On motion of Mr. Howard, seconded by Mr. Dubus, it is resolved that
the minutes of lB February 1969, be and they hereby are approved
as corrected on page one.

69-l2C Mr. Harold Taylor again comes before the Commission, the
matter having been continued from the February meeting, requesting
the rezoning from Agricultural (A) to Residential-2 of a parcel of
land in Dale Magisterial District of irregular shape containing 10 acres
t located 450 ft. ! west of Hopkins Road extending westwardly to a
depth of 1470 ft., being 240 ft. ! northwest of the intersection of
Hopkins Road and Centralia Road (Rte. l45). Refer to Sec. 97-l (1).
Mr. George Whitman, engineer for the Taylor subdivision, states
that Vestry Road was not extended in the preliminary subdivision
plat presented to the Commiasion due to the open ditch and deep
ravine. He goes on to say it was explained in detail over a period
some 45 minutes after which it was given tentative approval.
On motion of Mr. Howard, seconded by Mr. Browning, it is resolved
that the Commission recommends approval to Residential-2 of the
aforedescribed parcel of land as requested by Mr. Harold Taylor.
All vote aye.
69-l3C Mr. David F. Freeman again comes before the Commission, the
matter having been continued from the February meeting, requesting
the rezoning from Agricultural (A) to Commercial (C-2) of a parcel
of land in Manchester Magisterial District of irregular shape fronting
243 ft. on Hull Street Road (Rte. 360) extending northwestwardly to
a depth of 370 ft. being 690 ft. ! northeast of the intersection of
Hull Street Road (Rte. 360) and Pocoshock Boulevard. Refer to Sec.
40-5 (1) lots 1 & 2-1. He goes on to ask that the C-2 zoning to the
east be extended westwardly to include the next two brick houses.

69-15C Mr. J. F. Hubbard comes again for Mr. Clarence W. Johnson,
the matter having been continued from the meeting of 18 February,
requesting the rezoning frorn Agircultural (A) to Commercial (C~2) in
Manchester Magisterial District of a parcel of land of irregular
shape fronting 330 ft. i on Walmsley Boulevard (Rte. 647) extending
northwardly to a depth of 455 ft. i being 535 ft. west of the inter-
section of Walmsley Boulevard (Rte. 647) and Route lO. \ Refer to Sec.
41-2 (l) par. 22.
The Secretary reads a letter from the chairman of the Board of Deacons
of Branch's Baptist Church, Mr. N. Leslie Saunders, in which certain
conditions are spelled out which if met would eliminate their
opposition.
On motion of Mr. Burnett, seconded by Mr. Vaughan, it is resolved
that the Commission recommends approval of the requested Commercial
(C-2) zoning with the provision that a four (4) foot high fence and
plantings be placed to the east of the buildings, that no service
stations be permitted in the area, that an easement adjacent to
Walmsley Boulevard be dedicated to the county in accordance with the
Engineering Department standards and that the site layout and plans
be approved by the Planning Director.

69-16C Mr. J. D. Jordan, Jr. again comes before the Commission, this
matter having been continued from the meeting of l8 February, requesting
the rezoning from Residential (ft-2) to Commercial (C-2) in Bermuda
Magisterial District of a parcel of land of irregular shape, fronting
260 ft. i on Rte. 1515 extending westwardly to a depth of 300 ft. i
being 490 ft. i north of the intersection of Route 10 and Chester Road
(Rte. l44). Refer to Sec. ll5-3 & 7 (1) remainder of par. 17. He
states that he wishes to dispose of his property and with the exception
of this parcel the rest of his land is presently zoned C-2. He also
states that there is a possibility the land will be used for multi-
family purposes.
Mrs. Strickland, a real estate agent, states that she wants it all
commercial in order to market the entire tract.
On motion of Mr. Dubus, seconded by Mr. Howard, it is resolved that
the Commission recommends that the request for Commercial (C-2) zoning
be denied.

69-20C Mr. Frederick Gray, attorney for Pillow Mobile Homes, Inc.
comes requesting the rezoning from Agricultural to Commercial (C-2)
in Bermuda Magisterial District of a parcel of land of ir~egular
shape containing 7.39 acres fronting 145.0 ft. on U. S. Rte. 1 and
extending eastwardly l808.98 ft., the first 300 ft. presently zoned
Commercial (C-2) being 472.30 ft. northwest of the intersection of
Rte. land Rte. lO, better known as 12401 Jefferson Davis Highway.
Refer to Sec. l16-6 & 7 (1) the remainder of par. 28. .
He states that the purpose of the zoning is to allow an existing
mobile home sales company to extend its sales display area.
On motion of Mr. Dubus, seconded by Mr. Howard, it is resolved that
the Commission recommends approval to Commercial (C-2) of the afore-
described parcel of land as requested by Mr. Gray for Pillow Mobile
Homes, Inc.
All vote aye.
69-21C Mr. Charles Armistead, representing Mrs. Elma P. Chandler,
comes requesting the rezoning from Agriculutral to Commercial (C-2)
of a parcel of land in Bermuda Magisterial District of irregular
shape fronting 1200 ft. t on Rte. 619 extending northwardly to a
depth of 1650 ft. t being 1550 ft. t northeast of the intersection
of Rte. 619 and Rte. 301. Refer to Sec. 149-3, 4, 7 & 8 (1) par. 1.
He states that the proposed use is for a travel trailer camp site
(Arrowhead International, Inc.). He goes on to explain and show
the layout of a typical camp, pointing out that the camping area
will be fenced and there will be a "live-on" manager. The cost
will be about $3.50 per night. It is noted that recreational and
sanitation facilities will be provided.
The Planning Director states that Mr. Browning, Mr. Purdy, Mr. Caldwell
and he have met with ~1r. Armistead, Mr. Charles K. Koller (Arrowhead
International, Inc.) and others to look over the site and go over
the various details of setting up this project.
On motion of Mr. Dubus, seconded by Mr. Browning, it is resolved
that the Commission recommends Commercial (C-2) approval of the
aforementioned parcel as requested by Mrs. Chandler subject to the
site layout and plans being approved by the Planning Director and
further be it recommended that the necessary easement along Rte. 619
for the entire frontage be dedicated to the county.

69-22C Mr. Warren Chapman, agent for Mr. Paul E. Clendenin, comes
requesting the rezoning from Residential -2 (R-2) to Commercial (C-2)
in Manchester Magisterial District of a parcel of land of irregular
shape fronting 127 ft. on Hull Street Road (Rte. 360) extending
northwardly 967.78 ft., the first 300 ft. being presently zoned
Commercial (C-2), being 969.64 ft. west of the intersection of
Rte. 360 and Warwick Road. Refer to Sec. 30-l, 2 & 6 (1) the remainder
of par. l4.

He states that Mr. Clendenin will use the rear portion of the land
for a cabinet shop and the front for a carpet company. He points out
that the easement referred to by one of the Commissioners is written
into the deed and is very definitely tied down.
On motion of Mr. Browning, seconded by Mr. Howard, it is resolved
that the Commission recommends approval to Commercial (C-2) of
the aforementioned parcel of land as requested by Mr. Clendenin.

69-23C Mr. Zane Davis of the Chester Hidden Valley Corporation comes
requesting the rezoning from Agricultural and Residential-l to Resi-
dential-2 (R-2) of a parcel of land of irregular shape, in Bermuda
Magisterial District, containing 125.26 acres extending 2115 ft. t
northeast of Blk. Blot 9 of "Hidden Valley" Subdivision having a
depth east to west of 2750 ft. t being 1600 ft. t northeast of the
intersection of Rte. 619 (Happy Hill Rd.) Rte. 616 (South Chester
Road) and Rte. 786 (Baldwin Road). Refer to Sec. 32-4 & 8 (1) par. 1.
On motion of Mr. Howard, seconded by Mr. Vaughan, it is resolved that
the Commission recommends approval to Residential-2 of the aforedescribed
parcel of land as requested by the Chester Hidden Valley Corp.

69-24C Mr. Preston E. Clark comes requesting the rezoning from
Agricultural to Commercial (C-2) of a parcel of land of irregular
Shape in Midlothian Magisterial District fronting 200 ft. on Rte. 60
(Midlothian Turnpike) extending southwestwardly to a depth of 395 ft.,
being 1250 ft. t southeast of the intersection of Rte. 60 (Midlothian
Turnpike) and Robious Road. Ref~r to Sec. 17-12 & 16 (1) par. 3.
He states that he intends to/~Rn8tf~8~ and warehouse and printing
business on the property if zoned. He also cites that he has an
option to purchase subject to the zoning.
A letter from E. S. Hague notes that the property was sold to a
Mr. & Mrs. Porter with the understanding that only a home would be
built on it.
Another letter bearing the signature of Garland E. Farnsworth, president
of the Shenandoah Community Association indicates their opposition
to this zoning request.
Petitions bearing approximately 150 signatures are presented requesting
the zoning of Preston Clark be denied.
On motion of Mr. Dubus, seconded by Mr. Howard, it is resolved that
the Commission recommends that Commercial (C-2) zoning of the aforede-
scribed parcel of land be denied Mr. Preston Clark.

69-25C Mr. Frederick Gray, attorney, comes representing Mr. H. A.
Knabe requesting the rezoning from Agricultural to Industrial (M)
in Midlothian Magisterial District of a parcel of land of irregular
shape fron ting 1400 ft. :!: on the right of way of the Southern Railway,
extending northwardly 2260 ft. :!: being 230 ft. :!: northeast of the
intersection of Southern Railway and Rte. 60 (Midlothian Turnpike).
Refer to Sec. 15 (1) part of parcel 4.
The Secretary reads letters of opposition from Mrs. George Geissinger,
Sr. and Jr. and another from Rosie and Arthur Titcomb.
Mr. G~ay continues by showing an aerial photograph of the property in
question and the surrounding area. He points out that there are
approximately 60 acres in the tract with a buffer zone of 13~ acres
along Michaux Creek. A pre-cast concrete manufacturing plant plans
to use approximately 9 acres and there will be no dust, smoke or noise.
Gas will be piped to the site and a ~tmple spur will be brought from
the Southern Railroad over which two or three cars per week will use.
There will be five or six trucks per day bringing in sand and steel
and carrying out products. Twelve to fifteen persons will be employed.
A well and septic system will be provided for an equipment building
costing a total of l~ million. Commonwealth Natural Gas will bring
in gas at about $50,000.
Mr. Burnett states that he has been working with these people for
several weeks and that it is difficult to locate industrial site$.
While there are nice subdivisions in the area good screening separates
them from this tract and it is his opinion that it will not hurt them.
He points out that this is not a smoke stack industry.
Mr. J. J. Jewett speaking in behalf of the Salisbury Corporation states
that the applicants are good friends; however, he points out that the
Commission has just recommended, adjoining this tract, the very highest
type development of $50,000 to $100,000 home sites on 3 to 5 acre
parcels. He calls attention to the R-A Salisbury district and points
out that this and Salisbury West were created after years of study.
He speaks of the fact that future residential development will be
inferior to any present day subdivisions of industry comes into this
community. He asks that the greatest study possible be made and that
while he does not wish to tell Mr. Knabe what to do with his land he
questions if this is truly the highest and best use.
Mr. Henshaw cites that last month Mr. SharD of J. K. Timmons & Assoc.
did not wish to extend streets to cross the creek as the land was
too steep.
Mr. Jewett raises the question as to how the railroad could be crossed
at this point when others have been denied this privilege.
Upon a question from Mr. Burnett, Mr. Jewett states that industrial
zoning would not be good for Midlothian; there would be a few people
e~ployed and the rest would be a truck industry throwing rocks; they
w1ll have to haul aggregate in and out.
Mr. Bob Porter states that he has been working on this four or five
years and that he is not telling Mr. Jewett everything, just what
we want him to know.

case #69-25C be continued to the Tuesday, 15 April 1969 maeting and to
view the site with others.

Mr. Bob Porter states that they have studied the Justus property;
the gas company will serve the entire tract: the block comp~ny will
occupy 8 acres and Mr. Casey of Southern Railroad is present. Further,
that he cannot divulge lldmes of people who are going to use the tract.
He asks the Commission to go along and that he will not put anything
in that will be detrimental to others.
Mr. Henshaw asks if the easement objected to in the letters read
could not be shifted eastwardly to the Knabe property.
Mr. Porter states they tried to center the Knabe tract and Mr. Knabe
makes it known that he would not consider this.
The matter is concluded with an agreement that 3:00 PM Tuesday,
1 April 1969 at the Courthouse be set aside for a meeting to review
this case.
On motion of Mr. Dubus, seconded by Mr. Browning, it is resolved that
renewal of tentative approval of LORA LYNN HEIGHTS be and it hereby is
granted subject to the following conditions:
(1) All provisions of the subdivision regulations are complied with
and subject to all proposed street names being shown on the
tentative plat. Subject to all names for recordation being ap-
proved by Richmond Regional Planning Commission. (When the
"tentative final" is submitted, a letter from R.R.P.C. indicating
their approval of specific names will accompany plat.)
(2) All previous conditions are complied with.
(3) Public (county) water is used.

proved by Richmond Regional Planning Commission. (When the

resolved that tentative approval of LAKEWOOD FARMS be and it hereby
is granted subject to the following conditions:
(l) All provisions of the subdivision regulations are complied with

tentative plat. Subject to all names for recordation being
approved by Richmond Regional Planning Commission. (When the

Mr. Daniel cites that water service is being worked towards this
subdivision and there are projected lines in the area.
Whereupon on motion of Mr. Dubus, seconded by Mr. Howard. it is
resolved that tentative approval of ROLLING HILLS be and it hereby
is granted subject to the following conditions:
(1) All provisions of the subdivision regulations are complied
with and subject to all proposed street names being shown on

On motion of Mr. Dubus, seconded by Mr. Browning, it is resolved that
tentative approval of PEDERSEN SUBDIVISION be and it hereby is granted
subject to the following conditions:
(l) All provisions of the subdivision regulations are complied with
and subject to all proposed street names being shown on the
tentative plat. Subject to all names for recordation being ap-
proved by Richmond Regional Planning Commission. (When the
"tentative final" is submitted, a letter from R.R.P.C. indica-
ting their approval of specific names will accompany plat.)
(2) An overall plan is submitted showing the developers complete
holdings (in relation to this plat) and his future intentions
for development.
(3) All street names are used on the plat.
(4) A rndius curve be shown at intersection of unnamed road and
Point of Rock Road.
(S) Subdivision engineer has obtained all necessary state certification
for work on this subdivision layout.
NOTE: Mrs. Spencer calls attention to the soils, especially that
found in lots 4 and S.
r~. Karpus, developer of LaRA LYNN HEIGHTS, comes requesting
permission to construct two (2) houses to front on Silver Crest Road.
Upon consideration whereof and on motion of Mr. Dubus, seconded by
Mr. Howard, it 1s resolved that the Commission recommends to the
Board of Supervisors that the recorded building line of lots 6 and 7
in Block C in the subdivision of LaRA LYNN HEIGHTS be reversed.
All vote aye.
Mr. Dubus suggests that the Planning Director and staff prepare a
list of requirements to be met by the surveyors presenting plat~.
Same to be mailed out with the notation that after 60 days from
receipt plats will be returned which do not comply.
Mr. Howard adds that they be put on notice.
Mr. Burnett points out that the Code does not call for all these
things such as recorded building lines.

Mr. Balderson points out that when subdivision plats aRe sent in for
renewal at six (6) month intervals, the engineers with few exceptions
make the necessary changes to comply with the conditions imposed by
the Commission.
Mr. Mason advises the Commission that it has the right to adopt certain
rules and regulations.
Mr. Henshaw states that it may be best to start working on suggestions
for a new subdivision ordinance.
A discussion ensues concerning trash and other debris along Robious Road
and Old Bon Air Road off Route 60. It is pointed out that much of it
is caused by open trucks. Mr. Burnett cites that there is a County
Ordinance which requires trucks to be covered. He suggests that
whenever an uncovered truck is seen on the roads you should get the
license number and call the courthouse.
Upon being asked if the county police could check on this Mr. Burnett
states that he will get the county police to check it out and will ask
the Highway Department to see what they can do about the present
situation.
On motion of Mr. Henshaw, seconded by Mr. Browning, it is resolved
that the Planning Commission of Chesterfield County requests the
Virginia Department of Highways to clean up Robious Road and Old Bon
Air Road beginning at a point near Route 60 by removing trash, debris

Dear Sir:
The following concerns Mr. Hatold Taylor's request for rezoning
of a parcel of land containing 10 acres located ~50 feet west of
Hopkins Road, depth of 1470 feet, 240 feet northwest of the inter-
section of Hopkins Road and Centralia Road. Sec. 97-1 (1).
I am presently owner of Kendale Acres subdivision which Mr. Taylor
plans to extend. After looking au Mr. Taylor's purposed lot lay-
out I am against :It because he is planning to join with Jaymont
Drive, but back his lots against my subdivision. It seems to me
he could get the same lots by facing them toward Jaymont Drive.
I am also interested in seeing an extension road cut thru to Mr.
Turner's estate which~ is beyond the purposed subdivision. It
seems to me this'purposed subdivision would be layed out better
were the lots layed to coincide with Kendale Acres.
I am not against Mr. Taylor's extension, but would like to see it
coincide with Kendale Acres. I am interested in Mr. Turner's
property and would not like to see 10 acres in the middle planned
for the sole purpose of getting more lots, but would rather see
it planned to co-ordinate with Kendale Acres and adjoining property.

this is to advise that the Board of Deacons of Branch's Baptist Church
does not oppose the proposed rezoning of the captioned parcel, subject
to the following restrictions:
(1) That a brick screening wall, at least ten (10) feet in
height, be constructed along the rear of the proposed building.
(2) That a restriction be placed in the deed from Johnson to
the developers of this extension of Branch's Shopping Center that no
service station will be operated on this property.
If the applicant is agreeable to these two restrictions, we

Dear Sir:
Reference is made to application to rezone a parcel of land desig-
nated as Parcel 22 on Chesterfield County Tax Map 41-2, as covered
by the above case number.
We wish to register our very vigorous opposition to this request.
The parcel in question fronts on Walmsley Boulevard, directly across
the Boulevard from our church property and for the full frontage of
subject property on Walmsley Boulevard. To our knowledge there is
no other property nearer than State Route #10 now zoned business and
to favorably consider this request would tend to encourage similar
requests on adjacent residential property on Walmsley Boulevard, thus
changing the character of the area.

We feel that Walmsley Boulevard is residential in character and to
change the character of the neighborhood by this zoning would be very
undesirable and detrimental to the church. Our church is the largest
in Chesterfield County, with an enrollment of 1,787. Our work with
young people of the. community has been extensive for a long time and
we feel that it is imperative that we be granted the necessary pro~
tection to enable us to properly continue our work.
In 1967 our grounds, which total approximately 12 acres, and the church
plant were valued by our Middle District Association as having a value
of $675,000.00.
We earnestly request for the reasons given above that the request for
the rezoning of the property covered by the above case number be
denied.

this is to advise that the Board of Deacons of Branch's Baptist Church
does not oppose the proposed rezoning of the captioned parcel, subject
to the following restrictions: .
"
(1) That a brick screening wall, at least ten (10) feet in
height, be constructed along the rear of the proposed building.
(2) That a restriction be placed in the deed from Johnson to
the developers of this extension of Branch's Shopping Center that no
service station will be operated on this property.
If the applicant is agreeable to these two restrictions, we
have no objection to the rezoning, however, if the applicant is not
agreeable to these two restrictions, then we object to the rezoning.

situation which involved my dog. I

This situation was an attack upon my beagle by a Boxer
and Germanshepherd in the Fernleigh area of Bon Air. These
individuals, I would commend for their consideration in
handling the injured dog so gently and promptness in getting
him to a veterinarian. The damaged done to my dog was to
the extent the injured dog was ultimately put to sleep as a
result of the attack.

a Virginia corporation, hereinafter called "Company,"
WITNESSETH:
That for the sum of One Dollar ($1.00) and other valuable considerations, the receipt wherof is hereby
acknowledged, Owner grants unto Company, its successors and assigns, the perpetual right, privilege and
easement of right of way ten (10) feet in width to lay, construct, operate and maintain one or more lines of under-
ground conduits and cables and one or more lighting supports and lighting fixtures, as Company may from time to
time deem expedient or advisable, located on the right of way hereinafter described, for the purpose of trans-
mitting and distributing electric power by one or more circuits; for telephone, television and other communication
purposes; and for lighting purposes; together with all wires, conduits, cables, transformers, transformer enclosures,
concrete pads, manholes, hand holes , connection boxes,. ground connections, meters, attachments, equipment,
accessories and appurtenances desirable in connection therewith (hereinafter referred to as "facilities"), over,
under, through and across certain lands of Owner situated in Chesterfigld County Virg~""'i'
as sh~wn on Plat No.,~6g.;..S67 hereto attached and made part of this agreement; the location of the center
line of such right of way being shown in broken lines on such plat.
The facilities constructed hereunder shall remain the property of Company. Company shall have the right
to inspect, rebuild, remove, repair, improve, relocate on the right of way described above, and make such changes,
alterations, substitutions, additions to or extensions of its facilities as Company may from time to time deem
advisable.
Company shall at all times have the right to keep the right of way clear of all buildings, structures and
other obstructions (except fences), trees, roots and l\ndergrowth, All trees and limbs cut by Company at any time
shall remain the property of Owner,
For the purpose of constructing, inspecting, maintaining or operating its facilities, Company shall have
the right of ingress to and egress from the right of way over the lands of Owner. Company shall exercise such
right in such manner cis shall occasion the least practicable damage and inconvenience to Owner. Company shall
repair damage to roads, fences or other improvements and shall pay for all other damage when such damage results
from the construction, inspection or maintenance of Company's facilities, provided Owner gives written notice
thereof to Company within thirty (30) days after such damage occurs.
Owner, its successors and assigns, may use the right of way for any purpose not inconsistent with the
rights hereby granted, provided such use does not interfere with or endanger the construction, operation and main-
tenance of Company's facilities and provided that no buildings, structures or other obstructions (except fences)
may be constructed on the right of way. .
Owner covenants that it is seised of and has the right to convey the said easement of right of way, rights
and privileges; that Company shall have quiet and peaceable possession, use and enjoyment of the aforesaid
easement of right of way, rights and privileges; and that Owner shall execute such further assurances thereof as
may be required.
