Mr. O'Neill called the meeting !~o order at the Courthouse at 2:00 p.m~ (EDST) Mr. Dodd gave the invocation. On motion of Mr. Bookman, seconded by Mr. Apperson, thc minutes of July 26, 1978~ were approved as amended. Vote: Unanimous On motion of Mr. Dodd, seconded by Mr. Apperson, the Board of Supervisors this day approved all claims presented to the County for the month of August, 1978, and authorized the Treasurer of the County to issue warrants, a copy of such list is filed in the Treasurer's Office. Vote: Unanimous Mr. John Baldock, Pocahont~s Stste Forest Ran~er, ores~nted the Board with their annual check zn the amount of $21,42..40 for proceeds of harvesting trees at the Park~ He invited the Board to visit the Park and the new office building recently constructed there. A representative of the Division of Forestry was or, sent and gave a brief summary of the activities they perform. ~He added further that there had been 29 forest fires at which 314 acres had burned but this Only represented .15% of the area which they protect. The Board thanked Mr. Baldock and the other represent- atives present for their time coming to the meeting and for the check. Mr. Apperson discussed Oakdale Road, 2ucker Road and Yatesdale Road ~ith Mr~ Covington with regard to rural addition projects. Mr. Williams stated that the memo suggested projects and would like the Board's input but that there is approximately $90,000 for this work so there cannot be a large list. It was generally agreed that the Board could consider this matter further at its August 23rd meeting. On motion of Mr. Dodd, seconded by >Ir. Bookman, the following resolution was adopted: Whereas, complaints have been received from County residents regarding the steps in the sidewalk at 11531 Old Centralia Road; Now, Therefore, Be It Resolved that the Board of Supervisors of Chesterfield County hereby requests the Virginia Department of Highways and Transportation to reconstruct the aforementioned section of sidewalk in a manner such that the necessity for steps is eliminated; and Further, Be It Resolved that the Board of Supervisors of Chesterfield County hereby guarantees the VDH&T the appropriate cost of $2,500 to be paid from 3¢ Road Funds of Bermuda District. Vote: Unanimous Mr. Dodd stated he had correspondence stating the Highway Depart- ment would not consider putting the signal lights.±n Chester on a blinker system after 10:00 p.m, Mr. Covington stated the Highway Department did not approve of this type of system because of the safety aspect involved. Mrs. Girone stated she had received some interest in this type of system in her area as well. Mr. O'Neill stated he felt the Highway Department should be encouraged to use this type of system which isveryfunctionalinthe City of Richmond as well as otherareas. After further consideratio~ of this matter, it was on motion of Mr. Dodd, seconded by Mr. Bookman, resolved that the Highway Departmentdowhatever is necessa to have the si,gnal light system at the following intersections operate on a blinker system between the hours of 10:00 p.m. and 6:00 a.m.: 1. Route 10 and Harrowgate Road 2. Route 10 and Chester Road 3. Route 147 and Route 711 4. Route 147 and Buford Road 5. Route 147 and Forest Hill Avenue 6. Crowder Drive and Route 60 Vote: Unanimous Mr. Dodd presented Mr. Covington with a petition signed by approximately 280 people requesting that improvements be made to Old Centralia Road as listed below: 1. That the two highest elevations on this road be graded down; 2. That the highway be widened within the present right-of-way and the pavement be marked with a sOlid line on the sides and down the center; Do what is necessary to eliminate all steps in the sidewalk. and ' Extend the sidewalk from Thomas Dale High School to join the sidewalk on Route 10. ' On motion of Mrs. Girone, seconded by Mr. Bookman, it was resolved that the Highway Department be requested to install curbing on P~bious Road at the Greenfield Subdivision to join existing curb with new currently being installed by the developer with said construction to be paid with 3¢ Road Punds from Midlothien District. Vote: Unanimous Mr. Apperson discussed road matters on Banton and Dulwich Drive, and Sherbourne Avenue and a drainage problem between Bellbluff Dr. and Dalebrook. Mr. Covington stated he would look into the matter~ Mr. Bookman stated he would like the Board to aoorove a water line extension on Bayview Drive and indicated t~t these were old~ homes, they have experienced water problems for many years, that three residents would connect and that there was a possibility of a fourth connecting. After further consid'eration of the matter, it was on motion of Mr. Bookman, seconded byMr. Apperson, 78-306 that this Board approved a water line extension on Bayview Drive which is estimated to cost $4,700.00 and will extend approximately 275 ft. down BayView from Jessup Road. Vote: Unanimous Mr. Painter presented the Board with the water and sewer financial reports. III. on .motion of Mr. Bookman, seconded by Mr. Dodd, the Board approved and authorized the County Administrator to execute the following contract: W78-80CD (6(7)8802) Colonial Pines Estates, Section "B" Developer: Colonial Pines Estates, Inc. Contractor: Fred W. Barnes Construction Company Estimated Contract Cost: $46,681,50 Estimated County Cost: $ 3,052,00 Refund through connections Code: 366-1-11684-7221 Vote: Unanimous The Board expressed concern over tae deteriorating road conditions where the roads have been resurfacedafter sewer lines have been installed. Mr. Painter stated if the Board wanted the 3 year requirement the bids would reflect this. Mr. Bookman ond Mr. Dodd expressed a special interest on South Street and Milhorn, the Wagstaff Circle Subdivision, the Gatewood Subdivision and Spring Hill Subdivision and asked that the Highway Department resurface these roads prior to winter. Mr, Apperson expressed his reluctance to approve the Centralia Road water contract because this line was not listed in the consultants report, that he was not present during the meeting at which the Board let the contract out to bid (at which time he was attending a funeral and did not leave for any other reason) an. that this was Just a parallel line and would not provide additional people with water. He added further that Mr, Painter was convinced this line was needed and the low bid received was very reasonable fOr theproJect. Mr, Apperson stated he felt this proJect hadbeenpresentedina ucm~a~ manner. Mr. Dodd stated he was in favor of this because of the fire protection aspect and the cost. Girone, the Board approved a water line extension on Slosh Drive for an approximate cost of $12,150. Vote: Unanimous 78-307 On motion of Mrs. Girone, seconded by Mr. Bookman, the Board awarded ProjeCt W78-16C for water improvements along Salisbury Road and Salisbury Drive to SYdnor Hydrodynamics, Inc. in the amount of $62,226.00 and appropriated $68,448.60 from 563 Surplus to 380-1-68161-4393. Vote: Unanimous VII. It was generally agreed to defer Item VII, consideration of a refund to Brsnde~llfor the differencebe~al2"waterlineanda 24" water line through the 'Trade Center because there'was a,problem with how the. bids were rendered. County, whereby said Railroad Company grants unto said County the right or license to install and maintain, for the purpose of sewer main', a line of 12 inch asbestos-cement pipe across the right of way and under tracks of said Railroad Company near Chester, Virginia, as particularly described in said agreement, which agreement is dated February 9, 1978, a copy of which agree- ment is filed with the Board of Supervisors, Contract S78-71CD (7(7)8712). Vote: Unanimous On motion of Mr. Dodd_ seconded by Mrs. Girone, the Board appropriated funds for Sewer Contracts S76-1C, Divisions A and B, Fan Court Area, in the amount of $32,261.27 from 377 (Bermuda Escrow Reserve~ to ~80-1-76011-4393 (Construction Con- tracts - $30,440.88) and'380=l-76011-2142 (Engineering Services $1,820.39). Vote: Unanimous Mr. Dodd inquired why this did not come through as a change order. Mr. Welchons explained that select material was in the bid and a change order is not necessary for select material. On motion of Mr, Dodd, seconded by Mr. Bookman, the County Administrator was authorized to sign a deed of dedication on behalf of the County from Francis G, Slosh and Sue BL Slosh (husband and wife) Map Section 119-2 in Bermuda District. Vote: Unanimous On motion of Mr. O'Neill, seconded by Mr. Apperson, the Board accepted the counteroffer from Robert M. Thompson in the amount of $260.00 for a 16 ft. sewer easement across'property in Mapo.ca District, Project No. 6511-3/15. Vote: Unanimous Mr. Harmon stated this time and date had been scheduled for a public hearing regardin~ the vacation of Blocks K and N of Section D of Geni=o Es~a~es Subdivision, Mr. Harmon added that the right of way will be dedicated to the County to this parcel. There being no opposition, it was on motion of Mr. Boolu~an, seconded by Mr, Apperson, resolved that the following ordinance be adopted: An Ordinance to vacate Blocks K and N, Section D, of Genito Estates Subdivision, a plat of which subdivision wa. made by J. K. Tiraraons and Associates, Civil Engineer- Surveyor., dated January 18, 1973, and recorded on April 4, 1973 in the Clark's Office of the Circuit Court of Che.terfield County, Virginia, in Plat Book 20 at Page 32, the portion of which is hereby vacated is more particularly ,hown .haded in red. on a plat prepared by J. K. Timmons and Assomta~em, Civil Engineers and Surveyors, a copy of which plat is attached hereto and made a part hereof. Whereas, W, A. Blake and Louise Blake, and Ferne Mertens have petitioned the Board of Supervi.ora of Chesterfield Ciounty',' Virginia, to vacate lo~s 1, 2, 3 and 4 of Bl~¢k K, Section D of Gen~to Estates, and lots 1, 2, 3, 4 and 5 of Block N, Section D of Genito Estates, as shown, shaded in red, on a plat thereof prepared by J. Blake and Louise Blake, husband and wife, are the fee simple owners of the above described lots; Whereas, a 50 ft. road right of way known as Taplow Road shown on the said plat was previously vacated by ordinance adopted on June 23, 1976 by the Chesterfield County Board of Supervisors; Whereas, notice of the adoption of this ordinance has been given in accordance with Section 15.1-431 of the Code of Virginia., 1950, as amended; and Whereas, the proposed vacation of Blocks N and K, Section D, Genito Estates will not abridge the rights of any citizen. Now, Therefore, Be It Ordained by the Board of Supervisors of the County of Chesterfield, Virginia: Pursuant to Section 15.1-482(b) of the Code of Virginia, 1950, as amended, lots 1, 2, 3 and 4 of Block K an~"i'0~s"l,' 2, 3~ 4 and 5 of Block N of Section D in the Genito Estates Subdivsion as described above and shaded in red on the attached plat prepared by J. K. Timmons and Associates dated January 18, 1973, are hereby vacated. Pursuant to Section 15.1-485 of the Code of Virginia, 1950, as amended, the Clerk of the Chesterfield County Circuit Court shall mark the relevant portion of the plat recorded in Plat Book 20 at page 32 as vacated, and shall reference on such plat the deed book and page at which this ordinance is recorded. The effect of this ordinance is to destroy the force and effect of the recordation of the lots hereby vacated. According- ly, a certified copy of this ordinance, together with the plat attached hereto, shall be recorded no sooner than thirty (30) days hereafter in the Clerk's Office of the Chesterfield County Circuit Court and shall be indexed in the names of the County of Chesterfield, Virginia, as grantor and W~ A. Vote: Unanimous Mr. Harmon stated this time and date had been scheduled for a public hearing regarding the vacation of an alley in Redford's Subdivision. Mr. Apperson inquired if the entire alley could be vacated as he felt ether such requests would be received. Mr. stated that the advertisement only covered the land described and without being advertised it could not be done. There being no opposition, it was on motion of Mr~ Apperson, seconded by Mr. Bookman, resolved that the following ordinance be adopted: An Ordinance to vacate a portion of an alley of 20 ft. in width and 223.73 ft. in length which alley is located in Redford's Subdivision in Dale Magisterial District of Chesterfield County as shown on plat thereof duly recorded in the Clerk's Office of the Circuit Court of said County in Plat Book 5, Page 71. Whereas, Gladys M. Washburn has petitioned the Board of Supervisors of Chesterfield County, Virginia, to vacate a portion of an alley of 20 feet in width and 223.73 feet in length which is located in Redford's Subdivision in the Dale Magisterial District of Chesterfield County, Virginia, and is more particularly shown on a plat duly recorded in the Clerk's Office of the Circuit Court of said County in Plat Book 5, Page 71, made by W. W. LaPrade and Brothers, dated April 15, 1929, and revised ADril 27, 1929. The portion of alley petitioned to be vacated is more fully described as follows: 78-310 4 XVII. A portion of an alley twenty (20) feet in width which portion begins on the south line of Pate Avenue and runs in a southerly direction adjacent to parcels 12, 13, 14, 15 and 16 for a distance of 223.73 feet as more fully shown shaded in red on a olat made by W. W. LaPrade and Brothers, dated April 15, 1929, and revised April 27, 1929, a copy of which is attached hereto and made a part of this ordinance. Whereas, notice has been given pursuant to Section 15.1-431 of the Code of Virginia, 1950, as amended, by advertising, and Whereas, no public necessity exists for the continuance of the portion of alley sought to be vacated. Now, Therefore. Be It Ordained by,.the Board of Supervisors of Chesterfield County, Virginia: That pursuant to Section 15.1-482 (b) of the Code of Virginia 1950, as amended, the aforesaid portion of alley is hereby vacated as it is no longer necessary for public use. This ordinance shall be in full force and effect in accordance with Section 15.1-482 (b) of the Code of Virginia, 1950, as amended, and a certified copy of this ordinance, together with the plat attached hereto shall be recorded no sooner than thirty days hereafter in the Clerk's Office of the Circuit Court of Chesterfield, Virginia, pursuant to Section 15.1-485 of the Code of virgin.~.a, 1950, as amended. The effect of this ordinance pursuant to Section 15.1-483 is to destroy the force and effect of the recording of the portion of the plat vacated. This ordinance shall vest fee simole title in the portion of the alley vacated in the owners of the abutting lots free and clear of any rights of public use~ Since the portion of the alley hereby vacated is located on the peri- phery of the aforementioned recorded subdivision plat, this ordinance shall vest fee simple title in the entire width of the portion of the alley vacated in the owners of the five abutting lots on the eastern side of the alley free and clear of any rights of public use. Accordingly, this ordinance shall be indexed in the names of the County of Chesterfield as grantor and Gladys M. Washburn (widow), Harvey A. Anderson and Constance E. Anderson (husband and wife), and Robert L. Yeatts and Mildred ~. Yeatts '~husband and wife) as grantees. Vote: Unanimous Mr. Bookman stated he felt it would be best for all concerned if the bids to install a 24 inch water line in Brandermill through the Trade Center be rejected since the bids were not submitted in the proper form. On motion of Mr, Bookman, seconded by Mr. Apperson, it was resolved that all bids received for the installation of a water line through the Brandermill Trade Center be rejected and that the County bid its portion of the 24 inch line separately. Vote: Unanimous ~,,'.r, Painter presented the Board with a list of developer sewer and water contracts approved by the County Administrator. Mr, Apperson stated he felt the Utility Department should obtain prices and do the engineering for the Route 10 water line. Mrs. Girone stated this was an alternate to the Centralia line and inquired when the Board decided to do this route as well. Mr. Painter stated this line will be used to transport water 78-311 o from this area north and from S~ift Creek to this area when necessary~ Mrs. Girone stated this may be needed but felt the timing was wrong. Mr. Painter stated he had hoped to have some developer participation in this project. Mr. Apperson stated that developers have been supposedly developing along this area for the past seven years and nothing has ever become of it. He added further that because of the development of the Airport, people living along Route 10 h~d'their water table dropped ~7+ feet and they need water. He added that about 25 people {eed water and stated he hoped the line could be in the median when the four-laning of Route 10 had been accomplished and he had reason to believe that the Highway Department would permit this, After further discussion of this project and indications that it would be accomplished with money from the proposed bond issue, it was on motion of Mr. Apperson, seconded by Mr. Dodd, resolved that the Utility Department engineer and acquire right of way for the installation of a water line along Route 10~ Vote: Unanimous Mr. John Smith, representing the Chesmid Park Corp., stated he would like the County to install the sewer line involving the Midlothian Fire Station deeper and that his Corporation would be willing to guarantee $13,000. After further consideration of this matter, it was on motion of }Irs. Girone, seconded by Mr. Apperson, resolved that the County install sewer in the Midlothian area involving the Midlothian Fire Static Contract S78-37C, Alternate 4, which is at the depth specified in ~ri~__S~'s~e~ter.~da~.ed_..~ ~.7,~1~78, and that the Chesmid Park Corporation will be responsible fo~ the total cost'of installing the line deeper. Vote: Unanimous Mr~ O'Neill excused himself from the meeting~ On motion of Mr. Dodd, seconded by Mr. Apperson, the following erroneous tax claims were approved for payment: John H. Vote: Unanimous On motion of Mr. Dodd, seconded by Mr. Apperson, the Board denied the request of the School Board for additional School Guard Service at Falling Creek Elementary and Junior High Schools and Curtis, Thomas Dale, and Chester Intermediate until after the school session has begun at which time Sgt. Lynn~tthews is directed to investigate this situation and report back to the Board his evaluation of the traffic problem without further action by either Board. Vote: Unanimous 78-312 B.A. This day the County Environmental Engineer, in accordance with directions from this Board, made report in writing upon his exmmination of Bluemont Road, Birchleaf Road, Birchleaf Court and Millwood Road in Hidden Valley, Sections 2 and 5, Bermuda District. Upon consideration whereof, and on motion of Mr. Dodd, second~ by Mr. Apperson, it is resolved that Bluemont Road, Birchleaf Road, Birchleaf Court, and Millwood Road in Hidden Valley, Sectio~ 2 and 5, Bermuda District, be and they hereby are established as public roads. And be it further resolved, that the Virginia Department of Highways and Transportation, be and it hereby is requested to take into the Secondary System, Bluemont Road, beginning at its intersection with Cresthill Road, State Route 1596, northerly .11 mile to a temporary turn-around; Birchleaf Road, be%inning at its intersection with Cresthill Road, State Route 1596, northerly .06 mile to intersection with Birchleaf Court thence northerly .06 mile to intersection with Millwood Road thence northerly .11 mile to a temporary turn-around; Birchleaf Court beginning at its intersection with Birchleaf Road westerly .04 mile to a cul-de-sac; Millwood Road, beginning at intersection with Birchleaf Road westerly .09 mile to a dead end~ These roads serve 32 lots. And be it further resolved, that the Board of Supervisors guarantees to the Virginia Department of Highways a 50' right-of- way for all these roads. These sections of Hidden Valley are recorded as follows: Section 2, Plat Book 17, Pages 3/ and 38, October 31, 1969; and Section 5, Plat Book 25, Pages 77 and 78, February 13, 1976. Vote: Unanimous This day the County Environmental Engineer, in accordance with directions from this Board, made report in writing upon his examination of Sykes Road, Stiles Road, and Stiles Court in Bon Air Manor, Midlothian District. Upon consideration whereof, and on motion of Mr. Dodd, seconded by Mr. Apperson, it is resolved that Sykes Road, Stiles Road, and Stiles Court in Bon Air Manor, Midlothian District, be and they hereby are established as public roads. And be it further resolved, that the Virginia Department of Highways and Transportatiom, be and it hereby is requested to take into the Secondary System, Sykes Road, beginning ~14 mile from intersection with Cowan Road, State Route 843, and going .09 mile southerly to a cul-de-sac; Stiles Road, beginning at its inter- section with Cowan Road, State Route 843, and going .13 mile southerly to its intersection with Stiles Court, then ~06 mile southerly to a cul-de-sac; Stiles Court, beginning at intersectio~ with Stiles Road and going .06 mile westerly to a cul-de-sac~ These roads serve 31 lots. And be it further resolved, that the Board of Supervisors guarantees to the Virginia Department of Highways a 50' right- of-way for all of these roads except Stiles Court which has a 40' right-of-way~ This section of Bon Air Manor is recorded as follows: Plat Book 26, Page 55, May 27, 1976. Section C, Bermuda District, be and they hereby are established as public roads. Vote: Unanimous It was generally agreed that the request for a street light at the intersection of Wilcon Avenue and Fitzhugh Street be deferred for further investigation by the Environmental Engineer. On motion of Mr. Dodd, seconded by Mr.. Apperson, the Board authorized the County Administrator to sign a release indemnify- ing and holding forever harmless Mr. Douglas W. Conner for any and all claims and actions which may be instituted against Mr. Conner for use of the quarry for training purposes by personn, of the Chesterfield County Fire Department. Vote: Unanimous Mr, Bookman stated the Hancock Quarry might be considered for this purpose as well and suggested this possibility being investigated further. Mr. Dodd stated he thought the Fire Department was interested in the Conner Quarry because of the clarity of water. Mr~ Bookman stated the Hancock Quarry might be as clear and the Fire personnel would not have to travel as far. On motion of Mrs. Girone, seConded by Mr~ Bookman, the Board appointed Mr~ William Bunting to the Citizens Transportation Advisory Committee of the Metrooolitan Planning Organization for a term of two years effective immediately~ Vote: Unanimous On motion of Mr~ Bookman, seconded by Mr. Apperson, the Board reappointed Mr. Gerald Speeks to the Board of Appeals for the Uniform Statewide Building Code effective immediately and whose term will expire March 9, 1983. Vote: Unanimous On motion of Mr. Apperson, seconded by Mr. Dodd, the Board reappointed Mr. William G. Ritchie to the Chesterfield-Colonial Heights Department of Social Services Board effective immediately and whose term will expire J~ly 31, 1982~ Vote: Unanimous Mr. Bob Vellekamp of the Virginia Association for Retarded Citizens discussed with the Board the possibility of having an annual air show at the Chesterfield County Airport. He stated he had received the support of professional aviation group the proceeds of the show would benefit~Virginia's retarded citizens, it would be held October 13, 14, and 15, and it would have basically three components: 1. Commerical and professional displays of general aviation equipment; 2. Attendance by pilots in general and commercial aviation as well as a number of owners and enthusiasts of antique and experimental aircraft; and 3. Static displays and performers from private, commercial and military sources. He added further he was working with various departments in the County and would coordinate this project with t~eir cooperation. He stated the expected attendance should be about 12,000 people, that the food concessions would be handled by the current tenant at the Airport Restaurant, that there will be no entertainment groups, and that they would abide by all restrictions of the Code 78-315 12. There was some discussion regarding the termination of the contract and Mr~ Micas stated there would not be a contract as such but the Board would review each year's proposal and if the group was not complying with the Code, permission could be revoked~ After further discussion of the matter, it was ~on motion of Mr. Apperson, seconded by Mr. Dodd, resolved that the Virginia Association for Retarded Citizens be granted permission to use the Chesterfield County Airport for an Air Show on October 13, 14 and 15 subject to compliance with Chapter 4, Article III of the County Code. On motion of Mr. Apperson, seconded by Mr. Dodd, the Board authorized the County Administrator to enter into an agreement with the Virginia Department of Highways and Transportation subject to the contract being approved by the County Attorney for work which the County will perform for the Virginia Depart- ment of Highways and Transportation and will be paid by same relating to the Forest Hill Avenue planning effort and the annual data gathering responsibility for the transportation planning process in the Region. Vote: Unanimous Mr, Meiszer distributed a copy of a letter from the County of Fairfax relating to legislation to 'make Sheriffs' Offices appointed offices rather than elected. It was felt that the County should not seek such legislation at this time. Mr~ Muzzy presented the Board with new reflector signs to be installed at the entrance to the County Airport 'which should enable better visibility ~ On motion of Mr. Apperson, seconded by Mr. Dodd, the Board went into Executive Session to discuss legal matters. Vote: Unanimous Reconvening: Onm otion of the Board, the following resolution was adopted: Whereas, Lennie Pond is a resident of Chesterfield County and is a professional Grand National race car driver; .and Whereas, Lennie Pond placed first among 40 entrants in the 1978 NASCAR Winston Cup "Talladega 500" on August 6 1978 in Talladega, Alabama; and ' ' Whereas, Lennie Pond established a world record for all forms of automobile racing by driving 500 miles and averaging 174.700 miles per hour bringing national recognition to Chesterfield County; Now, Therefore, Be It Resolved, the Board of Supervisors of Chesterfield County wishes to acknowledge the driving success of Lennie Pond and congratulates him on winning the "Ta~ ~ 00" · ~amega 5 .
