Dir., Utilitie: It is here noted that the meetin~ scheduled for January 19. 1978, was cancelled due to a lack of a quorum !{rs. Girone called the meeting to order at the Chesterfield County Courthouse at 9:00 a.m. (EST) in the absence of the Chairman. ~r. Apperson gave the invocation. Dn motion of Mr. Bookman, seconded by Mr. Dodd, the minutes )f January 11, 1978, were approved as amended. 7ore: Unanimous Mr. Meiszer asked the Board if they had any objections to the minutes of the meetings as presented being bound in another minute book rather than having the secretarial staff retype them in the current minute book, The Board indicated approval of the change as long as they were bound in a permanent book and there were no legal reasons why this could not be done. Hr. Micas stated he would discuss the matter with ~{r. Meiszer after reviewing the relevant state law. .~r. Painter stated he had received a request from Mr. and Mrs. L. D. Cripe, 7921 Surre~4ood Drive, Surreywood Subdivision, for ~eimbursement of cost of damages due to sewage back-up in their ~asement. Mr. Bookman stated he had investigated this situation and the main line below the service line had been sheared which ~llowed roots to block the line, etc. which caused this back-up. ~e added Mr. and Mrs. Cripe were resuesting reimbursement in ;he amount of $4,776.33 which did no~ represent everything that Was damaged but felt this amount would be fair to themselves as ~ell as the County. Mr. Micas stated there had been no evidence Ipresented indicating that COunty personnel were at fault and that the County is protected by sovereign immunity and for those reasons .~econ~mnded denial.. ?~. Bookman stated he felt a obligation and it was on his motion, seconded by Apperson, resolved that Mr. and Mrs. L. D. Crioe be sed $4,776.33 for the cost of damages due to a in their basement. : Unanimous 78-15 Mr. William Moseley of Moseley-Hening Associates, architects for the Juvenile and Domestic Relations Court and Probation Building, presented the Board with bid tabulations for the above mentioned construction project. He stated they received 13 bids and were recommending the low bid in the amount of $698,800, which includes the base bid and alternate no. 1. He added further that all bids have been under the estimates, the building with the alternate is less than originally expected the alternate consists of 698 sq, ft,, etc, After further discussion of the matter, it was on motion of Mr. Bookman, seconded by Mr. Apperson, resolved that the low bid of Silas S. Kea and Sons Co. be approved in the amount of $698,800, which price includes base bid and alternate #1, for the construction of the Juvenile and Domestic Relations Court and Probation Building. Vote: Unanimous Mr. Meiszer stated that ~Ir. Ralph Carper of the Building Inspector's Office would be the County's project coordinator for any construction projects for the County, reviewing requests for payment, inspections, etc. He added if ~r. Carper had technical questions he would consult Mr. Cloer and if he had administrative questions he would contact Mr, Meiszer~ 2. I. Mr. Painter deleted discussion of the draft of the water agree- ment with Allied Chemical Corporation and Philio Morris Corpora- tion. ' ' ~ 2. II. On motion of Mr, Dodd, seconded by Mr Apperson, the Board increased encumbrances for Project W75-25CD in the amount of $2,828,70 for the relocation of the water line on Willis Road in conjunction with the 1-95 widening, Vote: Unanimous 2. III. The Board excused Mr', Bookman from the~meeting. On motion of Mr, Apperson, seconded by Mr. Dodd, the following Sewer Contract was approved: S77-22CD/1 Developer: Contractor: County Cost: County Cost: Route 60-Robious Road $110,091,55 O. S, Hastings, Jr, and Jean C, Hastings (his wife), C. L. Bookman, Sr, and June P, Bookman (his wife) Watts Contractors, Inc. $9,312,69 - Cash refund - Code: 380-77000-8070 $88,676.01 - Through Connection~Code:573-11781-8071 Vote: Unanimous Mr. Bookman returned to the meeting. On motion of Mr. Apperson, seconded by ~Mr. Dodd, it was reSolved that Change Order No. 1 for Contract 7032-5, Proctor's Creek Sewage Treatment Plant be approved in the amount of $13,469.28, which amount represents various deletions and additions normally expected in construction, at the request of the contractor, Rahman Construction Corporation and Rouse International. Vote: Unanimous 78-16 2. V. On motion of Mrs. Girone, seconded by Mr, Dodd, the Board approved the request from American Heritage Land Company, develooers of Heritage Commons, to modify Contract S77-38CD to orovide for off-site refunds from connection fees in the amount of $22,223,18, Code: 573-11781-8071. Vote: Unanimous On motion of Mr, Apperson, seconded by Mr. Dodd, Central Accounting was authorized to adjust encumbered sewer funds for Capital Project s: 1. 7032-23B Johnson Creek Pump Station Release of encumbered funds: $15,095.60 from 380-73000-2340 to 377-00000-0000 898.19 from 380-73000-2290 to 377-00000-0000 2. S76-2T Deerfield Collectors Increase encumbered funds - Additional Engineering $799.29 from 377-34325-0380 to 380-72000-2290 3, S76-2T-1 Deerfield Pump Station Increase encumbered funds - Additional Engineering $118.93 from 377-34325-0380 to 380-72000-2290 and further appropriated the following amounts for engineering: 1. S77-22CD Sewer to Route 60-Robious Road Area $6,637.81 from 573-32324-0380 to 380-77000-2290 (Funds for this project have been deposited by the developers) 2. 7032-25 Falling Creek Sewage Treatment Plant Expansion $574,770.00 from 573-34324-0380 to 380-74000-2290 (EPA will reimburse the County for 75% of the engineering cost) Vote: Unanimous 2. VIII. On motion of Mrs. Girone, seconded by Mr. Dodd, the County Attorney was authorized to institute condemnation proceedings against the property owners listed below if the amount as set opposite their names is not accepted. Be it further resolved that the County Administrator notify the said property owners by registered mail of the intention of the County to enter'upon and take the property which is to be the subject of said condemna- tion proceedings. An emergency existing, this resolution shall be and it hereby is declared in full force and effect immediately upon passage. This resolution is~.subject to the property owner agreeing to pay for the cost of condemnation. Wesley C. & Annie F. X. On motion of Mrs. Girone, seconded by Mr. Apperson, the Chairman and County Administrator were authorized to execute an agreement 78-17 2, XII. 3. A. ~ith Douglass K. Woolfolk, James R. and Patricia W, Fitzpatrick and the County which agreement allocates responsibility for the iconstruction of a water line along Castlebridge Road in Salisbury Subdivision, 7ote: Unanimous On motion of Mr. Bookman, seconded by Mr. Dodd, the County Administrator was authorized to accept a deed of dedication from Lawrence R, and Lynn G. Belcher for a 50 foot road right-of-way on the west side of Graves Road on behalf of the County. Vote: Unanimous Mr. Painter presented a list of developer contracts which had been executed by the County Administrator. Hr. Apperson inquired how the Right-of-Way Department determined if a bonafide offer has been made prior to condemnation proceedings requested by a developer. Mr. Pope stated they are sent copies ~f letters, at meetings, etc. Hr. Dodd inquired what the status was of the Drewry's Bluff bid. Hr. Welchons stated that HUD had just audited some of the projects for the County and he had waited to see if the Utilities Department had been following all requirements before starting this project. Re added it would be started immediately and added there may be ~ possibility of adding more homes at an additional cost of ~, ~bout $15,000. Apperson, the Board deferred consideration of the expenditure of $8~600 for stadium seats until February 8th to allow the County Administrator to ascertain the need for these improvements. Vote: Unanimous It was generally agreed to defer the appointments to the Mental Health and Mental Retardation~Services Board, On motion of Mr. Apperson, seconded by Mr. Bookman, Mr. C, L. Bookman was appointed to the Richmond Regional Planning District Commission as an elected official and Mr. R. Garland Dodd was appointed to the Commission as a representative from the Chesterfield County Planning Commission effective January 1, 1978. Vote: Unanimous On motion of Mr. Apperson, seconded by Mr. Bookman, ~fr. Nicholas M. Meiszer was appointed as Mr. J. Ruffin AoDerson's alternate and Mr, Stanley Balderson was appointed as M~. C. L. Bookman's alternate effective January 1, 1978, to the Richmond Regional Planning District Commission. : Unanimous On motion of Mr. Bookman, seconded by Mr. Apperson, the Circuit Court Judges were respectfully reouested to appoint Mr. J. L. Longest, Mr, William C. Lindsay, Jr., Mr. Ernest F. Clover Hill High.'.,School Keynotes 3, Meadowbrook High School Athletic Association Vote: Unanimous Mr. Meiszer stated he.had met with Mr. Micas and the Auditors of the Sirloin Restaurant and they had agreed to modifications of the lease the restaurant has with the County, He added the lease was not prepared at this time~ Mr~ Micas explained the modifications, After some discussion of the matter, it was on motion of Mr. Bookman, seconded by Mr. Dodd, res61ved that the modifications for the Sirloin Restaurant be approved, Vote: Unanimous On motion of Mr, Apperson, seconded by Mr. Bookman~ the following ordinance was adopted on ~n emergency basis with ~a Public Hearing to be held on February 22, 1978, at 10~00 "An Ordinance to amend the Code of the County of Chesterfield, 1975, as amended, to establish a Central Absentee Voter District" Be it ordained by the Board of Supervisors of the County of Chesterfield: (1) That the Code of the County of Chesterfield is amended and reenacted as follows: There is hereby established a central absentee voter election district in the Circuit Court Conference Room on the first floor across from the Circuit Court Judges' Chambers at the Chesterfield Courthouse for the purpose of receiving, counting and recording all absentee ballots in all elections cast within the County, Such central absentee voter election district shall receive, count and record all absentee ballots in accordance with the requirement of §24.1-233.1 of the Code of Virginia and all other applicable provisions of law. This shall be effective February 1, 1978 for a period of twelve months. Mr. Meiszer stated the Board had received a copy of the operating statements for the Nursing Home and the Airport, a copy of the revised delivery date for the audit reports for the County, and a copy of the Police Department's annual report of crime and statistics for the County. He also advised the Board that the interview for the Director of Community Development had been cancelled. On motion of the Board, the following resolution was adopted: Whereas, during the month of January, 1978, the County experienced hazardous weather conditions causing accidents and property damage; and~ I*~ereas, many residents of the County required assistance from the Chesterfield County Fire and Police Departments in these instances; and Whereas, through the efforts of dedicated, reliable and cooperative firemen and policemen, these situations were handled in a very professional and expedient manner. Now, Therefore, Be It Resolved on behalf of the citizens of Chesterfield County, this Board expresses their sincere gratitude and appreciation to these men for their time, effort and service to the County. Wells request~ a Conditional Use for five years to oermit the operation of an automotive and small truck repair and body sho~ in,an Agricultural (A) District on a parcel fronting approximatel~ 400 feet on Graves Road and being located approximately 7,000 fee~ east of its inter- section with River Road. Mr. Morris Mason, representing Mr. Melvin Floyd, requested deferral~ of this case for 30 days because he had just been retained and was not familiar with all aspects of the case, Mr. O'Neill inquired why this had been done at the last minute when the case 78-23 d ~ad been deferred several times before. ~r. Steve Bryant, attorney representing the applicant, stated~the conditions were agreeable. There being no opposition present, it was on motion of Mr, Bookman, seconded by Mr. Apperson, resolved that this request be approved subject to the following conditions: This conditional use shall be restricted to and for Horace H. Hines, Jr,, exclusively, and shall not be transferrable nor run with the land. This conditional use shall be granted for a period not to exceed one year from date of approval, No equipment, materials, supplies or other paraphernalia associated with the business operation, shall be olaced closer than 400 feet from the front property line. Ail access drives will be paved and vehicular and equipment parking areas shall be either paved or graveled within 60 days of date of approval, There will be no dumping of materials other than dirt, stone or rock on this parcel. There being no opposition, .t was on motion of Mrs. Girone, seconded by Mr. Bookman, resolved that this request be approved subject to the following conditions: The type and style of development of the parcel in question shall be of the same character as the existing Sycamore Square Shopping Center and previeusly approved Master Plan. 78-24 All utility lines shall be orovided with underground distributi~ Utility plans shall be submitted to the Utilities Deoartment for approval. Pedestrian walkways shall be provided, marked and shown on schematic plans, These walkways shall be placed at appropriate locations to be mutually agreed upon by the Division of Development Review and the applicant. An overall landscaping plan shall be oreDared in accordance to Article 25 of the Zoning Ordinance and approved by the Division of Development Review prior to the issuance of any building permit. An erosion and control plan shall be submitted to and approved by the Environmental Engineering Section prior to any land clearing. Schematic plans shall be submitted to and approved by the Division of Development Review and Planning Commission.
