Nelson, Chesterfield Health Director, as the "Top Doc" in the public health category in Richmond Magazine. Summary of Information: In the first ever public health category of Richmond Magazine's "Best" - Chesterfield Health Director, Bill Nelson has been named "top doc." Richmond Magazine staff mailed 4,200 surveys to licensed physicians in the Richmond Metropolitan area asking them questions related to which of their colleagues should be crowned with the honor. Physicians were asked several questions including who they would refer their loved one to if he/she needed help. After all the responses were counted, Dr. Nelson received the most votes as the "Top Doc" in public health. Dr. Nelson will be featured in the Richmond Magazine's April issue. Preparers Rebecca T. Su biect: Ordinance Amendments Relating to Department of Utilities Fee Changes County Administrator's Comments: County Administrator: Board Action Requested: Adopt attached amendments to Section 18-22 and 18-27 of the County Code relating to Department of Utilities fee changes Summary of Information: The Board of Supervisors held a public hearing on April 2, 2008 concerning the proposed changes to Utilities fees. The Utilities Department's analysis of the FY2009 budget, capital replacement projects, and projections over the next ten years indicate that current revenues, without increases, will not be sufficient to cover operating expenses. A wastewater commodity charge is proposed to increase by $0.08 per one hundred cubic feet (CCF). The bi-monthly base charges for a typical 5/8" residential size meter is proposed to increase by $2.44. These increases are needed to cover the cost of rendering water and wastewater utility services. The base charges for larger meters increases proportionately based on meter size. In addition, the department's analysis of costs for expansion projects and projections over the next ten years reflect a connection fee adjustment to cover capital costs. The connection fees for a 5/8" residential size meter are proposed to increase in wastewater as follows: from $2,370 to $2,725. The connection fees for larger meters will increase proportionately based on meter size. Preparers Allan M. Subject: Adoption of an Ordinance Relating to the Department of Building Inspection Fees County Administrator's Comments: County Administrator: Board Action Requested: ~" Adopt attached amendments to Section 5-5 of the County Code Relating to Department of Building Inspection Fees Summary of Information: The Board of Supervisors held a public hearing on April 2, 2008 concerning the proposed ordinance amendments relating to Building Inspection fees. The proposed changes are related to the inspection process and are being considered in order to recover approximately 1000 of the direct costs associated with building inspection functions. Costs associated with delivery of all services are affected by annual salary and benefit changes as well as other operating cost increases. These costs are exclusive of the costs related to the residential cash proffer inspection program, Fire Department plans review, and indirect costs such as electricity and water/wastewater bills. Fees are proposed to increase across all categories by 13.5% to 18.75%. The building permit fee for a new house is proposed to increase from $576 to $684. Other residential fee categories such as plumbing or electrical permit fees are proposed to increase in the same proportion. Commercial permit fees are based upon the estimated cost of the project. The current fee is $6.40 per thousand dollars of estimated cost; the proposed fee is $7.40 per thousand. All other residential and commercial permit fees are proposed to increase in similar proportion. The proposed fee changes are anticipated to generate an additional $525,000 in FY2009 and $218,000 in FY2010. These fees were last adjusted in FY2005. The ordinance is attached. Preparers Allan M. This amount is allocated to the schools at intervals during the year contingent upon funds availability. These times are December 15th, February 15th and May 5th. This practice allows for flexibility to adjust the School appropriation should the need arise due to a downturn in revenues or some other unplanned event. The amount is being recommended to increase from $6 million to $9 million and has not been increased since FY2006 (when it was increased from $4.5M to $6M). As of this date, staff does not know the final outcome of state revenue reductions but estimates the value at $1.5 million. The County was recently notified by the Virginia Retirement System of the retirement funding contribution rates for the FY2009-FY2010 biennium. The rate is lower than that used in the FY2009 proposed budget. This rate change allowed expenditure reductions in departments that have been set aside to cover the loss of state revenues. Each year staff calculates the amount of tax relief for personal property taxes as a direct result of the State's decision to cap the personal property tax relief reimbursement revenue available to Chesterfield. The appropriations resolution stipulates the reimbursement percentage rate for the different levels of value as follows: Personal use vehicles valued at $1,000 or less will be eligible for 1000 tax relief, consistent with prior years. Personal use vehicles valued at $1,001 to $20,000 will be eligible for 60% of tax relief. Personal use vehicles valued at $20,001 or more shall receive 60% of tax relief on the first $20,000 of value. All other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use, motor homes, etc.) will not be eligible for any form of tax relief under this program. Should the actual contract price for a project be less than the appropriation. the County Administrator may approve the transfer of excess funds back to the original funding source upon completion of the project. Sec. R Upon completion of a grant program, the County Administrator is authorized to close the grant and transfer balances back to the funding source. The County Administrator is authorized to reprogram Community Development Block Grant funds by closing program cost centers and transferring funding to newly approved programs based on adoption by the Board of Super<~isors. Sec. 9 The County Administrator may reduce revenue and expenditure appropriations related to programs, functions, or departments funded all or in part by the Commonwealth of Virginia and/or the federal government to the level approved by the responsible state or federal agency. Sec. l0 The Director of Accounting is authorized to make transfers to various funds for which there are transfers budgeted. The Director shall transfer funds only as needed up to amounts budgeted, or in accordance with an_v existing bond resolutions that specify the manner in which transfers are to be made. Sec. l l The Treasurer may advance monies to and from the various funds of the county to allow maximum cash flow efficiency. The advances must not violate county bond covenants or other legal restrictions that would prohibit such an advance. The Treasurer may also advance cash in support of employee benefit accounts. Sec. l2 The County Administrator is authorized to make expenditures fi-om Trust & Agency Fundy fir the specified reasons for which the fiords were established. In no case shall the expenditure exceed the available balance in the fund. Sec. l3 The County Administrator is authorized to transfer among appropriation categories and/or appropriate funds in excess of $50,000 for supplemental retirement. Worker's Compensation, healthcare for retirees, and other compensation-related costs. Sec. 14 The County Administrator may appropriate revenues and increase expenditures in excess of $50,000 for funds received by the county from asset forfeitures for expenditures related to drug enforcement or other allowable expenditures. The balance of these funds shall not lapse but be carried forward into the next fiscal year. Sec. l ~ The County Administrator may increase the genera] fund appropriation in the School Operating Fund contingent upon availability of funds and other circumstances, based on the following schedule: a) ]ncrease general fund transferiappropriation on December 15 by $3.000,000. b) ]ncrease general fund transfer/appropriation on February 7 5 by $3,000,000. c) ]ncrease general fund transferiappropriation on May 5 by $3,000,000. Sec. l6 The County Administrator is authorized to reallocate funding sources for capital projects, arbitrage rebates/penalties. and debt service payments and to appropriate bond interest earnings to minimize arbitrage rebates/penalties. This authority includes the appropriation of transfers among funds to accomplish such reallocations. Budgets for specific capital projects will not be increased beyond the level authorized by Sections 3 and 4. Se.c. l7 Salaries for Planning Commissioners will be increased equivalent to the merit increase county employees are eligible for. The effective date for pay increases. including the Planning Commission and ~Q~~~~ FY2009 APPROPRIATIONS RESOLUTION the Board of Supervisors, may cross fiscal years. Increases will be effective on the first day of the pay period that includes July 1. Sec. 18 The County Administrator is authorized to approve transfers among funds and capital projects as long as total net appropriation is not increased. Sec. 19 The Utilities Department rate stabilization reserve shall be maintained as per guidelines outlined below: a) The minimum annual contribution to the reserve will be 50% of the previous year's depreciation on fixed assets. b) The annual contribution to the reserve will continue until 100% of accumulated depreciation on the fixed assets is funded. If at the beginning of a fiscal year a reserve balance exceeds 100% of accumulated depreciation, a reduction in the annual contribution may be considered. c) Funds cannot be used from the rate stabilization reserve if the balance falls below 25% of that utility's fixed asset accumulated depreciation, other than for Utility internal borrowing purposes. d) The declaration of a financial emergency by the Director of Utilities and a corresponding four-fifths vote by the Board of Supervisors at a publicly advertised meeting declaring the existence of such an emergency is required to suspend Sec. 19a, Sec. 19b, and Sec. 19c. Sec. 20 Upon adoption of this resolution, the School Board and/or the School Superintendent may make expenditure and revenue changes within the school fund as follows: a) Transfers of $50,000 or less are subject to the approval of the Superintendent. b) Transfers of $50,001 to $499,999 require the approval of the Superintendent and the School Board. c) Transfers of $500,000 or more require the approval of the Superintendent, the School Board, and the Board of Supervisors. The School Board and/or the School Superintendent shall prepare a budget status report reflecting changes to the approved school budget between appropriation categories, as amended, and the report shall be presented to the County Administrator quarterly. Sec. 21 In accordance with the requirements set forth in Section 58.1-3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly, any qualifying vehicle situated within the County commencing January 1, 2008, shall receive personal property tax relief in the following manner: a) Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; b) Personal use vehicles valued at $1,001 to $20,000 will be eligible for 60% tax relief; c) Personal use vehicles valued at $20,001 or more shall receive 60% tax relief on the first $20,000 of value; d) All other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. Pursuant to authority conferred in Item 503.D of the 2005 State Appropriations Act, the County Treasurer shall issue a supplemental personal property tax bill in the amount of 100 percent of tax due without regard to any former entitlement to state PPTRA relief, plus applicable penalties and interest, to any taxpayer whose taxes with respect to a qualifying vehicle for tax year 2009 or any prior tax year remain unpaid on September 1, 2008, or such date as state funds for reimbursement of the state share of such bill have become unavailable, whichever occurs first. e) Penalty and interest with respect to bills issued pursuant to this section shall be computed on the entire amount of tax owed. Interest shall be computed at the rate provided in Section 9-51 of the county code from the original due date of the tax. The Board of Supervisors must approve all change orders of $50,000 or more or when the aggregate of all changes to a contract exceeds 10% of the original contract amount or 20% if the original contract is for less than $500,000. 000~~~ TENTATIVE APPROPRIATIONS RESOLUTION FY2010 Second Year Spending Plan Sec. 7 The County Administrator is authorized to approve transfers among Utilities funds and capital projects as long as funding sources are consistent and toatl net appropriation is not increased. Should the actual contract price for a project be less than the appropriation, the County Administrator may approve the transfer of excess funds back to the original funding source upon completion of the project. Sec. 8 Upon completion of a grant project, the County Administrator is authorized to close the grant and transfer balances back to the funding source. The County Administrator is authorized to reprogram Community Development Block Grant funds by closing program cost centers and transferring funding to newly approved programs based on adoption by the Board of Supervisors. Sec. 9 The County Administrator may reduce revenue and expenditure appropriations related to programs, functions, or departments funded all or in part by the Commonwealth of Virginia and/or the federal government to the level approved by the responsible state or federal agency. Sec. 10 The Director of Accounting is authorized to make transfers to various funds for which there are transfers budgeted. The Director shall transfer funds only as needed up to amounts budgeted, or in accordance with any existing bond resolutions that specify the manner in which transfers are to be made. Sec. 11 The Treasurer may advance monies to and from the various funds of the county to allow maximum cash flow efficiency. The advances must not violate county bond covenants or other legal restrictions that would prohibit such an advance. The Treasurer may also advance cash in support of employee benefit accounts. Sec. 12 The County Administrator is authorized to make expenditures from Trust & Agency Funds for the specified reasons for which the funds were established. In no case shall the expenditure exceed the available balance in the fund. Sec. 13 The County Administrator is authorized to transfer among appropriation categories and/or appropriate funds in excess of $50,000 for supplemental retirement, Worker's Compensation, healthcare for retirees, and other compensation-related costs. Sec. 14 The County Administrator may appropriate revenues and increase expenditures in excess of $50,000 for funds received by the county from asset forfeitures for expenditures related to drug enforcement or other allowable expenditures. The balance of these funds shall not lapse but be carried forward into the next fiscal year. Sec. 15 The County Administrator may increase the general fund appropriation in the School Operating Fund contingent upon availability of funds and other circumstances, based on the following schedule: a) Increase general fund transfer/appropriation on December 15 by $3,000,000. b) Increase general fund transfer/appropriation on February 15 by $3,000,000. c) Increase general fund transfer/appropriation on May 5 by $3,000,000. Sec. 16 The County Administrator is authorized to reallocate funding sources for capital projects, arbitrage rebates/penalties, and debt service payments and to appropriate bond interest earnings to minimize arbitrage rebates/penalties. This authority includes the appropriation of transfers among funds to accomplish such reallocations. Budgets for specific capital projects will not be increased beyond the level authorized by Sections 3 and 4. Sec. 17 Salaries for Planning Commissioners will be increased equivalent to the merit increase county employees are eligible for. Increases will be effective on the first day of the pay period that includes July 1. Sec. 18 The County Administrator is authorized to approve transfers among funds and capital projects as long as total net appropriation is not increased. Sec. 19 The Utilities Department rate stabilization reserve shall be maintained as per guidelines outlined below: a) The minimum annual contribution to the reserve will be 50% of the previous year's depreciation on fixed assets. b) The annual contribution to the reserve will continue until 100% of accumulated depreciation on the fixed assets is funded. If at the beginning of a fiscal year a reserve balance exceeds 100% of accumulated depreciation, a reduction in the annual contribution may be considered. c) Funds cannot be used from the rate stabilization reserve if the balance falls below 25% of that utility's fixed asset accumulated depreciation, other than for Utility internal borrowing purposes. d) The declaration of a financial emergency by the Director of Utilities and a corresponding four- fifths vote by the Board of Supervisors at a publicly advertised meeting declaring the existence of such an emergency is required to suspend Sec. 19a, Sec. 19b, and Sec. 19c. Sec. 20 Upon adoption of this resolution, the School Board and/or the School Superintendent may make expenditure and revenue changes within the school fund as follows: a) Transfers of $50,000 or less are subject to the approval of the Superintendent. b) Transfers of $50,001 to $499,999 require the approval of the Superintendent and the School Board. c) Transfers of $500,000 or more require the approval of the Superintendent, the School Board, and the Board of Supervisors. The School Board and/or the School Superintendent shall prepare a budget status report reflecting changes to the approved school budget between appropriation categories, as amended, and the report shall be presented to the County Administrator quarterly. Sec. 21 In accordance with the requirements set forth in Section 58.1-3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly, any qualifying vehicle situated within the County commencing January 1, 20 ] 0, shall receive personal property tax relief in the following manner: a) Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; b) Personal use vehicles valued at $1,001 to $20,000 will be eligible for 60% tax relief; c) Personal use vehicles valued at $20,001 or more shall receive 60% tax relief on the first $20,000 of value; all other vehicles which do not meet the definition of "qualifying" (business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. d) Pursuant to authority conferred in Item 503.D of the 2005 State Appropriations Act, the County Treasurer shall issue a supplemental personal property tax bill in the amount of 100 percent of tax due without regard to any former entitlement to state PPTRA relief, plus applicable penalties and interest, to any taxpayer whose taxes with respect to a qualifying vehicle for tax year 2010 or any prior tax year remain unpaid on September 1, 2009, or such 000~~~ TENTATIVE APPROPRIATIONS RESOLUTION FY2010 Second Year Spending Plan date as state funds for reimbursement of the state share of such bill have become unavailable, whichever occurs first. e) Penalty and interest with respect to bills issued pursuant to this section shall be computed on the entire amount of tax owed. Following for your information is a brief summary of the various initiatives that have been forthcoming since adoption of this Plan in October 2007: On December 18, 2007, the Planning Commission set January 15, 2008, for a public hearing to consider amendment to the Upper Swift Creek Plan amendment relative to levels of service for roads and schools. On January 9, 2008, the Board of Supervisors directed the Planning Commission to revisit the Upper Swift Creek Plan amendment and to bring forward in a timely fashion for review and consideration to amendments related to water quality, levels of service (roads, schools and public safety), land use, and economic development for the purpose of direction to the Planning Commission and the Board on proposals in the interim before the adoption of the new countywide Comprehensive Plan. On January 15, 2008, the Planning Commission recommended to the Board levels of service standards for roads and schools for the Upper Swift Creek Plan amendment geography. On January 30, 2008, the County Administrator sent a written request to the Planning Commission to act upon the Board's January 9th motion. In accordance with the requirements of the Code of Virginia (Sec. 15.2-2229) the Commission must prepare any plan amendments and submit them to public hearing within sixty (60) days of this request. Given these considerations, the Planning Commission had to schedule a public hearing by no later than March 30, 2008, in order to meet this deadline. On March 18, 2008, the Planning Commission, at a public hearing, recommended that the Board take no action on the Board initiated amendments to the Upper Swift Creek Plan amendment, so that the Board could consider, at a later date, recommendations for the Commission initiated amendment to the Upper Swift Creek Plan amendment. With respect to the agenda item, at the Board's April 9`h work session the Board has the following options: The Board can choose to not act on this agenda item. By not acting, the Board initiated Upper Swift Creek Plan amendments will end. However, the Planning Commission will forward its own recommendations regarding the amendments later this year. 2. The Board can set a public hearing to consider the Board initiated Upper Swift Creek Plan amendments. The Board would have until June 16, 2008 to amend the Plan. The Board can institute a new 60 day time period for the Planning Commission to make recommendations on Upper Swift Creek Plan amendments. 4. The Board can defer action on the agenda item. Subject: Appropriation of Additional Road Cash Proffers for McEnnally Road Reconstruction Project County Administrator's Comments: County Administrator: Board Action Requested: The Board is requested to appropriate an additional $620,000 in road cash proffers and cash proffer interest earnings ($564,945 from Traffic Shed 12, $55,055 from Traffic Shed 11) for the McEnnally Road Reconstruction Project. Summary of Information: In June 2006, the previous Board appropriated $770,000 in road cash proffers from Traffic Shed 12 for the McEnnally Road reconstruction project from Spring Run Road to Winterpock Road. McEnnally is a very narrow road. It is not capable of handling the traffic now using the road. The estimated cost to reconstruct McEnnally Road in 2006 was $955,000. The Board authorized staff to begin the project with the understanding that the project would have to be delayed, the scope reduced to match available funding or additional funds would have to be identified before the project could be constructed. Final construction plans have now been prepared. The current estimated cost for the project is $1,390,000. The increase is primarily associated with utility relocations, drainage revisions to reduce impacts on adjoining properties and general cost increases. An additional $620,000 is needed to proceed with the project. JOHN GRUBB FOR HIS CONTRIBUTIONS TO CHESTERFIELD COUNTY WHEREAS, Mr. John Maywood Grubb, Jr., known to baseball fans as Johnny Grubb, is a Chesterfield County resident; and WHEREAS, Mr. Grubb is a former Major League outfielder, designated hitter and occasional first baseman; and WHEREAS, he attended Chesterfield County public schools, graduating from Meadowbrook High School, where he played baseball, in 1967; and WHEREAS, after attending Manatee Junior College and Florida State University on baseball scholarships, Mr. Grubb was drafted by the San Diego Padres, having been previously drafted by the Boston Red Sox, Cincinnati Reds and Atlanta Braves, all of which had recognized his promise as an athlete; and WHEREAS, his impressive baseball career includes being called to the Major Leagues in 1972, being named to the Topps All-Rookie Team in 1973 and to the National League All-Star Team in 1974; and WHEREAS, Mr. Grubb was traded to the Cleveland Indians, signed with the Texas Rangers and was traded to the Detroit Tigers; and WHEREAS, he also was named American League Player of the week during 1986 and was inducted to the Meadowbrook High School Sports Wall of Fame and the Florida State Sports Hall of Fame; and WHEREAS, after retiring from the Major Leagues in 1988, Mr. Grubb distinguished himself through volunteer work with the Big Brothers organization; Veterans Hospital volunteerism; fundraising activities for CARITAS; service to Bethany Christian Church; public service support for the YMCA; speaking engagements for church groups, Kiwanis and Rotary clubs and for Ruritan, the Jewish Community Center and others; and WHEREAS, Mr. Grubb has exemplified good sportsmanship and good citizenship throughout his adult life; and WHEREAS, Mr. Grubb currently serves as Varsity Baseball Coach at Meadowbrook High School, where he continues to share his experience and expertise with the youths of Chesterfield County. Their joint efforts produced the Virginia Statute for Religious Freedom, a groundbreaking law passed in 1786 by the Virginia General Assembly. The Statute was the precursor to the religion clauses found in the First Amendment to the United States Constitution. The mission of the Council for America's First Freedom is to increase understanding and respect for religious freedom in diverse communities worldwide through education about this core human value: the freedom of thought, conscience and belief. Our mission builds on this legacy that began in Richmond, Virginia, was included in our American Bill of Rights, and is now recognized as an international human right. EDUCATIONAL PROGRAMMING RECENT PROGRAMS Framing a National Debate on Religion and the U.S. Constitution -Two experts with opposing viewpoints, Jeremy Gunn, Director of the ACLU's Program on Freedom of Religion and Belief, and Seamus Hasson, President of The Beckett Fund for Religious Liberty, met in a series of debates at law schools across the country to address key religious freedom issues. The debaters modeled the core value of our democratic society, a freedom to disagree and discuss. The debates examined the issues in depth and with mutual respect, encouraging open dialogue and educating the public about the importance of religious freedom. The aim of the debates was to reduce tension over legal and culture war religion issues by gaining greater understanding of them, and to create an environment for thoughtful reflection, instead of the knee jerk reactions that have dominated America's discourse to date. ONGOING PROGRAMS The Constitution and Religion in the Classroom -The Council has produced a package of materials featuring an edited DVD of the Religion in the Public Schools debate and a 16-page manual that provides the background and legal history of the First Amendment, frequently asked questions about religion in the public schools, and suggested teaching methods and classroom activities for covering this topic. The material serves both as a reference guide for teachers, who are confronted by these issues, and as a lesson plan that informs and engages students. The materials can be used on National Constitution Day in September and later in the school year to support curriculum and stimulate an ongoing discussion about religious freedom as a civic and personal virtue; which, though arising in the classroom, will go well beyond the schoolhouse door. Based on initial requests, the Council expects to mail over 7,000 copies of this material during its first year. These materials are now available on the Council's website. First Freedom Student Competition -This annual national essay competition asks 9th - 12`h grade students to examine religious freedom, its history, current importance, and relevance in their lives, as they vie for the opportunity to win cash prizes of $3000, $1500 and $750. The competition requires students to effectively analyze and defend the American and democratic ideal of religious freedom, thereby inspiring a deeper appreciation for the value of citizenship, democracy, and this constitutionally protected freedom. The Council also creates incentives for teachers to include religious freedom topics in their classrooms by providing a recommended reading list, teaching materials and by presenting an annual award for teaching excellence. First Freedom Awards -Each year, on the anniversary of the adoption of the Vir~inia Statute for Religious Freedom, the sitting President of the United States proclaims January 16 , to be National Religious Freedom Day. Annually, the Council hosts a dinner in January to recognize outstanding individuals who have made remarkable contributions to religious freedom in Virginia, in the nation and internationally. The Council presents the First Freedom Awards to individuals who champion the cause of religious liberty here and abroad. This event provides funds to support educational programming, including the First Freedom Student Competition. UPCOMING PROGRAMS International Religious Freedom Act Proiect -The Council will commemorate the ten-year anniversary of the International Religious Freedom Act (IKEA) of 1998 by creating a website for schoolchildren featuring educational materials relating to the Act. The IRFA created the Office of International Religious Freedom and set the standards for America to promote religious freedom around the world. This project will be created in collaboration with a conference that will be held in the fall of 2008 to honor and discuss the IRFA. We will meet with notable individuals attending the conference and engage them in filmed discussions about the creation of the International Religious Freedom Act and how it is viewed today. The website will feature a video history project that will use these interviews to document the stories of those who were involved in the creation and ratification of the IRFA. Another vital element of this website will be an analysis of the IRFA itself. The HoGdav Corner Children's Website -The Council is developing a children's web site that will be an academic tool for teaching children about religious freedom and diversity, while also providing a resource base for teachers. Teachers will be able to use this web site to make their lesson plans about the different holidays throughout the year fun and interesting. This innovative site, entitled The Holiday Corner, will teach children about the many holidays their classmates may celebrate. Through an interactive holiday calendar, complete with lesson plans and activities, children will diminish tension over the culture wars surrounding holidays and at the same time gain knowledge and respect for their classmates and their different religious practices. The Holiday Corner will pique the curiosity of children by providing games, art projects and personal video footage on how children across the country celebrate their religious holidays. There will also be a blog spot where students can write about and share their different holiday traditions. Vital Knowledge. Enduring Resaect -The Council will be introducing a communications and advertising campaign that will challenge and empower educators, experts, scholars, opinion leaders, and the national media, to amplify the dialogue about religious freedom. The objectives of the campaign are to increase knowledge, understanding and respect for religious freedom and to create awareness of the Council and our mission. The ultimate goal of this project is to positively impact our culture over time by becoming a more knowledgeable and respectful nation with regard to our religious diversity and religious freedom. EDUCATION CENTER First Freedom Center -The Council has completed the first phase of the First Freedom Center, located at the corner of 14 and Main Streets in Richmond, Virginia. These renovated buildings currently house the Council's offices and meeting space and our new exhibit entitled, Faces of Religious Freedom, where the lives and deeds of individuals who have helped define the concept of religious freedom are explored. The exhibit space also features an interactive conference area where visitors can learn about the ideals and history behind religious freedom. Visitors to the exhibit will gain a deeper understanding of the Council's mission and the significance of religious freedom in America and around the world. The final phase of the First Freedom Center will be constructed at the prominent corner of 14~' and Cary Streets on the site where the Virginia General Assembly, in 1786, passed the Virginia Statute for Religious Freedom and, for the first time in history placed into law the protection of religious freedom. The Center will add to the cultural richness of downtown and provide an opportunity for the Council to partner with other fine Virginia historic sites and attractions. The future Center will carry on its mission by providing enhanced exhibits and programs that examine America's progress in striving for religious freedom. Subject: Proposed Amendment to the County Code Pertaining to Unmanned (Self-service) Motor Vehicle Fueling Facilities in the I-1 Zoning District County Administrator's Comments: County Administrator: Board Action Requested: Board of Supervisors to hold a public hearing to consider amendments to the Code of the County of Chesterfield. Summary of Information: At the request of Commissioner Gulley, staff prepared an ordinance amendment that would allow unmanned motor vehicle fueling facilities in industrial zoning districts. The Commission reviewed and discussed this item at their January work session, and held a public hearing at their February meeting. The current ordinance does not currently allow unmanned motor vehicle fueling facilities in the I-1 (Light Industrial) zoning district. The I-1 district serves as the base district for other industrial zoning districts. Uses permitted in the I-1 district are incorporated in the more intensive I-2 and I-3 districts. There are many supporting retail and services uses permitted with restrictions in the I-1 district - unmanned motor vehicle fueling facilities would be consistent with these types of uses. The Planning Commission held a public hearing on the proposed amendment on February 19, 2008. No citizens spoke to the proposed amendment during the hearing. The Commission voted 4-0 (Waller, absent), to recommend approval of the proposal. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 19-181 AND 19-301 OF THE ZONING ORDINANCE RELATING TO UNMANNED MOTOR VEHICLE FUELING FACILITIES IN I-1 DISTRICTS BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 19-181 and 19-301 of the Code o the County o Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Sec. 19-181. Uses permitted with certain restrictions. The following uses shall be permitted in the I-1 District subject to compliance with the following conditions and other applicable standards of this chapter. If the following restrictions cannot be met, these uses may be allowed by conditional use, subject to the provisions of section 19-13: 000 (b) Uses permitted by right with restrictions in the C-1 District, artist material and supply stores, health clubs, messenger or telegraph services ~ office supply stores, and unmanned self-service motor vehicle fueling facilities, provided that: (1) Such uses shall only be permitted in projects of 25 acres or more; (2) At no time shall such uses exceed 30 percent of the gross floor area under construction or occupied by permitted uses in such projects; (3) Such uses are located internally to the project, not along any road on the periphery of the project; and (4) Shall be primarily for the convenience of the employees of the industrial uses. 000 Sec. 19-301. For the purposes of this chapter, the following words and phrases shall have the following meanings: 000 Unmanned self-service motor vehicle ueling acility: Any establishment having pumps and storage tanks at which fuels and oils for motor vehicles are dispensed or sold at retail, where: 1) dispensing is~erformed by the customer 2) there is no on-site attendant• and 3) vehicle repair services are not offered. Subject: PUBLIC HEARING: Consider the Exercise of Eminent Domain for the Acquisition of a Ten-Foot and Variable Width Easement for the County's Phone and Data Systems ministrator's Comments: County Administrator: Authorize the County Attorney to proceed with eminent domain for the acquisition of a 10' and variable width easement across the property of Myers Family Partnership, LP, 9800 Lori Road, PIN: 769663911400000, and authorization to enter and take such property prior to eminent domain proceedings. Summary of Information: On December 4, 2007 an offer of $6000.00, which includes $0.00 in damages, was made to Myers Family Partnership, LP for a 10' and variable width easement across property at 9800 Lori Road, PIN: 769663911400000. The Myers have indicated that the offer is acceptable, but staff has been unable to work out the final construction details and IST has indicated that it is necessary to proceed with the project. Construction of this fiber optic line will provide a system "loop" for the County's phone and data services. It will also provide an additional redundancy for the 911 system.
