This program is designed to give high school government students an opportunity to see their local government in action. In addition to attending today's board meeting, students have also attended a school board meeting and tomorrow morning each student will shadow a county or school official. Subject: County Administrator's Comments County Administrator's Comments: County Administrator: Board Action Requested: Summary of Information: The National Oceanic and Atmospheric Administration's (NOAA's) National Weather Service office in Wakefield, Virginia has recognized Chesterfield County as a StormReady community. StormReady is a nationwide community preparedness program that uses a grassroots approach to help communities develop plans to handle all types of severe weather. The program encourages communities to take a new, proactive approach to improving local hazardous weather operations by providing emergency managers with clear-cut guidelines on how to improve their hazardous weather operations by developing a hazardous weather plan, training weather spotters, holding emergency exercises, monitoring weather conditions locally and promoting the importance of public readiness. Subject: Resolution Recognizing May 2008, as "Older Americans Month" in Chesterfield County County Administrator's Comments: County Administrator: Board Action Requested: Adoption of the attached resolution. Summary of Information: Older Americans Month is observed in Chesterfield County and the nation in May to celebrate and acknowledge the contributions of past and present older Americans to our community and our country. The U.S. Administration on Aging has chosen "Working Together for Strong, Healthy and Supportive Communities" as the theme for Older Americans Month 2008. This theme states that it is the responsibility of all U.S. communities to work together and prepare for changing older adult populations by modernizing systems of care and providing consumers with more control over their lives. Many organizations and Chesterfield County departments provide services and programs to help older residents in Chesterfield County lead active, fulfilling and independent lives and to remain in their homes. In addition this year, students in 4th and Stn grades attending county schools had an opportunity to acknowledge positive older adult role models by participating in an essay contest about their favorite living senior (age 60 or older) who has impacted their life, sponsored by the Chesterfield Partnership for Successful Aging. The winner of the essay will also be recognized. Attached is the resolution recognizing May 2008, as "Older Americans Month." ~~~~~~ RECOGNIZING MAY 2008, AS "OLDER AMERICANS MONTH" IN CHESTERFIELD COUNTY WHEREAS, Chesterfield County is a community in which 65,546 citizens age 55 or older make their home; and WHEREAS, older adults in Chesterfield County and throughout the U.S. are a growing population with evolving needs; and WHEREAS, older Americans are valuable members of our society who are rich with experience and deserving of our respect; and WHEREAS, the number of baby boomers reaching traditional retirement age continues to increase, a fact that spotlights the need for increased attention to the needs of older adults; and WHEREAS, our older citizens of today and tomorrow promise to be among the most active and engaged older adult populations in our nation's history; and WHEREAS, it is the responsibility of this and all U.S. communities to work together and prepare for changing older adult populations by modernizing systems of care and providing consumers with more control over their lives; and WHEREAS, overall quality of life can be greatly enhanced when supportive communities help their older citizens obtain evidence-based approaches to making behavioral changes that can reduce risk of disease, disability, and injury; the tools to make informed decisions about, and gain better access to, existing health and long-term care options; and more options to avoid placement in nursing homes and remain at home as long as possible; and WHEREAS, Senior Connections, The Capital Area Agency on Aging has set aside May 2008 to recognize and honor older adults in Planning District 15 and celebrate their contributions; and WHEREAS, the Chesterfield TRIAD has declared May 7th as Senior Day in Chesterfield County. Following the work session, staff will incorporate any revisions into the adopted document. Staff is also requesting that the Board approve an addendum to the FY2009 Appropriations Resolution to indicate the Board's approved capital spending levels for FY2009 and approve the designation of funding for the FY2010 Appropriations Resolution incorporating all approved changes. Summary of Information: The Camp Baker Management Board has the responsibility of overseeing and monitoring the operation of Camp Baker. The position representing the Dale District has expired. Nominees are voted on in the order in which they are nominated. (~'© ®~ Biographical Data for Lisa Elko PERSONAL DATA: Lisa Elko was born August 17, 1960 in Richmond, Virginia. She has resided in Chesterfield County for forty-three years and currently resides at 11606 Park Branch Lane, Chesterfield, Virginia. She attended and graduated from Chesterfield County schools. She graduated with an Associate in Applied Science Degree from John Tyler Community College in August 2003. Ms. Elko and her husband David have been married since November 1980. They have two children. Patrick Elko passed away in August 2006 from complications due to a bone marrow transplant affiliated with Leukemia. Amy Elko is attending VCU Medical Center in the Nursing Program and will graduate in May 2009. She will also be married June 14, 2008. PROFESSIONAL EXPERIENCE: Lisa works for the Virginia Commonwealth University as Executive Assistant to the Vice President for Government Relations and Health Policy for VCU and the VCU Health System from October 2007 -present. As such she serves as point of contact for issues, requests, and inquiries received from Governor's Office, Members of the General Assembly, federal, state and local government officials, and various divisions and organizations within the university and community. In August 1999, Lisa was appointed by the Chesterfield Board of Supervisors as Clerk to the Board. She held that position until October 2007. As such she facilitated all aspects of the Chesterfield Board of Supervisors meetings. As Clerk she played an important role in providing quality customer service and communications with customers on behalf of the Board of Supervisors and county government. SPECIAL HONORS: In May 2004 she received the "Clerk of the Year" Award from the Virginia Municipal Clerks Association. In 2003 she was nominated to the General Code's Municipal Clerk's Honor Roll. Mayfield began her career in the Emergency Communications Center in February 1978 and held the positions of Emergency Services Dispatcher and Emergency Services Dispatch Supervisor; and WHEREAS, Ms. Mayfield continued her career with the Chesterfield County Police Department in 1984 serving in the position of Police Systems Analyst where she was responsible for handling multiple projects that included beat restructuring and geographical reporting areas, Time Accounting System design and implementation, CAD enhancements, and the 911 interface; and WHEREAS, Ms. Mayfield was promoted to Police Systems Supervisor in 1988 where she served as Project Manager for the design, development, and implementation of the Police Records Management System, False Alarm Reporting System, and the Wrecker System; and WHEREAS, Ms. Mayfield was the recipient of the 1994 Mason T. Chalkley Supervisor Concern for People Award for continually demonstrating the highest degree of concern for her subordinates and other Police Department personnel; and WHEREAS, Ms. Mayfield was promoted to Planning and Information Division Manager in 1996 where she had responsibility for long range planning in the areas of automation, and was responsible for the development and implementation of the Records Management System for National Incident Based Reporting; and WHEREAS, Ms. Mayfield returned to the Emergency Communications Center in 2002 as the Director and guided the center to achieve International Communications Accreditation through the Commission on Accreditation for Law Enforcement Agencies; State Emergency Medical Dispatching Accreditation through the Virginia Office of Emergency Services; implementation of the new Motorola Premier CAD and AVL, departmental Intranet website, integrated all phases of wireless 911 into emergency call taking processes, and supplied the vision for the creation of the first Departmental Performance Plan; and WHEREAS, Ms. Mayfield has held various positions in both professional and personal affiliations to include 311 Focus Group, Urban Area Security Initiatives, Capital Region 800 MHz Steering Committee, Credit Union Board of Directors, Chesterfield County Information Technology Advisory Group, State ICJIS Charge Standardization Project Committee, and Emergency Medical Services Advisory Group. Davis began her career in public social services in Virginia in 1966 and has been with the county since July 30, 1986; and WHEREAS, in her roles as social worker, senior social worker, and supervisor in the Chesterfield-Colonial Heights Department of Social Services, Mrs. Davis has competently served individuals, families and the community through the department's child welfare programs; and WHEREAS, Mrs. Davis has provided services and leadership in the areas of foster care, adoption, resource parent recruitment and training, and home studies to help shape Permanency Services into an exemplary program; and WHEREAS, Mrs. Davis has been instrumental in developing and implementing innovative initiatives to more effectively serve children, such as Concurrent Permanency Planning and joint training of foster and adoptive families; and WHEREAS, Mrs. Davis has committed her social work skills and practice wisdom to ensuring safety, well-being and permanence for hundreds of children in out-of-home placements; and WHEREAS, Mrs. Davis has been a dedicated advocate for children and families through improving and developing programs, as well as through skilled child and family assessments, service planning and delivery; and WHEREAS, Mrs. Davis has continually worked to improve the social services system through her contributions on agency, community, and state-level workgroups and task forces addressing policy, practice, programs and staffing. The legislation requires that the roads where the increased fine may be imposed be indicated by appropriately placed signs displaying the maximum speed limit and the increased penalty for violations. On June 20, 1996, the Commonwealth Transportation Board adopted a "Policy and Procedures" for processing requests for the increased maximum fine. The "Policy and Procedures" require the County to provide a Resolution to the local VDOT Resident Engineer requesting installation of the signs, identifying the specific roadway(s) where the signs are to be installed, confirming that the roadway(s) meet the criteria for posting, notifying VDOT that a speeding problem exists, and indicating that the increased fine has community support. Walton Park Road, Queensgate Road, Glenmeadow Road, Watch Hill Road, and Glenpark Lane in the Walton Park Subdivision and Hamlin Drive, Glen Oaks Drive, and Glen Oaks Court in the Glen Oaks Subdivision meet VDOT's criteria for installation of the signs indicating the increased maximum fine. Summary of Information: The Virginia Department of Transportation (VDOT) held a Nash Road Reconstruction Project design public hearing on January 17, 2008, at the Chesterfield County Central Library. The purpose of the project is to improve the geometry of Nash Road to provide a safer roadway that can handle increased traffic volumes. The county identified this project as a priority and included it in VDOT's Secondary Road Six Year Plan in 1997 when volumes on the road were 3,000 vehicles per day. Currently the volume is over 8,000 vehicles per day and is expected to double as the county develops. There have been numerous accidents along the road. The proposed project will make the road safer. There were thirty-four comments received for the record. Twenty of the comments were in favor of the project; five were opposed; and nine were in favor of the project with modifications. A summary of the comments received at the public hearing is available if desired by the Board. Two landowners requested VDOT to modify the alignment to reduce the impact to their property. VDOT investigated the requests but did not support changing the alignment. VDOT will shift utility easements off of the properties to reduce impacts somewhat. Summary of Information: On September 27, 2006, the Board of Supervisors authorized the County Administrator to execute a contract with AAC Technology Partners, LLC to provide consultant services to assist Utilities staff with needs assessment, RFP development, evaluation of RFP responses, and contract negotiations in selecting a new software solution that will meet our business requirements. This original contract with AAC Technology Partners, LLC is in the amount of $194,600. The original contract contains a provision for the county to request additional services associated with the Customer Information System project. Once the software selection process is complete, Utilities staff is requesting that AAC Technology Partners, LLC provide additional services during the vendor implementation and go-live phase. This phase involves a longer time commitment and more extensive involvement of AAC Technology Partners, LLC, resulting in the higher fee for the additional services. The overall project budget is $4,000,000. AAC Technology Partners, LLC has expertise in the area of Customer Information Systems. The County entered into a lease agreement dated August 25, 2005, with Krause Road Properties, L.L.C. for office space at 10111 Krause Road for the Community Corrections Services Department. Krause Road Properties has agreed to a lease addendum to allow the installation of Yagi mount antenna hardware and related equipment on the roof of the leased property to improve data transfer and operations between the county complex and the leased property. The Community Corrections Services Department is currently using a T1 line to connect to the County IST Department. The CCS computer system is significantly slower than most other county computer systems. The backbone speed T1 service is 1.5 Mbps. CCS will increase service speed to a minimum 50 Mbps. or approximately 33 times faster by installing wireless bridge technology. The wireless bridge will eliminate monthly costs and would save $4,200 annually. The system upgrade will pay for itself in approximately 25 months. Summary of Information: - Due to changes which the State Department of Housing and Community Development recently made to the Virginia Statewide Fire Prevention Code (VSFPC), it is necessary for the County to modify its amendments to the VSFPC to reflect the changes. The proposed amendments are contained in the attached ordinance. These amendments will not substantively change the County's fire prevention ordinance but are being made to reflect the changes in the VSFPC, which will go into effect on May 1. The VSFPC, which is enforced by the Fire Marshal's Office, is enforced uniformly throughout the state, but localities are allowed to amend the VSFPC to provide for more stringent fire prevention protection. Fire prevention code--Amendments, additions and deletions. The Virginia Statewide Fire Prevention Code is hereby amended and changed pursuant to Code of Virginia, § 27-97, in the following respects: 000 Chapter 3. General Precautions Against Fire 307.1 Title and Purpose. Delete and substitute section 307.1 as follows: This article shall be known as the Chesterfield County Ordinance for the Regulation of Open Burning. The purpose of this article is to protect public health, safety, and welfare by regulating open burning within Chesterfield County to achieve and maintain, to the greatest extent practicable, a level of air quality that will provide comfort and convenience while promoting economic and social development. This article is intended to supplement the applicable regulations promulgated by the State Air Pollution Control Board and other applicable regulations and laws. ~~ 307.1.1 Definitions. Delete and substitute section ~2 307.1.1 as follows: For the purpose of this article and subsequent amendments or any orders issued by Chesterfield County, the words or phrases shall have the meaning given them in this section. A. "Automobile graveyard" means any lot or place which is exposed to the weather and upon which more than five motor vehicles of any kind, incapable of being operated, and which it would not be economically practical to make operative, are placed, located or found. B. "Bonfire" means an outdoor fire utilized for ceremonial purposes. C. "Clean burning waste" means waste which does not produce dense smoke when burned and is not prohibited to be burned under this ordinance. D. "Construction waste" means solid waste which is produced or generated during construction of structures. Construction waste consists of lumber, wire, sheetrock, broken brick, shingles, glass, pipes, concrete, and metal and plastics if the metal or plastics are a part of the materials of construction or empty containers for such materials. Paints, coatings, solvents, asbestos, any liquid, compressed gases or semi-liquids, and garbage are not construction wastes and the disposal of such materials must be in accordance with the regulations of the Virginia Waste Management Board. 0~~~~~ 2723(05):77202.1 E. "Debris waste" means stumps, wood, and brush, ~~a ~~~-~~~ from property maintenance and/or land clearing operations. F. "Demolition waste" means that solid waste which is produced by the destruction of structures and their foundations and includes the same materials as construction waste. G. "Garbage" means rotting animal and, vegetable matter accumulated by a household in the course of ordinary day to day living. H. "Hazardous waste" means refuse or combinations of refuse which, because of its quantity, concentration or physical, chemical or infectious characteristics may: 1. Cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating illness; or 2. Pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed, or otherwise managed. I. "Household refuse" means waste material and trash normally accumulated by a household in the course of ordinary day to day living. J. "Industrial waste" means all waste generated on the premises of manufacturing and industrial operations such as, but not limited to, those carried on in factories, processing plants, refineries, slaughterhouses, and steel mills. K. "Junkyard" means an establishment or place of business which is maintained, operated, or used for storing, keeping, buying, or selling junk, or for the maintenance or operation of an automobile graveyard, and the term shall include garbage dumps and sanitary landfills. L. "Landfill" means a sanitary landfill, an industrial waste landfill, or a construction/demolition/debris landfill. See solid waste management regulations for further definitions of these terms. M. "Local landfill" means any landfill located within the jurisdiction of a local government. N. "Occupied building" means any structure occupied or intended for supporting or sheltering any occupancy. O. "Open burning" means the burning of any matter in such a manner that the products resulting from combustion are emitted directly into the atmosphere without passing through a stack, duct or chimney. P. "Open pit incinerator" means a device used to burn waste for the primary purpose of reducing the volume by removing combustible matter. Such devices function by directing a curtain of air at an angle across the top of a trench or similarly enclosed space, thus reducing the amount of combustion by-products emitted into the atmosphere. The term also includes trench burners, air curtain destructors and overdraft incinerators. 2723(05):77202.1 2 ~ ~ ~ ~@'~ Q. "Refuse" means trash, rubbish, garbage and other forms of solid or liquid waste, including, but not limited to, wastes resulting from residential, agricultural, commercial, industrial, institutional, trade, construction, land clearing, forest management and emergency operations. R. "Salvage operation" means any operation consisting of a business, trade or industry participating in salvaging or reclaiming any product or material, such as, but not limited to, reprocessing of used motor oils, metals, chemicals, shipping containers or drums, and specifically including automobile graveyards and junkyards. S. "Sanitary landfill" means an engineered land burial facility for the disposal of household waste which is so located, designed, constructed, and operated to contain and isolate the waste so that it does not pose a substantial present or potential hazard to human health or the environment. A sanitary landfill also may receive other types of solid wastes, such as commercial solid waste, nonhazardous sludge, hazardous waste from conditionally exempt small quantity generators, and nonhazardous industrial solid waste. See solid waste management regulations for further definitions of these terms. T. "Smoke" means small gas-borne particulate matter consisting mostly, but not exclusively, of carbon, ash and other material in concentrations sufficient to form a visible plume. U. "Special incineration device" means a pit incinerator, conical or tepee burner, or any other device specifically designed to provide good combustion performance. ~8?~ 307.2 Open Burning Regulations. Delete and substitute Section ~:~ 307.2 as follows: A. No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of refuse except as provided in this ordinance. B. No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of household refuse or garbage. C. No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of rubber tires, asphaltic materials, crankcase oil, impregnated wood or other rubber or petroleum based materials except when conducting bona fide fire fighting instruction at fire fighting training schools having permanent facilities. D. No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of hazardous waste or containers for such materials. E. No owner or other person shall cause or permit open burning or the use of a special incineration device for the purpose of a salvage operation or for the disposal of commercial/industrial waste. F. Open burning or the use of special incineration devices permitted under the provisions of this ordinance does not exempt or excuse any owner or other person from the consequences, liability, damages or injuries which may result from such conduct; nor does it excuse or exempt any owner or other person from complying with other applicable laws, ordinances, regulations and orders of the governmental entities having 2723(05):77202.1 3 ~ ~ ~ ~~r~. jurisdiction, even though the open burning is conducted in compliance with this ordinance. In this regard special attention should be directed to Code of Virginia, § 10.1- 1142, of the Forest Fire Law of Virginia, the regulations of the Virginia Waste Management Board, and the State Air Pollution Control Board's Regulations for the Control and Abatement of Air Pollution. G. Upon declaration of an alert, warning or emergency stage of an air pollution episode as described in part VII of the Regulations for the Control and Abatement of Air Pollution or when deemed advisable by the state air pollution control board to prevent a hazard to, or an unreasonable burden upon, public health or welfare, no owner or other person shall cause or permit open burning or use of a special incineration device, and any in process burning or use of special incineration devices shall be immediately terminated in the designated air quality control region. ~ 307.2.1 Exemptions. Delete and substitute subsection -}- 307.2.1 as follows: The following activities are exempted from the above prohibitions to the extent covered by the State Air Pollution Control Board's Regulations for the Control and Abatement of Air Pollution: A. Open burning for training and instruction of government and public fire fighters under the supervision of the designated official and industrial in-house fire fighting personnel; B. Open burning for camp fires or other fires that are used solely for recreational purposes, for ceremonial occasions, for outdoor noncommercial preparation of food, and for warming of outdoor workers; C. Open burning for the destruction of any combustible liquid or gaseous material by burning in a flare or flare stack; D. Open burning for forest management and agriculture practices approved by the state air pollution control board; and E. Open burning for the destruction of classified military documents. ~9~-2 307.2.2 Permissible open burning. Add subsection ~ 307.2.2 as follows: A. Open burning is permitted for the disposal of tree trimmings and garden trimmings located on the premises of private property, provided that the following conditions are met: A written permit, valid for 30 days, must be obtained from the Chesterfield Fire & EMS, Fire and Life Safety Division. Application for permit shall include: completed information form, the name, address and telephone number of the occupant and, if different, owner of the property on which the burn is conducted and of any other entity conducting or responsible for the burn. Application shall be submitted to the Fire and Life Safety Division at least I S days before the desired burn; 2. A copy of the burn permit shall be maintained at the site of the burn, shall be available for review at all times during the burn, shall be displayed so as to be visible from a public roadway and shall be maintained in a manner that protects it from deterioration by weather; a~ 2723(05):77202.1 4 3. The burning shall take place on the premises of the private property from which the trimmings were taken; and all reasonable effort shall be made to minimize the amount of material burned, with the number and size of the piles approved by Chesterfield County Fire & EMS, Fire and Life Safety Division; 4. The location of the burning shall be a minimum of 300 feet from any occupied building unless the occupants have given prior written permission, other than buildings located on the property on which the burning is conducted. If the Chesterfield County Fire & EMS, Fire and Life Safety Division determines that it is necessary to protect public health and welfare, it may direct that the above cited distances be increased; 5. All fires must be at least 50 feet from any structure; a~ 6. Permitted fires shall be constantly attended by a competent person until they are extinguished. The attendee shall have fire extinguishing equipment readily available for use as deemed necessary by the code official; 7. No regularly scheduled public or private collection service for such trimmings is available at the adjacent street or public road; i and 8. Permits for burning tree trimmings and/or garden trimmings shall be limited to two per site per year. B. Open burning is permitted for disposal of debris waste resulting from property maintenance, from the development or modification of roads and highways, parking areas, railroad tracks, pipelines, power and communication lines, buildings or building areas, sanitary landfills, or from any other designated local clearing operations which may be approved by Chesterfield Fire & EMS, Fire and Life Safety Division, provided the following conditions are met: A written permit, valid for 90 days, must be obtained from the Chesterfield Fire & EMS, Fire and Life Safety Division. Application for permit shall include: Fee for permit, completed information form, site plan drawing of burn site, proof of liability insurance for party performing burn, and the name, address and telephone number of the owner and, if different, developer of the property on which the burn is conducted and of any other entity conducting or responsible for the burn. Application shall be submitted to the Fire and Life Safety Division at least 15 days before the desired burn.- ; 2. A copy of the burn permit shall be maintained at the site of the burn, shall be available for review at all times during the burn, shall be displayed so as to be visible from a public roadway and shall be maintained in a manner that protects it from deterioration by weather; 3. The burning shall take place on the site from which the debris waste was generated. All reasonable effort shall be made to minimize the amount of material burned, with the number and size of the debris piles approved by Chesterfield County Fire & EMS, Fire and Life Safety Division; 4. The material to be burned shall consist of brush, stumps and similar debris waste and shall not include demolition material; 2723(05):77202.1 5 ~~~~~ 5. The location of the burning shall be a minimum of 500 feet from any occupied building unless the occupants have given prior written permission, other than buildings located on the property on which the burning is conducted. If the Chesterfield County Fire & EMS, Fire and Life Safety Division determines that it is necessary to protect public health and welfare, it may direct that the above cited distances be increased; 6. The burning shall be conducted at the greatest distance practicable from highways and airfields; 7. Permitted fires shall be constantly attended by a competent person until they are extinguished and conducted to ensure the best possible combustion with a minimum of smoke being produced. The attendee shall have fire extinguishing equipment readily available for use as deemed necessary by the code official; 8. The burning shall not be allowed to smolder beyond the minimum period of time necessary for the destruction of the materials; 9. The burning shall be conducted only when the prevailing winds are away from any city, town or built-up area.- ;and 10. The permit holder must maintain liability insurance in the minimum amount of $1,000,000.00 general liability coverage at all times while burning is taking place. At the time of permit application, a certificate of insurance coverage shall be submitted to the fire marshals C. Open burning is permitted for disposal of debris on the site of local landfills provided that the burning does not take place on land that has been filled and covered so as to present an underground fire hazard due to the presence of methane gas, provided that the following conditions are met: A written permit, valid for 90 days, must be obtained from the Chesterfield Fire & EMS, Fire and Life Safety Division. Application for permit shall include: fee for permit, completed information form, site plan drawing of burn site, proof of liability insurance for party performing burn; 2. The burning shall take place on the premises of a local sanitary landfill which meets the provisions of the regulations of the Virginia Waste Management Board; 3. Permitted fires shall be constantly attended by a competent person until they are extinguished and conducted to ensure the best possible combustion with a minimum of smoke being produced. The attendee shall have fire extinguishing equipment readily available for use as deemed necessary by the code official; 4. The material to be burned shall consist only of brush, tree trimmings, yard and garden trimmings, clean burning debris waste, or clean burning demolition waste; 5. All reasonable effort shall be made to minimize the amount of material that is burned; with the number and size of the debris piles approved by Chesterfield County Fire & EMS, Fire and Life Safety Division; 6. No materials may be burned in violation of the regulations of the Virginia Waste Management Board or the State Air Pollution Control Board. The exact site of the burning on a local landfill shall be established in coordination with the regional director and Chesterfield County Fire & EMS, Fire and Life Safety Division; no other site shall be used without the approval of these officials. Chesterfield County Fire & EMS, Fire and Life Safety Division shall be notified of the days during which the burning will occur: ;and 8. The permit holder must maintain liability insurance in the minimum amount of $1,000,000.00 general liability coverage at all times while burning is taking place. At the time of permit application, a certificate of insurance coverage shall be submitted to the fire marshal. D. Sections A through C above notwithstanding, no owner or other person shall cause or permit open burning or the use of a special incineration device during the months of May, June, July, er August, or Se tep tuber. ~ 307.2.3 Permits. Add subsection :~ 307.2.3 as follows: A. When open burning of debris waste or open burning of debris on the site of a local landfill is to occur within Chesterfield County, the person responsible for the burning shall obtain a permit from Chesterfield County Fire & EMS, Fire and Life Safety Division prior to the burning. Such a permit may be granted only after confirmation by Chesterfield County Fire & EMS, Fire and Life Safety Division that the burning can and will comply with the provisions of this ordinance and any other conditions which are deemed necessary to ensure that the burning will not endanger the public health and welfare or to ensure compliance with any applicable provisions of the State Air Pollution Control Board's Regulations for the Control and Abatement of Air Pollution. The permit may be issued for each occasion of burning or for a specific period of time deemed appropriate by Chesterfield County Fire & EMS, Fire and Life Safety Division. B. Prior to the initial installation (or reinstallation, in cases of relocation) and operation of special incineration devices, the person responsible for the burning shall obtain a permit from Chesterfield County Fire & EMS, Fire and Life Safety Division, such permits to be granted only after confirmation by Chesterfield County Fire & EMS, Fire and Life Safety Division that the burning can and will comply with applicable provisions in Regulations for the Control and Abatement of Air Pollution and that any conditions are met which are deemed necessary by Chesterfield County Fire & EMS, Fire and Life Safety Division to ensure that the operation of the devices will not endanger the public health and welfare. Permits granted for the use of special incineration devices shall at a minimum contain the following conditions: 1. All reasonable effort shall be made to minimize the amount of material that is burned. Such efforts shall include, but are not limited to, the removal of pulpwood, sawlogs and firewood. ~~~~8~~ 2723(05):77202.1 7 2. The material to be burned shall consist of brush, stumps and similar debris waste and shall not include demolition material. 3. The burning shall be attended at all times and conducted to ensure the best possible combustion with a minimum of smoke being produced. Under no circumstances should the burning be allowed to smolder beyond the minimum period of time necessary for the destruction of the materials. 5. The burning shall be conducted only when the prevailing winds are away from any city, town or built-up area. 6. The use of special incineration devices shall be allowed only for the disposal of debris waste, clean burning construction waste, and clean burning demolition waste. 7. Permits issued under this subsection shall be limited to a specific period of time deemed appropriate by Chesterfield County Fire & EMS, Fire and Life Safety Division. any 307.2.4 Attendance at Open Fires. Add subsection ~n~ 307.2.4 as follows: Permitted fires shall be constantly attended by a competent person until they are extinguished. The attendee shall have fire extinguishing equipment readily available for use as deemed necessary by the code official. 3n~ 307.2.5 Endangering Other Property. Add subsection ~n~ 307.2.5 as follows: No person shall kindle or authorize to be kindled or maintain any permitted fire in such a manner that it will endanger the property of another. 3-9~?~-6 307.2.6 Revocation of Permits. Add subsection 3~-6 307.2.6: If any permit holder violates any provision of this ordinance or if any permit holder makes a material misrepresentation on a permit application, The Fire Marshal may require the extinguishments of the fire and the burn permit shall be subject to revocation; 307.4 Fees. Delete and substitute section 307.4 as follows: 1. There shall be no fees for the permit required by Section 307.3.2(A). 2. Fees for permits required by section 307.3.2(B) and (C) and shall be ... $400.00 307.5 Attendance. Delete the words "Open burning". 308.3.1. Add the following sentences to the end of the opening paragraph of section 308.3.11 prior to the Exceptions, as follows:- 2~23~os>:~~2oa.l 8 0000~~ The owner or manager of any occupancy in Use Group R shall notify their tenants in writing of this code requirement at the time the tenants initially occupy the apartment and annually thereafter. A copy of this written notification shall be available for review by the code official. 308.3.1. Delete exception 2. 308.5.3 Sweating Joints. Add section 308.5.3 as follows: Any person using a torch or other flame-producing device for sweating pipe joints in any building or structure shall have available in the immediate vicinity, one approved fire extinguisher or water hose connected to a water supply. Combustible material in the close proximity of the work shall be protected against ignition by shielding, wetting, or other approved means. In all cases, the person performing the work shall remain in the vicinity of the sweating operation for one-half hour after the torch or flame-producing device has been used. 315.4 Materials Storage Regulation. Add subsection 315.4 as follows: No person shall store any combustible packing cases, boxes, barrels or similar containers or rubber tires, baled cotton, rubber, cork or other similarly combustible materials of a gross volume of greater than 2,500 cubic feet (70 m3) in any structure or on any premises, except under conditions approved by the code official. 31 S. 5 Storage, Park or Repair. Add subsection 315.5 as follows: No person shall store, park or repair any vehicle, tool or equipment that has a fuel tank that contains a flammable or combustible liquid or liquefied petroleum gas as a source of fuel within or on any occupancy in Use Group R, or part thereof, unless such building or structure is built for the purpose of such storage, parking or repairing in accordance with all requirements of the Uniform Statewide Building Code and this code. The owner or manager of any occupancy in Use Group R shall notify their tenants in writing of this code requirement at the time the tenants initially occupy the apartment and annually thereafter. A copy of this written notification shall be available for review by the code official. This section shall not apply to detached one- and two- family dwellings unless such storage, parking or repairing is conducted as a business. Such businesses must then comply with all applicable provisions of the Uniform Statewide Building Code and the Chesterfield County Code. Chapter 5. Fire Service Features 502.1. General Definitions. Delete and substitute the following definition: Fire Lane. An area designated by clearly visible signs and/or markings in which parking shall be prohibited, whether on public or private property, to ensure ready access for and to fire fighting equipment and facilities. X93-8 503.7 Illegal Use. Add subsection ~8 503.7 as follows: No person shall park or leave an unattended vehicle in or otherwise obstruct with a vehicle any designated or marked fire lane. 2. No person shall place or locate any equipment, materials, or any other object in or otherwise obstruct any designated or marked fire lane. The penalty for violation of section 503.8(1) shall be the same as outlined for other parking violations in the Chesterfield County Code. The penalty for 2723 (OS ):77202.1 9 violation of section 503.8(2) shall be the same as for all other violations of this chapter. Chapter 9 Fire Protection Systems 901.5.2 Altering or Changing Supervisory Services. Add subsection 901.5.2 as follows: The code official shall be notified prior to any alterations to the supervisory service equipment or if the agent providing supervisory service changes for any required fire protection system. Functional testing shall be conducted prior to the system being returned to service. The level of testing will be determined by the code official. All testing shall be conducted in the presence of the code official and appropriate documentation shall be provided to the code official to verify that the system is being supervised as designed and in accordance with the building code in effect at the time of installation. 901.6.1.1 Limited Area Sprinkler Systems. Add subsection 901.6.1.1 as follows: All limited area sprinkler systems shall be inspected annually and maintained according to NFPA 25 and in accordance with the following standards: 1. The sprinkler control valve shall be permanently marked with a sign stating "Sprinkler Control Valve." Markings made with embossed plastic tape, pencil, ink, crayon, or similar materials shall not be considered permanent. The sign shall be secured with noncorrosive wire, chain, or other means. 2. Markings shall be provided in a conspicuous place at the sprinkler control valve and shall state: "Notify the Fire Department (748-6240) before closing valve." 3. Valves connecting the limited area sprinkler system to the domestic water supply shall be locked open in an approved manner. 901.6.3 Reporting Results of Periodic Tests. Add subsection 901.6.3 as follows: The individual or company performing any test or inspection required under this article shall provide the code official with a complete written record of the test or inspection within 15 days after it is conducted. Such written record shall note plainly which standard, as referenced by this code, was used for the test or inspection. 904.11.6.1 Ventilation System. Delete and substitute subsection 904.11.6.1 as follows: The ventilation system in connection with hoods shall be operated at the required rate of air movement, and classified grease filters shall be in place when equipment under a kitchen grease hood is used. Cooking appliances, which require a commercial kitchen exhaust hood system, shall not be operated while the fire suppression system or kitchen exhaust system is non- operational or otherwise impaired. 904.11.6.6 Manual Operations. Add subsection 904.11.6.6 as follows: Instructions for manually operating the fire suppression system for the commercial kitchen exhaust system shall be posted conspicuously in the kitchen and shall be reviewed periodically with employees by the management. 907.21 Nuisance Alarm Activations. Add section 907.21 as follows: 2723~os>:~7ao2. i io C~~J ~-~~6 The owner and/or the occupant of any structure served by a fire protection system which has activated on two or more occasions when no fire, unsafe condition or other hazard has occurred, shall repair the system or correct conditions which are causing the system to activate. Chapter 10. Means of Egress -1~7:g 1027.22 Marking Means of Egress. Add subsection X7-6 1027.22 as follows: The code official may require the means of egress through storage areas to be marked, and the owner or his agent shall be responsible for marking and maintaining such aisles as required. Chapter 27. Hazardous Materials -General Provisions 2702.1 Definitions. Delete and substitute the following definition: Hazardous Materials. Those chemicals or substances which are physical hazards or health hazards as defined and classified in this Chapter~8, whether the materials are in usable or waste condition, including flammable and combustible liquids. Chapter 33. Explosives and Fireworks 3301.1.3.1 Fireworks Prohibited. Add subsection 3301.1.3.1 as follows: Permissible fireworks, as defined in the Statewide Fire Prevention Code, shall not be possessed, stored, sold, used or handled in Chesterfield County. 3308.1 General. Add the following text to 3308.1: A permit shall be required for the display of fireworks and pyrotechnic special effect materials. 3308.2 PermitApplication. Add the following text to 3308.2: Application for permits shall be made in writing at least 60 days in advance of the date of the display or discharge of fireworks or pyrotechnic special effect materials. The sale, possession, discharge and distribution of fireworks or pyrotechnic special effect materials for display shall be lawful only under the terms and conditions, and for the purpose set forth in the permit. A permit shall not be transferable, and shall not extend beyond the dates set forth in the permit. ~a ~n~T 3308.11 Violations. Aa~~~ee~e~3~v4o-'~- Delete and substitute 3308.11 as follows: No person shall store, possess, offer for sale, expose for sale, sell at retail or use or explode any fireworks or pyrotechnic special effect materials, except as provided in the rules and regulations issued by the code official for the granting of permits for supervised displays of fireworks or pyrotechnic special effect materials. Chapter 34. Flammable and Combustible Liquids 3404.1.1 Prohibited Storage. Add subsection 3404.1.1 as follows: The storage of flammable and combustible liquid shall be prohibited in occupancies of Use Group A, R-1, R-2, and in rental storage facilities. 3406.5.1.6 Fire Protection. Delete and substitute 3406.5.1.6 as follows: Whenever tank vehicles are automatically loaded with flammable liquids at bulk storage terminals without an employee in attendance, the loading rack area shall be protected by a 2723(05):77202.1 11 ~~~~~~ completely automatic fire suppression system approved by the code official. The system shall be designed to provide fire protection to both the loading rack and tank vehicles and shall be supervised by an accredited central station facility. Chapter 38. Li€ied Li uefied Petroleum Gases 3801.4 Emergency Services. Add subsection '24~ 3801.4 as follows: Anyone who supplies liquefied petroleum gas service shall have a qualified maintenance person available at all times to assist fire department personnel with emergency incidents involving the service. 3809.13. Delete and substitute section 3809.13 as follows: Protection of Containers. Containers shall be placed in a suitable enclosure or otherwise protected against tampering. The enclosure shall be secured to the sidewalk, concrete pad, or building to avoid tipping or movement of the enclosure. The servicing company's name and 24- hour phone number and "NO SMOKING" signs shall be provided and maintained on the enclosure. Vehicular protection shall be provided as required by the fire official. Summary of Information: Each year, as part of its annual budget review process, Planning Department staff prepares an analysis of its development review related fees compared to the cost to the Department of undertaking those reviews. It has been the Board of Supervisor's policy since 2002 to recover a targeted percentage of the Planning Department's development review costs through adjustments in the Department's development review related fees. First targeted at an 80 percent cost recovery rate, subsequent adjustments made by the Board of Supervisors in FY03 and FY04 lowered the cost recovery target for selected commercial activities. For FY09, Planning Department staff prepared a fee adjustment proposal, aligned with the Board's policy, to recover 80 percent of costs associated with selected residential reviews and 65 percent of costs associated with selected commercial reviews. Fees for site plan and rezoning reviews have not been adjusted since FY04. Staff does not recommend any adjustments to subdivision review related fees, as the Board of Supervisors adjusted these last fall for FY08. (Staff is projecting a 73 percent recovery rate in FY09.) Staff is recommending minor adjustments to fees associated with variance, special exception and mobile home related fees to simplify the fee structure, as individuals normally pay these "mom and pop" fees on a one-time basis. As is shown in Attachment A, since the comprehensive adjustments made by the Board of Supervisors to Planning Department fees in FY03 and FY04, about 30 percent of the Planning Department's operating budget has been covered by its development review related fee revenue. That share is projected to drop to 20 percent for FY08. Projections for FY09 (with and without the proposed adjustments) include part of the cost for new Planning Department positions approved by the Board of Supervisors as part of the County's FY09 budget. As shown in Attachment B, staff is proposing adjustments that are projected to generate an additional $163,300 in site plan fee revenue and $340,100 in rezoning fee revenue in FY09. The additional revenue represents an 85 percent increase in site plan fees and a 75 percent increase in rezoning fees. The significant jump in the proposed fees are a result of annual increases in salary and benefit costs combined with no increases to site plan fees since FY01 and no increases to rezoning fees since FY04. The costs associated with these proposed fee adjustments reflect only Planning Department costs related specifically to review activities, and not the related development review costs of other departments, such as Transportation, Utilities and Environmental Engineering. Attachment C is a draft ordinance outlining staff recommended changes. At their April 15, 2008 public hearing, the Chesterfield County Planning Commission recommended denial of staff recommended fee adjustments and the accompanying ordinance for the following reasons: • The Commission was concerned about how much of the Planning Department's operating costs should be recovered by fees. They felt this was a decision best addressed by the Board of Supervisors. • Referring to the proposed 80 percent residential and 65 percent commercial cost recovery goal, the Commission was concerned about the degree that development review costs should be recovered from one type of activity verses another. The Board elected not to increase the maximum cash proffer amount that can be accepted from zoning applicants to mitigate the impact of residential development on capital facilities. The calculated impact for FY2008 (May 2007) is $23,072. Staff is currently calculating this year's impact figure, which may be available prior to advertising this public hearing. After the public hearing, the Board could adopt a maximum acceptable cash proffer amount up to the 2007 amount of $23,072 per dwelling unit or up to the newly calculated 2008 cost, if it is available, for new cases effective beginning FY2009. Furthermore, staff recommends that the Board allow approved cases to be adjusted by up to 15.9% to reflect increases in the Marshall and Swift Building Cost Index since the $15,600 maximum proffer has not been adjusted since FY2006 (May 2005) Adjusting the three year old $15,600 cash proffer maximum amount by the 15.9% change in the Marshall and Swift Index would equate to $18,080 per dwelling unit for previously approved cases. Staff further recommends that the cash proffer policy be amended with respect to maximum cash proffer amounts and pending cases. Currently, policy specifies that a pending case will be subject to one change in the maximum cash proffer amount. Staff recommends that a pending case shall be subjected to only one revision in the maximum amount, such revision being the first revision following the submission of the application, provided the Board disposes of the case within two years of the application date. After such time, unless the case is deferred by the Board of Supervisors, staff recommends that the development proposal's impact shall be subject to the maximum cash proffer in place at the time of the Board's hearing. A second policy amendment emphasizes a preference for accepting improvements in lieu of cash payments as a means for zoning applicants to address their impact on capital facilities. The final recommendation is that the cash proffer policy be amended to automatically increase cash proffer amounts in approved cases by the increase in the Marshall and Swift Building Cost Index effective July 1 of each year. However, only one bid was received, and the amount significantly exceeded available funds. It was determined that the reason for lack of bids was due to the exposure of the HVAC contractor to liquidated damages without being under the "umbrella" of a general contractor, as well as the reluctance of the HVAC contractors to hold their price over a multi-phased, four-year project. The decision was made to re-bid the HVAC project, and include language that would assign the contract to the general contractor (Gulf Seaboard was awarded the general contract work at the March 12, 2008 board meeting). The county received three responses to the re-bid, and Southworth Mechanical was the low bid. A new bridge could be constructed. The bridge would provide a wider and safer roadway and would reduce the flooding problem on Otterdale Road. The estimated cost of a new bridge is approximately $2.55 million. Box culverts could be constructed to replace the bridge. Box culverts will also provide a wider and safer roadway. However, box culverts will not significantly reduce the flooding on Otterdale Road. If Otterdale Road was reconstructed in the future to reduce the flooding problem, the box culverts would probably not be usable. The estimated cost of box culverts is approximately $950,000. Due to safety concerns with the narrow width of the existing bridge and limited available funding, staff recommends the box culvert option be selected. It does not appear that local road funding will be available at this time. Furthermore, with a forty-four percent reduction in secondary road funds from VDOT, there is a low probability of funding a new bridge in the near future. The box culvert project can be constructed within a year with existing cash proffers. If sufficient funding is provided in the future to complete a more comprehensive reconstruction of Otterdale Road, a decision can be made to replace the box culverts or leave the boxes in place. Chesterfield County and the business community have agreed to provide half the funding by using $ 18 million in BPOL revenues. Route 360 (Winterpock Road to Otterdale Road) -widening to six/eight lanes This section of Route 360 carries between 20,000 and 43,000 vehicles per day. Route 1 at Old Bermuda Hundred Road -relocate intersection The intersection of Old Bermuda Hundred Road and Route 1 has less than desirable sight distance for motorists on Old Bermuda Hundred Road entering traffic on Route 1 and has been identified as a high accident location. Relocation of the intersection on Route 1 is needed to provide a better sight distance. This section of Route 1 carries approximately 22,000 vehicles per day. This volume is expected to increase to 36,000 vehicles per day by the year 2020. This project is not in VDOT's Six-Year Improvement Program. Funds for this project have been requested through the Tri-Cities MPO. 11. Powhite Parkway (between Route 288 and Brandermill Parkway) -widening to four lanes This section of Powhite Parkway carries approximately 17,000 vehicles per day. This volume is expected to increase to 40,000 vehicles per day by the year 2020. The Route 288 project included construction of two additional lanes on Powhite Parkway from Route 288 to Charter Colony Parkway. This project will extend the four-lane road through the Charter Colony Parkway intersection. This project is not in VDOT's Six-Year Improvement Program. 12. Powhite Parkway Extension; East-West Freeway; North-South Freeway Preliminary engineering and right-of--way acquisition are necessary for the county's outer beltway (Powhite Parkway Extension from Charter Colony Parkway to Route 360; East-West Freeway from Route 360 to Interstate 95; and North-South Freeway from East-West Freeway to Interstate 85). Preliminary engineering is needed to properly identify the location of the beltway. Right-of--way should be acquired where growth threatens to block the corridors. I am requesting funding for the projects and asking that this priority list be entered into the record for the Richmond District Public Meeting for the FY09-FY14 Six Year Improvement Program. Our top four priorities are highlighted below: Our number one priority project is Route 10 in the Enon area. Route 10 needs to be widened to sixleight lanes from Route 1 to Meadowville Road. Previously Congressman Forbes arranged for over $800,000 in SAFETEA -LU earmarks for this project. In last year's Program, this project was fully funded. In the draft FY09-FY14 Program, the project funding has been reduced by $8.8M with most of the funding shown as projections in the latter years of the Program. In addition, the project length was shortened and now does not include widening from Route 1 to Ware Bottom Spring Road. Even with the reduced length, the estimate for the project has increased by $30M. The program is showing a balance of $38.9M required for the project. The county has programmed $15M in county bond funds over the next six years in order to construct a first phase of the project (west of Old Stage Road and east of Bermuda Triangle Road). The county has completed design and right-of--way acquisition and utility relocations are underway for Phase I; however, due to increasing costs, construction of Phase I is in jeopardy. The county's second priority is the Route 60 project from Courthouse Road to Old Buckingham Road. This section of Route 60 needs to be widened to six lanes. This section of Route 60 is carrying approximately 45,000 vehicles per day. This volume is expected to increase to 57,000 vehicles per day by the year 2020. Summary of Information: The Chesterfield County Parks and Recreation Department has requested permission from the Board of Supervisors to stage a fireworks display at the Chesterfield County Fairgrounds on July 4, 2008, with no rain date. The Parks and Recreation Department has conducted similar displays on the same property in previous years without incident. The fireworks supplier, Zambelli Fireworks MFG. Co., Inc., has obtained a liability insurance policy naming the County of Chesterfield as an additional insured party in the amount of $2,000,000. All permits for fireworks displays, must be approved by the Chesterfield County Board of Supervisors and have me# or agreed to meet the following restrictions: 1. A minimum liability insurance certificate of $1,000,000.00 must be secured; subject to the approval of the County Attorney. The County shall be named in addition to the insured on the certificate or proof of insurance. 2. The discharge site must be pre-approved. by the Chestefield County Fire Marshal or his appointed assistant. This visit should be coordinated with the shooter if possible and conducted prior to submitting the permit application to the Board of Supervisors. 3. All handling, storage, discharge, and activities related to the fireworks must follow the Virginia Statewide Fire Prevention Code and related standards_ 4. The person in charge of the event, based on prior approval, is responsible for: a. coordinating and/or providing adequate fire protection for the display, b. arranging appropriate security and crowd control for discharge and display areas, c. policing the fallout area after the display for the purpose of locating unexploded shells. The area is to be searched and rendered safe before allowing public access. 5. No. 28 FIREWORKS CHAPTER 31 Chesterfield County Fire Prevention Code Sec. F-3101.1 Scope: The manufacture, display, sale or discharge of fireworks shall comply with the provisions of this chapter. F-3102.1 Definition: Fireworks shall mean and include any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets, Roman candles, sparklers or other devices of like construction and any device containing any explosive or flammable compound, or any tablets or other devices containing any explosive substance, except that the term "fireworks" shall not include auto flares, paper caps containing not in excess of an average of .25 grain (16.2 mg) of explosive content per cap, and toy pistols, toy canes, toy guns or other devices for use of such caps, the sale and use of which shall be permitted at all times. F-3103.2 Violations: No person shall store, possess, offer for sale, expose for sale, sell at retail, or use or explode any fireworks, except as provided in the rules and regulations issued by the fire official for the granting o.f permits for supervised public displays of fireworks. F-3103.3 Display: Permitted fireworks displays shall be conducted by an operator approved by the fire official, and the fireworks shall be arranged, located, discharged and fired in a manner that will not constitute a hazard to property or endanger any person. Mauger Title: Fire Chief Attachments: ^ Yes ~ No 005.39 RECOGNIZING MAY 18-24, 2008, AS "EMERGENCY MEDICAL SERVICES WEEK" WHEREAS, emergency medical services is a vital public service; and WHEREAS, the members of emergency medical services teams are ready to provide lifesaving care to those in need twenty-four hours a day, seven days a week; and WHEREAS, immediate access to quality emergency medical care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and WHEREAS, injury prevention and the appropriate use of the EMS system will help reduce national health care costs; and WHEREAS, emergency medical services providers and emergency departments have traditionally served as the safety net of America's health care system; and WHEREAS, emergency medical services teams consist of emergency physicians, emergency nurses, emergency medical technicians, paramedics, firefighters, communications officers, educators, administrators, and others; and WHEREAS, working together, these emergency medical services teams responded to over 23,000 medical emergencies in Chesterfield County in 2007, representing countless hours of dedicated service to the community; and WHEREAS, the members of emergency medical services teams, whether career or volunteer, engage in many hours of specialized training and continuing education to enhance their lifesaving skills; and WHEREAS, the citizens and guests of Chesterfield County benefit daily from the knowledge, skills, and dedication of these highly trained individuals; and WHEREAS, it is appropriate to recognize the value and the accomplishments of the emergency medical services providers from Chesterfield Fire and EMS, Defense Supply Center Richmond, Chesterfield County's Emergency Communications Center, and the volunteer rescue squads of Bensley-Bermuda, Ettrick-Matoaca, Forest View, and Manchester. Preparers Janice Blakley Attachments: ^ Yes ~ No '~oz~s Title: Clerk to the Board RECOGNIZING MAY 17-24, 2008, AS "SAFE BOATING WEEK" IN CHESTERFIELD COUNTY WHEREAS, Americans are increasingly heading to the water for recreation and relaxation as opportunities for on-the-water activity increase each year; and WHEREAS, with this growth comes additional responsibility; and WHEREAS, it is essential that both novice and experienced boaters alike learn and practice safe boating habits, wear a life jacket and have essential safety equipment; and WHEREAS, this year's theme of the Boating Safety Campaign, "Boat Smart from the Start, Wear Your Life Jacket," recognizes that boating safety begins before the boat leaves the dock; and WHEREAS, studies show that boaters who take a boating course are four to five times less likely to have a boating accident, and 80 percent of the people who have died in boating accidents were not wearing life jackets; and WHEREAS, the number of boats registered in the Commonwealth of Virginia is 253,057, and even more boats visit our area waters each summer; and WHEREAS, hundreds of lives could be saved each year by the wearing of life jackets, and the life jackets of today are more comfortable, more attractive and wearable than styles of past years; and WHEREAS, the law requires that wearable life jackets be carried for each person on board the boat, and little effort is needed to wear those life jackets; and WHEREAS, boating courses are readily available from the Coast Guard Auxiliary throughout the year. Subject: Public Hearing to Consider a Purchase Contract to Sell Approximately 49 Acres Located on Whitepine Road to Charles R. Primm County Administrator's Comments: County Administrator: Board Action Requested: Staff recommends that the Board hold a public hearing and authorize the County Administrator to enter into the contract and the conveyances of property contemplated by the contract. Summary of Information: On April 2, 2008, the Board scheduled this public hearing to consider approval of a real estate purchase contract to sell approximately 49 acres of land to Charles R. Primm. This parcel is the last large parcel of land in the Airport Industrial Airpark located at the end of Whitepine Road across from Maruchan. Economic Development has had a difficult time marketing this parcel in the past as it is a challenging site to develop and use because of wetlands and challenging topography. Additionally, and most significantly, the site has no sewer. The sewer will need to be extended approximately 2500 feet from the northwest area of Belmont and Cogbill Roads to serve the site. The small sewer stub on Whitepine Road does not have enough capacity to serve the entire site. In the past, no small user has been interested in locating on this site because extending the sewer was cost prohibitive. Preparers Title: E. Wilson Davis. Primm has offered to purchase the entire 49 acres for $48,000 per acre, exclusive of wetlands (to be determined by delineation paid for by Mr. Primm) Mr. Primm intends to develop approximately 15 buildable sites after extending the sewer to the property. Mr. Primm is working with clients consistent with the I-1 zoning in the Airpark who are interested in locating on the site. Given the unusually high cost of the sewer extension, Mr. Primm has asked the County to give him a credit toward the purchase price of the property in an amount equal to the cost he incurs to extend the sewer up to $450,000. The details of the contract are outlined below: 1. The County will give Mr. Primm a credit toward the total purchase price in an amount equal to the actual costs he incurs to extend sewer to the property up to $450,000. The County Utilities Department has estimated this figure to be the reasonable cost of extending the sewer and advises that the extension will benefit other undeveloped properties in the area. 2. The contract requires Mr. Primm to purchase at least two (2) of the 49 acres of the property within six (6) months of the completion of his engineering and financing due diligence periods and the remainder of the property over seven (7) years in acreage amounts he determines, but in locations within the remaining property he and the County mutually agree upon. This will allow Mr. Primm to phase development of the site; and 3. Primm shall provide the County with a Performance Bond in an amount sufficient to secure his obligations under the contract, including extending the sewer line to the property and purchasing all 49 acres within 7 years. In the event Mr. Primm breaches the contract, the bond will be forfeited to the County and all improvements made to the property shall become and remain the property of the County. Economic Development recommends approval of the contract.
