Myers, Jr. <br /> <br />REQUEST AND PROPOSED USE: A Conditional Use to permit the operation of <br /> a Dog Kennel. The applicant proposes to keep four (4) dogs on the par- <br /> cel in question. <br /> <br />''GENERAL LOCATION AND TAX MAP INFORMATION: The lot in question is located <br /> at 3U06 Totty Street in Ettrick. The lot fronts the north line of Totty, <br /> southwest of the intersection of Totty and Jackson Streets. Tax Map 'Sec. <br /> 182-13 (1) parcel 15. <br /> <br />ACREAGE~ EXISTING ZONiNG~~ EXISTING LAND USE (SUBJECT PARCEL): The parcel <br /> contains approximately 3 quarters of an acre, is zoned Residential (R-y) <br /> and is occupied by a single family dwelling. <br /> <br />ADJACENT AND AREA ZONING AND LAND USE: Ail adjacent property is zoned Re- <br /> sidential (R-y) and is either occupied by single family dwellings or re- <br /> mains vacant and wooded. <br /> <br />'GENERAL' PLANS: Single family residential development for the area en- <br /> compassing the parcel in question. <br /> <br />STAFF ANALYSIS AND RECOMMENDATION: Review of the request and inspection <br /> of the parcel indicates the applicant intends to keep four dogs of mixed <br /> breeds on the parcel in question. At present these animals are either <br /> chained in the rear yard or kept in the house. Planning Staff has re- <br /> ceived a memo from the Chesterfield County Animal Control Officer, indi- <br /> cating that that office has had quite a few complaints concerning the <br /> keeping of these dogs on the parcel in question. These complaints range <br /> from noise from the dogs running at large and two summons have been writ- <br /> ten within the past year. Staff on inspection of the parcel noted that <br /> upon approaching the parcel considerable amount of noise was generated from <br /> from the animals in question. It was noted that three of the animals are <br /> chained in various spots within the rear yard and the fourth animal was <br /> running loose. Staff is of the opinion that such an operation and activity <br /> is not conducive to the wellbeing or general character of the neighborhood <br /> Therefore denial of the request is recommended. However, should the Com- <br /> mission see fit to recommend approval of the request, the following con- <br /> ditions of operation are suggested. <br /> <br />1. This Conditional Use shall be granted to and for William B. Myers, Jr. <br /> only and shall not be transferable nor run with the land. <br />2. This conditional use shall be restricted to the keeping of no more <br /> than four dogs for a period not to exceed 6 months from date of ap- <br /> proval. At such time the number of dogs shall be reduced to no more <br /> than 3. <br />3. These dogs shall be confined to either the interior of the applicant's <br /> home or to an area within the rear yard which will be so constructed <br /> to contain the animals in question. <br />4. The area for the keeping of the dogs shall be maintained and cleaned <br /> daily.
