REQUEST: Amendment to Conditional Use (Case 78S160) to permit a sleep disorder center
(hospital) in an Agricultural (A) Disti'ict.
PROPOSED LAND USE:
A sleep disorder testing and treatment facility (hospital), to include outpatient care
and overnight testing facilities for maximum of five (5) patients, is planned.

Public Water System:
There is an existing eight (8) inch water line along the east side of Professional Road,
adjacent to the request site. The existing structure is connected to the public water system.
Use of the public water system is required by County Code.

There is an existing eight (8) inch wastewater collector extending along Professional Road,
adjacent to the request site. The existing structure is connected to the public wastewater
system. Use of the public wastewater system is required by County Code.
Drainage and Erosion:
ENVIRONMENTAL
No existing or anticipated on or off-site drainage or erosion problems.
PUBLIC FACILITIES
Fire Service:
This property is currently served by the Buford Fire/Rescue Station, Company Number
9, and Forest View Rescue Squad.
Transportation:
The proposed use will have a minimal impact on the existing transportation network.
LAND USE
Comprehensive Plan:
The request property lies within the boundaries of the Bon Air Community. Plan.which
suggests the request property is appropriate for office use.
Area Development Trends:
Properties within the S.D.T. Office Park have been developed for a mix of office uses.
On December 13, 1978, the Board of Supervisors, upon a favorable recommendation by
the Planning Commission, approved rezoning from Residential ~-7) to Agricultural (A)
with Conditional Use to permit professional/business office use on the request property and
surrounding area (Case 78S160). With the approval of Case 78S160, conditions were
imposed to address architectural treatment, building square footage, landscaping, signage,
buffers, lighting, location of dumpsters, etc.

These conditions were designed to ensure that development within the office park is
compatible with surrounding residential development in Bon Air. With approval of this
request, these conditions would remain intact.
On September 23, 1987, the Board of Supervisors approved amendment to Condition 16
of Case 78S160 to allow a dumpster on the request property to be located more than ten
(10) feet from the building. (Case 87S101)
Site Design:
The request property has been developed for an office building and associated parking
facilities with access to Professional Road. It is the intent to operate the proposed sleep
disorder center within the existing building.
CONCLUSIONS
The proposed sleep disorder center would be considered a hospital type use, rather than
professional office use, by the Zoning Ordinance. Therefore, in order to operate the sleep
disorder clinic, amendment to the Conditional Use must be obtained. With the acceptance of the
proffered condition restricting the number of patients that are housed overnight, the proposed use
should have a similar impact as office use. The Bon Air Community Plan suggests the request
property is appropriate for office use. Conditions of zoning for Case 78S160 ensure compatibility
with existing area residential zoning and land uses.
Given these considerations, approval of this request is recommended.
CASE HISTORY
Planning Commission Meeting (5/19/98):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Shewmake, seconded by Mr. Gulley, the Commission recommended
approval of this request and acceptance of the proffered condition on page 2.
AYES: Unanimous.
The Board of Supervisors, on Wednesday, May 27, 1998, beginning at 7:00 p.m., will take under
consideration this request.

In Midlothian Magisterial District, CHARLES W. AND VIRGINIA
P. KEBLUSEK requested amendment to Conditional Use Planned
Development (Case 78S160) and amendment of zoning district
map to permit a sleep disorder center in an Agricultural (A)
District. The density of such amendment will be controlled
by zoning conditions or Ordinance standards. The
Comprehensive Plan suggests the property is appropriate for
office use. This request lies on 0.8 acre known as 2529
Professional Road. GPIN 758-718-7997 (Sheet 3).
Mr. Jacobson presented a summary of Case 98SN0218 and stated
that the Planning Commission and staff recommend approval and
acceptance of the proffered conditions. He noted the Bon Air
Community Plan suggests the request property is appropriate
for office use.
Mr. Charles W. Keblusek stated that the recommendation is
acceptable.
There was no opposition present.
Mr. Barber commended Mrs. Humphrey on her affiliation with
MCV and the fine work that she does in all types of medical
areas, this being one of them, and wished her continued
success.
Mrs. Humphrey stated that specialized health services are
becoming community-based.
On motion of Mr. Barber, seconded by Mrs. Humphrey, the Board
approved Case 98SN0218 and accepted the following proffered
condition:
A maximum of five (5) patients shall be accommodated
between the hours of 7:00 p.m. and 7:00 a.m.
