsch, it is resolved that when a prospective buyer is obtained
that the County Engineer should work with him to schedule a program
whereby this request can be fulfilled since it is the intention of this
Board to cooperate in ~very way with the Girl Scouts in the sale of their
property..
Mrs. Terry Johnston, who lives in ~ester, comes before the Board
complaining that her dog had been picked up at CUrtis School on Friday
and sold on Saturday a~d states further that she does not believe
this is any way to treat County citizens.
Lt. Simmons states that the dog was picked up on Friday morning at
the request of the School teachers who stated that the dog had been
hanging around the School for several weeks with no tags and the dog
was given to a family in Midlothian with the specific understanding
that if anyone called for such a dog it would have to be returned, but
unfortunately the dog escaped that night and cannot be found at this
time.
Whereupon, it was generally conceded that it was a regrettable situation
that the dog had escaped but that no one had broken a law or changed
a policy and nothing can be done for Mrs. Johnston.
On motion of Mr. Martin, seconded by. Mr. Purdy, it is resolved that
the following two ordinances which have been advertised be and they
hereby are approved:
AN ORDINANCE to vacate that portion of the subdivision
plat of Rock Creek Park, Section liB", made by J.K.Timmons,
Engineer and Surveyor, dated May 2, 1956 and recorded in
Plat Book 9, Page 132, in the Clerk's Office of the Circuit
Court of Chesterfield County, Virginia, which establishes
an eight-foot easement for drainage and utilities on Lot 12,
Block A, Hock Creek Park, Section "B" along the eastern
boundary of said lot, which easement is more particularly
shown as outlined in red on a plat made by J.K.Timmons and
Associates, Civil Engineers & Surveyors, dated February 7,
1969, a copy of which is attached hereto and made a part
hereof.
WHEREAS, Dr. Hsui-Sheng Hsu and Mrs. Barbara C. Hsu, his wife,
have petitioned the Board of Supervisors of Chesterfield Oounty,Virginia,
to vacate that portion of the aforesaid subdivision plat of Rock Creek
Park, Section "C", which establishes an easement for drainage and
utilities on Lot 1, Block 0, of RcDck Creek Park, Section "C", along
tee western boundary of said lot, as outlined in red on the attached
plat dated February 7, 1969, by J.K.Timmons & Associates, Civil

Engineers and Surveyors, is hereby vacated, but no part of the similar
easement along the rear of said lot is vacated by this Ordinance.
This Ordinance shall be in full force and effect in accordance
with Section 15.1-482 of the Code of Virginia, 1950, as amended, and
a certified copy of this Ordinance shall be recorded in the Clerk's
Office of the Circuit Court of Chesterfield County, Virginia.

wife,have petitioned the Board of Supervisors of Chesterfield County,
Virginia,to vacate that portion of the aforesaid subdivision plat of
Rock Creek Park, Section liB", which establishes ah eight-foot easement
for drainage and utilities on Lot 12, Block A, Rock Creek Park,
Section "B", along its eastern boundary, which easement is outlined in re
red on a plat by J.K.Timmons & Associates, Civil Engineers and Surveyors,
dated February 7, 1969, a copy of which is attached hereto and made
a part hereof, and notice of the consideration of the adoption of such
ordinance has been given in accordance with Section 15.1-431 of the
Code of Virginia, 1950, as amended:
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS
OF THE COUNTY OF CHESTERFIELD, VIRGINIA:
1. That pursuant to Section 15.1-482 of the Code of Virginia,
1950, as amended, that portion of the aforesaid subdivision plat of
Rock Creek Park, Section "B", which establishes an easement for
drainage and utilities on Lot 12, Block A, of Rock Creek Park,
Section "B",along the eastern boundary of said lot, as outlined in red
on the attached plat dated February 7, 1969, by J.K.Timmons & Associates,
Civil Engineers and furveyors, is hereby vacated, but no part of the
similar easement along the rear of said lot is vacated by this Ordinance.
This Ordinance shall be in full force and effect in accordance
with Section 15.1-482 of the Code of Virginia, 1950, as amended, and
a certified copy of this ordinance shall be recorded in the Clerk's
Office of the Circuit Court of Chesterfield County, Virginia.
Mr. W. R.Davidson and Mr. Harold Warren of the Highway Department come
before the Board to discuss the problem of replacing street signs and
state that it is the Highway'S policy to install street signs but the
problem of replacing them once torn down or worn out has not been solved.
Mr. Davidson further states that approximately 200 street signs

were replaced last year and that the Highway must add another sign
crew or let the County do the replacements.
Mr. Daniel thinks that the replacement of signs will average 400
per year.
After further discussion it was decided that Mr. Davidson will start
on the replacement of signs and keep the cost of each so that some
idea can be gained for a per item basis.
The matter of installing County utilities in the utility strips
acquired by the County adjacent to County roads was discussed briefly
and it was generally agreed that a meeting would be requested with
Mr. Harwood and Mr. Blundon of the Highway Department.
Mr. W. Curtis Wright comes before the Board complaining of the fact
that he paid $500.00 for a sewer conn8ction on WaIDnut Drive and has
been requested to pay an additional $600.00 by the Sewer Department for
the lowering of the sewer laterals. After some discussion of this
mateer, it is on motion of Mr. Purdy, seconded by Mr. Browning, resolved
that Mr. Wright be requested to pay $100.00 additional which pays for
the lowering of the sewer laterals.
Mr. Stamie Lyttle, Chairman of a Committee on Field Houses for High
Schools come before the Board and states that the School Board has
agreed that field houses should be built at five High Schools; however,
there is insufficient money in the School budget to finance same and
presented a resolution from the School Board requesting the County to
advance $75,000 to pay one-half of this project and states that the
School Board will repay the $75,000 from the proceeds of the next
Bond ~ssue. Upon consideration whereof, and on motion of Mr. Apperson,
sedonded by Mr. Martin, it is resolved that trois Board agrees to pay
$75,000 from the General Fund toward the installation of field houses
in Matoaca, Thomas Dale, Meadowbrook, Manchester and Midlothian High
Schools and advances $75,000 from the General Fund of the County to
the School Board to pay the second half of this project with the
understanding that the School Board will reimburse the General Fund
this amount from the proceeds of the next Bond Issue.
It is understood that each field house will cost approximately $30,000
and the total cost would be $150,000.
There was read a letter from Mrs. Orcutt and Mrs. Greene, again
requesting that some work be accomplished on the Chalkley Elementary
School grounds for the specific purpose of the children in the neighbor-
hood playing football and baseball. Upon consideration whereof, and
on motion of Mr. Browning, seconded by Mr. Apperson, it is resolved
that this letter be sent to the School Board for further consideration.
On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved that
contracts be and they hereby are approved:

On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved
that the request for an extension of the 16" water line on Turner Road
be approved, provided that at least three of the citizens will pay
for the water connection and upon the further consideration that the
additional areas be contacted for possible further extensions.
It is here noted that the Board of Supervisors will tour the sewer
line project on the north bank of the Falling Creek Reservoir on
March 27 at 1:30 P.M. to ascertain the need for a better housekeeping
program on this sewer -project.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
this Board awards Contract 6511-21 for the installation of sewers
in Meadowbrook to the Roanoke Construction Company who submitted the
low bid of $177,647.00, and the recommendation for the use of clay pipe
as approved by the Engineer.
The County Engineer produced a map of the Warwick Acres Subdivision
and showeq generally where Project 6511-35 would be.
Upon consideration whereof, and on motion of Mr. Martin, seconded by
Mr. Appersog, it is resolved that the County Engineer be and he hereby
is authorized to seek bids on the installation of sewers in Warwick
Acres.
On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved
that this Board vacate a sewer easement across the property of
Clifford D. and Grace E. Langlois, under Project 6511-63/42 with the
understanding that the County has secured a replacement of this
easement.
On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved
that the following permits be awarded to the stated Companies:
1. Commonwealth Gas Distribution Corp.-College Park Subdo
2. C & P Telephone Company -Hidden Valley Estates -Buried Cable
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
the property of the following people be condemned if the award of
$25.00 as the price of an easement be not accepted:

It was generally agreed that the Executive Secretary would notify
Mr. Ash and Mr. Ingram of the recent drainage ruling by the Attorney
General.
The Drainage Committee having set a public hearing on March 21, 1969
postponed said public hearing until April 28,1669 at 7:30 P.M.
The communication from the Richmond Community Council, the City Manager
of the City of Richmond and the Richmond Regional Planning Commission
concerning the proposed Mental Health Program was briefly explained;
however, no action was taken concerning this matter.
The Board was notified by the Highway Department that Tucker Road,
from a point on Route 10, 0.26 mile north of Route 611, and running
east 0.20 mile to a cul-de-sac has been taken into the State Secondary
.:ystem of roads.
On motion of Mr. Browning, seconded by Mr. Purdy, it is resolved
that the following erroneous tax claims be and they hereby are approved
for payment:

There was read a letter from Mr. Leslie Saunders stating that Mr.
Percy Harris, III, had broken the agreement made to the Board when a
Use Permit was approved on lliniel Street.
It was generally agreed that the Executive Secretary write to Mr.
Harris asking him to comply with the provisions of the Use Permit
granted.
The notice of a meeting of the State ~mpensation Board on April 3, 1969
at 9:00 A.M. was read to the Board.
On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved that
Mr. C. G. Manuel be requested to attend any meetings in the area
concerning the disposal of solid waste.
It is here noted that Mr. Purdy votes Nay, saying that the County should
continue to take care of its own waste disposal.
The Board was notified that service had been received by the Executive
Secretary of Court action taken in the County's name to clear up the
gift of certain property from the H. T. Goyne Estate.
This is a matter of clearing legally the ~ift of the land to the John
Tyler Community College.
There was read a request from the John Tyler Community College stating
that fertain work was necessary to be accomplished which work could
not be financed by the State of Virginia and requested that each
locality pay a share of this expense, which share for the County of
Chesterfield would be $30,830.00 for the coming fiscal year.
Upon consideration whereof and on motion of Mr. Apperson, seconded
by Mr. Browning, it is resolved that said amount be included in the
1969-'70budget to pay for Chesterfield's share of this expense.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
the Treasurer of the County be and he hereby is requested to transfer
tbe sum of $214,000 fr6m the Sewer Bond Construction Fund (77) to the
Sewer Debt Service Fund (72) and the sum of $185,820. to be appropriated
from the unappropriated surplus of said fund to the Sewer Debt Service
Fund (72-320) and the sum of $4923.00 to be transferred from 13-155-298
to addition to building 13-152-601.2.
On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved
that the following game claim of Mr. William S. Newsom in the amount
of $20.00 be and it hereby is approved for payment.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that
the following ordinance be introduced and advertised for hearing on
April 23, 1969 at 2:00 P.M.:

providing for removal of inoperative automobiles
on residential property.
Sec. 3-20 RSMOVAL OF INOPERATIVE AUTOMOBILES FROM RESIDENTIAL
PROPERTY
It shall be unlawful for any person, firm or corporation
to keep any automobile or automobiles on any property within the
County zoned for residential purposes whose condition is such that
it is economically impractical to make them operative, except when
kept within a fully enclosed building or structure.
There was a brief discussion of the extension of ~.743, whereupon
Mr. Apperson reported that ~lr. Davidson of the Highway Department was
still investigating the extension of this road and nothing could be
done until the Highway finished this investigation.
On motion of Mr. Purdy, seconded by Mr. Apperson, it is resolved that
the County assume the cost of a street light at the intersection of
Dudley Drive and Hollis Road in Victoria Hills and the request to
take over a street light 1n Forest Glen Circle be referred to the
street Light Committee.
On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved
that the following Vacation Policy be and it hereby is adopted
to become effective April 1, 1969.
SECTION II-VACATION LEAVE:
Every officer or employee who has been in the County's service for
a period of (12) months or more shall be allowed vacation leave
with pay. Vacation leave with pay shall accrue in accordance with
the following schedule:
FIRST YEAR - 1/2 day leave per month, but allowed to take none
during first 12 months.
ONE YEAR TO FIVe YEARS - 1 day leave per month, allowed to carry
over 1/3 of each year's allotment to
maximum accumulation of 16 days.
SIX YEARS TO ~EN YEARS - 1-1/4 days leave per month, allowed to
carryover 1/3 of each year's allotment
to maximum accumulation of 20 dayso
OVER TEN YEARS - 1~1/2 days leave per month, allowed to carryover
1/3 of each year's allotment to maximum accumulation
of 24 days.
It is here noted that Mr. Martin abstains from voting.

On motion of Mr. Purdy, seconded by Mr. Browning, it is resolved that
this Board grant a Variance to Mr. W. I. Dennis, Rt. #2, Box 74&,
~ester, Virginia, to construct a dwelling facing on Rt. 10, the
building of which would encroach 10 feet on another lot until the
present house is removed with the condition that the existing trailer
is removed from the premises.
On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved
that the two weeks period from April 7th through the 19th be declared
"Specia) Clean-Up Week" for the County of Chesterfield.
On motion of Mr. Browning, seconded by Mr. .Purdy, it is resolved that
this Board adjourns at 6:40 p.m. to April 9, 1969 at 9:00 A.M.

board, without dissenting vote, approved~the estimate of funds deemed
necessary by the School Board for the public schools of Chesterfield
County for the fiscal year 1969-70 in the amount of $28, 488, 361. 00.
The board further directed that the superintendent of schools
forward said estimate to the board of supervisors of Chesterfield County
with the request that it be approved and included in the total budget of
the county for the fiscal year 1969-70.

My clients, Dr. and Mrs. Hsiu-Sheng Hsu, are ~
much anxious to acquire two-adjoining lots in Chesterfie~d
County and to build a house thereon. However, in order
to do so, it will be necessary to obtain the County's
approval to vacate two drainage and utilities easements
which run along the boundary between the two lots.

Department'has been alerted to the fact that a request for
vacation of the easements will be made, and it is my under-
standing from-talking to my clients that this Department
would have no objection to the request.

which you might have. I realize that I will have to give
notice and would appreciate any instructions as to such
notice. Also, please let me know of whatever fee is re-
quired to be submitted with this petition.

Your Petitioners, Dr. Hsiu-Sheng Hsu and Barbara C.
Hsu, his wife, respectfully represent:
1. That they have contracted to purchase those two
certain lots in Midlothian District, Chesterfield County,
Virginia, described as follows:
(1) That certain lot designated as Lot 12,
Block A, on plat of subdivision of Rock
Creek Park, Section "B" made by J~ K.
Timmons, Engineer & Surveyor, dated May 2,
1956, and recorded in the Clerk's Office
of the Circuit Court of Chesterfield
County, Virginia, in Plat Book 9, at
page 132, which said lot will be herein-
after referred.to as, "Lot 12-A-B"; and
(2) That certain lot described as Lot 1,
Block D, on plat of subdivision of Rock
Creek Park, Section "C," made by J. K.
Timmons, Civil Engineer, dated July 12,

subdivision plats referred to, on which they are described
as being "for surface and underground drainage and under-

ground and overhead utilities" and as being "subject to the
right of the County of Chesterfield and/or the City of
Richmond, Virginia, to establish alleys on said easements
at any future time without cost for property involved";
6. That your Petitioners desire to build a house
upon said lots, at a location where said easements are
located, and that their proposed house, as planned, cannot
be built unless said easements are vacated; and
7. That your Petitioners do hereby apply for the
vacation, in accordance with Section 15.1-482 of the Code of
Virginia, 1950, as amended, of those portions of the afore-
said subdivision plats which establish the aforesaid ease-
ments, and pray that the Board of Supervisors- will consider
the ordinances attached hereto in order that the aforesaid

On motion of Mr. Russell, seconded by Mr. Spencer, the School
Board directed that the Board of Supervisors be respectfully nottlied that
bec.ause of the increased costs of school construction and our efforts to
fulfill the planned program for school housing, funds are not now available
for the construction of field houses at the county high school sites.
Realizing that such facilities are desirable to the county recreational
and school programs, the Board of Supervisors is hereby petitioned to
provide the total cost of five field houses ($150,000) with the assurance
that the Chesterfield County School Board will reimburse the Board of
Supervisors one-half of the total cost ($75,000) upon the passage of the
next school bond referendum.

Gentlemen:
As you know we are endeavoring to promote a Community Program
whereby elementary school age children may participate in sports
and after school activities. We had about 50% of the student
body desiring to participate in this program through the media
of football, baseball, cheer leading, etG.
As of last year we used the school property for the practice
of football. This year of 1969 we hope to use the school
property for the sports of DQQtball and baseball.
The condition of the field we are presently using is highly
in need of grading and seeding. Due to the ruts and stones
it causes a hazardous condition which is detrimental to the
safety of the boys participating.
We would deeply appreciate anything you and the Board of
Supervisors can do to help us in this matter.

Dear Mr. Horner,
The Board of Directors of the Richmond Area Community Council at
their meeting on March 19, 1969 took note of the recommendation of the
Manager of the City of Richmond that the City and the counties of
Chesterfield, Henrico and Hanover form an area mental health services
board.
Our Council has long been interested in the development of mental
health services, especially of comprehensive mental health centers. In
keeping with that interest, the Board voted to endorse the proposal of the
City Manager and to urge each governmental body to act promptly to estab-
lish an area mental health services board.
On behalf of the Community Council, I should like to offer our good
offices for the purpose of convening a meeting of governmental leaders to
discuss the proposal should such a meeting be deemed desirable. ,I should
further like to offer the staff resources of our Council to any mental
health services board which may be created until such time as that board is
funded and can employ its own staff.
. Please do not hesitate to contact me if we can be of any assistance
in this matter.

SUBJECT:
Comprehensive Health Planning
On Thursday, March 13, 1969 the Richmond Regional Planning Commission met
and concluded its scheduled business at 4:20 p.m. The Executive Director had found
it necessary to bring an unscheduled request before the Commission, for which most
Commissioners were not able to stay due to the lateness of the hour. This request was
prepared by the Executive Director Thursday morning March 13, 1969 after talking
with the State Division of Planning and Community Affairs the afternoon of March 12,
1969. It was necessitated by the attached letter of March 7, 1969 from the Richmond
Area Community Council and from talks in San Francisco on March 10 and 11, 1969
with the Assistant Surgeon General of the U. S. Public Health Service and representatives
from the Detroit and Washington, D. C. Councils of Governments. Additional discussion
followed the evening of March 12, 1969 with a representative of the U. S. Department
of Housing and Urban Development. The memorandum of the Executive Director is
attached for your information.
For these reasons, which demanded action prior to March 20, 1969 the Executive
Committee used its emergency power to act for the full Commission and upon the motion
by Mr. Davis, seconded by Mr. Flippo, voted unanimously (Mr. C. L. Townes, Sr.
being absent, Mr. B. Earl Dunn being present) to resolve that:
The Richmond Regional Planning Commission hereby expresses
its interest in being designated as the areawide comprehensive
health planning agency. and requests that the Regional Health
Core Planning Committee work with the Commission and its
staff to bring about the best possible approach to the solution
of the comprehensive health planning problem.

As stated in the memorandum from the Executive Director this does not commit
the Richmond Regional Planning Commission to becoming the agency for areawide
comprehensive health planning, but it expresses our interest in this area. We hope
that no local governing body or their representatives will take action to support the
Regional Health Care Planning Committee until after the Richmond Regional Planning
Commission, its staff, the local public health departments, and others have had time
to study various alternatives. A final recommendation is expected by the Commission's
June, 1969 meeting. ,
The Executive Director has been instructed to meet with all the necessary
agencies to resolve this problem. He will continue to assist the Regional Health
Care Planning Committee in gathering supporting data for their application.

SUBJECT:
Comprehensive Health Planning
In 1966 Congress passed Public law 89-749 "Comprehensive Health Planning,
and Public Health Service Amendments" which provides project grants to public and
non profit organizations to cover fifty (50) per cent of the cost of area-wide community
health planning activities, including the development of plans and coordination for
community health services. The Act requires that a single agency be designated as
the responsible unit within an urban area to perform this planning function. It permits
, designation of either an areawide governmental agency or a non profit, private
corporation. The Act further provides for a developmental grant to permit creation
of both a proposed work program and the organizational structure required to carry
out such a program.
The Commission staff recommends a heavy involvement in this area of planning
for the Richmond Regional Planning Commission. This position is supported by the
National Service to Regional Councils, the U. S. Department of Housing and Urban
Development, and the State Division of Planning and Community Affairs. The staff
position in this matter is that it cannot in good conscious recommend delegation to a
priviate, non-publicly elected agency, the responsibility for determining what is in
the public interest insofar as it relates to the health and welfare of over half a million
people in this region.
At this moment a Regional Health Care Planning Committee, formed by the
Richmond Area Community Council is preparing an application to request designation
as the area wide health planning agency by incorporating an organization to be known
as the Capitol Area Health Planning Council. The Commission staff is assisting them
in gathering information for their application.
It is requested that the Commission pass a resolution expressing interest in
being designated as the areawide comprehensive health planning agency and re-
questing that the Regional Health Care Planning Committee work with the Commission
and its staff to bring about the best possible approach to the solution of the com-
prehensive health planning problem.

In effect this resolution would accomplish the following:
1. Place the Commission on record as being interested in being designated
as the area-wide agency for comprehensive health planning.
2. Allow the Commission and its staff time to meet with the various public
and private health agencies to cooperatively develop the most feasible
approach to solving this problem.
3. Alert each of the local governing bodies and the State Department of
. Health to the need to defer action or consideration of the independent
request until such time as the Commission can explore various alternative
approaches. This could be accomplished prior to July 1, 1969. '
4. Prevent hasty action by an od hoc private group until such time as the
pub I ic sector (including each local public health department) has had
sufficient opportunity to participate in the development of a coordinated
and cooperative proposal.
This resolution does not commit the Commission to final action in this oreo.

On February 26, 1969, after a public hearing, the Board of
Supervisors granted a use permit to Mr. Percy Harris, III for one
year to operate as a distributor for Amway products. In his motion,
Mr. Purdy provided that this use permit would be for one year, with
Mr. Harris'having the right to,reapply for another use permit after
its expiration; Mr. Purdy further provided that one .ofthe stipula-
tions of the use permit was that all traffic to and from Mr. Harris'
home in connection with this business would be routed down Percival
Street, up Daniel Street, to his driveway and would leave by the
same route. It was explicitly. explained by Mr. Purdy that under no
circumstances would any traffic turn onto Gayle and then come down
,Daniel Street to Mr. Harris' home. As a further stipulation to the
granting of this use permit, Mr. Purdy provided that no truck weigh-
ing greater than two tons would be allowed in this subdivision.
On March 3, 1969, at approximately 5:45 p.m., a Preston 151
truck, No. 238, proceeded down Gayle, turned onto Daniel and backed
into Mr. Harris' driveway. This truck, having an empty weight in
excess of four and one-half tons and a gross weight of eleven.ton~,
departed at 6:45 p.m. '.
This event indicates one of two .things. Either Mr. Harris
has no intention of operating within the limits of the use permit
granted, or, as I argued at the hearing, cannot control the traffic
as required under the restrictions of the use permit.

4261 Daniel Street, Chester, Virginia
Dear Mr. Burnett:
The Board of Supervisors granted the above use permit on Wednesday,
February 26, 1969, for one year with certain stipulations.
One of the stipulations made by Mr. Purdy was that all delivery
trucks be limited to a maximum of two tons. The attorney for
Mr. Harris stated that "his client is willing to agree to any
restrictions."
This willingness on the part of Mr. Harris was of short duration
as he violated this stipulation on Monday, March 3, 1969, and again
on Friday, March 14, 1969.
Following is a detailed account on each of the above violations:
1. First Violation
Monday, March 3, 1969 - Preston 151 Motor Line
Truck Number 238, Virginia license number TH820,
backed into Mr. Harris' driveway at 5:40 P.M.,
and departed at 6:45 P.M. The gross weight of
this truck is 22,000 pounds, the empty weight is
9,850 pounds, making a net or load weight of
12,150 pounds or, a little over six ton capacity.
2. Second Violation
Friday, March 24, 1969 - Preston 151 Motor Line
Truck Number 886, Trailer Number 053, Maryland
license number BIA166, backed into Mr. Harris'
driveway at 9:50 A.M., and departed at 10:20 A.M.
We have witnesses and snapshots of both of the above incidents to
further substantiate these violations. Based on the above evidence,
it appears that Mr. Harris has no intention whatsoever of complying
with the restrictions placed upon the use permit granted him by
the Board of Supervisors.
will you please present this letter to the Board of Supervisors
in order that they may be aware that Mr. Harris either cannot, or
has not, any intention of operating within the limits that were
contingent to the granting of his use permit.

TO THE CHAIRMAN OF THE BOARD OF SUPERVISORS ADDRESSED:
Dear Sir:
Reference is made to our notice of March 14, 1969. The probability
is that the General Assembly will not terminate its current extra session
until sometime in April and that House Committee Room #4 will not be
available to the Compensation Board on April 1, 1969. For this reason
it has become necessary to change the date and place of meeting,
Wherefore, written notice is hereby given you that the Compensation
Board will meet on the 3rd day of April 1969, beginning at 9 o'clock A.M.
on that day in Room 905 of the Ninth Street Office Building (formerly
Hotel Richmond), Richmond, Virginia, for the purpose of fixing the salary
and expenses of the Attorney for the Commonwealth, Treasurer, Commissioner
of the Revenue and Sheriff for the fiscal year beginning July 1, 1969 and
ending June 30, 1970.
The meeting aforesaid will be adjourned from day to day until its
purpose shall have been accomplished.

This lener is wril-i'en to transmH the recommendaHon of the Capital Region Park
Authority and the Richmond Regional Planning Commission with regard to the operation
and managemeni. of solid waste disposal in each of our iurisdictions.
On December ]2, ]968, the Richmond Regional Planning Commission unanimously
passed a resolu;-ion asking the CapHal Region Park Authority to accept responsibility for
establishing solid waste disposal operations on a regional basiso This request was trans-
mitted to the Capital Region Park Authority, which unanimously passed a resolution on
January 16, 1969 asking your municipal governments to turn over to j-he Capital Region
Park Authority the administration of all sanitary landfills. These requests incorporate
the foll~wing three points:
1. The regional approach to solid waste disposal be utilized.
2. The sanitary landfill method of solid waste disposal be followed.
3. The Capital Region Park Aurhorii.y manage and operate this
regional system.
In order to implement these recommendations it is requested that each jurisdiction
,draft the necessary ordinance(s) -to suppor;. this request, place jj- on your agenda as soon
as possible, and take affirmative action. The City of Richmond and the Counties of
Henrico and Chesterfield will need to pass ordinances expanding the powers of j'he
Capital Region Park Authority, through an amendmenj. to the CRPA Articles of Incorporation.
This amendment should be prepared jointly by the City Attorney, the Henrico County
Attorney, and -the Chesterfield County CommonweaH.h's Ai.I'orney. Once these have been
adopted the County of Hanover should join the Capital Region Park Authority as provided
for in the Park Authorii"ies Act. The Hanover County Commonwealth's Attorney should

work with the aforementioned officials or Chesterfield, Henrico, and Richmond ;'0
accomp! ish this acHon.
In order to expedi-j'e the establishment of regional sol id waste disposal operations
it would be appreciated if each !ocal governing body, by resolution or ordinance,
authorize its CHy Manager, Coun-ry Manager, or Execul.ive Secre'tary (or their
representaHve(s) to begin meeting with '(he Director orj-he Park Authority to establish
the method by which these facilities and personnel will be brough'{ under the adminis-
tration of ;.he CapHal Region Park Authority and the financial arrangemen-rs which
,,,,ill be required. The implemen-raj-jon of this proposal w!l\ require additional action
by each governing body at a later date ;'0 approve ,the administrative del'ails which
wI i! be recommended.

7. A tentative inventory and appraisement of the estate of H. T.
Goyne. Sr. reveals that the balance of land set forth ,in the agreement
still stands in the name of H. T. Goyne. Sr.
8. Your petitioners. desiring to carry out the provisions of
the agreement. are uncertain whether the provisions of the agreement
sufficiently bind the heirs of H. T. Goyne. Sr. to convey the balance
of the property set forth therein; whether or not said property should
be included in the decedents gross estate for tax purposes and whether
there will be a liability on the estate for the payment to the United States
for estate taxes and to the State of Virginia for payment of inheritance
taxes.
WHEREFORE. your petitioners pray that they be afforded the
aid and guidance of the Court in construing the provisions of the
agreement. and particularly. whether under the terms thereof. the
petitioners. as Co-Executors are sufficiently empowered to convey the
balance of the property called for in the aforesaid agreement on behalf
of the estate. and if not. whether the property should be included in the
decedents gross estate for Federal and State tax purposes. and that the
Court authorize the payment of appropriate fees and expenses of petitioners
counsel in bringing and conducting this suit.

Dear Mr.. Horner:
Under statewide policies governing Virginia IS. con1munity colleges, the
Cornn10nwealth provide s funds for:
1) basic buildings, equiplTlent and furniture;
2)' salaries of all college employees and;
3) maintenance and operating expenses.
The political subdivisions in a region served by a comrnunity college are
responsible for 'providing funds for:
1) expenses of the Local Board;
,2) liaison and spccial services to local industries, schools,
businesses, professional and civic groups, etc.; .,
3) the required site;
4) all site improvcrnents [including parking areas, roads, utility
connections, sidewalks, exterior lights, etc.] up to building
foundations.
John Tyler Community College has the required site but a continuing need
exists for funds to fulfill other obligations which are the responsibility of
the supporting subdivisions. The attached budget reflects the needs of
the college for the coming fiscal year beginning July 1, 1969. This budget
has been approved by the Local Board 'which has as members, whorn the
Board of Supervisors has appointed, Ivlr. Edwin B, Brooks, Jr., Dr.
Edward T. Kubu, and Mr. D. Jack Otto. There will be a continuing need
for such funds from Chesterfield County and the Local Board will ahvays
strive for an equitable distribution of .the financial bUl:den among the par-
ticipating localities.
The Local Board has further determined by a "fair share" fonnula the
arnount to be requested from each locality served by the college. The
form,ula took into consideration the true value of property subject to
local taxation and the population in the political subdivision. Primary
crnphasis was givcn, however, to the n,-lmbcr of students from. the political
subdivision who have been served by the college.

A. $214,000.00 from the Sewer Bond Construction Fund, fund 77,
to the Sewer Debt Service Fund, fund 72.

Building, 13-155-601.2. This is to pay architect fees not
provided for in cost of building addition.
Also, we need an appropriation of $185,820 to Sewer Debt

debt costs have been paid.

Board of Supervisors resolution
dated March 26~ 1969.
Memorandum to Department Heads:
Effective April 1, 1969, the employees of your department will be
allowed vacation leave as follows:
Every officer or employee who has been in the County's service for a
period of twelve (12) months or more shall be allowed vacation leave with
pay. Vacation leave with pay shall accrue in accordance with the following
schedule:
FIRST YEAR - 1/2 day leave per month, but allowed to take none during the
first 12 months.
ONE YEAR TO FIVE YEARS - 1 day leave per month, allowed to carryover 1/3
of each year's allotment to maximum accumulation
of 16 days.
SIX YEARS TO TEN YEARS - 1 1/4 days leave per month, allowed to carryover
1/3 of each year's allotment to maximum accumula-
tion of 20 days.
OVER TEN YEARS - 1 1/2 days leave per month, allowed to carryover 1/3 of
each year's allotment to maximum accumulation of 24 days.
The leave accumulated prior to April 1, 1969, (5/6 day per month
since the employee's last anniversary date) should now be determined for
each member of your department.
Please send me a "Report of Accumulated Leave" for your department
within the month of April utilizing the following format:

set as a policy on vacat~on and sick leave for all County personnel:
Section I - Sick Leave:
Any L" . t officer or employee who has been in ,the County's service
for one (1 month or more and is compelled to be absent from his work
on account of illness, shall be allowed sick leave at the rate of one
(1) day for each comple ted month of service.
Such sick leave allowance with pay shall be granted to salaried
officers and employees when they are incapacitated for the perfor-
mance of their duties because of sickness or injury or on exposure
to contagious disease, and not more than two (2) days sick leave
allowance will be granted for serious illness in the employee's
immediate family.
In the first year of employment an employee may be granted a maximum
of five (5) days of advanced sick leave after all accufuu1ated sick
and vacation leave have been used. Sick leave shall be accumulative
to a total not exceeding sixty (60) working days. ,A doctor's
certificate will be required to certify the employee's sickness
after the first week's absence. Extreme cases requiring more sick
leave than allowed herein may be reviewed by the Board of Supervisors.
Section 11- Vacation Leave:
Every --, . ~ officer or employee who has been in the County's

vacation leave with pay. Vacation leave with pay shall accrue in
accordance with the following schedule:
FIRST YEAR - 1/2 day leave per month, but allowed to take none
during first 12 months.
ONE YEAR to FIVE YEARS - 1 day leave per monthfallowed to carry
over 1/3 of each year s allotment to
maximum accumulation of 16 days.
SIX YEARS TO TEN YEARS - 1 1/4 days leave per month, allowed to
carryover 1/3 of each year's allotment to
maximum accumulation of 20 days.
OVER TEN YEARS - 1 1/2 days leave per month, allowed to carryover
1/3 of each year's allotment to maximum accumula-
tion of 24 days.

Section I - Sick Leave:

with pay. Vacation leave with pay shall accrue in accordance with
the following schedule:
(a) After six (6) months of continuous service, one week of
vacation will be allowed.
(b) From six (6) months through 5 years, vacation leave will
be earned at the rate of 1 day per month.
(c) From six (6) years to 15 years of continuous service,
vacation leave will be earned at the rate of l~ days
per month.
(d) Over 15 years of continuous service, vacation leave will
be earned at the rate of l~ days per month.
Vacation leave may be accumulated under the following conditions:
(a) One-half of vacation leave may be accumulated to a total
not to exceed 30 days.
(b) Upon separation from the County's service, an employee
shall be entitled to pay for all accrued vacation leaveo
(c) Vacation leave with pay shall be scheduled and approved
by the Department head.
A part-time permanent employee working one-half time or more is
eligible for vacation leave, sick leave and holidays on a pro-rated
basis after six months of service vjith the County. Part time employees
should be given credit for their previous ~unty employment when
placed on a full-time basis.

CO}lMENTS ON SICK LEAVE
AND VACATION POLICY
Section I .- Sick Leave:
Basically the proposed policy as regards sick leave
m~ets with my approval. However, to preclude certain situa-
tions from arising, the following changes or additions
are suggested:
1. There should bea definition of "contagious
disease." I had lunch yesterday with a
group of people. This morning one came do,ill
with measles. Should I take sick leave and,
if so, for hmv long?
2. "Immediate family" should be defined.
(Husband, wife, child, parents, parents-in-
law, brother, sister.)
3. In the event of death in immediate family,
does one take sick leave, vacation, or'leave
wi th pay?
4. Insert the following after the first sentence
of third paragraph: '''lnthe event the in-
dividual leaves the County's service before
he has' accLUnmulated these advanced days,
those remaining shall be deducted from his
last pay check."
5. Can an employee be granted advanced sick
leave in his second or sllcceeding years?

I cannot follow the example given for John Smith, If
he has 16 days accumulated on December 31, 1965 (I assume),
and receives 12 days of which he uses 14, how does he get
17 days on December 31, 1966. If the 16 days is as of
December 31, 1966, and the 14 days are taken during '67, I
still do not see how he has accrued 17 days. As a matter of
fact, trying to figure this out demonstrates the preference
for a calendar year.
